ENFORCEMENT DECREE OF THE ULSAN NATIONAL INSTITUTE OF SCIENCE AND TECHNOLOGY ACT

 Article 1 (Purpose)
The purpose of this Decree is to prescribe matters mandated by the Ulsan National Institute of Science and Technology Act and those necessary for the enforcement thereof. <Amended by Presidential Decree No. 26551, Sep. 25, 2015>
 Article 2 (Registration for Incorporation)
(1) Ulsan National Institute of Science and Technology (hereinafter referred to as "UNIST") shall register its incorporation at the seat of its principal office within three weeks from the date on which it obtains approval for the articles of incorporation pursuant to Article 3 of the Ulsan National Institute of Science and Technology Act (hereinafter referred to as the "Act").
(2) Matters required for the registration for incorporation under paragraph (1) shall be as follows:
1. Objectives;
2. Name;
3. Seat of its principal office;
4. Names and addresses of executive officers;
5. Total amount of assets.

 Article 3 (Registration for Relocation)
(1) When UNIST relocates its principal office, it shall register its relocation at the former location within three weeks and register matters under the subparagraphs of Article 2 (2) at the new location within three weeks. <Amended by Presidential Decree No. 26551, Sep. 25, 2015>
(2) When UNIST relocates its principal office within the jurisdiction of the same registry, it shall register its relocation within three weeks. <Amended by Presidential Decree No. 26551, Sep. 25, 2015>
 Article 4 (Registration for Alterations)
Where any matters prescribed in Article 2 (2) 1, 2, 4, and 5 are altered, UNIST shall register such alteration at the seat of its principal office within three weeks. <Amended by Presidential Decree No. 26551, Sep. 25, 2015>
 Article 5 (Documents to Accompany Application for Registration)
An application filed for registration under any provision of Articles 2 through 4 shall be accompanied by the following documents:
1. Articles of association in cases of registration for incorporation under Article 2;
2. Documents evidencing the relocation of the principal office in cases of registration for relocation under Article 3;
3. Documents evidencing the amendment in cases of registration for an amendment under Article 4.
 Article 6 (Calculation of Period for Registration)
With regard to any of the matters to be registered pursuant to Articles 2 through 4 as well as subject to authorization or approval from the Minister of Science and ICT, a period for registration thereof shall count from the date on which a relevant written authorization or approval is delivered to the recipient. <Amended by Presidential Decree No. 20740, Feb. 29, 2008; Presidential Decree No. 24423, Mar. 23, 2013; Presidential Decree No. 28210, Jul. 26, 2017>
 Article 7 (Effect of Registration Other than Registration for Incorporation)
Matters required to be registered other than the registration for incorporation shall not be asserted against a third party unless such matters are registered.

 Article 8 (Organization)
The President of UNIST shall determine matters concerning the organization of UNIST following a resolution by the board of directors.

 Article 9 (Standards for Qualification for Faculty)
(1) Faculty members of UNIST under Article 8 (1) of the Act shall be those based on the following classifications, who are citizens of the Republic of Korea or foreigners with research and instruction ability, teaching ability, and with knowledge and of character as faculty members:
1. Professor: A person who has at least eight years' career experience in aggregate of research experience, teaching experience, post-doctorate professional experience;
2. Associate professor: A person who has at least eight years' career experience in aggregate of research experience, teaching experience, post-doctorate professional experience;
3. Assistant professor: A person who has acquired a doctorate.
(2) The subparagraphs of Article 2 of the Enforcement Decree of the Gwangju Institute of Science and Technology Act shall apply mutatis mutandis to the years of career experience in research, the years of teaching experience, or the years of professional experience under the subparagraphs of paragraph (1). In such cases, "Gwangju Institute of Scienec and Technology" shall be construed as "UNIST", and "institutions recognized by Gwangju Institute of Science and Technology" shall be construed as "industrial businesses and institutions recognized by UNIST".
(3) Matters concerning visiting professors and lecturers shall be prescribed by school regulations.

