CRAFT INDUSTRY PROMOTION ACT

Act No. 13299, May 18, 2015

 Article 1 (Purpose)
The purpose of this Act is to contribute to the improvement of the quality of cultural life of the people and development of the national economy through the creation of the foundation for the development of the craft industry by providing matters necessary to support and promote the craft industry.
 Article 2 (Definitions)
The terms used in this Act shall be defined as follows:
1. The term "craft" means the work or ability of making handicraft goods (including manual work to which a mechanical manufacturing process is partly added) in pursuit of functionality and decorativeness based on techniques, skills, materials, patters, etc., in which cultural elements are reflected;
2. The term "craft goods" means the output of craft production which have utilitarian and artistic values, including traditional craft goods produced based on traditional techniques, skills, materials, etc., peculiar to the Korean people and modern craft goods produced using modern materials, skills or techniques;
3. The term "craft industry" means crafts or the development, creation, production, distribution, exhibition, consumption, utilization, etc., of craft goods (referring to tangible and intangible goods, services and the mixtures thereof creating financial value added using crafts; hereinafter the same shall apply) and the industry related thereto.
 Article 3 (Responsibility of Government and Local Governments)
(1) The Government and local governments shall formulate and execute policies necessary to promote the craft industry.
(2) The Government and local governments shall formulate a plan to make excellence in Korean crafts widely known, and develop and disseminate the craft industry.
 Article 4 (Relationship to Other Statutes)
Except as otherwise expressly provided for in other Acts, this Act shall apply to the promotion of the craft industry.
 Article 5 (Formulation, Implementation, etc., of Basic Plans for Promotion of Craft Industry)
(1) The Minister of Culture, Sports and Tourism shall formulate and implement basic plans for the promotion of the craft industry (hereinafter refereed to as "basic plan") every five years for the promotion of the craft industry.
(2) A basic plan shall include the following:
1. Mid- and long-term basic directions for the promotion of the craft industry;
2. Matters necessary to improve systems and statutes for the promotion of the craft industry;
3. Matters necessary to support business startups and production for the promotion of the craft industry;
4. Matters necessary to improve the quality of craft goods;
5. Matters necessary for research, development, and dissemination relating to techniques necessary for the creation and production of craft goods;
6. Matters necessary to promote the utilization and revitalize the distribution of craft goods;
7. Matters necessary to lay the foundation for the revitalization of the craft industry;
8. Matters necessary for the training of professionals in the craft industry;
9. Matters necessary for international exchanges and overseas expansion;
10. Other matters necessary for the promotion of the craft industry.
(3) The Minister of Culture, Sports and Tourism shall formulate and implement a detailed action plan (hereinafter referred to as "action plan") every year in accordance with a basic plan.
(4) Where the Minister of Culture, Sports and Tourism formulates a basic plan and an action plan, he/she shall pre-consult with the heads of relevant central administrative agencies, and hear opinions of the Craft Industry Promotion Committee referred to in Article 6.
(5) Where necessary to formulate and implement a basic plan and action plan, the Minister of Culture, Sports and Tourism may request the heads of relevant local governments, or relevant institutions, corporations, organizations, or individuals for cooperation, and any person, in receipt of such request, shall comply therewith, except in extenuating circumstances.
(6) Paragraphs (4) and (5) shall apply where the Minister of Culture, Sports and Tourism alters a basic plan and an action plan finalized: Provided, That the foregoing shall not apply where he/she alters any insignificant matters prescribed by Presidential Decree.
 Article 6 (Craft Industry Promotion Committee)
(1) The Craft Industry Promotion Committee (hereinafter referred to as the "Committee") shall be established under the Ministry of Culture, Sports and Tourism to deliberate on the following matters for the promotion of the craft industry:
1. Matters concerning the formulation of a basic plan and an action plan;
2. Evaluation and consultation on policies related to the craft industry;
3. Other programs designated by the Minister of Culture, Sports and Tourism or necessary to achieve the objectives of the Committee.
(2) The Committee shall be composed of 10 to 15 members, including one chairperson and one vice chairperson.
(3) The chairperson shall be elected by the Committee from among its members, and the vice chairperson shall be appointed by the chairperson with the consent of the Committee.
(4) Members of the Committee shall be appointed by the Minister of Culture, Sports and Tourism from among those who have extensive expertise, experience, and high reputation in crafts and the craft industry.
(5) The term of office of members shall be three years, and may be renewed.
(6) Where necessary to efficiently conduct affairs of the Committee, the Committee may organize and operate subcommittees.
(7) Other matters necessary for the composition, operation, etc., of the Committee shall be prescribed by Presidential Decree.
