REGULATIONS ON INTERNATIONAL COOPERATION IN SCIENCE AND TECHNOLOGY

 Article 1 (Purpose)
The purpose of this Decree is to prescribe matters necessary for science and technology cooperation under Article 18 of the Framework Act on Science and Technology. <Amended by Presidential Decree No. 20213, Aug. 6, 2007>
 Article 2 (Definitions)

1. The term “project for the internationalization of science and technology” means an international joint research project under subparagraph 2, a project to lay the foundation for the internationalization of science and technology under subparagraph 3, and a project for policy studies, planning, evaluation and management aiming at the internationalization of science and technology;
2. The term “international joint research project” means a research project that the Government, local governments, corporations, organizations or individuals of the Republic of Korea conduct by investing, jointly with the government, corporations, organizations or individuals of a foreign country, science and technology resources required to perform the same research and development task, including expenses, human resources, facilities, apparatus and materials, and information related to research and development;
3. The term “project to lay the foundation for the internationalization of science and technology” means the following projects executed by the Minister of Science and ICT in order to promote science and technology cooperation:
(a) Project to support the establishment of a foreign research institute, such as an overseas research and cooperation center, or the inducement for such institution to be established in the Republic of Korea;
(b) Project to exchange science and engineering personnel, including the invitation to Korea and utilization of overseas Korean scientists and engineers and foreign scientists and engineers and the overseas dispatch of Korean scientists and engineers;
(c) Project to collect and utilize overseas science and technology information;
(d) Project to take part in multilateral international projects for science and technology cooperation and such;
(e) Other projects to lay the foundation necessary for promoting the internationalization of science and technology.
 Article 3 (Relationship to Other Statutes)
Except as otherwise provided in other statutes, international cooperation projects for science and technology shall be governed by this Regulation.
 Article 4 (Execution, etc. of Projects for Internationalization of Science and Technology)
(1) The Minister of Science and ICT may execute projects for the internationalization of science and technology in order to promote the internationalization of science and technology. <Amended by Presidential Decree No. 20740, Feb. 29, 2008; Presidential Decree No. 24423, Mar. 23, 2013; Presidential Decree No. 28210, Jul. 26, 2017>
(2) The Minister of Science and ICT shall formulate and implement a year-to-year detailed implementation plan to execute projects for the internationalization of science and technology pursuant to a master plan for science and technology referred to in Article 7 (1) of the Framework Act on Science and Technology (hereinafter referred to as the “Act”). <Amended by Presidential Decree No. 20213, Aug. 6, 2007; Presidential Decree No. 20740, Feb. 29, 2008; Presidential Decree No. 24423, Mar. 23, 2013; Presidential Decree No. 28210, Jul. 26, 2017>
(3) The Minister of Science and ICT may designate the following institutions or organizations as a specialized institution under Article 18 (2) of the Act (hereinafter referred to as “specialized institution”): <Amended by Presidential Decree No. 20213, Aug. 6, 2007; Presidential Decree No. 20740, Feb. 29, 2008; Presidential Decree No. 21551, Jun. 25, 2009; Presidential Decree No. 24423, Mar. 23, 2013; Presidential Decree No. 28210, Jul. 26, 2017>
1. The Korea Institute of Science and Technology Evaluation and Planning established pursuant to Article 20 of the Act;
2. The National Research Foundation of Korea under the National Research Foundation of Korea Act;

(4) The Minister of Science and ICT may conclude an agreement with specialized institutions and have them provide support necessary for planning, evaluation and management, etc. of projects for the internationalization of science and technology. <Amended by Presidential Decree No. 20740, Feb. 29, 2008; Presidential Decree No. 24423, Mar. 23, 2013; Presidential Decree No. 28210, Jul. 26, 2017>
(5) The Minister of Science and ICT may conclude an agreement, by project task, with the following institutions or organizations and have them conduct such project task with regard to projects for the internationalization of science and technology: <Amended by Presidential Decree No. 20213, Aug. 6, 2007; Presidential Decree No. 20740, Feb. 29, 2008; Presidential Decree No. 22977, Jun. 24, 2011; Presidential Decree No. 24423, Mar. 23, 2013; Presidential Decree No. 28210, Jul. 26, 2017>
1. Institutions or organizations under each subparagraph of Article 14 (1) of the Basic Research Promotion and Technology Development Support Act;
2. Other institutions or organizations that the Minister of Science and ICT deems appropriate to perform tasks of projects for the internationalization of science and technology.
(6) The methods of concluding an agreement under paragraphs (4) and (5) and details to be contained therein shall be governed by the Regulations on Management, etc. of National Research and Development Projects. <Amended by Presidential Decree No. 20213, Aug. 6, 2007>
 Article 5 (Promotion of Science and Technology Cooperation)
In order to promote science and technology cooperation, the Minister of Science and ICT may execute the following matters. In such cases, he/she shall consult in advance with the Minister of Foreign Affairs in any case falling subparagraph 1 or 2: <Amended by Presidential Decree No. 20740, Feb. 29, 2008; Presidential Decree No. 24423, Mar. 23, 2013; Presidential Decree No. 28210, Jul. 26, 2017>
1. Organization and operation of a joint committee on science and technology pursuant to an agreement on science and technology cooperation concluded with a foreign country;
2. Implementation of support projects, including technological support for developing countries and countries abundant with natural resources and the fostering of human resources thereof;
3. Mutual exchange of a research group for each major expertise and holding of joint academic conferences;
4. Other matters with regard to enhancing cooperation with major countries.
 Article 6 (Overseas Dispatch of Korean Scientists and Engineers, etc.)
The Government may dispatch overseas Korean scientists and engineers and relevant public officials to conduct international joint research, projects to lay the foundation for the internationalization of science and technology, or other relevant projects.
 Article 7 (Security Management of Projects for Internationalization of Science and Technology)
(1) The heads of specialized institutions and institutions or organizations under Article 4 (5) shall formulate and implement security measures that include the following matters so as to prevent an unauthorized leak of important information, such as the results of research and development, in the course of executing projects for the internationalization of science and technology:
1. Security measures for participating researchers;
2. Security measures for information related to research and development and for research facilities;
3. Security measures for the public release of outcomes of research and development.
(2) The Minister of Science and ICT may examine the actual state of security management of the specialized institutions and institutions or organizations referred to in paragraph (1) and, if vulnerability in security management is found, he/she may request them to overcome such vulnerability. <Amended by Presidential Decree No. 20740, Feb. 29, 2008; Presidential Decree No. 24423, Mar. 23, 2013; Presidential Decree No. 28210, Jul. 26, 2017>
