ACT ON THE ESTABLISHMENT AND MANAGEMENT OF SPECIAL COMMISSION ON AGRICULTURE, FISHERIES AND RURAL POLICIES

The purpose of this Act is to contribute to the growth of agriculture and fisheries which are the basis of the State and national economy and to promoting the welfare of farmers and fishermen by establishing the Special Commission on Agriculture, Fisheries and Rural Policies and by prescribing necessary matters concerning the organization and operation thereof in order to present the direction of mid-term and long-term policies for the growth of agriculture, fisheries and rural communities and the action plan thereof, and check and assess the conditions of the promotion thereof based on the national consensus in response to new Multilateral Trade Negotiation of the World Trade Organization and changes in the circumstances of agriculture and fisheries in the Republic of Korea and abroad. <Amended by Act No. 7274, Dec. 31, 2004; Act No. 8866, Feb. 29, 2008>
| Article 2 (Establishment and Functions of Commission) |
| (1) | The Special Commission on Agriculture, Fisheries and Rural Policies (hereinafter referred to as the "Commission") shall be established under the control of the Minister for Food, Agriculture, Forestry and Fisheries. <Amended by Act No. 8866, Feb. 29, 2008> |
| (2) | The Commission shall deliberate on the following matters: <Amended by Act No. 7274, Dec. 31, 2004; Act No. 8866, Feb. 29, 2008> |
| 1. | Matters concerning the field of agriculture and fisheries of new Multilateral Trade Negotiation of the World Trade Organization; |
| 2. | Matters concerning direction-setting for mid-term and long-term policies for the growth of agriculture and fisheries and rural communities; |
| 3. | Matters concerning the strengthening of the competitiveness of agriculture and fisheries and the stabilization of income of farmers and fishermen; |
| 4. | Matters concerning the balanced development of rural communities, medical service, education and the promotion of other welfare of rural communities; |
| 5. | Matters concerning the social conflict related to the promotion of measures for agriculture, fisheries and rural communities; |
| 6. | Matters requested by the Minister for Food, Agriculture, Forestry and Fisheries in connection with subparagraphs 1 through 5; |
| 7. | Matters requested by the chairperson or not less than 1/4 of the incumbent members of the Commission; |
| 8. | Matters concerning the action plan for matters under subparagraphs 1 through 7 and the checking and assessment of the conditions of the promotion thereof. |
| Article 3 (Composition of Commission) |
| (1) | The Commission shall be comprised of not more than 30 commissioners, such as the representatives of farmers' and fishermen's organizations and consumers' organizations, and academic and media experts, etc., including the chairperson and ex officio commissioners. |
| (2) | The Minister for Food, Agriculture, Forestry and Fisheries shall appoint the chairperson from among those who have advanced knowledge and a high moral reputation, a full understanding and wide administration experience in agriculture and fisheries, and rural communities. <Amended by Act No. 8866, Feb. 29, 2008> |
| (3) | Ex officio commissioners shall be the Vice Minister of Strategy and Finance, the Vice Minister for Food, Agriculture, Forestry and Fisheries, the Vice Minister of Health and Welfare, and the director general of the headquarters in charge of trade negotiations of the Ministry of Foreign Affairs and Trade. <Amended by Act No. 8866, Feb. 29, 2008; Act No. 9932, Jan. 18, 2010> |
| (4) | The Minister for Food, Agriculture, Forestry and Fisheries shall appoint commissioners, other than ex officio commissioners, from among those under any of the following subparagraphs on the recommendation of the chairperson of the Commission: <Amended by Act No. 7274, Dec. 31, 2004; Act No. 7988, Sep. 27, 2006; Act No. 8748, Dec. 21, 2007; Act No. 8866, Feb. 29, 2008> |
| 1. | Not more than 12 representatives of farmers' and fishermen's organizations, such as the chairperson of the National Agricultural Cooperatives Federation established under the Agricultural Cooperatives Act, the chairperson of the National Federation of Fisheries Cooperatives established under the Fisheries Cooperatives Act, etc.; |
| 3. | Not more than seven academic experts, etc. and journalists. |
| Article 4 (Duties of Chairperson) |
| (1) | The chairperson shall represent the Commission and preside over its business, such as the convocation of meetings of the Commission, etc. |
| (2) | Where the chairperson is unable to perform his/her duties due to illness or by other compelling reason, a commissioner of commissioners, other than ex officio commissioners, shall perform his/her duties on his/her behalf in the order determined by the Commission in advance. |
| Article 5 (Term of Office of Commissioners) |
| (1) | The term of office of commissioners, other than ex officio commissioners, shall be two years, and they may be reappointed. <Amended by Act No. 7274, Dec. 31, 2004> |
| (2) | Where a vacancy arises for a commissioner who is not an ex officio commissioner due to his/her death or for other reasons, the Minister for Food, Agriculture, Forestry and Fisheries may appoint a new commissioner on the recommendation of the chairperson of the Commission. In such cases, the term of office of a commissioner newly appointed shall be the remaining period of his/her predecessor. <Amended by Act No. 7274, Dec. 31, 2004> |
