FRAMEWORK ACT ON THE PROMOTION OF SAFETY EDUCATION FOR CITIZENS

CHAPTER I GENERAL PROVISIONS
 Article 1 (Purpose)
The purpose of this Act is to prescribe matters necessary for the promotion of national safety education, so as to contribute to creating communities safe from disasters.
 Article 2 (Definitions)
The terms used in this Act are defined as follows:
1. The term "safety education" means education provided to help citizens acquire knowledge or skills on safety to ensure that they are aware of the importance of safety and able to effectively handle various disasters and safety accidents;
2. The term "human resources specializing in safety education" means persons with qualifications prescribed by Presidential Decree, among persons with knowledge and abilities to provide safety education or conduct research related to safety education.
 Article 3 (Responsibilities of the State)
(1) The State and local governments shall formulate and implement policies to promote safety education and provide assistance necessary for promoting safety education.
(2) The State and local governments shall make efforts to provide safety education in a systematic and continuous manner through organic connections among persons in charge of the education.
(3) The State and local governments shall endeavor to enhance people's awareness of the effects and necessity of safety education. <Newly Inserted on Jan. 29, 2020>
 Article 4 (Relationship to Other Statutes)
Except as otherwise provided in other statutes, safety education shall be governed by this Act.
CHAPTER II FORMULATION AND IMPLEMENTATION OF MASTER PLANS FOR SAFETY EDUCATION
 Article 5 (Formulation and Implementation of Master Plans for Safety Education)
(1) The Minister of Public Administration and Security shall formulate a master plan for safety education (hereinafter referred to as "master plan") every five years and implement the master plan after making the master plan final and conclusive by undergoing deliberation by the Central Safety Management Committee prescribed in Article 9 of the Framework Act on the Management of Disasters and Safety. <Amended on Jul. 26, 2017>
(2) The master plans shall include the matters falling under each of the following subparagraphs:
1. Basic objectives and directions of promotion of safety education;
2. Details of promotion of safety education;
3. Fostering human resources specializing in safety education;
4. Inspection of actual situation and evaluation of safety education;
5. Methods to secure financial resources necessary for the promotion of safety education;
6. Other matters deemed necessary for promoting safety education.
(3) When necessary to revise a master plan, the Minister of Public Administration and Security shall revise the master plan by undergoing deliberation by the Central Safety Management Committee prescribed in Article 9 of the Framework Act on the Management of Disasters and Safety: Provided, That minor matters prescribed by Presidential Decree may not undergo deliberation. <Amended on Jul. 26, 2017>
(4) Where a master plan is finalized or revised, the Minister of Public Administration and Security shall notify the heads of relevant central administrative agencies and the heads of local governments thereof. <Amended on Jul. 26, 2017>
(5) Matters necessary for procedures for formulating master plans, etc. shall be prescribed by Presidential Decree.
 Article 6 (Formulation of Safety Education Implementation Plans)
(1) The heads of relevant central administrative agencies and the heads of local governments shall formulate and execute annual safety education implementation plans on matters under their jurisdiction, in compliance with master plans prescribed in Article 5 (hereinafter referred to as "implementation plan").
(2) Matters necessary for procedures for formulating implementation plans, etc. shall be prescribed by Presidential Decree.
 Article 7 (Evaluation of Outcomes of Promotion of Safety Education)
(1) The heads of central administrative agencies and the heads of local governments shall conduct a self-evaluation of the outcomes of promotion of safety education based on implementation plans each year and incorporate the outcomes thereof in the formulation and implementation of policies for safety education under their jurisdiction.
(2) The heads of central administrative agencies and the heads of local governments shall submit the outcomes of promotion of safety education based on implementation plans and the result of self-evaluation to the Minister of Public Administration and Security, as prescribed by Ordinance of the Ministry of Public Administration and Security. <Amended on Jul. 26, 2017>
(3) The Minister of Public Administration and Security shall check the status of promoting policies for safety education and may, if necessary as a resulting of checking, request the heads of central administrative agencies and the heads of local governments to change the implementation plans. In such cases, the heads of central administrative agencies and the heads of local governments in receipt of such request shall comply therewith, except in extenuating circumstances. <Amended on Jul. 26, 2017>
(4) Matters necessary for the methods, timing, etc. for evaluating the outcomes of promotion of safety education shall be prescribed by Presidential Decree.
 Article 8 (Cooperation of Relevant Institutions)
(1) If necessary for formulating or implementing a master plan, the Minister of Public Administration and Security may request the heads of central administrative agencies, local governments and public institutions to render cooperation. <Amended on Jul. 26, 2017>
(2) If necessary for formulating or executing an implementation plan, the heads of central administrative agencies and the heads of local governments may request the heads of relevant public institutions and human resources specializing in safety education, etc. to render cooperation.
