ACT ON THE ESTABLISHMENT OF THE KOREA NATIONAL UNIVERSITY OF CULTURAL HERITAGE

 Article 1 (Purpose)
The purpose of this Act is to establish the Korea National University of Cultural Heritage to train specialists in traditional culture who have theoretical background in and practical application of the creative succession and development of traditional culture and the conservation, management and utilization of cultural properties, thereby contributing to the dissemination and promotion of Korean culture.
 Article 2 (Establishment)
(1) The Korea National University of Cultural Heritage (hereinafter referred to as the "Cultural Heritage University") shall be established under the Administrator of the Cultural Heritage Administration.
(2) The seat of the Cultural Heritage University shall be prescribed by Presidential Decree.
 Article 3 (Principle of Operation)
In the operations of the Cultural Heritage University, to achieve the purposes of the university specified in Article 28 of the Higher Education Act, equal opportunity and autonomy of education shall be guaranteed.
 Article 4 (President)
(1) The Cultural Heritage University shall have a president.
(2) The president shall exercise overall control of the academic affairs, supervise faculty and staff under his/her control, guide students and represent the Cultural Heritage University.
(3) The president shall be recommended by the Administrator of the Cultural Heritage Administration, reviewed by the Minister of Culture, Sports and Tourism and appointed by the President.
 Article 5 (Faculty, Staff, etc.)
(1) The Cultural Heritage University shall employ faculty, staff, and teaching assistants, in addition to the president.
(2) Faculty members shall be classified as professors, associate professors, and assistant professors. <Amended by Act No. 15642, Jun. 12, 2018>
(3) In addition to the faculty members referred to in paragraph (2), the Cultural Heritage University may employ adjunct faculty members, visiting faculty members, honorary professors, part-time lecturers, etc. (hereinafter referred to as "adjunct faculty members, etc.") to engage in education or research.
(4) Qualification standards for faculty members, teaching assistants, adjunct faculty members, etc. under paragraphs (1) and (3) shall be governed by Articles 16 and 17 of the Higher Education Act.
(5) Matters necessary for the appointment and maximum number of faculty members, staff members, teaching assistants, adjunct faculty members, etc. shall be prescribed by Presidential Decree.
 Article 6 (School Regulations)
(1) The president may formulate or amend school regulations (hereinafter referred to as "school regulations") within the scope of Acts and subordinate statutes.

