ACT ON SPECIAL MEASURES FOR FIVE NORTH KOREAN DOS

 Article 1 (Purpose)
The purpose of this Act is to prescribe special measures concerning the public administration of the five North Korean Dos and unrecovered Sis/Guns. <Amended by Act No. 13291, May 18, 2015>

 Article 2 (Definition)
The definitions of terms used in this Act shall be as follows:
1. The term "five North Korean Dos" means Hwanghae-do, Pyeongannam-do, Pyeonganbuk-do, Hamgyeongnam-do, and Hamgyeongbuk-do, all of which are the administrative district of Do as of August 15, 1945 and have not been recovered yet.
2. The term “unrecovered Si/ Gun” means any Si/Gun which belongs to the administrative district of Gyeonggi-do and Gangwon-do as of August 15, 1945 and has not been recovered yet.

 Article 3 (Temporary Location of Do Office)
The temporary office of the five North Korean Dos shall be located in Seoul Special Metropolitan City, until the territories under their jurisdiction are recovered.

 Article 4 (Affairs in Charge)
The five North Korean Dos and unrecovered Sis/Guns (hereinafter referred to as “five North Korean Dos, etc.”) shall take charge of the following affairs under the direction of the Minister of the competent Ministry, until the territories under their jurisdiction are recovered:
1. Survey and research:
(a) Collection and analysis of information which covers a variety of fields of the five North Korean Dos, etc., such as politics, economy, society, culture, and education;
(b) Research on a variety of policies which are to be executed when the five North Korean Dos, etc. are recovered;
2. Assistance to and management of the residents escaping from the five North Korean Dos and unrecovered Sis/Guns (hereinafter referred to as “residents of the North Korean Dos”):
(a) Examination of the actual status and the support of the livelihoods of the residents of the North Korean Dos;
(b) Assistance for exchange projects between refugees from North Korea and the residents of the North Korean Dos;
(c) Fostering of and assistance to the descendants of the residents of the North Korean Dos;
3. Assistance for business affairs concerning reunion of separated family members;
4. Inheriting and developing the folk culture of the five North Korean Dos, etc.;
5. Providing guidance and assistance to the organizations for the residents of the North Korean Dos;
6. Cultivating free democracy and heightening a sense of security;
7. Issuance of various kinds of certificates to the residents escaping from the five North Korean Dos;
8. Other projects, prescribed by Presidential Decree, concerning the five North Korean Dos, etc. and the residents of the North Korean Dos.

 Article 5 (Do Governors)
(1) The five North Korean Dos shall have Do Governors.
(2) The Do Governors provided in paragraph (1) shall be appointed by the President by way of the Prime Minister, upon the recommendation of the Minister of the Interior and Safety, and shall serve as public officials in political service. <Amended by Act No. 11690, Mar. 23, 2013; Act No. 12844, Nov. 19, 2014; Act No. 14839, Jul. 26, 2017>
(3) A Do Governor determined by Presidential Decree, from among the Do Governors under Article 4 (1), shall take charge of the business affairs related to unrecovered Sis/Guns set forth in each subparagraph of the same Article. <Newly Inserted by Act No. 13291, May 18, 2015>

 Article 6 (Administrative Organizations)
The administrative organizations of the five North Korean Dos, etc. shall be determined by Presidential Decree. <Amended by Act No. 13291, May 18, 2015>

 Article 7 (Establishment of Five North Korean Dos Committee)
If it is necessary to jointly handle the affairs of the five North Korean Dos, etc., in whole or in part, a Committee on Five North Korean Dos may be established, as prescribed by Presidential Decree. <Amended by Act No. 13291, May 18, 2015>

 Article 8 (Assistance to Organizations related to Residents of North Korean Dos)
The Committee on Five North Korean Dos may allow the organizations related to the residents of the North Korean Dos, which conduct the business of assisting and supporting the affairs provided in Article 4, to use the property managed by the Committee without consideration. <Amended by Act No. 13291, May 18, 2015>

ADDENDUM
This Act shall enter into force on the date of its promulgation.

Article 1 (Enforcement Date)
This Act shall enter into force on the date of its promulgation.
Article 2 (Transitional Measures)
The Do Governor who is holding office as at the time when this Act enters into force, shall be considered appointed under this Act.

This Act shall enter into force on the date of its promulgation.

Article 1 (Enforcement Date)
This Act shall enter into force on the date of its promulgation. (Proviso Omitted.)

ADDENDA <Act No. 12844, Nov. 19, 2014>
Article 1 (Enforcement Date)
This Act shall enter into force on the date of its promulgation: Provided, That from among the Acts amended pursuant to Article 6 of the Addenda, the amendments to the Acts which have been promulgated before this Act enters into force but the enforcement dates of which have yet to arrive, shall enter into force on the enforcement date of the relevant Act.

This Act shall enter into force three months after the date of its promulgation.

This Act shall enter into force on the date of its promulgation: Provided, That among the Acts amended pursuant to Article 5 of this Addenda, amended parts of the Acts which were promulgated before this Act enters into force but the enforcement dates of which have not arrived, shall enter into force on the enforcement date of the relevant Act, respectively.