 Article 7 (Fact-Finding Survey)
(1) The Minister of Culture, Sports and Tourism shall regularly conduct fact-finding research on the craft industry for formulating and implementing policies to promote the Craft industry.
(2) The Minister of Culture, Sports and Tourism shall publish an analysis report based on the result of fact-finding survey.
(3) The Minister of Culture, Sports and Tourism may request the heads of relevant central administrative agencies or relevant local governments, or institutions, corporations, organizations related to the craft industry to cooperate for fact-finding survey. In such cases, any person, in receipt of such request, shall comply therewith, except in extenuating circumstances.
(4) Matters necessary for the timing, subject matters, methods, etc., of fact-finding research under paragraph (1) shall be prescribed by Presidential Decree.
 Article 8 (Support for Business Startups and Production)
(1) The Minister of Culture, Sports and Tourism may provide support necessary for promoting business startups relating to the craft industry, and the growth and development of founders.
(2) The Minister of Culture, Sports and Tourism, or the Mayor of a Special Metropolitan City, the Mayor of a Metropolitan City, the Metropolitan Autonomous City Mayor, the Governor of a Do, or the Special Self-Governing Province Governor (hereinafter referred to as the "Mayor/Do Governor") may provide necessary support, such as financing to producers of craft goods, to strengthen the competitiveness of the craft industry and to promote the production of excellent craft goods.
(3) Necessary matters concerning eligibility, methods, and procedures for support for business startups and production referred to in paragraphs (1) and (2), shall be prescribed by Presidential Decree.
 Article 9 (Training of Professionals)
(1) The Government or local governments may support programs relating to the training of professionals in the related fields to promote the craft industry.
(2) In order to train professionals referred to in paragraph (1) the Government or local governments may designate research institutes, colleges, and other institutions as institutions that train professionals for the craft industry, as prescribed by Presidential Decree.
(3) The Government or local governments may fully or partially subsidize the expenses incurred in training professionals to institutions that train professionals for the craft industry designated under paragraph (2), as prescribed by Presidential Decree.
 Article 10 (Improvement of Quality of Craft Goods and Development of Techniques for Craft Goods)
(1) The Minister of Culture, Sports and Tourism may provide support to improve the quality of craft goods and to develop craft techniques necessary for the production and creation of craft goods, such as materials, raw materials, and handling techniques of craft goods.
(2) The Government and local governments may provide support for the efficient supply and demand of raw materials necessary for the production of craft goods and research and development concerning alternative materials.
(3) The Minister of Culture, Sports and Tourism may designate an institution that may be entrusted with affairs concerning quality improvement and craft technique development programs referred to in paragraph (1) and take full charge of such affairs among institutions, corporations, or organizations related to the craft industry.
(4) Any institution designated under paragraph (3) shall be deemed an institution that takes full charge of technique development programs referred to in Article 17 (2) of the Framework Act on the Promotion of Cultural Industries, and paragraph (3) of the aforesaid Article shall apply mutatis mutandis to such institution.
(5) Necessary matters concerning eligibility, methods, and procedures for support referred to in paragraphs (1) and (2), the scope of entrustment and methods of and procedures for designation referred to in paragraph (3) shall be prescribed by Presidential Decree.
 Article 11 (Expansion of Infrastructure for Craft Industry)
The Government and local governments shall endeavor to secure infrastructure for the craft industry, such as the expansion of support facilities, and the creation of complexes and zones, for the promotion of the craft industry.
 Article 12 (Revitalization of Distribution and Promotion of Investment)
(1) The Government and local governments shall endeavor to revitalize the distribution of craft goods, such as modernization of the distribution structure.
(2) The Government and local governments may proactively provide support to business for joint purchase, joint sale, etc., of cooperatives related to crafts established under the Small and Medium Enterprise Cooperatives Act or the Framework Act on Cooperatives.
(3) The Government and local governments shall make necessary endeavors to promote investment in the craft industry, such as the provision of information on and intermediation of financing.
 Article 13 (Revitalization of International Exchanges and Overseas Expansion)
(1) In order to promote the craft industry, the Minister of Culture, Sports and Tourism shall provide support to boost international exchanges and overseas expansion.
(2) Necessary matters concerning eligibility, methods, and procedures for support referred to in paragraph (1) shall be prescribed by Presidential Decree.
 Article 14 (Designation, etc., of Excellent Craft Goods)
(1) The Minister of Culture, Sports and Tourism may designate excellent craft goods.
(2) Craft goods designated under paragraph (3) may have a label thereon, indicating that they have been designated by the Minister of Culture, Sports and Tourism as excellent craft goods.
(3) The Minister of Culture, Sports and Tourism shall reflect special support for excellent craft goods in a basic plan, such as support for branding, exhibition, intermediation of investment, support for overseas expansion, and international cooperation.
