The purpose of this Public Announcement is to enhance transparency of restrictions on and promote foreign investment by integrating and announcing restrictions on foreign investment, including any unfavorable treatment against, or imposition of extra obligations on, foreigners or foreign-capital-invested companies compared to the nationals or corporations of the Republic of Korea as set forth in Acts and subordinate statutes, notices, etc. other than the Foreign Investment Promotion Act (hereinafter referred to as the “Act”) in accordance with Article 4 (4) of the Act and Article 5 (10) of the Enforcement Decree thereof (hereinafter referred to as the “Decree”).
| Article 2 (Relations to other Statutes, etc.) |
| (1) | This Public Announcement shall not supercede any Acts and subordinate statutes, notices, etc. other than the Act. |
| (2) | Each foreigner or foreign-capital-invested company shall comply with restrictions imposed by other statutes, notices, etc. as well as the categories of business in which foreign investment is restricted under Article 4 (3) of the Act and Article 5 (1) of the Decree. |
| Article 3 (Preparation of Public Announcement) |
| (1) | The details of announcement by the Minister of Trade, Industry and Energy under Article 4 (4) of the Act are as set forth in attached Table. |
| (2) | If any amendment or supplement is made by the head of a relevant administrative agency with respect to what is announced herein, the Minister of Trade, Industry and Energy shall revise and announce this Public Announcement accordingly within three months of the date the amended or supplemented Act, subordinate statute, notice, etc. enters into force. |
