 Article 1 (Purpose)
The purpose of this Decree is to prescribe matters delegated by the Lottery Tickets and Lottery Fund Act and matters necessary for enforcing said Act.

 Article 1-2 (Method of Drawing Printed and Electronic Mixed Raffle Tickets)
Winning numbers of printed and electronic mixed raffle tickets (hereinafter referred to as "printed and electronic mixed raffle tickets") defined in subparagraph 1 (f) of Article 2 of the Lottery Tickets and Lottery Fund Act (hereinafter referred to as the "Act") shall be drawn using lottery machines other than devices with information processing capabilities, such as computer programs.

 Article 2 (Details of Yearly Plans for Issuing Lottery Tickets)
"Matters prescribed by Presidential Decree, such as types and face values of lottery tickets, the total amount of lottery tickets issued, the conditions of issuance, and methods of paying the prizes" in Article 4 (3) of the Act means the following:
1. Types and names of lottery tickets;
2. The total amount and number of lottery tickets issued, estimated amount and number of lottery tickets to be sold, face values, and timing and cycle of issuance by type of lottery tickets (excluding the total amount and number of lottery tickets issued, in cases of online lottery tickets);
3. Details of the prizes, such as odds of winning or estimated value of prize;
4. Sales methods, such as sales areas;
5. Payment of the prizes, such as the rate and method of paying the prizes;
6. Lottery ticket distribution costs and percentages of proceeds from lottery tickets.

 Article 2-2 (Amendment to Yearly Plans for Issuing Lottery Tickets)
"Cause prescribed by Presidential Decree, such as the occurrence of unexpected change in demand for lottery tickets" in Article 4 (5) of the Act means any of the following cases:
1. Where any unexpected change occurs in demand for lottery tickets;
2. Where a new type of lottery tickets is issued;
3. Any other cases where it is necessary to amend a yearly plan for issuing lottery tickets provided for in Article 4 (3) of the Act for the sound development of the lottery business.

 Article 3 (Limit Per Purchase)
"Amount prescribed by Presidential Decree" in Article 5 (2) of the Act means 100,000 won.

 Article 3-2 (Lottery Tickets Purchasable by Credit Card)
"Lottery ticket prescribed by Presidential Decree, impracticable to purchase directly with cash" in the proviso to Article 5 (4) of the Act means: <Amended by Presidential Decree No. 27545, Oct. 18, 2016>
1. An electronic raffle ticket;
2. An electronic instant lottery ticket;
3. A printed and electronic mixed raffle ticket (limited to lottery tickets issued and sold in electronic form through the information and communications network defined in Article 2 (1) 1 of the Act on Promotion of Information and Communications Network Utilization and Information Protection, Etc. (hereafter in this Article, referred to as "information and communications network"));
4. An online lottery ticket (limited to lottery tickets issued and sold in electronic form through the information and communications network linked to the central computer center equipped with lottery ticket issuing systems).

 Article 4 (Approval for Contract for Sale of Online Lottery Tickets)
"Matters delegated by Presidential Decree, such as the requirements and standards for a contract party" in Article 6 (2) of the Act means:
1. The number of contract parties;
2. Requirements for persons eligible to apply for a contract and persons eligible for a preferential contract;
3. Terms and conditions of a contract, such as sales charges;
4. The method of selecting contract parties;
5. Schedules for selecting contract parties.

