 Article 1 (Purpose)
The purpose of this Public Notice is to provide for matters necessary to determine the scope of advanced technology and products under Article 5 of the Industrial Development Act.
 Article 2 (Criteria for Selecting Advanced Technology and Products)
The criteria for selecting advanced technology and products are as follows:
1. Highly technology-intensive areas where technology is being rapidly innovated;
2. Areas where advanced technology and products create new demand and high added value;
3. Areas where advanced technology and products have great ripple effects on technology and the economy; and can provide comparative advantage in technology and efficiency;
4. Other areas where advanced technology and products substantially save resources and energy, improve productivity, and conserve the environment.
 Article 3 (Scope of Advanced Technology and Products)
The scope of advanced technology and products are as specified in attached Table 1.
 Article 4 (Application for Confirmation and Processing Period)
(1) A person who intends to have a particular technology and products confirmed as falling within the scope of advanced technology and products (hereinafter referred to as "applicant") shall prepare an application in attached Form 1, and accompanying documents; and shall file them with the Ministry of Trade, Industry and Energy:
1. A statement on the technology and products covered by the application.
(2) Pursuant to Article 5 (1), the Minister of Trade, Industry and Energy shall determine whether to confirm a particular technology and products as advanced technology and products within 14 days (hereinafter referred to "processing period") from the date the relevant application is filed: Provided, That the period required for supplementing documents pursuant to Article 5 (2) shall not be included in the processing period.
(3) If an applicant fails to submit supplementary documents within the period specified in Article 5 (2), the Minister of Trade, Industry and Energy may reject the relevant application.
(4) None of the documents submitted shall be returned to applicants; and no information in such documents shall be disclosed to the public without the applicant' consent, except for the purposes specified by statutes and this Public Notice.
 Article 5 (Examination and Confirmation of Advanced Technology and Products)
(1) Upon receipt of an application filed for the confirmation of advanced technology and products under Article 4 (1), the Minister of Trade, Industry and Energy shall examine and confirm whether the relevant technology and products fall within the scope of advanced technology and products. Accordingly, the Minister of Trade, Industry and Energy shall consult with the government agency having jurisdiction over the relevant technology, before examining and confirming the technology and products as advanced technology and products.
(2) The Minister of Trade, Industry and Energy shall review an application and required documents filed under paragraph (1); and may request the applicant to submit supplementary documents within a set period, if the submitted documents are insufficient or if additional documents are required.
 Article 6 (Issuance of Certificates)
When the Minister of Trade, Industry and Energy determines that a particular technology and products fall within the scope of advanced technology and products, he/she shall issue a certificate to the applicant in attached Form 2.
ADDENDA
1. This Public Notice shall enter into force on the date it is publicly notified.
2. The previous Public Notice of the Scope of Advanced Technology and Products, publicly notified by the Ministry of Trade, Industry and Energy (No. 2010-233) on December 31, 2010, shall be repealed following the enforcement of this Public Notice.
