PRESIDENTIAL ADVISORY COUNCIL ON SCIENCE AND TECHNOLOGY ACT

 Article 1 (Purpose)
The purpose of this Act is to establish the Presidential Advisory Council on Science and Technology pursuant to Article 127 (3) of the Constitution of the Republic of Korea to adopt innovations, etc. in science and technology, and to provide for necessary matters concerning the organization and functions thereof.
 Article 2 (Functions)
The Presidential Advisory Council on Science and Technology (hereinafter referred to as the "Advisory Council on Science and Technology") shall perform the following functions:
(a) Matters concerning strategies for developing science and technology and the direction-setting for major policies aimed at innovating national science and technology and developing information and human resources;
(b) Matters concerning improving systems and policies in the fields of national science and technology;
(c) Other matters submitted to the Advice Council on Science and Technology by the President because he/she deems necessary to pursue developments in the fields of science and technology;
2. Functions that deliberate on the following related to major science and technology policies, innovations in science and technology, etc.:
(a) Matters concerning formulating and coordinating major policies and plans for promoting science and technology;
(b) Matters concerning the mid-term and long-term objectives and direction-setting for policies concerning the development of science and technology under Article 7 (1) and (2) of the Framework Act on Science and Technology, a master plan for science and technology, and a comprehensive plan to promote regional science and technology under Article 8 (1) of the aforesaid Act;
(c) Matters concerning an action plan for the following year and the results achieved in the preceding year under Article 7 (5) of the Framework Act on Science and Technology;
(d) Matters concerning a plan to increase budget funding related to science and technology and recommendations for public institutions, etc. under Article 4 of the Act on the Management of Public Institutions to invest in research and development;
(e) Matters concerning allocating, adjusting and efficiently operating the budget for research and development projects implemented by the Government (hereinafter referred to as "national research and development projects") every year;
(f) Matters concerning mid-term and long-term plans related to national research and development projects;
(g) Matters concerning inspection, analysis and evaluation of national research and development projects;
(h) Matters concerning a plan to foster and develop government-funded research institutes in the fields of science and technology;
(i) Matters concerning formulating and coordinating policies related to the engine for growth;
(j) Matters concerning coordinating policies related to innovations in science and technology in the fields of cultural and tourist industries, components and materials, and innovations in processes;
(k) Matters concerning policies aimed at training human resources for science and technology;
(l) Matters concerning establishing a support system for implementing regional technology innovation policy;
(m) Matters concerning funding for technology innovation;
(n) Matters concerning supporting polices related to national standards and intellectual property rights;
(o) Matters concerning solving economic and social problems by utilizing science and technology;
(p) Matters concerning promoting industry-academia-research cooperation;
(q) Matters concerning the research ethics of national research and development projects;
(r) Matters concerning creating a safe environment for research in the fields of science and technology;
(s) Matters prescribed by this Act or other statutes as matters to be deliberated at the deliberative council under Article 5;
(t) Matters on which deliberation is requested by the head of a central administrative agency;
(u) Other matters submitted to meetings by the Chairperson, which are related to affairs and the operation of the deliberative council under Article 5.
 Article 3 (Composition)
(1) The Advisory Council on Science and Technology shall be comprised of not more than 30 members, including one chairperson and one vice chairperson.
(2) The President shall become the Chairperson of the Advisory Council on Science and Technology, and the Chairperson shall designate the Vice Chairperson from among its members falling under paragraph (3) 1.
(3) The Advisory Council on Science and Technology shall consist of the following:
1. Persons commissioned by the Chairperson from among experts who have extensive knowledge and experience in the fields of science and technology, politics, economy, human science, society and culture;
2. Heads of central administrative agencies and public officials in political service prescribed by Presidential Decree.
(4) The term of office of members falling under paragraph (3) 1 shall be one year and they may serve consecutive terms.
(5) Where a vacancy occurs in the Advisory Council on Science and Technology, the Chairperson shall immediately designate a new member to fill a vacancy pursuant to paragraph (3).
 Article 4 (Chairperson)
(1) The Chairperson shall convene and preside over the plenary council under Article 5 (2); and if necessary, he/she may convene and preside over the advisory council under Article 5 (3) or the deliberative council under Article 5 (4).
(2) If necessary, the Chairperson may require the Vice Chairperson to perform his/her duties concerning the plenary council on his/her behalf.
(3) The Chairperson may require the Vice Chairperson to perform his/her duties concerning the advisory council under Article 5 (3) or the deliberative council under Article 5 (4) on his/her behalf. In such cases, where the Vice Chairperson is also unable to perform the duties of the Chairperson due to extenuating circumstances, he/she may designate a person from among members of the relevant council and require him/her to perform the duties of the Chairperson on his/her behalf.
 Article 5 (Councils)
(1) The Advisory Council on Science and Technology shall be divided into the plenary council, the advisory council and the deliberative council.
(2) The plenary council shall consist of all members of the Advisory Council on Science and Technology and deliberate on the following:
1. Determining general matters, such as the operation of the Advisory Council on Science and Technology;
2. Matters regarding which the deliberative council is required to hear opinion from the plenary council for it to perform its functions;
3. Other matters submitted to the plenary council by the Chairperson.
(3) The advisory council shall consist of not more than 20 members designated by the Chairperson from among members referred to in Article 3 (3) 1; and shall perform functions referred to in subparagraph 1 of Article 2.
(4) The deliberative council shall consist of not more than 20 members, including members designated by the Chairperson from among members referred to in Article 3 (3) 1 and members referred to in subparagraph 2 of the aforesaid paragraph; and shall perform functions referred to in subparagraph 2 of Article 2.
