 Article 1 (Purpose)
The purpose of this Decree is to provide for matters delegated by the Daegu Gyeongbuk Institute of Science and Technology Act and matters necessary for enforcing said Act. <Amended by Presidential Decree No. 21162, Dec. 12, 2008>
 Article 2 (Registration for Incorporation)
(1) The Daegu Gyeongbuk Institute of Science and Technology under the Daegu Gyeongbuk Institute of Science and Technology Act (hereinafter referred to as the “Act”) shall file for registration for its incorporation with the registry having jurisdiction over its principal place of business within three weeks from the date its articles of incorporation are authorized under Article 3 of the Act. <Amended by Presidential Decree No. 21162, Dec. 12, 2008>
(2) Matters to be included in registration for incorporation under the provisions of paragraph (1) shall be as follows:
1. Objectives;
2. Organizational Name;
3. Principal place of business;
4. Names and addresses of executive officers;
5. Total assets.
 Article 3 (Registration for Relocation)
(1) When the Daegu Gyeongbuk Institute of Science and Technology relocates its principal place of business, it shall file for registration for relocation with the registry having jurisdiction over its old place of business within two weeks and shall file for registration of the matters referred to in Article 2 (2) with the registry having jurisdiction over its new place of business within three weeks. <Amended by Presidential Decree No. 21162, Dec. 12, 2008>
(2) When the Daegu Gyeongbuk Institute of Science and Technology relocates its principal place of business within the jurisdiction of the same registry, it shall file for the registration for relocation within three weeks. <Amended by Presidential Decree No. 21162, Dec. 12, 2008>
 Article 4 (Registration of Amendment)
If the Daegu Gyeongbuk Institute of Science and Technology intends to amend any provision regarding a matter specified in Article 2 (2) 1, 2, 4, or 5, it shall file for registration of the amendment with the registry having jurisdiction over its principal place of business within two weeks. <Amended by Presidential Decree No. 21162, Dec. 12, 2008>
 Article 5 (Documents Accompanying Application for Registration)
An application filed for registration under any provision of Articles 2 through 4 shall be accompanied by the following documents:
1. Articles of incorporation in cases of registration for incorporation under Article 2;
2. Documents certifying the relocation of the principal place of business in cases of registration of relocation under Article 3;
3. Documents certifying the amendment in cases of registration of an amendment under Article 4.
 Article 6 (Calculation of Period for Registration)
The period prescribed for registration of matters that require authorization or approval from the Minister of Science and ICT under Articles 2 through 4 shall be counted from the date the letter of authorization or approval is served. <Amended by Presidential Decree No. 20740, Feb. 29, 2008; Presidential Decree No. 24470, Mar. 23, 2013; Presidential Decree No. 28210, Jul. 26, 2017>
 Article 7 (Effect of Registration Other Than Registration for Incorporation)
The Daegu Gyeongbuk Institute of Science and Technology shall have no valid defense against a third party with regard to a matter that requires registration, other than registration for incorporation, unless and before the matter is registered.
 Article 8 (Submission of Budget Request for Contributions)
(1) The Daegu Gyeongbuk Institute of Science and Technology shall submit a budget request for contributions for the following year to the Minister of Science and ICT, along with the following documents, by not later than April 30 each year: <Amended by Presidential Decree No. 20740, Feb. 29, 2008; Presidential Decree No. 21162, Dec. 12, 2008; Presidential Decree No. 24470, Mar. 23, 2013; Presidential Decree No. 28210, Jul. 26, 2017>
1. A business plan for the following year;
2. An estimated income statement and an estimated balance sheet for the following year;
3. Other documents necessary for clarifying the details of the budget.
(2) If the Minister of Science and ICT finds that a request filed pursuant to paragraph (1) is reasonable, he/she shall appropriate the budget for the requested amount. <Amended by Presidential Decree No. 20740, Feb. 29, 2008; Presidential Decree No. 24470, Mar. 23, 2013; Presidential Decree No. 28210, Jul. 26, 2017>
 Article 9 (Notification of Determination on Contributions)
When a determination is made on the budget for contributions, the Minister of Science and ICT shall notify the Daegu Gyeongbuk Institute of Science and Technology of such determination. <Amended by Presidential Decree No. 20740, Feb. 29, 2008; Presidential Decree No. 21162, Dec. 12, 2008; Presidential Decree No. 24470, Mar. 23, 2013; Presidential Decree No. 28210, Jul. 26, 2017>
 Article 10 (Payment of Contributions)
(1) When the Daegu Gyeongbuk Institute of Science and Technology intends to receive contributions, it shall submit a payment request to the Minister of Science and ICT, along with a business plan and a budget implementation plan for each quarter of the pertinent year. <Amended by Presidential Decree No. 20740, Feb. 29, 2008; Presidential Decree No. 24470, Mar. 23, 2013; Presidential Decree No. 28210, Jul. 26, 2017>