(4) Where the Government, local governments, and public institutions under the Act on the Management of Public Institutions purchase craft goods, the Minister of Culture, Sports and Tourism may request them to preferentially purchase excellent craft goods.
(5) Necessary matters concerning criteria and procedures for designation, methods of labeling, and support for excellent craft goods, shall be prescribed by Presidential Decree.
 Article 15 (Cancellation of Designation of Excellent Craft Goods)
(1) In any of the following cases, the Minister of Culture, Sports and Tourism may cancel the designation of excellent craft goods: Provided, That where excellent craft goods fall under subparagraph 1, he/she shall cancel the designation thereof:
1. Where craft goods have been designated as excellent craft goods by deception or other fraudulent means;
2. Where craft goods fail to meet criteria for designation referred to in Article 14 (5).
(2) Where the Minister of Culture, Sports and Tourism intends to cancel the designation of any excellent craft goods pursuant to paragraph (1), he/she shall hold a hearing thereon.
 Article 16 (Designation, etc., of Institution That Takes Full Charge of Affairs)
(1) The Minister of Culture, Sports and Tourism may designate an institution that takes full charge of affairs (hereinafter referred to as "institution that takes full charge of affairs) concerning the promotion of the craft industry in order to efficiently conduct activities necessary for the promotion of the craft industry.
(2) An institution that takes full charge of affairs shall conduct the following:
1. Examination, research, and development concerning the craft industry and support for the craft industry;
2. Distribution, exhibition, and advertisement for the revitalization of the craft industry and support therefor;
3. Support for international exchanges and overseas expansion;
4. Designation of excellent craft goods;
5. Building and standardization of database on craft goods;
6. Other activities necessary to achieve the objectives of the designation of the institution that takes full charge of affairs.
(3) The Government may subsidize expenses incurred in the operation, etc., of an institution that takes full charge of affairs.
(4) Matters necessary for the designation, operation, etc., of an institution that takes full charge of affairs, shall be prescribed by Presidential Decree.
 Article 17 (Fusion and Connection of Craft Industry)
(1) The Government shall formulate a policy necessary to modernize the craft industry, such as mutual development through the fusion and connection between traditional craft and modern craft.
(2) In order to make the craft industry to develop through the fusion or connection with a wide variety of cultural content, such as modern design and traditional patterns, the Minister of Culture, Sports and Tourism shall reflect such fusion connection in relevant policies.
(3) Where necessary for the fusion and connection of the craft industry, the Minister of Culture, Sports and Tourism may request the heads of relevant central administrative agencies for cooperation. In such cases, in receipt of such request, the heads of central administrative agencies shall provide cooperation, except in extenuating circumstances.
 Article 18 (Promotion of Local Craft Goods)
(1) The Government or local governments may subsidize expenses incurred in the production and development of local craft goods, opening and operation of stores specialized in local craft goods, promotion of exporting local craft goods, and other matters prescribed by Presidential Decree to those who conduct or intend to conduct a business of producing local craft goods.
(2) The Government or local governments shall endeavor to make the local craft industry to develop in line with cultural tourism, education, and experience programs of its own region.
 Article 19 (Discovery of Best Practice and Awarding)
The Government and local governments may provide necessary support, such as the discovery of best practices that have contributed to the promotion of the craft industry through the daily use, industrialization, and globalization of Korean crafts, and awarding of prizes.
 Article 20 (Delegation or Entrustment of Authority)
(1) The Minister of Culture, Sports and Tourism may delegate part of his/her authority under this Act to the Mayor/Do Governor, as prescribed by Presidential Decree.
(2) The Minister of Culture, Sports and Tourism may entrust part of his/her affairs under this Act to an institution that takes full charge of affairs designated under Article 16, or a relevant institution, corporation, or organization, as prescribed by Presidential Decree.
 Article 21 (Legal Fiction as Public Officials in Application of Penal Provisions)
When penal provisions under Articles 129 through 132 of the Criminal Act are applied, executives and employees of any institution that takes full charge of affairs engaged in affairs entrusted by the Minister of Culture, Sports and Tourism pursuant to Article 20, shall be deemed public officials.
 Article 22 (Administrative Fines)
(1) Any person who attaches a label of excellent craft goods to any craft goods without obtaining the designation of excellent craft goods pursuant to Article 14 (1), shall be punished by an administrative fine not exceeding five million won.
(2) The administrative fines under paragraph (1) shall be imposed and collected by the Minister of Culture, Sports and Tourism, as prescribed by Presidential Decree.
ADDENDUM
This Act shall enter into force six months after the date of its promulgation.