 Article 10 (Special Appointment, etc.)
(1) Notwithstanding Article 9 (1), the President of UNIST may specially appoint or promote those whose research achievements, etc. are deemed outstanding following a resolution by the board of directors.
(2) Notwithstanding Article 9 (1), where it is necessary to fill a faculty opening in a department to which it is difficult to appoint a person who has acquired a doctorate or a department which needs professional experience, the President of UNIST may specially appoint a person who has graduated from a four year college or university, or who has the qualification equal to or higher than the aforesaid academic degree according to the following classifications following a resolution by the board of directors:
1. Professor: A person who has at least 12 years' of career experience in research, teaching experience, professional experience;
2. Associate professor: A person who has at least eight years' of career experience in research, teaching experience, professional experience;
3. Assistant professor: A person who has at least five years' of career experience in research, teaching experience, professional experience.

 Article 11 (Mandatory Retirement)
The retirement age system shall be implemented regarding full-time faculty members, and detailed matters shall be prescribed by school regulations following a resolution by the board of directors.

 Article 12 (Honorary Professors)
The President of UNIST may appoint or commission a person who has a great personality and high reputation as a man of virtue, and has contributed or will be able to contribute to the development of UNIST because his/her research achievements are remarkable as honorary professor, as prescribed by school regulations.

 Article 13 (Examination of Qualification and Evaluation of Achievements of Faculty Members)
(1) The President of UNIST shall examine qualification of faculty members and evaluate their achievements.
(2) Criteria for examination and evaluation under paragraph (1) shall be prescribed by school regulations.

 Article 14 (Fixed Number of Students)
The President of UNIST shall adjust and allot a fixed number of students of UNIST under Article 11 of the Act, according to the outlook for demand for human resources for science and technology and the admission capacity of UNIST.

 Article 15 (Reporting of Fixed Number)
The President of UNIST shall formulate a plan for quota of students and report such plan to the Minister of Education and the Minister of Science and ICT before its entrance examination. <Amended by Presidential Decree No. 28210, Jul. 26, 2017>

 Article 16 (Qualification for Admission)
(1) Any person who may enroll a bachelor's degree course of UNIST pursuant to Article 11 of the Act shall be a person who falls under any of the following:
1. A high school graduate or a person recognized by the Minister of Education to have academic ability at least equal to a high-school diploma;
2. A person who has completed a course of study equivalent to high school under subparagraph 3 of Article 2 of the Elementary and Secondary Education Act in a foreign country;
3. A person expected to complete second grade in high school, who is recognized by the Science Talent Selection Committee of UNIST to have distinguished ability in the field of science and technology.
(2) Any person who may enroll a master's degree course and a specialized master's degree course of UNIST pursuant to Article 11 of the Act shall be a person who falls under any of the following:
1. A graduate of a four-year college or university, who has been granted, or is expected to be granted a degree equal to or higher than a bachelor's degree under Article 35 (1) of the Higher Education Act;
2. A person who is a graduate or prospective graduate student of a four-year college or university in a foreign country or has completed at least a 16-year school curricula in a foreign country;
3. A person recognized by the Minister of Education to have academic ability at least equal to the qualification under subparagraph 1;
4. A student of a four-year college or university, who meets requirements prescribed by the President of UNIST.
(3) Any person who may enroll a doctoral degree course of UNIST pursuant to Article 11 of the Act shall be a person who falls under any of the following:
1. A person who has been granted or is expected to be granted an academic degree equal to or higher than a master's degree under Article 35 (2) of the Higher Education Act;
2. A person who has completed a master's degree course in a foreign university or at least an 18-year school curricula in a foreign country;
3. A student in a master's degree course or specialized master's degree course in UNIST or other graduate school in science and engineering, who meets requirements prescribed by the President of UNIST.
(4) Matters necessary for the composition, operation, etc. of the Science Talent Selection Committee of UNIST under paragraph (1) 3 shall be prescribed by the President of UNIST.

 Article 17 (Foreign Students)
Regarding a foreigner, the President of UNIST shall investigate the type of school from which the relevant foreigner graduated, the term of study, etc., and may approve qualification for admission only for the person who meets qualification for admission under Article 16.

 Article 18 (Methods of Admission)
(1) Admission process shall be conducted by document screening, written examination and interview pursuant to Article 11 of the Act, and where the President of UNIST deems it necessary, he/she may add or omit part thereof.
(2) Detailed matters concerning methods of admission, such as the time of admission process and allocation of marks for each subject, shall be prescribed by the President of UNIST.