(2) Upon receipt of a payment request under paragraph (1), the Minister of Science and ICT shall pay the contributions, if he/she finds that the business plan and the budget implementation plan for the pertinent quarter are reasonable. <Amended by Presidential Decree No. 20740, Feb. 29, 2008; Presidential Decree No. 24470, Mar. 23, 2013; Presidential Decree No. 28210, Jul. 26, 2017>
 Article 11 (Business Plan)
(1) The Daegu Gyeongbuk Institute of Science and Technology shall state its goals, policies, the details of major programs, and the budget required for such programs specifically in the business plan submitted for the following year pursuant to Article 11 (1) of the Act. <Amended by Presidential Decree No. 21162, Dec. 12, 2008>
(2) When the Daegu Gyeongbuk Institute of Science and Technology intends to revise the business plan under paragraph (1) with regard to an important matter, it shall submit another business plan to the Minister of Science and ICT for approval, specifying the matter to be revised and the reasons for revision. When it is intended to revise the business plan with regard to an academic matter, the relevant business plan shall also be submitted to the Minister of Education. <Amended by Presidential Decree No. 20740, Feb. 29, 2008; Presidential Decree No. 24470, Mar. 23, 2013; Presidential Decree No. 28210, Jul. 26, 2017>
 Article 12 (Annual Financial Reports)
The Daegu Gyeongbuk Institute of Science and Technology shall submit an annual financial report on revenues and expenditures that has been audited by a certified public accountant designated by the Minister of Science and ICT, to the Minister of Science and ICT by not later than March 31 of the following year, along with the following documents. In such cases, the report on academic matters shall also be submitted to the Minister of Education: <Amended by Presidential Decree No. 20740, Feb. 29, 2008; Presidential Decree No. 21162, Dec. 12, 2008; Presidential Decree No. 24470, Mar. 23, 2013; Presidential Decree No. 28210, Jul. 26, 2017>
1. An income statement and a balance sheet for the pertinent year;
2. A business plan for the pertinent year and a comparison sheet of the results of implementation of the plan;
3. Written opinions issued respectively by the certified public accountant and the auditor who audited relevant financial statements;
4. Other documents certifying the details of settlement of accounts.
 Article 13 (Application Mutatis Mutandis of Regulations on Payment of Contributions)
Articles 8 through 12 shall apply mutatis mutandis where the Daegu Gyeongbuk Institute of Science and Technology receives contributions from the head of a central administrative agency, other than the Minister of Science and ICT, the head of a local government, the head of a public institution under the Act on the Management of Public Institutions, or the head of a national or public university. <Amended by Presidential Decree No. 20740, Feb. 29, 2008; Presidential Decree No. 21162, Dec. 12, 2008; Presidential Decree No. 24470, Mar. 23, 2013; Presidential Decree No. 28210, Jul. 26, 2017>
 Article 14 (Appropriation of Surplus)
When Daegu Gyeongbuk Institute of Science and Technology has a surplus after the settlement of accounts for a fiscal year, it shall appropriate such surplus to compensate the losses brought forward and shall carry over the balance to the following year or transfer the balance to the Development Fund under Article 14 (1) of the Act. <Amended by Presidential Decree No. 21162, Dec. 12, 2008>
 Article 15 (Organization)
Matters regarding the organization of the Daegu Gyeongbuk Institute of Science and Technology shall be determined by the president, following a resolution passed at a meeting of the board of trustees. <Amended by Presidential Decree No. 21162, Dec. 12, 2008; Presidential Decree No. 23323, Nov. 30, 2011>
 Article 15-2 (Council)
(1) When forming a council of the Daegu Gyeongbuk Institute of Science and Technology under Article 12-3 (1) of the Act (affiliated institutions shall be excluded; hereinafter the same shall apply), council members who represent each unit composing it including faculty members, staff members (including researchers), and students shall be elected by vote: Provided, That where council members include alumni of the Daegu Gyeongbuk Institute of Science and Technology and those who can contribute to the development thereof, those council members shall be commissioned by the president.
(2) Meetings of the council shall be classified into regular and interim meetings, and a regular meeting shall be held at least once a year and an interim meeting shall be held whenever necessary.
(3) Other than matters prescribed in paragraphs (1) and (2), matters necessary for the election and commissioning of council members, holding of council meetings, and the composition and operation of the council shall be prescribed by the articles of incorporation.