 Article 5 (Restrictions, etc. on Advertisements regarding Lottery Tickets)
(1) A lottery business entity provided for in Article 5-2 (1) 4 of the Act (hereinafter referred to as "lottery business entity") or a person who conducts a business concerning lottery tickets in accordance with a contract with the lottery business entity shall display in any of the following advertisements a warning that lottery ticket sales to juveniles are prohibited pursuant to Article 7 (1) of the Act: Provided, That he/she needs not display such warning message with the approval of the Korea Lottery Commission established under Article 13 of the Act (hereinafter referred to as the "Korea Lottery Commission") if it is physically impossible or inappropriate to display the warning message: <Amended by Presidential Decree No. 27323, Jul. 6, 2016; Presidential Decree No. 27545, Oct. 18, 2016>
1. A commercial defined in subparagraph 21 of Article 2 of the Broadcasting Act;
2. An advertisement in a newspaper or online newspaper defined in subparagraph 1 or 2 of Article 2 of the Act on the Promotion of Newspapers, Etc., or in a periodical defined in subparagraph 1 of Article 2 of the Act on the Promotion of Periodicals, including Magazines;
(2) Where any of the following persons intends to obtain approval of a plan for advertising lottery from the Korea Lottery Commission pursuant to Article 7 (2) of the Act, he/she shall go through the relevant entrusted business entity or re-entrusted business entity according to the following classifications; and the same shall also apply where the person intends to obtain approval for any change in the approved matters under the main sentence of Article 7 (3) of the Act:
1. In the case of a re-entrusted business entity: The relevant entrusted business entity;
2. In the case of a person who engages in lottery business in accordance with a contract with an entrusted business entity: The entrusted business entity;
3. In the case of a person who engages in lottery business in accordance with a contract with a re-entrusted business entity: The re-entrusted business entity.
(3) "Where the relevant person changes an insignificant matter prescribed by Presidential Decree" in the proviso to Article 7 (3) of the Act means:
1. Where the person changes the advertising media or advertising period to the extent that advertising expenses do not increase;
2. Where the person extends the advertising period to the extent that the total period is extended up to one year;
3. Where the person changes advertising expenses due to the extension of the advertising period provided for in subparagraph 2.
(4) "Matters prescribed by Presidential Decree, such as uses of the proceeds from lottery tickets" in Article 7 (4) of the Act means:
1. The relevant lottery business entity;
2. Uses of the proceeds from lottery tickets;
3. A warning that lottery ticket sales to juveniles are prohibited provided for in Article 7 (1) of the Act;
4. A statement that the prize is not paid if it is impractical to verify as to whether a lottery ticket is a winning ticket or to confirm its authenticity due to damage to the lottery ticket or any other reason pursuant to Article 8 (5) of the Act;
5. The extinctive prescription of the prize provided for in Article 9 (1) of the Act;
6. Details of the prizes, such as odds of winning or estimated value of prize; (replaced with entries in a lottery application form, in cases of online lottery tickets);
7. The method and place of paying prizes;
8. The method of determining winners of lottery prizes (replaced with entries in a lottery application form, in cases of online lottery tickets).

 Article 5-2 (Installment Payments of Prize)
(1) Where the Korea Lottery Commission intends to pay the prize in installments pursuant to Article 8 (3) of the Act, matters necessary for the installment payments, such as the period of installment payments, amount to be paid in installments, and method of calculating reserves for the installment payments, shall be included in the yearly plan for issuing lottery tickets provided for in Article 4 (3) of the Act.
(2) The Korea Lottery Commission shall establish standards and procedures for stable management of the prize paid in installments pursuant to paragraph (1). <Newly Inserted by Presidential Decree No. 27545, Oct. 18, 2016>

 Article 6 (Limits on Rollovers)
"Extent prescribed by Presidential Decree" in Article 8 (4) of the Act means two draws.

 Article 7 (Entrustment of Issuance of Lottery Tickets)
(1) A person that intends to be partially entrusted with the issuance of lottery tickets pursuant to Article 12 (1) of the Act shall submit the following documents to the Korea Lottery Commission:
1. A plan for entrusted operation;
2. The articles of incorporation (limited to domestic corporations);
3. A document that replaces the articles of incorporation or the transcript of entries in the register of the relevant corporation (limited to foreign corporations);
4. A document verifying that the relevant person meets the requirements for entrusted business entities specified in Article 9.
(2) The Korea Lottery Commission shall select an entrusted business entity by open competition; and shall publicly pre-announce the detailed standards, procedures, method, etc. for selecting the entrusted business entity.
(3) Upon receipt of documents under paragraph (1), the Korea Lottery Commission shall verify the following documents by sharing administrative information pursuant to Article 36 (1) of the Electronic Government Act: Provided, That where an applicant does not agree to verify any document specified in subparagraph 1, the Korea Lottery Commission shall require the applicant to submit the document (referring to a copy of the document if the document is a business registration certificate):
1. A certified copy or abridged transcript of the resident registration card of the applicant (referring to the representative and executive officers if the applicant is a corporation or organization) as well as a business registration certificate;
2. A transcript of entries in the register of the relevant corporation (limited to domestic corporations).

