ENFORCEMENT DECREE OF THE CAREER EDUCATION ACT

Presidential Decree No. 26727, Dec. 22, 2015

CHAPTER I GENERAL PROVISIONS
 Article 1 (Purpose)
The purpose of this Decree is to prescribe matters delegated by the Career Education Act and matters necessary for the enforcement of said Act.
 Article 2 (Surveys on Status of Career Education)
(1) Each survey on status of career education under Article 6 (1) of the Career Education Act (hereinafter referred to as the "Act") shall include the following matters:
1. Status of students' careers, such as entering higher schools and finding employment;
2. Status of human resources and facilities related to career education;
3. Status of operation of career education programs;
4. Actual state of cooperation on career education between schools and regional communities;
5. Actual state of career education in school classes;
6. Other matters concerning career education, regarding which the Minister of Education deems necessary to conduct a survey of status.
(2) Where necessary for the survey on status of career education referred to in Article 6 (1) of the Act, the Minister of Education may request the related institutions (including relevant administrative agencies and schools; hereinafter the same shall apply), organizations, etc. to submit data or to state their opinions. In such cases, the related institutions, organizations, etc. shall comply with such request, except in any extenuating circumstances.
(3) The Minister of Education shall publish the findings from the survey on status of career education referred to in Article 6 (1) of the Act on the website of the National Career Education Center provided for in Article 15 of the Act or of the Ministry of Education.
(4) Except as expressly provided for in paragraphs (1) through (3), detailed matters concerning the survey on status of career education shall be prescribed by the Minister of Education.
CHAPTER II CAREER EDUCATION IN ELEMENTARY AND SECONDARY SCHOOLS
 Article 3 (Goals and Standards for Accomplishment of Career Education)
Where the Minister of Education intends to formulate goals and standards for accomplishment of Career Education under Article 8 (1) of the Act, he/she shall undergo deliberation by the Curriculum Council under Article 1 of the Regulations on the Curriculum Council. The same shall also apply for any modification of any goal or standards for accomplishment already formulated.
 Article 4 (Dedicated Career Coach)
(1) A person assigned to a middle school or high school as a dedicated career coach shall have a teacher's license indicating a subject prescribed by Ordinance of the Ministry of Education as his/her major subject (including where it is indicated as his/her minor subject) under Article 4 of the Decree on Certification of Teachers.
(2) In cases of an elementary or secondary school (excluding middle schools and high schools), a dedicated career coach may be assigned in a way of assigning a teacher holding a position sharing school affairs under Article 19 (3) of the Elementary and Secondary Education Act.
(3) At least one dedicated career coach shall be assigned to each school: Provided, That in cases of a school whose size does not exceed that prescribed by a superintendent of education, the duties of a dedicated career coach may be assigned to a touring teacher.
(4) A specialist assisting dedicated career coach provided for in Article 9 (2) of the Act, shall meet each of the following requirements:
1. He/she shall not fall under any ground for disqualification prescribed in subparagraphs 1 and 3 through 5 of Article 33 of the State Public Officials Act;
2. He/she shall have completed at least 40 hours’ education or training on career education conducted by a superintendent of education;
3. He/she shall meet the criteria for qualifications prescribed and publicly notified by the Minister of Education in connection with career education.
 Article 5 (Organization, Operation, etc. of Career Experience Curriculum)
(1) The Minister of Education shall prescribe basic matters concerning the standards for, and details of, the career experience curriculum subject to Article 12 (1) of the Act.
(2) A superintendent of education may prescribe standards and details suitable to regional circumstances within the scope of career experience curriculum prescribed by the Minister of Education under paragraph (1).
 Article 6 (Operation of Intensive Academic Year or Semester for Career Education)
(1) Where a superintendent of education intends to operate an intensive academic year or semester for career education under Article 13 (1) of the Act (hereinafter referred to as "career semester system"), he/she shall take into account factors such as the opinions of students and their parents and the actual state of schools to which the career semester system applies.
(2) A superintendent of education may manage a career semester system in connection with, or by integrating it with, the free-learning semester prescribed in Article 44 (3) of the Enforcement Decree of the Elementary and Secondary Education Act.
(3) Except as otherwise provided for in paragraphs (1) and (2), detailed matters necessary for the operation of a career semester system shall be prescribed by a superintendent of eduction after consultation with the Minister of Education.
CHAPTER III CAREER EDUCATION IN UNIVERSITIES AND COLLEGES
 Article 7 (Career Education in Universities and Colleges)
Where necessary to support career education in universities and colleges under Article 14 (2) of the Act, the Minister of Eduction may request the related institutions and organizations to provide cooperation such as in-service training of university or college students or career counselling.
CHAPTER IV SUPPORT FOR CAREER EDUCATION
 Article 8 (Support for Career Experience)
An information-providing system under Article 18 (2) of the Act shall be managed to perform the following services:
1. Generation and management of statistics related to institutions providing vocational experience under Article 18 (1) of the Act (hereinafter referred to as "institutions providing vocational experience");
2. Provision of information on registration and management of institutions providing vocational experience;
3. Generation and diffusion of other information necessary for career experience.
 Article 9 (Certification of Career Experience Providers as Education-Donor Institutions)
(1) Under Article 19 (1) of the Act, the Minister of Education may certify an institution providing career experience that meets each of the following requirements, as an education-donor institution providing vocational experience:
1. It shall provide students with opportunities for vocational experience free of charge;
2. It shall have human resources, facilities, etc. to provide students with opportunities for vocational experience;
3. It shall have sufficient experience programs necessary for vocational experience;
4. It shall have detailed and feasible plans for management of education.
(2) A person who intends to obtain certification of an education-donor institution providing career experience (hereinafter referred to as "certification") under Article 19 (1) of the Act, shall file an application prescribed by Ordinance of the Ministry of Education, with the Minister of Education, appending documents prescribed by Ordinance of the Ministry of Education.
(3) In granting certification, the Minister of Education may hear opinions of related experts.
(4) Upon receipt of an application under paragraph (2), the Minister of Education shall determine as to whether to grant certification and inform the applicant of the result thereof within six months from the date of application.
(5) Upon granting certification, the Minister of Education shall issue a certificate prescribed by Ordinance of the Ministry of Education to an education-donor institution providing career experience.
 Article 10 (Assessment of Career Education of City/Do Office of Education)
(1) Factors subject to assessment of career education of the Office of Education of the Special Metropolitan City, Metropolitan City, a Metropolitan Autonomous City, a Do or Special Self-Governing Province (hereinafter referred to as "City/Do") shall be as follows:
1. Status of implementation of, and support for, career education of the Office of Education of a City/Do;
2. Actual state of career education of schools within the jurisdiction of the Office of Education of a City/Do;
3. Any other matter prescribed by the Minister of Education concerning career education.
(2) Where necessary for the assessment referred to in Article 23 (1) of the Act, the Minister of Education may request a superintendent of education to submit related data, such as the outcome of self-assessment conducted under Article 23 (2).
(3) Except as otherwise prescribed in paragraphs (1) and (2), detailed matters necessary for the assessment of career education of the Office of Education of a City/Do, shall be prescribed by the Minister of Education.

This Decree shall enter into force on December 23, 2015.