 Article 15-3 (Donation and Joint Use of Land)
Any person who intends to donate land, research facilities, or research equipment to the Daegu Gyeongbuk Institute of Science and Technology and to jointly use them under Article 14-2 (1) of the Act shall enter into a contract on the donation procedures and joint use with the Daegu Gyeongbuk Institute of Science and Technology: Provided, That the procedures for accepting donations under subparagraph 1 of Article 2 of the Act on Collection and Use of Donations shall be governed by relevant statutes or regulations.

 Article 16 (Submission of Research Plans and Research Reports)
A research plan or research report submitted by the Daegu Gyeongbuk Institute of Science and Technology pursuant to Article 15 of the Act shall be accompanied by the following documents: <Amended by Presidential Decree No. 21162, Dec. 12, 2008>
1. An analysis sheet of domestic and overseas trends of technologies related to the relevant research project;
2. A plan for utilization after research and development;
3. Other reference documents explaining the details of the relevant research project.
 Article 17 (Number of School Days and Semesters)
The number of school days shall be determined by the president, which shall be at least 32 weeks, and each school year shall be basically divided into two semesters but may be divided into at least three semesters, if the president deems it necessary. <Amended by Presidential Decree No. 23323, Nov. 30, 2011>

 Article 18 (Units of Completion)
The units of completion shall be represented by credits, and matters regarding subjects of each course, compulsory credits, the method of completion, and years of enrollment shall be prescribed by academic regulations.

 Article 19 (Number of Years Required for Graduation)
The number of years required to complete the course for a bachelor's degree shall be four years, the number of years required to complete the course for a master's degree shall be at least two years, and the number of years required to complete the course for a doctoral degree shall be at least two years, but the number of years required for a bachelor's degree may be reduced by not more than one year, and the years for a master's or doctoral degree may be reduced by not more than six months, respectively. <Amended by Presidential Decree No. 23323, Nov. 30, 2011>

 Article 20 (Joint Operation of Curricula with Domestic or Foreign University or Research Institute)
The Daegu Gyeongbuk Institute of Science and Technology may jointly operate courses for a bachelor's degree or curricula of the graduate school with a domestic or foreign university or research institute specializing in the knowledge-based industries or cutting-edge science, as prescribed by academic regulations.

 Article 21 (Classification of Faculty Members)
Faculty members under Article 12-4 (1) of the Act (hereinafter referred to as “faculty members”) shall be classified into full-time members and non full-time members. <Amended by Presidential Decree No. 29689, Jun. 25, 2019>

 Article 22 (Criteria for Qualification of Faculty Members)
(1) To be qualified as a faculty member, a person shall be either a national of the Republic of Korea or a foreigner, who shall meet any of the following requirements, from among persons who have a leadership for research, the ability to educate, and good insight and character as a faculty member: <Amended by Presidential Decree No. 27849, Feb. 7, 2017>
1. Assistant professor: A person who acquires a doctoral degree;
2. Associate professor: A person with at least four years of research performance, educational career, or work experience after acquiring a doctoral degree;
3. Professor: A person with at least eight years of research performance, educational career, or work experience after acquiring a doctoral degree.
(2) In case of paragraph (1), the number of years of research performance, educational career, or work experience may be aggregated.
(3) Matters regarding lecturers shall be prescribed by academic regulations.
(4) Article 2 of the Enforcement Decree of the Gwangju Institute of Science and Technology Act shall apply mutatis mutandis to the number of years of research performance, educational career, or work experience under paragraph (1). In such cases, “Gwangju Institute of Science and Technology” shall be construed as “Daegu Gyeongbuk Institute of Science and Technology”, and “the Government, public institutions under Article 4 of the Act on the Management of Public Institutions (hereinafter referred to as “public institutions”) or institutions recognized by the Gwangju Institute of Science and Technology” as “industries or institutes recognized by the Daegu Gyeongbuk Institute of Science and Technology”. <Amended by Presidential Decree No. 28683, Feb. 27, 2018>

 Article 23 (Special Appointment)
Notwithstanding Article 22 (1), the president may specially appoint a person whose achievements in research are significant as a faculty member or specially promote such person to a higher position, following a resolution passed at a meeting of the board of trustees. <Amended by Presidential Decree No. 23323, Nov. 30, 2011>

 Article 24 (Mandatory Retirement)
A mandatory retirement age system shall be implemented for full-time faculty members, and further details about the system shall be prescribed by academic regulations following a resolution passed at a meeting of the board of trustees.

 Article 25 (Emeritus Professors)
The president may confer the title “emeritus professor” upon a person who has contributed, or is able to contribute, to the development of the Daegu Gyeongbuk Institute of Science and Technology with good character and standing as well as with significant achievements in research, as prescribed by academic regulations. <Amended by Presidential Decree No. 23323, Nov. 30, 2011>

 Article 26 (Examination of Qualification of Faculty Members and Evaluation of Their Achievements)
(1) The president shall examine the qualification of faculty members and evaluate their achievements. <Amended by Presidential Decree No. 23323, Nov. 30, 2011>
(2) The criteria for the examination and evaluation under paragraph (1) shall be prescribed by academic regulations.

