FISHERY RESOURCES PROTECTION ACT

 Article 1 (Jurisdictional Waters)
Marine waters surrounding the Korean Peninsula and the islands annexed thereto, and enclosed by the boundaries created by connecting the following boundaries shall be regarded as jurisdiction waters for the conservation of fishery resources (hereinafter referred to as the "marine jurisdictional waters"):
1. A line running from the summit of "Uh-Am" Pass which is located in Kyungheung-kun, Hamkyongpuk-do, to 42.15 degrees North latitude and 130.45 degrees East longitude;
2. A line running from 42.15 degrees North latitude and 130.45 degrees East longitude to, 38 degrees North latitude and 132.50 degrees East longitude;
3. A line running from 38 degrees North latitude and 132.50 degrees East longitude, to 35 degrees North latitude and 130 degrees East longitude;
4. A line running from 35 degrees North latitude and 130 degrees East longitude, to 34.40 degrees North latitude and 129.10 degrees East longitude;
5. A line running from 34.40 degrees North latitude and 129.10 degrees East longitude, to 32 degrees North latitude and 127 degrees East longitude;
6. A line running from 32 degrees North latitude and 127 degrees East longitude, to 32 degrees North latitude and 124 degrees East longitude;
7. A line running from 33 degrees North latitude and 124 degrees East longitude, to 39.45 degrees North latitude and 124 degrees East longitude;
8. A line running from 39.45 degrees North latitude and 124 degrees East longitude, to the west end of "Ma-An" Island (one of "Shindo" Islands located in Yongchon-kun, Pyonganpuk-do); and
9. A line running from the west end of "Ma-An" Island, to the west end of the border line between Korea and Manchuria.
 Article 2 (Permission for Fishery within Jurisdictional Waters)
A person intending to operate fishing within the jurisdictional waters shall obtain permission from the Minister of Oceans and Fisheries <Amended by Act No. 1783, Apr. 23, 1966; Act No. 5153, Aug, 8, 1996; Act No. 8852, Feb. 29, 2008; Act No. 11690, Mar. 23, 2013>
 Article 3 (Penal Provisions)
Any person who violated the provisions of Article 2 shall be liable to imprisonment for not more than three years or a fine of not more than 30 million won, and the fishing boats, fishing gears, catch, cultivations and its products owned or carried by him shall be confiscated. <Amended by Act No. 14738, Mar. 21, 2017>
 Article 4 (Investigation of Offense)
With regard to the investigation of the offenses under preceding Article, the boarding officers and privates on naval vessels or other public officials prescribed by the Presidential Decree shall perform the duties of judicial police officials. If necessary for the investigation under preceding paragraph, an order may be issued to the vessel in violation to return to the port. If a violation of Article 2 is suspected, any vessel, including vessels simply passing through the jurisdictional waters, may be compelled to stop for inspection, search, or other necessary measures.
ADDENDA
(1) Permissions, licenses on or notification of fishery given or made prior to February 19, 1952, shall be regarded as permitted under this Act. <Amended by Act No. 1783, Apr. 23, 1966>

This Act shall come into force on the date of its promulgation.
ADDENDA <Act No. 5153, Aug, 8, 1996>
Article 1 (Enforcement Date)
This Act shall come into force on the enforcement date of the Presidential Decree relating to the organization of the Ministry of Maritime Affairs and Fisheries and of the National Maritime Police Agency pursuant to the provision amended in Article 41 of this Act within 30 days from promulgation of this Act.