(3) A person requested to render cooperation pursuant to paragraphs (1) and (2) shall comply therewith, except in extenuating circumstances.
CHAPTER III IMPLEMENTATION OF SAFETY EDUCATION
 Article 9 (Promotion of Policies for Safety Education)
The State and local governments shall promote the following policies for smooth implementation of safety education:
1. Development and dissemination of teaching materials and programs for safety education;
2. Fostering and utilization of human resources specializing in safety education;
3. Support for safety education at schools and other educational institutions;
4. Other matters prescribed by Presidential Decree for smooth implementation of safety education.
 Article 10 (Safety Education at Schools)
(1) The head of an institution providing education for the following persons shall implement safety education for the relevant educatees:
1. Infants of child care centers prescribed in subparagraph 3 of Article 2 of the Infant Care Act;
2. Young children of kindergartens prescribed in subparagraph 2 of Article 2 of the Early Childhood Education Act;
3. Students of schools prescribed in Article 2 of the Elementary and Secondary Education Act;
4. Students of schools prescribed in Article 2 of the Higher Education Act.
(2) The Minister of Public Administration and Security may support the following matters by consulting with the Minister of Education: <Amended on Jul. 26, 2017>
1. Matters concerning the implementation of safety education at schools prescribed in Article 2 of the Elementary and Secondary Education Act;
2. Matters concerning development and dissemination of the materials related to safety education at schools;
3. Other matters necessary for smoothly promoting safety education at schools.
(3) The Minister of Public Administration and Security may consult with the Minister of Education so as to incorporate matters concerning safety into educational activities, such as school curricula. <Amended on Jul. 26, 2017>
 Article 11 (On-The-Job Education for Disaster Management Agencies)
The Minister of Public Administration and Security may implement job capability education on safety management for persons prescribed by Presidential Decree, among persons in charge of duties related to disasters and safety at the disaster management agencies prescribed in subparagraph 5 of Article 3 of the Framework Act on the Management of Disasters and Safety. <Amended on Jul. 26, 2017>
 Article 12 (Safety Education at Multi-User Facilities)
Facility managers of the following multi-user facilities, etc. shall implement safety education for the users of such facilities:
1. Places of public performance under subparagraph 4 of Article 2 of the Public Performance Act;
2. Sports facilities prescribed in Article 13 of the National Sports Promotion Act;
3. Movie theaters prescribed in subparagraph 10 of Article 2 of the Promotion of the Motion Pictures and Video Products Act;
4. Means of public transportation prescribed in subparagraph 2 of Article 2 of the Act on the Support and Promotion of Utilization of Mass Transit System;
5. Passenger ships prescribed in subparagraph 1-2 of Article 2 of the Marine Transportation Act;
6. Airplanes prescribed in subparagraph 1 of Article 2 of the Aviation Safety Act;
7. Other facilities prescribed by Presidential Decree, among facilities used by many and unspecified persons.
 Article 13 (Safety Education at Social Welfare Facilities)
Facility managers of the following social welfare facilities, etc. shall implement safety education for persons dwelling in such facilities and the users of such facilities:
1. Social welfare facilities prescribed in subparagraph 4 of Article 2 of the Social Welfare Services Act, such as welfare facilities for persons with disabilities, welfare facilities for children, welfare facilities for senior citizens, and facilities for mental patients' rehabilitation to the society;
2. Hospital-level medical institutions under Article 3 (2) 3 of the Medical Service Act;
3. Other facilities prescribed by Presidential Decree, among facilities equivalent to those in subparagraphs 1 and 2.
CHAPTER IV PROMOTION AND MANAGEMENT OF SAFETY EDUCATION
 Article 14 (Development of Safety Education Programs)
(1) In order to provide citizens with diverse opportunities for safety education, the State and local governments shall research, develop and disseminate safety education programs.
(2) In order to facilitate research and development prescribed in paragraph (1), the State and local governments may support institutions and organizations specializing in the research and development of safety education programs.
(3) Matters necessary for the scope of institutions and organizations prescribed in paragraph (2) and methods of supporting such institutions and organizations, etc. shall be prescribed by Presidential Decree.
 Article 15 (Designation of Safety Education Institutions)
(1) The Minister of Public Administration and Security may designate safety education institutions, the main purpose of which is to implement safety education, by consulting with the Minister of Education. <Amended on Jul. 26, 2017>
(2) Matters necessary for designation of safety education institutions prescribed in paragraph (1), such as designation standards shall be prescribed by Presidential Decree.
