STATE FUNERAL ACT

 Article 1 (Purpose)
The purpose of this Act is to contribute to integration of the public by holding a funeral in a pious and solemn manner where any person respected for having rendered distinguished service to the State or society, passes away.
 Article 2 (Persons Eligible for State Funerals)
Where any of the following persons is deceased, a State funeral may be held in consideration of the family, etc. of the deceased, following a determination by the President, after undergoing deliberation by the State Council at the recommendation of the Minister of the Interior and Safety: <Amended by Act No. 11690, Mar. 23, 2013; Act No. 12844, Nov. 19, 2014; Act No. 14839, Jul. 26, 2017>
1. Either a current or former President;
2. A President-elect;
3. Any person who is revered by the nation for having rendered distinguished service to the State or society.
 Article 3 (Establishment of National Funeral Committee)
(1) A National State Funeral Committee may be established to hold a State funeral whenever necessary.
(2) Necessary matters concerning the organization and operation of the National State Funeral Committee shall be prescribed by Presidential Decree.
 Article 4 (Scope and Period of Funerals)
(1) If it is decided to hold a State funeral pursuant to Article 2, the State shall establish and operate a funeral parlor and supervise the carrying of the coffin, the funeral ceremony and burial ceremony.
(2) The head of any local government and the head of any overseas diplomatic mission may establish and manage an incense alter.
(3) The period of a funeral shall be up to 5 days: Provided, That the period may be extended following deliberation by the State Council, if any extenuating circumstance, such as a natural disaster, exists.
 Article 5 (Funeral Expenses)
All expenses incurred in holding a State funeral under Article 4 (1) shall be paid by the National Treasury: Provided, That expenses for meals for funeral visitors and other expenses prescribed by Presidential Decree shall be excluded.
 Article 6 (Hoisting Flags)
Flags shall be hoisted while a State funeral is held.
ADDENDA
Article 1 (Enforcement Date)
This Act shall enter into force three months after the date of its promulgation.
Article 2 Omitted.
Article 3 (Relations with other Acts and Subordinate Statutes)
A citation of any provision of the former State and National Funeral Service Act in any other Act or subordinate statute as at the time this Act enters into force shall be deemed a citation of the provisions of this Act in lieu of the former provision, if such corresponding provision exists herein.

Article 1 (Enforcement Date)
(1) This Act shall enter into force on the date of its promulgation.
(2) Omitted.

ADDENDA <Act No. 12844, Nov. 19, 2014>
Article 1 (Enforcement Date)
This Act shall enter into force on the date of its promulgation: Provided, That the amended part of an Act which was promulgated before this Act enters into force, but the date on which it enters into force has not arrived yet, among Acts amended by Article 6 of the Addenda, shall enter into force on the enforcement date of the relevant Act, respectively.

ADDENDA <Act No. 14839, Jul. 26, 2017>
Article 1 (Enforcement Date)
This Act shall enter into force on the date of its promulgation: Provided, That among the Acts amended pursuant to Article 5 of this Addenda, amended parts of the Acts which were promulgated before this Act enters into force but the enforcement dates of which have not arrived, shall enter into force on the enforcement date of the relevant Act, respectively.
