ACT ON THE COLLECTION AND COMPILATION OF HISTORICAL MATERIALS AND DISSEMINATION OF KOREAN HISTORY

CHAPTER Ⅰ GENERAL PROVISIONS
 Article 1 (Purpose)
The purpose of this Act is to make contributions to the promotion of the study of Korean history and its systematic development, as well as the enhancement of people’s historical awareness through facilitating research, collection, preservation, and compilation of all kinds of historic materials necessary to study the history of our country (hereinafter referred to as "Korean history") and establish the system therefor, based on which study, compilation, education and dissemination of Korean history shall be facilitated.
 Article 2 (Definitions)
The definitions of terms used in this Act shall be as follows:
1. The term "historical materials" means documents which are materials for the study of history (including documents, books, photographs, epigraphs, paintings, calligraphic works, audio and video taped materials, oral recording materials, electronically recorded materials, etc.; hereinafter the same shall apply);
2. The term "research of historical materials" means confirming the existence of historical materials, physical form, state of preservation, whereabouts, lists, etc.;
3. The term "collection of historical materials" means possessing historical materials confirmed through research by means of rental, copy, purchase, receipt of gifts, consignment, etc.;
4. The term "compilation" means editing and publishing historical materials and research outputs on Korean history and processing them in electronic forms, such as services using the information and telecommunication network;
5. The term "education and training of Korean history" means education and training provided to professionals, teachers, public officials, etc. for study of Korean history and development of the ability to enhance historical awareness;
6. The term "informatization of Korean history" means collection, processing, production, and provision of contents related to historical materials and Korean history in electronic form.
 Article 3 (Relations with other Acts)
Matters pertaining to the research, collection, preservation, and compilation of historical materials and the study, compilation, education and training, dissemination, etc. of Korean history shall be governed by this Act, unless special provisions exist in other Acts.
CHAPTER Ⅱ NATIONAL INSTITUTE OF KOREAN HISTORY
 Article 4 (Establishment of National Institute of Korean History)
The National Institute of Korean History (hereinafter referred to as the "Institute") shall be installed under the jurisdiction of the Minister of Education to promote the study of Korean history and its systematic development. <Amended by Act No. 8852, Feb. 29, 2008; Act No. 11690, Mar. 23, 2013>
 Article 5 (Duties)
The Institute shall carry out duties falling under each of the following subparagraphs:
1. Establishment and implementation of long-term plans and annual plans for the research, collection and preservation of historical materials in Korea and abroad;
2. Establishment and implementation of long-term plans and annual plans for the research, compilation, education and training, and dissemination of Korean history;
3. Fostering, etc. of professionals in the area of education and training of Korean history and management of historical materials;
4. Establishment and implementation of long-term plans and annual plans for informatization of Korean history;
5. Cooperation and coordination between institutions related to Korean history and historical materials;
6. Request for perusal and/or copy of important historical materials of the State to persons who own or manage them, and the preservation, management, compilation, etc. of important historical materials of the State;
7. Other research, collection, preservation, and compilation of historical materials and study, compilation, education and training, dissemination, etc. of Korean history.
 Article 6 (Composition)
(1) The Institute shall be composed of 15 to 20 members, including a chairperson and two standing members.
(2) The chairperson shall be appointed by the President and be appointed to the post of public official in political service. Standing members shall be appointed to the post of public officials belonging to the Senior Civil Service prescribed by Article 2-2 of the State Public Officials Act.
(3) Members shall be commissioned by the Minister of Education in accordance with a recommendation of the chairperson, and matters pertaining to the commissioning of members, including their qualifications, shall be prescribed by Presidential Decree. <Amended by Act No. 8852, Feb. 29, 2008; Act No. 11690, Mar. 23, 2013>
(4) The term of office of members shall be three years and consecutive terms shall be permitted.
 Article 7 (Meetings of Institute)
(1) Meetings of the Institute shall be formed by all members, including the chairperson, and the chairperson shall preside over such meetings.
(2) Meetings of the Institute shall be convened by the chairperson, be commenced with the attendance of a majority of registered members and make decisions with the approval of a majority of members present at the meeting.
 Article 8 (Duties of Chairperson)
(1) The chairperson shall represent the Institute, supervise the affairs of the Institute and direct and supervise employees thereof.
(2) Where the chairperson is unable to perform his/her duties due to an extenuating circumstance, a standing member designated by the chairperson shall perform such duties.
 Article 9 (Disqualification of Members)
(1) Persons who fall under any of the following subparagraphs may not hold office as a member:
1. Persons who are not citizens of the Republic of Korea;
2. Persons who fall under any subparagraph of Article 33 (1) of the State Public Officials Act;
3. Members of a political party;
4. Persons who have registered as a candidate for an election held, as prescribed by the Public Official Election Act.
(2) When a member falls under any subparagraph of paragraph (1), he/she shall, naturally, retire from office.
 Article 10 (Operation)
(1) The Institute may employ public officials necessary to have them deal with the affairs of the Institute.
