ACT ON THE PREVENTION AND MANAGEMENT OF CARDIO-CEREBROVASCULAR DISEASES

Act No. 14217, May 29, 2016

 Article 1 (Purpose)
The purpose of this Act is to alleviate personal suffering and damage and social burden resulting from cardio-cerebrovascular diseases and to contribute to improving people's health.
 Article 2 (Definitions)
The terms used in this Act shall be defined as follows:
1. "Cardio-cerebrovascular diseases" means the following cardiac disorders, cerebrovascular diseases, and diseases antecedent thereto:
(a) Myocardial infarction and other ischemic heart diseases;
(b) Cardiac arrest;
(c) Cerebral infarction and other cerebrovascular diseases;
(d) High blood pressure;
(e) Diabetes;
(f) Other diseases specified by Ordinance of the Ministry of Health and Welfare;
2. "Management of cardio-cerebrovascular diseases" means activities for prevention and medical treatment of, rehabilitation from, and research on cardio-cerebrovascular diseases.
 Article 3 (Duties of State, etc.)
(1) The State and local governments shall endeavor to prevent cardio-cerebrovascular diseases and provide patients with medical services appropriate for cardio-cerebrovascular diseases by implementing and supporting programs for managing cardio-cerebrovascular diseases (hereinafter referred to as "cardio-cerebrovascular disease programs").
(2) Medical personnel and the heads of medical institutions under the Medical Service Act shall cooperate with the State and local governments in implementing cardio-cerebrovascular disease programs.
 Article 4 (Formulation of Comprehensive Plan for Managing Cardio-Cerebrovascular Diseases)
(1) The Minister of Health and Welfare shall formulate a comprehensive plan for managing cardio-cerebrovascular diseases every five years (hereinafter referred to as the "comprehensive plan").
(2) Each comprehensive plan shall include the following matters:
1. Basic goals and direction-setting for the programs for managing cardio-cerebrovascular diseases;
2. Plans and methods for implementing programs for managing cardio-cerebrovascular diseases;
3. Training of specialized medical personnel necessary for managing cardio-cerebrovascular diseases;
4. Measures for managing statistical data and information about cardio-cerebrovascular diseases;
5. Other matters prescribed by Ordinance of the Ministry of Health and Welfare.
(3) The Special Metropolitan City Mayor and each Metropolitan City Mayor, Special Self-Governing City Mayor, Do Governor, or Special Self-Governing Province Governor (hereinafter referred to as "Mayor/Do Governor") shall formulate a detailed implementation plan respectively pursuant to the master plan, considering the situation of each local government.
(4) The detailed implementation plan under paragraph (3) shall be formulated as part of the regional healthcare plan under Article 7 of the Regional Public Health Act.
(5) If the Minister of Health and Welfare or a Mayor/Do Governor deems necessary for formulating a comprehensive plan or a detailed implementation plan, he/she may request relevant agencies, organizations and facilities to provide information and cooperate in formulating such plan. Upon receipt of a request for such cooperation, agencies, etc. shall comply with the request, except in extenuating circumstances.
(6) Other matters necessary for formulating and implementing the comprehensive plan and detailed implementation plans, shall be prescribed by Presidential Decree.
 Article 5 (Projects for Research on Cardio-Cerebrovascular Diseases)
(1) The Minister of Health and Welfare may implement projects to research cardio-cerebrovascular diseases (hereinafter referred to as "research projects for cardio-cerebrovascular diseases") so as to develop technologies for prevention and medical treatment of and rehabilitation from cardio-cerebrovascular diseases.
(2) The research projects for cardio-cerebrovascular diseases shall include the following tasks:
1. Analysis and prediction of domestic and international trends of research projects for cardio-cerebrovascular diseases and demands for research projects for cardio-cerebrovascular diseases;
2. Public invitation of proposals for annual tasks of research projects for cardio-cerebrovascular diseases, deliberation on such proposals, and selection of proposed tasks;
3. Evaluation and utilization of outcomes of research projects for cardio-cerebrovascular diseases;
4. Other matters that the Minister of Health and Welfare deems necessary for implementing research projects for cardio-cerebrovascular diseases.
