 Article 1 (Purpose)
The purpose of this Act is to establish the Korea National Defense University and provide for matters regarding the operation of the University to promote the education, research, analysis, and development of sciences on national security policies and national defense management, and to train professional human resources to take charge of affairs related to national security.

 Article 2 (Establishment)
The Korea National Defense University shall be established under the jurisdiction of the Minister of National Defense.

 Article 3 (Establishment of Graduate Schools, etc.)
(1) The Korea National Defense University shall consist of the National Security Graduate School, the National Defense Management Graduate School, and the Department of Job Training.
(2) The Korea National Defense University shall establish, within it, the Faculty Board and other necessary divisions.
(3) Matters necessary for the organization, missions, operation, etc. of each Graduate School, the Department of Job Training, the Faculty Board, etc. referred to in paragraphs (1) and (2) shall be prescribed by Presidential Decree.

 Article 4 (Courses, Years Required for Graduation, etc.)
(1) The Korea National Defense University shall establish basic non-degree courses (hereinafter referred to as "basic courses") and degree courses for a degree (hereinafter referred to as "degree courses") and may also establish special courses, if deemed necessary by the Minister of National Defense.
(2) The number of years required to graduate from a basic course shall be one year, and the number of years required to graduate from a degree course shall be prescribed by Presidential Decree by applying mutatis mutandis Article 31 of the Higher Education Act, while the number of years required for graduation from a special course shall be determined by the Minister of National Defense.
(3) Matters necessary for the operation of basic courses and degree courses and other relevant matters shall be prescribed by Presidential Decree.

 Article 5 (Qualification for Admission)
Persons qualified to enter the Korea National Defense University shall be classified as follows from among the persons selected from the Armed Forces, government agencies, or other institutions or organizations prescribed by Presidential Decree:
1. A basic course: Persons who meet the qualification requirements prescribed by Presidential Decree;
2. A degree course: Persons who meet the qualification requirements under Article 33 of the Higher Education Act and the qualification requirements prescribed by Presidential Decree;
3. A special course: Persons who meet the qualification requirements determined by the Minister of National Defense.

 Article 6 (Subjects)
(1) The subjects of the basic course shall be those necessary for the formulation and execution of national security policies.
(2) The subjects of the degree course shall be those necessary for scientific research on national security and national defense science, which shall be determined by the Minister of National Defense, subject to prior consultation with the Minister of Education.
(3) The subjects of the special course shall be determined by the Minister of National Defense.

 Article 7 (Grant of Decree, etc.)
A person who finishes a degree course shall be granted a degree and registered pursuant to Article 35 of the Higher Education Act, and the types of degrees shall be determined by the Minister of National Defense, subject to prior consultation with the Minister of Education.

 Article 8 (Appointment of President, etc.)
(1) The Korea National Defense University shall have one president and one vice president, and each Graduate School shall be headed by one dean, the Department of Job Training by one director, and the Faculty Board by one dean.
(2) The Korea National Defense University shall have professors, associate professors, assistant professors (hereinafter referred to as "professors, etc."), and other public officials as necessary.
(3) The president of the Korea National Defense University shall be appointed by the President upon recommendation by the Minister of National Defense from among general-level officers; and the vice president, the dean of each Graduate School, and the dean of the Faculty Board shall be appointed by the Minister of National Defense from among general-level officers or professors: Provided, That if the vice president, the dean of a Graduate School, or the dean of the Faculty Board is to be appointed from among professors, such position shall be filled by the Minister of National Defense upon recommendation by the president of the Korea National Defense University. <Amended by Act No. 14609, Mar. 21, 2017>
(4) The term of office of the vice president, the dean of each Graduate School, and the dean of the Faculty Board shall be two years: Provided, That the foregoing shall not apply where a general-level officer is appointed to vice president, dean of a Graduate School, or dean of the Faculty Board. <Amended by Act No. 14609, Mar. 21, 2017>
(5) Matters necessary for the appointment of the director of the Department of Job Training and his/her term of office, and other matters shall be prescribed by Presidential Decree.

 Article 9 (Appointment, etc. of Professors, etc.)
(1) Professors, etc. in charge of education in degree courses shall be appointed from among persons who are qualified pursuant to Article 16 of the Higher Education Act. In such cases, professors and associate professors shall be appointed by the President upon recommendation by the Minister of National Defense, and assistant professors shall be appointed by the Minister of National Defense upon recommendation by the president of the Korea National Defense University.
(2) Professors, etc. solely in charge of education in basic courses or special courses shall be appointed by the Minister of National Defense from among field-grade officers or civilian military employees who meet the qualification requirements prescribed by Presidential Decree.
(3) The President may delegate his/her authority to appoint professors and associate professors under paragraph (1) to the Minister of National Defense, as prescribed by Presidential Decree.
(4) Professors, etc. in charge of education in degree courses shall be appointed under contract, and the term of each appointment shall be as follows:
1. Professors: Up to eight years;
2. Associate professors: Up to six years;
3. Assistant professors: Up to four years.
(5) Where professors, etc. are appointed from among persons other than military persons or civilian military employees, such professors, etc. shall be deemed State public officials in specific service, and the Educational Officials Act and the Special Act on the Improvement of Teachers’ Status and the Protection of Their Educational Activities shall apply mutatis mutandis respectively to the remuneration, training programs, as well as the guarantee of status for such professors, etc., the punishment of such professors, etc., and petitions filed by such professors, etc. <Amended by Act No. 13936, Feb. 3, 2016>

 Article 10 (Affiliated Institutions)
(1) The Research Institute for National Security Affairs and a library as affiliated institutions shall hereby be established in the Korea National Defense University.
(2) Matters necessary for the organization, missions, operation, etc. of the Research Institute for National Security Affairs and the library shall be prescribed by Presidential Decree.

 Article 11 (Collection of Tuition Fees, etc.)
(1) The president of the Korea National Defense University may charge tuition fees and other charges to executive officers or employees of institutions or organizations prescribed by Presidential Decree, who enter the Korea National Defense University.
(2) Matters necessary regarding the tuition fees and other charges referred to in paragraph (1) shall be prescribed by Ordinance of the Ministry of National Defense.

ADDENDA
Article 1 (Enforcement Date)
This Act shall enter into force on January 1, 2000.
Article 2 (Repeal of Other Act)
The Act on the Establishment of the National Defense Graduate School is hereby repealed.

Article 4 (Transitional Measures concerning Enrolled Students and Graduates)
(1) Persons currently enrolled in the National Defense Graduate School under the former Act on the Establishment of the National Defense Graduate School (hereinafter referred to as the "National Defense Graduate School") at the time when this Act enters into force shall be deemed to have been enrolled in the Korea National Defense University under this Act (hereinafter referred to as the "Korea National Defense University").
(2) Persons who graduate from the national security course of the National Defense Graduate School before this Act enters into force shall be deemed to have graduated from the basic course of the National Security Graduate School or National Defense Management Graduate School of the Korea National Defense University.
(3) Persons who graduate from a master degree course of the National Defense Graduate School before this Act enters into force shall be deemed to have graduated from the corresponding degree course of the Korea National Defense University.
Article 5 (Transitional Measures concerning Teaching Staff Members)
(1) Teaching staff members of the National Defense Graduate School at the time when this Act enters into force may be appointed to teaching staff members of the Korea National Defense University within the maximum of the full number of the Korea National Defense University.
(2) As regards teaching staff members appointed pursuant to paragraph (1), the class of rank and the class of salary held in the National Defense Graduate School shall be respected, and the date of appointment at the educational institution to which each belonged initially shall be deemed the date of appointment under this Act.