 Article 8 (Re-Entrustment of Issuance of Lottery Tickets)
(1) An entrusted business entity that intends to partially re-entrust the issuance of lottery tickets pursuant to Article 12 (2) of the Act shall submit an application for approval for re-entrusted operation to the Korea Lottery Commission, including the following documents:
1. A draft contract for re-entrustment;
2. A plan for re-entrusted operation prepared by a person that intends to obtain re-entrustment;
3. The articles of incorporation of a person that intends to obtain re-entrustment (limited to domestic corporations);
4. A document that may replace the articles of incorporation or the transcript of entries in the register of the relevant corporation (limited to foreign corporations);
5. A document verifying that the relevant person meets the requirements for re-entrusted business entities specified in Article 9.
(2) The application for approval for re-entrusted operation provided for in paragraph (1) shall include the following matters:
1. The name of the person that intends to obtain re-entrustment as well as the location of such person's principal place of business;
2. Re-entrusted business, the period of re-entrustment, termination of a contract for re-entrustment, etc.;
3. Lottery ticket distribution costs, such as re-entrustment charges;
4. Cooperation, etc. with the entrusted business entity;
5. Any other matters regarding re-entrusted issuance of lottery tickets.
(3) Article 7 (3) shall apply mutatis mutandis to the procedures for filing an application for approval for re-entrusted operation under paragraph (1).

 Article 9 (Requirements for Entrusted Business Entities and Re-Entrusted Business Entities)
(1) Economic ability provided for in Article 12 (3) 1 of the Act means the ability to raise capital and funds required for the stable operation of entrusted business or re-entrusted business.
(2) Technical ability provided for in Article 12 (3) 1 of the Act means the ability to operate, maintain, repair and secure lottery ticket sales systems as well as to prevent a failure of the systems, if the relevant lottery tickets are electronic raffle tickets, electronic instant lottery tickets, online lottery tickets, or printed and electronic mixed raffle tickets.
(3) "Matters prescribed by Presidential Decree" in Article 12 (3) 3 of the Act means:
1. The relevant person must have morality and social credibility necessary for issuing lottery tickets in light of the person's business activities, property status, etc.;
2. A plan for entrusted operation or a plan for re-entrusted operation, including long-term prospects for revenue and expenditure, expected proceeds, etc., must be reasonable and feasible.

 Article 10 (Functions of Korea Lottery Commission)
"Matters prescribed by Presidential Decree" in Article 13 (2) 13 of the Act means:
1. Providing guidelines on issuing, managing, and selling lottery tickets provided for in Article 31 of the Act;
2. Disclosing the information regarding lottery tickets and the actual status of fund management by the Lottery Fund provided for in Article 32 (2) of the Act;
3. Imposing an administrative fine pursuant to Article 36 (1) 2 through 6 of the Act;
4. Establishing and amending the regulations on the operation and management of the Lottery Fund under Article 16.

 Article 11 (Members of Korea Lottery Commission)
“Public officials in general service belonging to the Senior Executive Services of the related ministries prescribed by Presidential Decree” in Article 14 (2) 1 of the Act means one public official in general service belonging to the Senior Executive Service of each of the following agencies, in charge of fund management in the Lottery Fund: <Amended by Presidential Decree No. 24441, Mar. 23, 2013; Presidential Decree No. 25751, Nov. 19, 2014; Presidential Decree No. 27545, Oct. 18, 2016; Presidential Decree No. 28211, Jul. 26, 2017>
1. Ministry of Science and ICT;
2. Ministry of the Interior and Safety;
3. Ministry of Culture, Sports and Tourism;
4. Ministry of Health and Welfare;
5. Ministry of Employment and Labor;
6. Ministry of Gender Equality and Family;
7. Ministry of Land, Infrastructure and Transport;
8. Ministry of SMEs and Startups;
9. Ministry of Patriots and Veterans Affairs.

