ENFORCEMENT DECREE OF THE FRAMEWORK ACT ON THE PROMOTION OF LEISURE OF CITIZENS

Presidential Decree No. 26623, Nov. 11, 2015

 Article 1 (Purpose)
The purpose of this Decree is to prescribe matters mandated by the Framework Act on the Promotion of Leisure of Citizens and those necessary for the enforcement thereof.
 Article 2 (Formulation of Master Plans for Leisure Promotion)
(1) The Minister of Culture, Sports and Tourism shall formulate a master plan for leisure promotion (hereinafter referred to as “master plan”) under Article 7 (1) of the Framework Act on the Promotion of Leisure of Citizens (hereinafter referred to as the “Act”) by no later than the end of November of the year preceding the year in which the relevant master plan commences.
(2) To formulate a master plan, the head of each relevant central administrative agency shall prepare a divisional plan on issues within its remit and submit the plan to the Minister of Culture, Sports and Tourism.
(3) The Minister of Culture, Sports and Tourism shall make guidelines for preparing a divisional plan referred to in paragraph (2) in consultations with the heads of relevant central administrative agencies; and shall notify the heads of relevant central administrative agencies thereof.
(4) The head of a relevant central administrative agency may request that relevant administrative agencies, local governments, etc. submit necessary materials and data, if required to prepare a divisional plan referred to in paragraph (2).
(5) The Minister of Culture, Sports and Tourism shall compile the divisional plans submitted under paragraph (2) and finalize a master plan in consultation with the heads of relevant central administrative agencies.
(6) The Minister of Culture, Sports and Tourism shall notify the heads of relevant central administrative agencies and local governments of the master plan finalized under paragraph (5).
 Article 3 (Formulation of Action Plans for Leisure Promotion, etc.)
(1) To ensure that the heads of relevant central administrative agencies and local governments formulate an action plan for the promotion of leisure under Article 7 (3) of the Act (hereinafter referred to as “action plan”), the Minister of Culture, Sports and Tourism shall make guidelines for preparing an action plan for the following year and notify the heads of relevant central administrative agencies and local governments thereof by the end of November each year.
(2) The heads of relevant central administrative agencies and local governments shall submit performance results for the previous year and the action plan for the relevant year formulated in compliance with the guidelines made under paragraph (1) to the Minister of Culture, Sports and Tourism by no later than the end of January each year.
(3) The Minister of Culture, Sports and Tourism shall compile the performance results and action plans submitted under paragraph (2) and notify the heads of relevant central administrative agencies and local governments thereof.
 Article 4 (Contents, etc. of Leisure Education)
(1) The leisure education referred to in Article 11 (1) of the Act shall include the following:
1. Matters relating to the enhancement of knowledge, skills, attitudes, and values on leisure activities;
2. Matters necessary for cultivating leisure professionals and improving their expertise;
3. Other matters necessary for promoting leisure engagement.
(2) The State and local governments shall provide or support leisure education under Article 11 (1) of the Act at the following facilities:
2. Schools as defined in Article 2 of the Higher Education Act;
3. Cultural facilities as defined in Article 2 (1) 3 of the Culture and Arts Promotion Act;
4. Sports facilities as defined in subparagraph 1 of Article 2 of the Installation and Utilization of Sports Facilities Act;
5. Lifelong study halls and lifelong study centers as defined in Articles 21 and 21-2 of the Lifelong Education Act;
6. Social welfare centers as defined in subparagraph 5 of Article 2 of the Social Welfare Services Act;
7. Other facilities where people’s leisure activities continuously take place, as determined and publicly notified by the Minister of Culture, Sports and Tourism or prescribed by ordinance of a local government.
ADDENDUM
This Decree shall enter into force on November 19, 2015.
