PROMOTION OF TRADITIONAL MARTIAL ARTS ACT

 Article 1 (Purpose)
The purpose of this Act is to contribute to the improvement of citizens' health, the enhancement of citizens' cultural lifestyle, and the advancement as a cultural state by promoting traditional martial arts with cultural value.
 Article 2 (Definitions)
The term used in this Act shall be defined as follows: <Amended by Act No. 13248, Mar. 27, 2015>
1. The term "traditional martial arts (including martial arts designated as national intangible cultural heritage pursuant to the Act on the Safeguarding and Promotion of Intangible Cultural Heritage)" means martial skills, techniques, and systems for attack and fighting that have been created and systemized domestically or introduced from abroad and creatively formalized and systemized domestically, which are recognized as having traditional and cultural value worth promoting at the State level;
2. The term "instructor of traditional martial arts" means a person who teaches traditional martial arts in a school, a workplace, a community, or any other place.
 Article 3 (Establishment, etc. of Basic Plan for Promotion of Traditional Martial Arts)
(1) The Minister of Culture, Sports and Tourism shall establish and implement a comprehensive basic plan for traditional martial arts (hereinafter referred to as the "basic plan") in order to preserve and promote traditional martial arts in a systematic manner.
(2) The basic plan shall include the following matters:
1. Basic direction-setting for the promotion of traditional martial arts;
2. Matters concerning survey, research, etc. for the promotion of traditional martial arts;
3. Matters concerning the designation and support of traditional martial arts eligible for fostering;
4. Matters concerning the education and training of instructors of traditional martial arts;
5. Matters concerning exchange and cooperation between traditional martial arts and the hosting of events;
6. Matters concerning schemes for securing and efficient management of funds for the promotion of traditional martial arts;
7. Other matters specified by Presidential Decree as necessary for the promotion of traditional martial arts.
 Article 4 (Responsibilities of State and Local Governments)
(1) The State and each local government shall establish and implement various measures for the promotion of traditional martial arts in accordance with the basic plan.
(2) The State and each local government shall encourage, protect, and foster citizens' voluntary activities for traditional martial arts, install facilities necessary for such activities, secure human resources and organizations, grant subsidies for the budget, and develop better conditions for such activities.
 Article 5 (Fostering of Organizations of Traditional Martial Arts)
The State and each local government shall foster and support organizations of traditional martial arts for the promotion of traditional martial arts.
 Article 5-2 (International Centre of Martial Arts for Youth Development and Engagement under Auspices of UNESCO)
(1) The International Centre of Martial Arts for Youth Development and Engagement under the auspices of UNESCO (hereinafter referred to as the “ICM”) shall be established to facilitate the implementation of the Agreement between the Government of the Republic of Korea and the United Nations Educational, Scientific and Cultural Organization (Unesco) regarding the International Centre of Martial Arts for Youth Development and Engagement Under the Auspices of Unesco (Category 2) and to preserve and promote traditional martial arts from around the world.
(2) The ICM shall be a corporation.
(3) The ICM shall have executive officers and necessary employees in accordance with its articles of incorporation.
(4) Except as provided for in this Act, the provisions of the Civil Act regarding incorporated foundations shall apply mutatis mutandis to the matters concerning the ICM.
(5) The State and the relevant local government may subsidize expenses incurred for in operating the ICM within budgetary limits.

 Article 6 (Training of Instructors of Traditional Martial Arts, etc.)
(1) The Minister of Culture, Sports and Tourism shall take measures necessary for training instructors of traditional martial arts and improving their quality for the promotion of traditional martial arts.
(2) Necessary matters concerning the types and grades of instructors of traditional martial arts, the criteria for qualification for such instructors, and the testing and licensing of such instructors shall be prescribed by Presidential Decree.
ADDENDUM
This Act shall enter into force one year after the date of its promulgation.

Article 1 (Enforcement Date)
This Act shall enter into force one year after the date of its promulgation.

Article 1 (Enforcement Date)
This Act shall enter into force six months after the date of its promulgation.
Article 2 (Transitional Measures concerning the ICM)
(1) The International Centre of Martial Arts for Youth Development and Engagement under the auspices of UNESCO established as an incorporated foundation under the Civil Act as at the time this Act enters into force (hereinafter referred to as the “International Centre of Martial Arts as an incorporated foundation” in this Article) shall be deemed the ICM established under Article 5-2 when it has completed the registration for incorporation with permission from the Minister of Culture, Athletics and Tourism after resolution by its governing board about the succession of its status. In this regard, the International Centre of Martial Arts as an incorporated foundation shall be deemed dissolved notwithstanding the provisions of the Civil Act concerning the dissolution and liquidation of corporations.
(2) In the case of paragraph (1), all assets, rights, and obligations of the International Centre of Martial Arts as an incorporated foundation shall be deemed those of the ICM.
(3) In the case of paragraph (1), acts performed by or in relation to the International Centre of Martial Arts as an incorporated foundation shall be deemed those performed by or in relation to the ICM.
(4) In the case of paragraph (1), the executive officers and employees of the International Centre of Martial Arts as an incorporated foundation shall be deemed those assigned or appointed by the ICM. In this regard, the terms of office of an executive officer shall be the remainder of his/her term of office as specified in the articles of incorporation of the International Centre of Martial Arts as an incorporated foundation.
