The purpose of this Act is to dispose of valuables confiscated from those who have committed the crimes provided in the National Security Act, or ordered to be reverted to the National Treasury pursuant to said Act, in a prompt, effective and well-directed manner to ensure national security, notwithstanding the provisions of any other statute or regulation. <Amended by Act No. 3318, Dec. 31, 1980; Act No. 15973, Dec. 18, 2018>
| Article 2 (Definition of Confiscated Valuables) |
The term "confiscated valuables" used in this Act means any weapons, communications instruments and materials, equipment and other articles, and any operational valuables including securities, currencies, etc., confiscated by a final and conclusive judgement from any person who falls under any of the following subparagraphs, or ordered to be reverted to the National Treasury pursuant to Articles 15 (2) and 22 of the National Security Act: <Amended by Act No. 3318, Dec. 31, 1980; Act No. 15753, Sep. 18, 2018; Act No. 15973, Dec. 18, 2018> | 1. | The North Korean puppet group or a member thereof; |
| 2. | An anti-state organization or a member thereof that acts in concert with a North Korean puppet group; |
| 3. | A person who acts on an order of any person prescribed in subparagraph 1 or 2; |
| 4. | A person engaged in any anti-state activity in concert with a North Korean puppet group. |
| Article 3 (Disposal of Confiscated Valuables) |
| (1) | The Director of the National Intelligence Service may directly use or dispose of all or some of any confiscated valuables with approval from the President following deliberation thereon by the State Council, if they are deemed necessary for an intelligence-gathering activity or the public benefit. <Amended by Act No. 1522, Dec. 16, 1963; Act No. 5454, Dec. 13, 1997; Act No. 5681, Jan. 21, 1999; Act No. 15973, Dec. 18, 2018> |
| (2) | In cases of amounts denominated in the currency of the Republic of Korea, out of the confiscated valuables directly used under paragraph (1), the Director of the National Intelligence Service shall deduct said amounts from the amount of annual expenditure of the National Intelligence Service and then pay such amounts to the National Treasury. <Amended by Act No. 5454, Dec. 13, 1997; Act No. 5681, Jan. 21, 1999; Act No. 15973, Dec. 18, 2018> |
| Article 4 (Enforcement Decree) |
Necessary matters to enforce this Act shall be prescribed by Presidential Decree.