 Article 27 (Quotas of Students)
The president shall adjust and determine the quotas of students according to the projected demand for science and technology personnel and the capacity of the Daegu Gyeongbuk Institute of Science and Technology. <Amended by Presidential Decree No. 23323, Nov. 30, 2011>

 Article 28 (Reporting of Quotas)
(1) The president shall formulate a plan for the quotas of students and shall report the plan to the Minister of Education and the Minister of Science and ICT before conducting an admission examination. <Amended by Presidential Decree No. 23323, Nov. 30, 2011; Presidential Decree No. 24470, Mar. 23, 2013; Presidential Decree No. 25751, Nov. 19, 2014; Presidential Decree No. 28210, Jul. 26, 2017>

 Article 29 (Qualification for Admission)
(1) To be qualified for admission to a bachelor's degree course, a person shall meet any of the following requirements: <Amended by Presidential Decree No. 24470, Mar. 23, 2013; Presidential Decree No. 27849, Feb. 7, 2017>
1. A person who has graduated from a high school or a person recognized by the Minister of Education as one with an educational background at least equivalent to the graduation from a high school;
2. A person who has completed an educational course in a foreign country, equivalent to a high school defined under subparagraph 3 of Article 2 of the Elementary and Secondary Education Act;
3. A student who is expected to finish the second-year course in a high school and is recognized by the Committee for the Selection of Gifted Persons in Science affiliated with the Daegu Gyeongbuk Institute of Science and Technology as one with excellent aptitude for science and technology.
(2) To be qualified for admission to a master's course degree, a person shall meet any of the following requirements: <Amended by Presidential Decree No. 24470, Mar. 23, 2013>
1. A person who has graduated from a four-year university with at least a bachelor's degree defined unde Article 35 (1) of the Higher Education Act;
2. A person who has graduated from a four-year university in a foreign country or who has completed at least 16 years' schooling courses in a foreign country;
3. A person recognized by the Minister of Education as one who has an educational background at least equivalent to the qualification under subparagraph 1;
4. A person who is enrolled in a four-year university and meets the requirements prescribed by academic regulations.
(3) To be qualified for admission to a doctoral degree course, a person shall meet any of the following requirements:
1. A person who holds at least a master's degree defined under Article 35 (2) of the Higher Education Act;
2. A person who has completed the course for a master's degree in a foreign university or who has completed at least 18 years' schooling courses in a foreign country;
3. A person who is enrolled in the course for a master's degree in the Daegu Gyeongbuk Institute of Science and Technology or any other graduate school of science and engineering and meets the requirements prescribed by academic regulations.
(4) Matters necessary for the formation and management of the Committee for the Selection of Gifted Persons in Science affiliated with the Daegu Gyeongbuk Institute of Science and Technology under paragraph (1) 3 shall be prescribed by academic regulations.

 Article 30 (Foreign Students)
The president may approve the qualification of only the foreigners who meet the requirements specified in Article 29 for admission after verifying the qualification of foreigners who have graduated from a domestic or foreign high school, university, or graduate school, such as the type of school and the number of years required for the graduation of the school, as prescribed by academic regulations. <Amended by Presidential Decree No. 23323, Nov. 30, 2011>

 Article 31 (Methods of Screening for Admission)
(1) Screening for admission shall be conducted by screening documents, written tests, and interviews, but some of such tests may be added or omitted, if the president deems it necessary. <Amended by Presidential Decree No. 23323, Nov. 30, 2011>
(2) Further details about the methods of screening for admission, including the timing for screening for admission and points allotted to each subject, shall be prescribed by academic regulations.

 Article 32 (Full or Partial Exemption from School Fees and Financial Assistance for School Expenses)
The Daegu Gyeongbuk Institute of Science and Technology may fully or partially exempt students enrolled in each educational course from school fees, including tuition fees, or may provide financial assistance to students for school expenses.

 Article 33 (Academic Regulations)
Detailed matters necessary for the management and operation of degree courses, faculty members, and students shall be prescribed by academic regulations.

 Article 34 (Criteria for Imposing Administrative Fines)
The criteria for imposing administrative fines under Article 24 (1) of the Act shall be as prescribed in the attached table.

This Decree shall enter into force on March 12, 2004.

This Decree shall enter into force on the date of its promulgation: Provided, That the amendments to Presidential Decrees to be amended pursuant to Article 5 of the Addenda, which were promulgated before this Decree enters into force but the dates on which they enter into force have yet to arrive, shall enter into force on the enforcement date of the relevant Presidential Decree.
