ENFORCEMENT DECREE OF THE ACT ON THE PROMOTION OF EDUCATION OF CRITICAL FOREIGN LANGUAGES

 Article 1 (Purpose)
The purpose of this Decree is to prescribe matters delegated by the Act on the Promotion of Education of Critical Foreign Languages and matters necessary for the enforcement thereof.
 Article 2 (Scope of Critical Foreign Languages)
"Language prescribed by Presidential Decree" in subparagraph 1 of Article 2 of the Act on the Promotion of Education of Critical Foreign Languages (hereinafter referred to as the "Act") means each language set forth in the attached Table.
 Article 3 (Formulation, etc., of Master Plans to Promote Critical Foreign Language Education)
(1) The Minister of Education shall formulate a master plan to promote critical foreign language education referred to in Article 5 (1) of the Act (hereinafter referred to as "master plan") by no later than the end of February of the year the master plan commences.
(2) The Minister of Education may hear opinions of related experts, etc., where necessary to formulate a master plan.
(3) Upon formulation of a master plan, the Minister of Education shall publicly announce it on the website of the Ministry of Education.
 Article 4 (Formulation, etc., of Action Plans to Promote Critical Foreign Language Education)
(1) The Minister of Education shall formulate an action plan to promote critical foreign language education referred to in Article 6 (1) of the Act (hereinafter referred to as "action plan") by no later than March 31, each year.
(2) An action plan shall contain the following:
1. Major projects to promote critical foreign language education;
2. Detailed plan for operating each project;
3. Other matters the Minister of Education deems necessary to promote the projects.
(3) The Minister of Education shall reflect the outcomes of examining and evaluating the implementation results of an action plan under Article 6 (2) of the Act in formulating an action plan for the following year. <Newly Inserted by Act No. 29766, May 21, 2019>
(4) The Minister of Education shall compile the outcomes of examining and evaluating the implementation results of an action plan reflected under paragraph (3) to reflect such outcomes in formulating next master plans under Article 6 (2) of the Act. <Newly Inserted by Act No. 29766, May 21, 2019>
(5) Upon formulation of an action plan, the Minister of Education shall publicly announce it on the website of the Ministry of Education.
 Article 5 (Fact-Finding Surveys, etc.)
(1) A fact-finding survey referred to in Article 7 (1) of the Act shall be conducted on the following:
1. Status of critical foreign language experts;
2. Status of educational institutions and research institutes related to critical foreign languages;
3. Status of education and research related to critical foreign languages;
4. Other matters the Minister of Education deems necessary to grasp the status of the education of critical foreign languages.
(2) The Minister of Education may conduct a fact-finding survey and prepare statistics thereon referred to in Article 7 (1) of the Act, by outsourcing them to a research institution, corporation, or organization having expertise and human resources related to critical foreign languages.
 Article 6 (Criteria, Procedures, etc., for Designation of Specialized Educational Institutions)
(1) Under Article 8 (1) of the Act, the Minister of Education may designate schools referred to in Article 2 of the Higher Education Act (hereinafter referred to as "schools") which meet all of the following requirements, as specialized educational institutions for critical foreign languages (hereinafter referred to as "specialized educational institutions"):
1. It shall have programs necessary for critical foreign language education;
2. It shall be equipped with facilities and equipment necessary for critical foreign language education;
3. It shall meet other requirements the Minister of Education deems necessary to promote critical foreign language education.
(2) A school that desires to be designated as a specialized educational institution referred to in Article 8 (1) of the Act, shall submit an application to the Minister of Education, accompanied by the following documents:
1. A plan to perform duties prescribed in Article 9 (1) of the Act;
2. An education plan including the curriculum for and details of critical foreign language education;
3. A plan for raising expenses incurred in performing its duties;
4. Documents to verify whether it meets the designation criteria referred to in paragraph (1).
(3) Upon receipt of an application referred to in paragraph (2), the Minister of Education shall determine whether to designate the applicant as a specialized educational institution, within three months from the application date.
(4) Where the Minister of Education designates, re-designates, or revokes the designation of, a specialized educational institution referred to in Article 8 (1) of the Act, he/she shall notify such fact to the relevant institution and publicly announce it on the website of the Ministry of Education.
 Article 7 (Subsidization of Costs)
The following costs may be granted to specialized educational institutions in accordance with Article 9 (2) of the Act:
1. Costs incurred in exchanging and training critical foreign language experts;
2. Costs incurred in developing and operating educational programs related to critical foreign languages;
3. Costs incurred in improving the educational environment, such as purchase of educational materials and equipment;
4. Costs incurred in projects for cooperation with overseas foreign language institutions and research institutes;
5. Other costs deems necessary to promote critical foreign language education.
 Article 8 (Delegation of Authority)
The Minister of Education shall delegate the authority for the following matters to the President of the National Institute for International Education, in accordance with Article 14 (1) of the Act: <Amended by Act No. 29766, May 21, 2019>
1. Formulation of master plans referred to in Article 5 of the Act;
2. Formulation of action plans referred to in Article 6 of the Act, and examination and evaluation of the implementation results of action plans;
3. Designation, assessment, re-designation, and the revocation of designation, of specialized educational institutions referred to in Article 8 of the Act;
4. Requests to provide data referred to in Article 11 of the Act;
5. Holding hearings referred to in Article 13 of the Act.
ADDENDUM
This Decree shall enter into force on August 4, 2016.

This Decree shall enter into force on June 19, 2019.