(3) The Minister of Health and Welfare shall endeavor to promote international cooperation in research projects for cardio-cerebrovascular diseases and shall also endeavor to prepare schemes to dispatch specialists to foreign countries and invite specialists to the Republic of Korea to introduce advanced technologies.
 Article 6 (Projects for Surveys and Statistics on Cardio-Cerebrovascular Diseases)
(1) The Minister of Health and Welfare may implement projects for surveys and statistics related to cardio-cerebrovascular diseases (hereinafter referred to as "projects for surveys and statistics on cardio-cerebrovascular diseases"), such as the rate of prevalence and recurrence of cardio-cerebrovascular diseases and the mortality rate of cardio-cerebrovascular diseases, by collecting and analyzing continually and systematically data about risk factors for the prevalence of cardio-cerebrovascular diseases, medical treatment of such diseases, and rehabilitation from such diseases. The Statistics Act shall apply to collecting statistical data, compiling statistics, etc. in such cases, and the personal information handled for compiling statistics shall be deemed exempt from the application of the Personal Information Protection Act pursuant to Article 58 (1) of said Act.
(2) The projects for surveys and statistics on cardio-cerebrovascular diseases under paragraph (1), shall include the following projects:
1. A project concerning statistics on registration of cardio-cerebrovascular diseases;
2. A cohort study for ascertaining causes of cardio-cerebrovascular diseases;
3. Other projects that the Minister of Health and Welfare deems necessary for compiling statistics related to cardio-cerebrovascular diseases.
(3) The Minister of Health and Welfare may request medical personnel who examine and treat cardio-cerebrovascular diseases or medical institutions under the Medical Service Act, the Korea Health Insurance Service or the Health Insurance Review and Assessment Service under the National Health Insurance Act, or any other corporation, institution, organization, etc. engaging in a business related to cardio-cerebrovascular diseases to submit data necessary for the projects for surveys and statistics on cardio-cerebrovascular diseases; or to state opinions thereon, as prescribed by Ordinance of the Ministry of Health and Welfare. Any person who receives a request to submit data or express an opinion in such cases shall comply with such request, except in extenuating circumstances.
(4) Other matters necessary for implementing projects for surveys and statistics on cardio-cerebrovascular diseases shall be prescribed by Ordinance of the Ministry of Health and Welfare.
 Article 7 (Programs for Preventing Cardio-Cerebrovascular Diseases)
(1) The Minister of Health and Welfare, a Mayor/Do Governor, or the head of a Si/Gun/Gu may implement programs to continuously and systematically accumulate information about cardio-cerebrovascular diseases for preventing cardio-cerebrovascular diseases and to efficiently provide people with information necessary for managing cardio-cerebrovascular diseases (hereinafter referred to as "programs for preventing cardio-cerebrovascular diseases").
(2) The programs for preventing cardio-cerebrovascular diseases under paragraph (1) shall include the following services:
1. Collecting various kinds of information about cardio-cerebrovascular diseases and establishing and managing a database;
2. Providing people with information about cardio-cerebrovascular diseases and related consulting services;
3. Developing educational materials concerning cardio-cerebrovascular diseases and conducting educational and promotional programs;
4. Education and training of human resources for consulting services on cardio-cerebrovascular diseases;
5. Other services that the Minister of Health and Welfare deems necessary for preventing cardio-cerebrovascular diseases.
(3) Other matters necessary for implementing programs for preventing cardio-cerebrovascular diseases shall be prescribed by Ordinance of the Ministry of Health and Welfare.