 Article 19 (Submission, etc. of Written Request for Appropriation of Contribution)
(1) Where the Minister of Science and ICT intends to pay a contribution to UNIST pursuant to Article 14 (1) of the Act, he/she shall require UNIST to submit a written request for appropriation of a contribution for the following year to him/her along with the following documents by the end of April every year: <Amended by Presidential Decree No. 28210, Jul. 26, 2017>
1. Business plan for the following year under Article 29 (1);
2. Estimated income statement and estimated balance sheet for the following year;
3. Other documents necessary to clarify the details of the appropriation.
(2) Where the Minister of Science and ICT deems the details of an application under paragraph (1) reasonable, he/she shall appropriate a contribution in the budget for the following year. <Amended by Presidential Decree No. 28210, Jul. 26, 2017>

 Article 20 (Notification of Determination of Contribution)
Where the appropriation of a contribution for the following year is determined, the Minister of Science and ICT shall notify UNIST of such determination. <Amended by Presidential Decree No. 28210, Jul. 26, 2017>

 Article 21 (Payment, Management and Use of Contribution)
(1) Where UNIST intends to obtain a contribution determined pursuant to Article 20, it shall submit an application for the payment of the contribution to the Minister of Science and ICT along with quarterly business plans and budget execution plans for the relevant year. <Amended by Presidential Decree No. 28210, Jul. 26, 2017>
(2) Where the Minister of Science and ICT who receives an application for the payment of a contribution under paragraph (1) deems quarterly business plans and budget execution plans for the relevant year appropriate, he/she shall pay the contribution. <Amended by Presidential Decree No. 28210, Jul. 26, 2017>
(3) UNIST in receipt of a contribution pursuant to paragraph (2) shall establish and manage a separate account.
(4) UNIST that receives a contribution pursuant to paragraph (2) shall use the contribution for the purposes determined in quarterly business plans and budget execution plans.

 Article 22 (Application of Provisions on Payment of Contribution Mutatis Mutandis)
Articles 19 through 21 shall apply mutatis mutandis where in addition to the Minister of Science and ICT, the head of a central administrative agency, the head of a local government or the head of a public institution under Article 4 of the Act on the management of Public Institutions pays a contribution to UNIST. In such cases, the "Minister of Science and ICT" shall be construed as the "head of a central administrative agency, the head of a local government or the head of a public institution under Article 4 of the Act on the Management of Public Institutions". <Amended by Presidential Decree No. 28210, Jul. 26, 2017>

 Article 23 (Academic Period)
An academic period for each course of study under Article 16 (2) of the Act shall be in accordance with the following classifications, and the minimum period of study required for each course of study and the maximum period of attendance allowed shall be prescribed by the President of UNIST:
1. Bachelor's degree course: Four years;
2. Master's degree course and specialized master's degree course: At least two years;
3. Doctoral degree course: At least two years.

 Article 24 (Semester and Number of School Days)
(1) A term under Article 16 (2) of the Act shall be a semester system in principle, and where the President of UNIST deems it necessary, he/she may divide the academic year into at least three terms.
(2) The number of school days under Article 16 (2) of the Act shall be prescribed by the President of UNIST for a period of at least 32 weeks each year.

 Article 25 (Units, etc.)
A unit of a course of study shall be a credit, and matters concerning methods of completion of a course of study, such as credits required to be earned for each course of study, shall be prescribed by the President of UNIST.

 Article 26 (Joint Operation of Courses of Study with Domestic and Foreign Universities and Research Institutes)
UNIST may operate bachelor's degree courses, master's degree courses, specialized master's degree courses or doctoral degree courses in conjunction with domestic and foreign universities and research institutes related to knowledge-based industries and fields of advanced science.

 Article 27 (Reduction of and Exemption from School Expenses and Payment of Educational Expenses)
UNIST may make a reduction in and exemption from school expenses, such as tuition, or pay educational expenses for students in each course of study.

 Article 27-2 (Organization and Operation of the Senate)
(1) When the Senate of UNIST under Article 16-2 (1) of the Act is organized, Senate members representing each group, such as faculty members, staff (including researchers), and students, shall be elected by election: Provided, That where the alumni of UNIST or persons who can contribute to the development of UNIST are included in Senate members, such Senate members shall be commissioned by the President of UNIST.
(2) The meetings of the Senate shall be classified into regular meetings and special meetings, which shall be held at least once per year and frequently, respectively, as prescribed by the articles of incorporation.
(3) Except as provided in paragraphs (1) and (2), the election and commission of Senate members, the meetings of the Senate, and other matters necessary for the organization and operation of the Senate shall be prescribed by the articles of incorporation.