(5) A quorum for meetings of the plenary council of the Advisory Council on Science and Technology shall be a majority of the incumbent members thereof attend, and resolutions shall be adopted with the concurrent votes of a majority of the members present; and a quorum for meetings of advisory council and the deliberative council shall be a majority of the incumbent members that consist of the respective councils, and resolutions shall be adopted with the concurrent votes of a majority of the members present, respectively.
(6) Where the Chairperson deems it necessary, he/she may require the heads of relevant agencies or relevant experts to attend the plenary council and the respective councils of the Advisory Council on Science and Technology, and to present opinions.
(7) Necessary matters concerning detailed matters, etc. concerning the composition of, procedures for convening, the operation of and deliberation by the plenary council and the respective councils of the Advisory Council on Science and Technology shall be prescribed by Presidential Decree.
 Article 6 (Subcommittees of Advisory Council)
(1) Subcommittees may be established to deal with matters delegated by the advisory council or to preexamine matters on which it is to provide advice.
(2) The Chairperson shall designate members of each subcommittee from among members belonging to the advisory council.
(3) A person designated by the Chairperson from among members of each subcommittee shall convene and preside over its meetings.
(4) In addition to matters provided for in paragraphs (1) through 3, matters necessary for the operation of each subcommittee shall be prescribed by Presidential Decree.
 Article 7 (Steering Committee, etc. of Deliberative Council)
(1) The deliberative council shall establish a steering committee to preexamine matters on which it is to deliberate (excluding matters to be deliberated under paragraphs (3) and (4)), to provide practical advice, and to deliberate on agenda items delegated by the deliberative council, as prescribed by Presidential Decree.
(2) The deliberative council may establish a special committee that preexamine s special cases among matters under its jurisdiction, provides practical advice, and deliberates on special matters delegated by the deliberative council. In such cases, a case preexamined by the special committee and on which it has provided practical advice shall be deemed preexamined by the steering committee and practical advice on which shall be deemed provided by the steering committee.
(3) A regional science and technology promotion council shall be established in the deliberative council to deliberate on the following, as prescribed by Presidential Decree:
1. Matters concerning formulating a comprehensive plan to promote regional science and technology under Article 8 (1) of the Framework Act on Science and Technology and action plans by year under paragraph (3) of the aforesaid Article;
2. Matters concerning coordinating policy or a project which a central administrative agency or local government implements to promote regional science and technology;
3. Matters concerning efficiently operating the budget for a national research and development project related to regional science and technology;
4. Matters concerning exchange of and cooperation in science and technology among local governments;
5. Other matters placed on the agenda of meetings by the chairperson of the regional science and technology promotion council.
(4) A basic research promotion council shall be established in the deliberative council to deliberate on the following including analysis, direction-setting for policy, etc. concerning investment in basic research, as prescribed by Presidential Decree:
1. Matters concerning prior deliberation and coordination of a comprehensive plan to promote basic research under Article 5 of the Basic Research Promotion and Technology Development Support Act;
2. Matters concerning establishing roles in basic research and coordinating overlapping investments among central administrative agencies;
3. Matters concerning calculating a percentage of basic research expenses of the budget for a national research and development project every year;
4. Other matters submitted to meetings by the Minister of Science and ICT, which are necessary to promote basic research.
(5) In addition to matter provided for in paragraphs (1) through (4), necessary matters concerning the composition and operation of the steering committee, the special committee, the regional science and technology promotion council and the basic research promotion council shall be prescribed by Presidential Decree.
 Article 8 (Utilization of Result of Deliberation)
(1) The Advisory Council on Science and Technology shall notify the heads of related central administrative agencies and the heads of local governments of the outcomes of deliberation pursuant to subparagraph 2 of Article 2.
(2) The head of each related central administrative agency and the head of each local government shall reflect the outcomes of deliberation by the Advisory Council on Science and Technology in science and technology policy over which he/she has direct jurisdiction.
(3) The Minister of Science and ICT shall reflect matters related to the budget for a national research and development project among matters deliberated by the Advisory Council on Science and Technology in the outcomes of allocating, adjusting, etc. the budget for a national research and development project under Article 12-2 of the Framework Act on Science and Technology.
 Article 9 (Functions of Executive Secretary, Secretariat, etc.)
(1) One member shall be assigned to an executive secretary for efficiently operating the plenary council, the advisory council and the deliberative council of the Advisory Council on Science and Technology and to provide support therefor.
(2) A secretariat shall be established in the advisory council to support affairs of the Advisory Council on Science and Technology.
(3) If necessary to efficiently conduct affairs of the Advisory Council on Science and Technology, it may request the heads of related central administrative agencies and local governments, or the heads of related institutions, organizations, etc. to second public officials or executives and employees under his/her jurisdiction or to hold concurrent positions.
(4) Necessary matters concerning forming and operating the secretariat under paragraph (2) shall be prescribed by Presidential Decree.
 Article 10 (Requesting Related Government Agencies, etc. to Provide Cooperation, etc.)
Where the Advisory Council on Science and Technology deems it necessary, it may request related administrative agencies, public organizations, or other institutions and organizations, related experts, etc. to submit data, or gather consensus therefrom.
 Article 11 (Allowances and Travel Expenses)
The Advisory Council on Science and Technology may provide allowances and reimburse travel expenses to its members, within the budgetary limits.
ADDENDUM
This Act shall enter into force three months after the date of its promulgation.