 Article 12 (Operation, etc. of Korea Lottery Commission)
(1) To convene a meeting pursuant to Article 15 (1) of the Act, the Chairperson of the Korea Lottery Commission shall notify each member of the Commission of the date, place and agenda items of the meeting in writing five days before the meeting is held: Provided, That if it is necessary to convene a meeting urgently or if any other extenuating circumstances exist, the timing and method for giving notice may be determined otherwise, as prescribed by the Operational Rules of the Korea Lottery Commission provided for in Article 14.
(2) Meetings of the Korea Lottery Commission shall be made public: Provided, That this shall not apply where the Korea Lottery Commission deems it inappropriate to disclose its meeting and accordingly adopts a resolution not to do so.
(3) The Korea Lottery Commission shall prepare minutes of its meetings, as prescribed by its Operational Rules provided for in Article 14.

 Article 13 (Allowances and Travel Expenses)
Allowances may be provided and travel expenses reimbursed within budgetary limits to members who attend a meeting of the Korea Lottery Commission: Provided, That this shall not apply where a member specified in Article 14 (2) 1 of the Act attends its meeting in direct relation to his/her duties.

 Article 14 (Operational Rules of Korea Lottery Commission)
Matters necessary for operating, etc. the Korea Lottery Commission shall be determined by the Chairperson of the Korea Lottery Commission by a resolution of the Commission. The same shall also apply to any amendment thereto.

 Article 15 (Fundraising for Lottery Fund)
"Income prescribed by Presidential Decree" in Article 21 (2) 4 of the Act means:
1. Contributions from persons other than the Government;
2. Income, such as interest, that accrues while an entrusted business entity or a re-entrusted business entity is managing the funds specified in Article 21 (2) 1 of the Act.

 Article 15-2 (Assessment of Lottery Fund Projects)
(1) The Korea Lottery Commission shall assess the following matters in relation to Lottery Fund projects pursuant to Article 22 (3) of the Act:
1. The degree of achievement of the project objectives as well as project performance;
2. Efficiency of implementing and managing the projects;
3. Any other matters the Korea Lottery Commission deems necessary to efficiently manage Lottery Fund projects.
(2) The Korea Lottery Commission shall prepare a performance assessment manual on the detailed criteria, methods, etc. necessary for assessing Lottery Fund projects pursuant to paragraph (1).
(3) Where deemed necessary for assessing Lottery Fund projects pursuant to paragraph (1), the Korea Lottery Commission may request the head of an institution, etc. provided for in Article 25 of the Act to submit data regarding such assessment. In such cases, the head of the relevant institution, etc. shall comply with such request, except in extenuating circumstances.
(4) To efficiently assess performance of Lottery Fund projects, the Korea Lottery Commission may operate a performance assessment team consisting of at least five but not more than ten persons commissioned by the Chairperson, who meet any of the following requirements:
1. A university or college professor holding an assistant professorship or a higher position, who has expertise in the field of economics, finance or administration;
2. A doctorate holder belonging to a research institute, who has expertise in the field of economics, finance or administration;
3. A certified public accountant, an attorney, or an expert in economics, finance or administration, who has at least five years' work experience;
4. Any other person deemed to have extensive expertise and experience in performance assessment.

 Article 16 (Regulations on Operation and Management of Lottery Fund)
(1) Except as otherwise expressly provided for in the Act and this Decree, matters necessary for operating and managing the Lottery Fund as well as the subject matter, method, procedures, etc. of assessment shall be prescribed by the regulations on the operation and management of the Lottery Fund that the Chairperson of the Korea Lottery Commission determines and publicly announces.
(2) To determine the regulations on the operation and management of the Lottery Fund pursuant to paragraph (1), the Chairperson of the Korea Lottery Commission shall obtain a resolution of the Korea Lottery Commission. The same shall also apply to any amendment to the regulations on the operation and management of the Lottery Fund.