| Article 6 (Convocation of Meeting) |
| (1) | The chairperson shall convoke a meeting of the Commission and preside over such meeting. |
| (2) | Where a meeting falls under any of the following subparagraphs, the chairperson shall convoke a meeting of the Commission: <Amended by Act No. 8866, Feb. 29, 2008> |
| 1. | Where the Minister for Food, Agriculture, Forestry and Fisheries requests the chairperson to convoke a meeting of the Commission; |
| 2. | Where not less than a third of the incumbent members of the Commission requests the chairperson to convoke a meeting; |
| 3. | In other cases, where the chairperson deems the convocation of a meeting is necessary. |
| (3) | The Commission shall hold a meeting by attendance of a majority of the incumbent members and pass a resolution with the consent of not less than two thirds of the members present at the meeting. |
| (4) | Where the chairperson deems it necessary, he/she may request the heads of the relevant central administrative agencies (excluding ex officio commissioners), farmers and fishermen, executives of producers' organizations under subparagraph 4 of Article 3 of the Framework Act on Agriculture and Fisheries, Rural Community and Food Industry or nongovernmental experts to attend a meeting of the Commission and state their opinions. <Amended by Act No. 8748, Dec. 21, 2007; Act No. 8866, Feb. 29, 2008; Act No. 9717, May 27, 2009> |
| Article 7 (Standing Committee) |
| (1) | The Commission may establish the standing committee so that it may deliberate on and moderate agenda items to be laid before the Commission, deal with matters delegated by the Commission and support other activities of the Commission. |
| (2) | The standing committee shall be comprised of not more than 15 standing commissioners, including one chairperson (hereinafter referred to as "chairperson of the standing committee"). |
| (3) | The Vice Minister for Food, Agriculture, Forestry and Fisheries shall be the chairperson of the standing committee. <Amended by Act No. 8866, Feb. 29, 2008> |
| (4) | Standing commissioners shall be appointed by the chairperson of the Commission from among public officials in general service belonging to the Senior Executive Service of central administrative agencies, the representatives of farmers' and fishermen's organizations and consumers' organizations, and academic or news media experts. <Amended by Act No. 7796, Dec. 29, 2005> |
| (5) | Articles 4, 5 and 6 (1) through (3) and (5) shall apply mutatis mutandis to the standing committee. |
| Article 8 (Subcommittees and Expert Advisers) |
| (1) | The standing committee may establish subcommittees to efficiently deliberate on agenda items deemed necessary. |
| (2) | The chairperson of the standing committee shall appoint the chairperson of a subcommittee from among the standing commissioners. |
| (3) | The standing committee may keep expert advisers for professional research and study on the business of the Commission. |
| Article 9 (Support for Operation of Commission) |
| (1) | The secretariat shall be established in the Commission to conduct the business of the Commission. |
| (2) | Where the chairperson of the Commission deems it necessary for performing its duties, public officials of the relevant agencies or members of the staff of the organizations concerned may be dispatched to him/her, or he/she may request them to hold concurrent posts in consultation with the heads of the agencies concerned or the heads of the organizations concerned. |
| (3) | The Government shall subsidize a budget necessary for the performance of duties of the Commission and its secretariat. |
| Article 10 (Regional Commissions) |
The head of a metropolitan local government may establish a regional special commission on agriculture, fisheries and rural policies in order to strengthen the competitiveness of agriculture and fisheries and promote the welfare of farmers and fishermen in the district under his/her jurisdiction. In such cases, the number of commissioners shall be 15 or less.
| Article 11 (Regulations for Operation of Commission) |
The organization and operation of the Commission, the standing committee, subcommittees and the secretariat and other necessary matters shall be prescribed by the regulations for operation of the Commission.
| Article 12 (Report on Outcomes of Operation of Commission) |
The Government shall report the outcomes of operation of the Commission to the Food, Agriculture, Forestry and Fisheries Committee of the National Assembly half-yearly. <Amended by Act No. 9129, Aug. 25, 2008>

| (1) | (Enforcement Date) This Act shall enter into force on the date of its promulgation. |
| (2) | (Transitional Measures concerning Term of Office of Commissioners) Notwithstanding Article 5 (1), the term of office of commissioners, other than ex officio commissioners (including cases where the provision of Article 7 (5) applies mutais mutandis thereto), who are appointed in accordance with the former provisions as at the time this Act enters into force, shall be terminated on December 31, 2004. |
