ACT ON THE ASSISTANCE TO KOREAN 4-H ACTIVITIES

 Article 1 (Purpose)
The purpose of this Act is to assist the youth of the Republic of Korea in carrying out 4-H activities to help them grow up to be well-rounded and agriculturally-minded individuals as well as the next generation of creative minds, thereby contributing to national development.
 Article 2 (Definitions)
The terms used in this Act are defined as follows: <Amended on Feb. 11, 2020>
1. The term "4-H" means the four concepts of a clear head (Head: intellectual development), a true heart (Heart: moral development), willing hands (Hands: development of a hardworking spirit), and joyous health (Health: physical development);
2. The term "4-H activities" means the following activities based on the 4-H concepts:
(a) Camping activities, cultural activities, and other educational and training activities to practice the 4-H concepts;
(b) Publicity, publication and research activities to spread and develop the 4-H concepts;
(c) International exchange activities, including exchanges between the 4-H youth in Korea and those in other countries;
(d) Other activities to solidify and spread the 4-H concepts.
 Article 3 (Establishment of Policies for 4-H Activities)
(1) The Administrator of the Rural Development Administration shall establish and implement policies necessary to support 4-H activities in order to ensure the systematic and efficient implementation of 4-H activities.
(2) In establishing the policies under paragraph (1), the Administrator of the Rural Development Administration shall consult in advance with the head of the relevant central administrative agency.
 Article 4 (Designation of Organization in Charge of 4-H Activities)
The Administrator of the Rural Development Administration may designate a non-profit legal entity meeting the following requirements as an organization to be in charge of 4-H activities in order to support 4-H activities in a systematic and efficient way:
1. It has been established with the aim of supporting 4-H activities;
2. It has specialized human resources and educational facilities and equipment;
3. It has supported 4-H activities on a national level for the last one or more year.
 Article 5 (Reimbursement of Expenses)
(1) The State or local governments may reimburse the organizations performing 4-H activities for operational expenses, facility expenses, and other expenses. <Amended on Feb. 11, 2020>
(2) An individual, corporation, or organization may contribute or donate money or other property to support and promote the organizations performing 4-H activities. <Newly Inserted on Feb. 11, 2020>

 Article 5-2 (Use of Protection Outfits)
(1) If necessary to support and promote the organizations performing 4-H activities, the State or a local government may allow the gratuitous use of state-owned or public facilities, notwithstanding the State Property Act or the Public Property and Commodity Management Act.
(2) Where the State or a local government allows the use of state-owned property or public property, the period thereof may be within 10 years, notwithstanding Article 35 (1) of the State Property Act or Article 21 (1) of the Public Property and Commodity Management Act. In such cases, such period may be renewed.

 Article 5-3 (Tax Reduction or Exemption)
(1) The State may reduce or exempt taxes imposed on organizations performing 4-H activities pursuant to the Restriction of Special Taxation Act in order to promote 4-H activities.
(2) The State may apply special taxation to property contributed or donated to the organizations performing 4-H activities under Article 5 (2), pursuant to the Restriction of Special Taxation Act.

 Article 6 (Reporting on Business Plan, etc.)
The organization in charge shall prepare a business plan and a revenue and expenditure budget for each fiscal year and submit a report thereon to the Administrator of the Rural Development Administration by no later than the beginning of each such fiscal year. The same shall also apply where any change is made to such plan or budget.
 Article 7 (Reporting on Settlement of Accounts)
The organization in charge shall prepare a statement of accounts concerning revenue and expenditure for each fiscal year and have it inspected by a certified public accountant, and then shall submit a report thereon to the Administrator of the Rural Development Administration within three months after each fiscal year ends.
 Article 8 (Inspection, etc. of Operations)
When necessary to conduct supervision, the Administrator of the Rural Development Administration may have the organization in charge submit a report on its operations or direct the public officials under his/her management to inspect the operations of the organization. <Amended on Feb. 11, 2020>
 Article 9 (Prohibition of Use of Similar Names, etc.)
No person shall use any name that may be misunderstood as that of the organization in charge, and manufacture or use the promotional products and marks of the organization in charge without the consent thereof.
 Article 10 (Administrative Fines)
Any person who falls under any of the following subparagraphs shall be subject to an administrative fine not exceeding two million won:
1. A person who refuses, obstructs or evades reporting or an inspection under Article 8;
2. A person who violates Article 9 by using any name that may be misunderstood as that of the organization in charge or by manufacturing or using any promotional product or mark of the organization in charge without the consent thereof.