 Article 28 (Creation, Management, etc. of Fund)
(1) UNIST shall manage the development fund (hereinafter referred to as the "Fund") created pursuant to Article 17 of the Act by establishing a separate account, and where UNIST intends to reduce the capital of the Fund, it shall obtain approval from the Minister of Science and ICT. <Amended by Presidential Decree No. 28210, Jul. 26, 2017>
(2) Where a person who makes a contribution or a donation under Article 17 (2) 1 of the Act specifies the purpose of such contribution or donation for the purpose of using the contribution or donation in a specific project, UNIST shall use the relevant contribution or donation for the specified purpose only: Provided, That where it is inevitable to alter the purpose thereof, UNIST shall obtain prior consent from a person who has made such contribution or donation.
(3) "Revenue prescribed by Presidential Decree" in Article 17 (2) 3 of the Act means the amount of money transferred into the Fund pursuant to Article 31.
(4) "Projects prescribed by Presidential Decree" in Article 17 (3) 3 of the Act means the following projects:
1. Project to support students and researchers;
2. Project to operate and manage the Fund;
3. Project to manage and honor donors.
(5) In addition to matters prescribed in paragraphs (1) through (4), matters necessary for the operation and management of the Fund shall be prescribed by the articles of incorporation.

 Article 28-2 (Donation and Joint Use of Land, etc.)
Any person who intends to donate land, research facilities, research equipment, etc. to UNIST and use the same jointly with UNIST under Article 17-2 (1) of the Act shall conclude a contract on the donation procedures and joint use with UNIST: Provided, That the procedures for accepting donations under subparagraph 1 of Article 2 of the Act on Collection and Use of Donations shall be governed by the relevant statute.

 Article 29 (Business Plans)
(1) UNIST shall classify and describe the objectives, policies, details of main projects and the necessary budget in a business plan for the following year submitted pursuant to Article 18 (1) of the Act.
(2) Where UNIST intends to alter important matters in a business plan under paragraph (1), it shall submit a business plan specifying matters to be altered and grounds for alteration to the Minister of Science and ICT and obtain his/her approval of such business plan. In such cases, where it intends to alter matters concerning school affairs, it shall also submit the relevant business plan to the Minister of Education. <Amended by Presidential Decree No. 28210, Jul. 26, 2017>

 Article 30 (Statement of Accounts)
UNIST shall submit the revenue and expense accounts for each business year audited and inspected by a certified public accountant or an accounting firm pursuant to Article 18 (2) of the Act to the Minister of Science and ICT, along with the following documents by the end of March of the following year. In such cases, it shall also submit matters concerning academic affairs to the Minister of Education: <Amended by Presidential Decree No. 28210, Jul. 26, 2017>
1. Income statement and balance sheet for the relevant year;
2. Comparative table of a business plan for the relevant year and the result of the execution thereof;
3. Written opinion of a certified public accountant or an accounting firm that has conducted the relevant audit and inspection;
4. Written opinion of an auditor who has conducted the relevant audit and inspection;
5. Other attached documents that may verify the details of the settlement of accounts.

 Article 31 (Handling of Surplus Funds)
Where a surplus is generated as a result of the settlement of accounts for each fiscal year, UNIST shall appropriate such surplus to make up for loss brought forward, and carry forward the residual surplus to the following year or transfer the residual surplus into the Fund.

 Article 32 (Submission of Research Plans and Research Reports)
Where UNIST submits a research plan and research report pursuant to Article 19 (1), it shall submit such research plan and research report along with the following documents:
1. Table of analysis of domestic and overseas technological research-related trends;
2. Plan for utilization after research and development;
3. Other reference documents that may explain the details of research.

 Article 33 (Standards for Imposition of Administrative Fines)
Standards for imposition of administrative fines under Article 27 (2) of the Act shall be as specified in the attached Table.

 Article 34 (School Regulations)
Detailed matters necessary for the management of academic degree courses, faculty members and students, and the operation of UNIST shall be prescribed by school regulations.
