PROMOTION OF THE RESEARCH AND DEVELOPMENT OF WONDER DRUGS BY USING NATURAL SUBSTANCES ACT

 Article 1 (Purpose)
The purpose of this Act is to lay the groundwork for the research and development of wonder drugs by using natural substances, such as supporting natural substances science, and promote the research and development of wonder drugs by using natural substances and the industrialization of such development technology, thereby improving the health of nationals and contributing to the development of the national economy.
 Article 2 (Definitions)
The definitions of terms used in this Act shall be as follows:
1. The term "natural substances" means organisms, such as animals and plants living in land or the sea and things derived from living things, such as the cells of living things or things originated from tissue culture;
2. The term "ingredients of natural substances" means substances included in natural substances, which are biologically active, such as exerting influence on a living body in a direct or indirect manner;
3. The term "wonder drugs by using natural substances" means medicines researched and developed by using the ingredients of natural substances, which have new elements and effects;
4. The term "natural substances science" means the study and technology of researching and utilizing natural substances and the ingredients thereof, such as the separation of ingredients from natural substances, the investigation of the chemical structure, the exploration of biological activity and the research of efficient production and manufacturing methods.
 Article 3 (Formulation of Research and Development Plans)
(1) The Minister of Health and Welfare shall formulate and implement plans to promote the research and development of wonder drugs by using natural substances, after undergoing deliberations by the policy deliberative committee for health and medical service technology under Article 6 of the Health and Medical Service Technology Promotion Act. <Amended by Act No. 11978, Jul. 30, 2013>
(2) Plans (hereinafter referred to as "plans to promote research and development") under paragraph (1) shall include the following matters:
1. Mid-to-long term objectives and details of the research and development of wonder drugs by using natural substances;
2. Measures to secure investment funds necessary for the research and development of wonder drugs by using natural substances;
3. Matters concerning the development and efficient utilization of human resources necessary for the research and development of wonder drugs by using natural substances;
4. Matters concerning the use and preservation of the outcomes of research and development of wonder drugs by using natural substances;
5. Matters concerning research and development on natural substances science;
6. Other important matters necessary for promoting the research and development of wonder drugs by using natural substances.
(3) The Minister of Health and Welfare may request the relevant institutions or organizations, etc. to provide cooperation necessary for formulating and implementing plans, when necessary for formulating and implementing plans to promote research and development under paragraph (1). In such cases, the relevant institutions or organizations, etc., upon receiving requests for cooperation, shall comply with such requests unless any extenuating circumstance exists. <Amended by Act No. 8852, Feb. 29, 2008; Act No. 9932, Jan. 18, 2010>
(4) Necessary matters concerning the formulation and implementation of plans to promote research and development shall be prescribed by Presidential Decree.

 Article 6 (Expansion of Investments in Research and Development)
The Minister of Health and Welfare shall actively seek to expand investments in the research and development of wonder drugs by using natural substances. <Amended by Act No. 8852, Feb. 29, 2008; Act No. 9932, Jan. 18, 2010>
 Article 7 (International Cooperation)
The Minister of Health and Welfare shall seek to promote the international cooperation on the research and development of wonder drugs by using natural substances and take efficient measures to introduce advanced technology. <Amended by Act No. 8852, Feb. 29, 2008; Act No. 9932, Jan. 18, 2010>
 Article 8 (Promotion of Joint and Cooperative Research and Development)
The Minister of Health and Welfare shall promote joint and cooperative research and development among the industrial sector, academic circles and research institutes, so as to efficiently promote the research and development of wonder drugs by using natural substances. <Amended by Act No. 8852, Feb. 29, 2008; Act No. 9932, Jan. 18, 2010>
 Article 9 (Support for Relevant Industry)
The Minister of Health and Welfare shall take supportive measures to promote the industrialization of the outcomes of research and development of wonder drugs by using natural substances. <Amended by Act No. 8852, Feb. 29, 2008; Act No. 9932, Jan. 18, 2010>
 Article 10 (Collection and Dissemination of Information on Research and Development)
The Minister of Health and Welfare shall collect and analyze information on the research and development of wonder drugs by using natural substances in Korea and abroad, such as the research and development trend or market trend, and manage and disseminate such information in a systematic and comprehensive manner, in an effort to efficiently promote the research and development of wonder drugs by using natural substances. <Amended by Act No. 8852, Feb. 29, 2008; Act No. 9932, Jan. 18, 2010>
 Article 11 (Fostering Natural Substances Science, etc.)
(1) The Government shall take the following measures, in order to foster and develop natural substances science, etc.: <Amended by Act No. 8852, Feb. 29, 2008; Act No. 9932, Jan. 18, 2010; Act No. 11690, Mar. 23, 2013; Act No. 12844, Nov. 19, 2014; Act No. 14839, Jul. 26, 2017>
1. Nurturing of specialized human resources for promotion of the research of natural substances science, and fostering and supporting of the basic study of natural substances science by the Minister of Education;
2. Developing, fostering and supporting of the basic technology and advanced technology related to natural substances science by the Minister of Science and ICT;
3. Fostering and supporting of the basic study on the development, preservation, production, use, etc. of the resources of natural substances in land by the Minister of Agriculture, Food and Rural Affairs;
4. Supporting of the research and development on natural substances science which may be applicable to the areas of health care, medical treatment, food sanitation, etc. and fostering and supporting of projects related to clinical tests by the Minister of Health and Welfare;
5. Fostering and supporting of the basic study on the development, preservation, production, use, etc. of the resources of marine natural substances by the Minister of Oceans and Fisheries.
(2) The Minister of Health and Welfare shall establish a public support system, in order to support research on natural substances science and that on the use and preservation the resources of natural substances, and maintain and develop the mutual cooperative system among the industrial sector, academic circles and research institutes in the field of natural substances science. <Amended by Act No. 8852, Feb. 29, 2008; Act No. 9932, Jan. 18, 2010>
 Article 12 (Designation and Utilization of Relevant Specialized Institutions and Organizations)
The Minister of Health and Welfare may designate or utilize the relevant specialized institutions or organizations, for joint and cooperative research and development under Article 8, the management and dissemination of information under Article 10, and the establishment of a support system to develop research on natural substances science and the resources of natural substances and promote cooperation among the industrial sector, academic circles and research institutes under Article 11 (2). <Amended by Act No. 8852, Feb. 29, 2008; Act No. 9932, Jan. 18, 2010>
 Article 13 (Tax Reduction and Exemption)
When it is inevitable to import some items, as they are not produced in Korea, the Government may allow the reduction of and exemption from customs and value added tax under the Customs Act or the Value-Added Tax Act, with regard to the import of such items, among the related materials, equipment or reagents necessary for the research and development of wonder drugs by using natural substances or natural substances science.
 Article 14 (Application of other Acts)
The Health and Medical Service Technology Promotion Act shall govern matters concerning the research and development of wonder drugs by using natural substances, except as otherwise prescribed in this Act.
ADDENDUM
This Act shall enter into force six months after the date of its promulgation.

This Act shall enter into force on the date of its promulgation: Provided, That the amended parts of the Acts which were promulgated before this Act enters into force but the enforcement dates of which have not arrived yet among the Acts amended pursuant to Article 6 of the Addenda shall respectively enter into force on the enforcement of such Acts.

Article 1 (Enforcement Date)
This Act shall enter into force on the date of its promulgation: Provided, That the amended provisions of the Acts, which were promulgated before this Act enters into force, but the date on which they are to enter into force, has not arrived yet, among the Acts amended pursuant to Article 5 of the Addenda, shall enter into force on the enforcement dates of such Acts, respectively.