 Article 8 (Epidemiological Investigations)
(1) If the Minister of Health and Welfare deems necessary for ascertaining causes of prevalence and recurrence of cardio-cerebrovascular diseases, he/she may conduct epidemiological investigations.
(2) Matters regarding the timing, methods, details, etc. of epidemiological investigations under paragraph (1), shall be prescribed by Presidential Decree.
 Article 9 (Designation, etc. of Centers for Cardio-Cerebrovascular Diseases)
(1) In order to provide the following services, the Minister of Health and Welfare may designate general hospitals, as defined in Article 3 (2) 3 (e) of the Medical Service Act, as centers for cardio-cerebrovascular diseases:
1. Medically treating and rehabilitating patients of cardio-cerebrovascular diseases;
2. Assisting personnel in performing tasks related to the comprehensive plan under Article 4;
3. Surveying and researching prevention and medical treatment of and rehabilitation from cardio-cerebrovascular diseases;
4. Collecting, analysing, and providing data related to programs for preventing cardio-cerebrovascular diseases;
5. Advocating and educating prevention and management of cardio-cerebrovascular diseases;
6. Other services specified by Ordinance of the Ministry of Health and Welfare as those necessary for managing cardio-cerebrovascular diseases.
(2) If a center for cardio-cerebrovascular diseases fails to perform any of the services under paragraph (1) or fails to comply with any of the guidance or supervision under Article 11, the Minister of Health and Welfare may order the center to take corrective measures.
(3) In any of the following cases, the Minister of Health and Welfare may revoke the designation of a center for cardio-cerebrovascular diseases:
1. If a center for cardio-cerebrovascular diseases fails to perform any of the services under paragraph (1) or fails to comply with any of an order to take corrective measures under paragraph (2);
2. If a center for cardio-cerebrovascular diseases fails to meet any of the standards for designation under paragraph (4);
3. If a center for cardio-cerebrovascular diseases fails to comply with any of the guidance or supervision under Article 11;
4. If any of the grounds prescribed by Presidential Decree exists.
(4) Matters such as the standards, methods, and procedure for designating centers for cardio-cerebrovascular diseases and the procedure, etc. for revoking the designation, shall be prescribed by Ordinance of the Ministry of Health and Welfare.
 Article 10 (Subsidization for Expenses)
The State and local governments may subsidize the following expenses, within budgetary limits:
1. Expenses incurred to centers for cardio-cerebrovascular diseases in expanding facilities, human resources, and equipment necessary for providing the services under Article 9 (1);
2. Expenses incurred to the corporations and organizations to whom services are entrusted pursuant to Article 13 (2) in performing the entrusted services.
 Article 11 (Guidance, Supervision, etc.)
The Minister of Health and Welfare shall guide and supervise centers for cardio-cerebrovascular diseases in providing services and may order the head of each center for cardio-cerebrovascular diseases to report the outcomes of services and necessary matters concerning the status of operation or to submit necessary documents.
 Article 12 (Hearings)
When the Minister of Health and Welfare intends to revoke designation under Article 9 (3), he/she shall hold hearings.
 Article 13 (Delegation and Entrustment)
(1) The Minister of Health and Welfare may delegate part of his/her authority under this Act to the head of an affiliated agency or a Mayor/Do Governor, as prescribed by Presidential Decree.
(2) The Minister of Health and Welfare may outsource part of the services under this Act to corporations and organizations related to cardio-cerebrovascular diseases, as prescribed by Presidential Decree.
ADDENDA
Article 1 (Enforcement Date)
This Act shall enter into force one year after the date of its promulgation: Provided, That Article 6 shall enter into force three months after the date of its promulgation.
Article 2 (Transitional Measure concerning Centers for Cardio-Cerebrovascular Diseases)
The regional centers for cardio-cerebrovascular diseases designated by the Minister of Health and Welfare pursuant to Articles 39 and 41 of the Framework Act on Health and Medical Services, shall be deemed centers for cardio-cerebrovascular diseases designated under this Act.