 Article 17 (Distribution and Uses of Proceeds from Lottery Tickets)
(1) The percentages at which the proceeds from lottery tickets are distributed under the main sentence of Article 23 (1) of the Act shall be as follows: <Amended by Presidential Decree No. 26922, Jan. 22, 2016>
1. The Science and Technology Promotion Fund established under Article 22 of the Framework Act on Science and Technology: 12.583/100;
2. The National Sports Promotion Fund established under Article 19 of the National Sports Promotion Act: 10.371/100;
3. The Workers' Welfare Promotion Fund established under Article 87 of the Framework Act on Labor Welfare: 5.310/100;
4. The Fund for the Establishment and Promotion of Small and Medium Enterprises established under Article 63 of the Small and Medium Enterprises Promotion Act: 6.356/100;
5. The Cultural Heritage Preservation Fund established under Article 3 of the Cultural Heritage Preservation Fund Act: 14.286/100;
6. A local government: 17.267/100;
7. The Special Account for Development Projects of Jeju Special Self-Governing Province established under Article 160 of the Special Act on the Establishment of Jeju Special Self-Governing Province and the Development of Free International City: 17.267/100;
8. The Community Chest of Korea established under the Community Chest of Korea Act: 4.286/100;
9. The Forest Environment Function Promotion Fund established under Article 58 (1) of the Creation and Management of Forest Resources Act: 5.846/100;
10. The Korea Veterans Health Service established under the Korea Veterans Health Service Act: 6.428/100.
(2) In adjusting any percentage specified in paragraph (1) under the proviso to Article 23 (1) of the Act, the Korea Lottery Commission shall take into account the following matters:
1. Funding conditions of a Fund, etc. provided for in paragraph (1) (hereafter in this Article, referred to as "Fund, etc."), such as internal income, idle money, and debts;
2. Results of the performance assessment conducted pursuant to Article 22 (3) of the Act;
3. Results of deliberations on and adjustment of a plan for appropriation of the proceeds from lottery tickets under Article 24 (2) of the Act.
(3) When taking into account the matters specified in paragraph (2) pursuant to paragraph (2), the Korea Lottery Commission shall preferentially consider the results of the performance assessment provided for in paragraph (2) 2.
(4) Except as otherwise expressly provided for in paragraphs (2) and (3), details necessary for adjustments, the criteria and method for considering the matters specified in paragraph (2) and details about adjustments, such as the method for calculating an adjustment rate, shall be determined by a resolution of the Korea Lottery Commission.
(5) "Projects prescribed by Presidential Decree" in Article 23 (3) 5 of the Act means support projects implemented in relation to a disaster defined in subparagraph 1 of Article 2 of the Countermeasures against Natural Disasters Act; or a disaster, etc. defined in subparagraph 1 of Article 3 of the Framework Act on the Management of Disasters and Safety, resolutions on which are passed by the Korea Lottery Commission.
(6) Where a fund management plan formulated under the National Finance Act is finalized by the National Assembly, the Korea Lottery Commission shall prepare a monthly revenue and expenditure plan and a quarterly execution plan for the Lottery Fund, and distribute funds according to such plans. In such cases, the Korea Lottery Commission may adjust the timing and amount of distribution, taking account of the capital requirements, funding conditions, etc. of a Fund, etc. to which the proceeds from lottery tickets or funds of the Lottery Fund are distributed pursuant to Article 23 (1) or (3) of the Act.
(7) Where any difference occurs between the amount to be distributed to a Fund, etc. pursuant to Article 23 (1) of the Act and the amount distributed to a Fund, etc. pursuant to paragraph (6), the Korea Lottery Commission shall reflect the difference in the fund management plan for the year after next at the latest. In such cases, the difference shall be distributed to a Fund, etc. at the percentage adjusted in the relevant year under the proviso to Article 23 (1) of the Act.