(3) Matters necessary for the entries in school regulations and the procedures for formulating or amending school regulations shall be prescribed by Presidential Decree. <Amended by Act No. 15642, Jun. 12, 2018>
 Article 7 (Colleges)
(1) The Cultural Heritage University may have colleges and departments belonging to colleges, within the scope prescribed by Presidential Decree.
(2) Each college and department of a college referred to in paragraph (1) shall be headed by a dean and a chair respectively; and a person among professors, associate professors or assistant professors shall be the dean of a college or the chair of a department of a college.
(3) The dean of a college and the chair of a department shall, by order of the president and the dean of the relevant college respectively, exercise overall control of the academic affairs, supervise faculty and staff under their control and guide students.
 Article 8 (Graduate Schools)
(1) Graduate schools shall be established under the Cultural Heritage University for the purpose of training high-level creative specialists in traditional culture by further developing education of traditional culture.
(2) Graduate schools shall have master's degree courses and doctoral degree courses, and the type of degree of each course shall be prescribed by Presidential Decree.
(3) Matters concerning the organization of graduate schools shall be prescribed by Presidential Decree, and matters necessary for the operation thereof shall be determined by school regulations.
 Article 9 (Maximum Number of Students)
Matters regarding the maximum number of students of each college and graduate school shall be determined by school regulations within the scope prescribed by Presidential Decree.
 Article 10 (Admission Qualifications)
Those who have academic background stipulated in Article 33 of the Higher Education Act are qualified for admission to the Cultural Heritage University.
 Article 11 (Students Selection Process)
(1) The president shall select students to be admitted through a regular selection process or a special selection process from among those who have the qualifications referred to in Article 10.
(2) Matters necessary for the regular or special selection process referred to in paragraph (1) shall be prescribed by Presidential Decree.
 Article 12 (Term of School Years)
(1) The term of school years for a bachelor's degree course of the Cultural Heritage University shall be four or five years: Provided, That cases where the term of school years is five years shall be prescribed by Presidential Decree.
(2) The term of school years for courses for a master's degree or doctoral degree of the Cultural Heritage University shall be at least two years respectively.
(3) Notwithstanding paragraphs (1) and (2), the term of school years may be reduced for any person who has earned more credits than those required to graduate specified in school regulations, as prescribed by Presidential Decree.
 Article 13 (Conferment of Degrees)
(1) The president shall confer a bachelor's degree to a person who has completed a bachelor's degree course determined by school regulations.
(2) The president shall confer a master's degree or a doctor's degree to a person who has completed a master's degree or doctoral degree course determined by school regulations.
 Article 14 (Specialized Courses for Traditional Culture)
(1) In order to improve expertise of human resources engaged in the fields related to traditional culture and cultural properties, non-degree specialized courses for traditional culture shall be established.
(2) For the purpose of efficiently operating specialized courses for traditional culture, the Training Center for Traditional Culture shall be established.
(3) Matters necessary for the organization and operation of the Training Center for Traditional Culture shall be prescribed by Presidential Decree.
 Article 15 (Affiliated Facilities, etc.)
(1) The president may establish research facilities, affiliated facilities, and other necessary facilities to fulfill the establishment purpose of the Cultural Heritage University.
(2) Matters necessary for the organization and operation of affiliated facilities, etc. shall be prescribed by Presidential Decree.
 Article 16 (Subordinate Organizations)
Matters concerning the subordinate organizations of the Cultural Heritage University shall be prescribed by Presidential Decree.
 Article 17 (Educational Finance, etc.)
(1) Finances necessary for operating the Cultural Heritage University shall be borne by the National Treasury.
(2) Students of the Cultural Heritage University may be granted reduction or exemption of school expenses, including tuition fees, or a subsidy for school expenses pursuant to the Ordinance of the Culture, Sports and Tourism Ministry.
(3) If deemed necessary, the president may request the heads of related institutions or organizations to use facilities related to traditional culture. In such cases, the head of the relevant institution or organization shall cooperate therein.
 Article 18 (Standards for Arrangement of Facilities and Faculty Members)
(1) The Administrator of the Cultural Heritage Administration shall secure the facilities and faculty members necessary to fulfill the purpose of establishing the Cultural Heritage University.
(2) Standards for facilities and arrangement of faculty members for operating the Cultural Heritage University shall be prescribed by Presidential Decree.
 Article 19 (Prohibition of Use of Similar Name)
No person, other than the Cultural Heritage University under this Act, shall use the name "Korea National University of Cultural Heritage" or any other similar name.
 Article 20 (Application Mutatis Mutandis of Education-Related Acts and Subordinate Statutes)
Except as otherwise expressly provided for in this Act, matters concerning the establishment and operation of the Cultural Heritage University shall be subject to the application of the education-related Acts and subordinate statutes, such as the Framework Act on Education, the Higher Education Act, the Framework Act on the Development of Human Resources, the Educational Officials Act, the Lifelong Education Act, the Act on the Promotion of Specific Education for Brilliant Children, and the Act on the Account Establishment and Finance Management of National Universities. <Amended by Act No. 13979, Feb. 3, 2016>
 Article 21 (Administrative Fines)
(1) A person who uses the name "Korea National University of Cultural Heritage" or any other similar name thereto in violation of Article 19 shall be punished by a fine not exceeding three million won.
(2) The administrative fines under paragraph (1) shall be imposed and collected by the Administrator of the Cultural Heritage Administration.
ADDENDA
Article 1 (Enforcement Date)
This Act shall enter into force one year after the date of its promulgation.
Article 2 (Transitional Measures concerning Korea National University of Cultural Heritage)
Former Korea Cultural Heritage School established under Article 2 of the Higher Education Act and the Decree on Establishment of Korea Cultural Heritage School (hereinafter referred to as the "Korea Cultural Heritage School") as at the time this Act enters into force shall be deemed the Korea National University of Cultural Heritage under this Act.
Article 3 (Transitional Measures concerning Enrolled Students and Graduates)
The enrolled students and graduates of the Korea Cultural Heritage School as at the time this Act enters into force shall be deemed the enrolled students and graduates of the Korea National University of Cultural Heritage under this Act.
Article 4 (Transitional Measures concerning Faculty, Staff, etc.)
The president, faculty members, staff members and teaching assistants being employed by the Korea Cultural Heritage School as at the time this Act enters into force shall be deemed the president, faculty members, staff members and teaching assistants of the Korea National University of Cultural Heritage under this Act.
Article 5 (Succession to Rights and Obligations)
All rights and obligations that belong to the Korea Cultural Heritage School as at the time this Act enters into force shall be succeeded to the Korea National University of Cultural Heritage under this Act.

Article 1 (Enforcement Date)
(1) This Act shall enter into force on the date of its promulgation.