(2) Where a participation of professionals is needed for the collection, compilation, etc. of historical materials, the chairperson may commission professionals in relevant areas as a research member of historical materials as prescribed by Presidential Decree.
(3) Where necessary for the research and collection of historical materials, the chairperson may commission persons as a research member of historical materials by region or by institution in Korea and abroad, as prescribed by Presidential Decree.
(4) Other matters necessary for the operation of the Institute shall be prescribed by Presidential Decree.
 Article 11 (Fairness in Job Performance)
(1) Each person engaged in the affairs of study, research, etc. of Korean history, as prescribed by this Act, shall carry out his/her duties fairly and objectively.
(2) No person engaged in the affairs of the Institute may use the contents of documents, etc. that have come to his/her knowledge in connection with the performance of said affairs for any purpose, other than for the academic purpose of research of Korean history.
CHAPTER Ⅲ RESEARCH, COLLECTION, PRESERVATION, ETC. OF HISTORICAL MATERIALS
 Article 12 (Research of Historical Materials)
(1) The Institute shall carry out nationwide or regional research of historical materials in Korea and research of historical materials in foreign countries in order to identify the current state of historical materials.
(2) Where necessary for the research of historical materials prescribed by paragraph (1), the Institute may request the lists of historical materials to institutions of the State, local governments, individuals or organizations in possession of historical materials, and the heads of institutions concerned, individuals or organizations shall provide cooperation.
 Article 13 (Perusal and Copying of Historical Materials)
The Institute may request perusal and copying of historical materials related to Korean history preserved and managed by an institution of the State, a local government, an individual or an organization. In such cases, the head of the institution concerned, individual or organization shall comply with such request, unless there are special provisions in other Acts.
 Article 14 (Consignment and Preservation of Historical Materials)
(1) When any institution of the State, local government, individual or organization requests consignment and preservation of historical materials in its possession for permanent and safe preservation thereof, the Institute may receive and preserve them in its trust through an examination.
(2) When a request is made by the person who has provided historical materials, as prescribed by paragraph (1), the Institute shall pay the necessary cost to the individual or organization concerned.
(3) Matters pertaining to the examination method, procedure, and reward for consignment and preservation as prescribed by paragraphs (1) and (2) shall be provided for by Presidential Decree.

CHAPTER Ⅳ RESEARCH, COMPILATION AND DISSEMINATION OF KOREAN HISTORY
 Article 16 (Study and Compilation)
(1) The Institute shall conduct studies on important historical materials and Korean history, and compile the results thereof for the purpose of promoting the study of Korean history and its systematic development.
(2) The Institute shall study or compile matters falling under each of the following subparagraphs:
1. Basic historical materials by era;
2. Basic historical materials by theme;
3. Historical materials in accordance with the political needs of the State;
4. Study results in connection with Korean history.
 Article 17 (Education and Training of Korean History)
(1) The Institute may carry out any of the following subparagraphs for education and training of Korean history:
1. Dissemination of Korean history by utilizing the mass media;
2. Preparation of education and training courses on Korean history, development of learning materials, instructions and fostering of professionals;
3. Operation of education and training institutions for promotion of Korean history;
4. Education and training of Korean history at universities and professional educational institutions.
(2) Matters pertaining to the education and training courses on Korean history, instructions, the organization and operation of education and training institutions, etc. prescribed by paragraph (1) shall be provided for by Presidential Decree.
 Article 18 (Verification of Competence in Korean History)
(1) The Institute may verify people’s competence in Korean history in order to promote people’s interest in Korean history and to foster the knowledge and thinking ability as well as the ability to solve problems.
(2) Matters pertaining to the method, procedure, contents and subjects of the verification of competence in Korean history prescribed by paragraph (1) shall be provided for by Presidential Decree.
 Article 19 (Facilitation of Informatization of Korean History)
(1) The Institute shall establish and implement basic plans and annual plans for informatization of Korean history so that the Korean people can easily learn and conveniently utilize Korean history.
(2) The Institute shall operate the comprehensive information center in the area of history so as to facilitate informatization of Korean history.
(3) In order to facilitate informatization of Korean history through cooperative systems between the institutions concerned, the Institute shall establish the Council for Informatization of Korean History therein.
(4) Matters pertaining to facilitation of informatization of Korean history prescribed by paragraphs (1) through (3) shall be provided for by Presidential Decree.
CHAPTER Ⅴ SUPPLEMENTARY PROVISIONS
 Article 20 (Delegation and Commission of Authority)
(1) The Minister of Education may delegate some of the authorities provided for in this Act to the heads of local governments (including the superintendents of education offices), as prescribed by Presidential Decree. <Amended by Act No. 8852, Feb. 29, 2008; Act No. 11690, Mar. 23, 2013>
(2) The Minister of Education may commission some of the duties provided for in this Act to professional institutions and organizations related to Korean history, as prescribed by Presidential Decree. <Amended by Act No. 8852, Feb. 29, 2008; Act No. 11690, Mar. 23, 2013>
ADDENDUM
This Act shall enter into force three months after the date of its promulgation.