 Article 18 (Plan for Appropriating Proceeds from Lottery Tickets)
“Matters prescribed by Presidential Decree, such as uses of the proceeds from lottery tickets” in Article 24 (1) of the Act means:
1. The outline of a project, such as uses of the proceeds from lottery tickets, details of the project, and the total project cost;
2. Detailed project plans by unit project;
3. Any other matters concerning uses of the proceeds from lottery tickets determined by the regulations on the operation and management of the Lottery Fund under Article 16.

 Article 19 (Application for Use of Lottery Fund)
"Matters prescribed by Presidential Decree, such as uses of the Lottery Fund and an amount requested" in Article 26 (1) of the Act means:
1. The outline of a project, such as uses of funds from the Lottery Fund, details of the project, and the total project cost;
2. The amount requested;
3. Detailed project plans by unit project;
4. Any other matters concerning uses of funds from the Lottery Fund determined by the regulations on the operation and management of the Lottery Fund under Article 16.

 Article 20 (Management of Idle Money)
"Method prescribed by Presidential Decree" in subparagraph 3 of Article 28 of the Act means:
2. Making a deposit in the Public Capital Management Fund established under Article 2 of the Public Capital Management Fund Act.

 Article 21 (Preferential Contracts with Persons with Disabilities, etc.)

A patient suffering from potential aftereffects of defoliants; or a second-generation patient suffering from actual aftereffects of defoliants determined and registered pursuant to Article 4 of the Act on Assistance to Patients Suffering from Actual or Potential Aftereffects of Defoliants, etc. and Establishment of Related Organizations;
4. A person of distinguished service during special military missions and his/her bereaved family or family determined and registered pursuant to Article 6 of the Act on Honorable Treatment of Persons of Distinguished Service during Special Military Missions and Establishment of Related Organizations;
5. A person eligible for veteran's compensation and his/her bereaved family determined and registered pursuant to Article 4 of the Act on Support for Persons Eligible for Veteran’s Compensation.

 Article 22 (Disclosure of Information Related to Lottery Tickets, etc.)
(1) "Matters prescribed by Presidential Decree" in Article 32 (1) of the Act means:
1. The number and amount of lottery tickets issued (excluding online lottery tickets);
2. Lottery ticket distribution costs;
3. The status of payment of the prizes.
(2) The Korea Lottery Commission shall semi-annually disclose the information related to lottery tickets as well as the operational status of the Lottery Fund by publishing them in the Official Gazette, by the end of February and by August 31 each year pursuant to Article 32 (2) of the Act.

 Article 22-2 (Delegation of Authority)
The authority of the Korea Lottery Commission concerning any of the following matters shall be delegated to the Chairperson of the Korea Lottery Commission pursuant to Article 33-2 of the Act:
1. Insignificant matters determined by the Korea Lottery Commission, included in the yearly plan for issuing lottery tickets provided for in Article 4 (3) of the Act;
2. Approval for any change of the advertising media or advertising slogans provided for in Article 7 (3) of the Act;
3. Termination of a contract for re-entrustment upon request by a business entity re-entrusted under Article 12 (2) of the Act;
4. Any other insignificant matters determined by a resolution of the Korea Lottery Commission, necessary to efficiently conduct such affairs as the operation and management of the Lottery Fund under Article 22 of the Act; and the preparation of guidelines on issuing, managing and selling lottery tickets under Article 31 of the Act.

 Article 22-3 (Review of Regulation)
The Minister of Strategy and Finance shall review the appropriateness of the following matters every three years (referring to the day before each third anniversary from the base date), counting from the following relevant base dates; and shall take such necessary measures as making improvements:
1. Restrictions, etc. on sale of lottery tickets provided for in Articles 3 and 3-2: January 1, 2014;
2. Restrictions, etc. on advertisements regarding lottery tickets provided for in Article 5: January 1, 2014.