(3) Where an institution designated as a safety education institution falls under any of the following cases, the Minister of Public Administration and Security may revoke the designation thereof: Provided, That he/she must revoke the designation where falling under subparagraph 1: <Amended on Jul. 26, 2017>
1. Where the trading agency has obtained the designation by fraud or other improper means;
2. Where the institution no longer complies with the standards for designation of specialized manpower fostering institutions under paragraph (2).
(4) When revoking the designation of a safety education institution, the Minister of Public Administration and Security shall notify the Minister of Education of the fact of revocation. <Amended on Jul. 26, 2017>
(5) The Minister of Public Administration and Security shall not designate persons (in cases of corporations, including the representatives thereof) whose designation has been revoked pursuant to paragraph (3) as safety education institutions within one year from the date on which the designation was revoked. <Amended on Jul. 26, 2017>
 Article 16 (Instructions for Safety Education Institutions)
(1) The Minister of Public Administration and Security may provide instructions and issue orders necessary for smooth operation of safety education institutions designated. <Amended on Jul. 26, 2017>
(2) Where a person who has obtained the designation of safety education institution falls under any of the following cases, the Minister of Public Administration and Security may order corrections or the suspension of operation of such institution, as prescribed by Presidential Decree: <Amended on Jul. 26, 2017>
1. Where a person who has obtained the designation of safety education institution runs such institution, in violation of the designation standards prescribed in Article 15;
2. Where the constructor violates this Act or an order under this Act.
(3) Procedures and standards for the administrative dispositions prescribed in paragraph (2) shall be prescribed by Presidential Decree.
 Article 17 (Inspection of Current Status and Evaluation of Safety Education)
(1) The heads of relevant central administrative agencies or the heads of local governments shall submit the outcomes of implementation of safety education pursuant to Articles 9 through 13 to the Minister of Public Administration and Security. <Amended on Jul. 26, 2017>
(2) The Minister of Public Administration and Security shall inspect the outcomes of implementation of safety education submitted pursuant to paragraph (1). <Amended on Jul. 26, 2017>
(3) The Minister of Public Administration and Security may request the heads of relevant institutions and schools to incorporate the outcomes of inspection prescribed in paragraph (2) in the following evaluations: <Amended on Jul. 26, 2017>
1. The internal evaluation of a central administrative agency or local government prescribed in Articles 14 (1) and 18 (1) of the Framework Act on Public Service Evaluation;
(4) The Minister of Public Administration and Security shall release the outcomes of inspection prescribed in paragraph (2) to the press, etc., as prescribed by Presidential Decree. <Amended on Jul. 26, 2017>
(5) Matters necessary for the methods, timing, etc. for inspecting the outcomes of implementation of safety education shall be prescribed by Presidential Decree.
 Article 18 (Support for Safety Education in Communities)
(1) The State and local governments may provide safety education-related organizations, lifelong educational institutions prescribed in subparagraph 2 of Article 2 of the Lifelong Education Act, etc. with facilities and equipment for implementation of safety education and safety education-related research and development.
(2) The State and local governments may support culture classes, etc. operated by the State, local governments, public institutions, etc. for establishment of safety education-related educational courses.
 Article 19 (Use of Public Facilities)
If necessary for safety education, a person who implements safety education may use public facilities, as prescribed by Presidential Decree, as far as it does not impair their original use.
 Article 20 (Fostering of Human Resources Specializing in Safety Education)
(1) The State and local governments shall formulate and promote policies for the following matters to foster human resources specializing in safety education:
1. Matters concerning the supply and demand, and utilization of human resources specializing in safety education;
2. Matters concerning the fostering, and education and training of human resources specializing in safety education;
3. Matters concerning the management and certification for careers related to human resources specializing in safety education;
4. Other matters prescribed by Presidential Decree, among matters necessary for fostering human resources specializing in safety education.
(2) If necessary when formulating and implementing the policies prescribed in paragraph (1), the State and local governments may support universities, research institutes, etc. related to fostering human resources specializing in safety education, etc. In such cases, universities, research institutes, etc. to be supported shall be prescribed by Presidential Decree.

Article 1 (Enforcement Date)
This Act shall enter into force one year after the date of its promulgation.

ADDENDA <Act No. 14839, Jul. 26, 2017>
Article 1 (Enforcement Date)
(1) This Act shall enter into force on the date of its promulgation: Provided, That the amended parts of the Acts which were promulgated before this Act enters into force but whose enforcement dates have yet to arrive among the Acts to be amended pursuant to Article 5 of Addenda, shall enter into force on the respective dates when the relevant Acts enter into force.
Articles 2 through 6 Omitted.
