ACT ON THE ESTABLISHMENT OF DIPLOMATIC MISSIONS ABROAD OF THE REPUBLIC OF KOREA

 Article 1 (Establishment and Functions)
Missions of the Republic of Korea shall be established in foreign countries under the jurisdiction of the Minister of Foreign Affairs to take partial charge of diplomatic or consular affairs under the control of the Ministry of Foreign Affairs. <Amended on Mar. 23, 2013>

 Article 2 (Kinds)
Missions of the Republic of Korea (hereinafter referred to as "missions") shall be classified into Embassy, Representative Office and Consulate General. <Amended on Mar. 31, 2020>

 Article 2-2 (Establishment Criteria)
(1) When a mission is established or changed, the kind and size, etc. thereof shall be determined, taking the following into consideration: <Amended on Mar. 23, 2013; Mar. 31, 2020>
1. Political-affair relationship with the relevant state;
2. Economic relationship with the relevant state or region;
3. Protection of overseas Korean nationals and demand for consular services in the state or region;
4. Working relationship with the relevant international organization;
5. Matters deemed necessary by the Minister of Foreign Affairs in line with changes in the international environment.
(2) Matters necessary for each subparagraph of paragraph (1) shall be prescribed by Presidential Decree.

 Article 3 (Branch Offices and Sub-Branches)
Branch offices and sub-branches may be established in the missions, as prescribed by Presidential Decree, if necessary to assign the said offices and sub-branches with affairs under the jurisdiction of the missions.

 Article 4 (Names of Branch Offices and Sub-Branches)
The name and location of each branch office and sub-branch and the jurisdiction thereof shall be prescribed by Presidential Decree. <Amended on Mar. 31, 2020>

 Article 5 (Head of Each Mission)
(1) A head shall be assigned to each mission.
(2) The heads of Embassy and Representative Office shall be an ambassador extraordinary and plenipotentiary, respectively, and the head of a Consulate General shall be a consul-general. <Amended on Mar. 31, 2020>
(3) An ambassador extraordinary and plenipotentiary shall exercise overall control over the affairs of the relevant diplomatic missions and direct and supervise public officials belonging thereto, under the direction of the Minister of Foreign Affairs. <Amended on Mar. 23, 2013; Mar. 31, 2020>
(4) The consul-general shall, upon the order of the Minister of Foreign Affairs and the ambassador extraordinary and plenipotentiary, exercise overall control over the affairs of the relevant diplomatic missions, and direct and supervise the public officials under his or her control. <Amended on Mar. 23, 2013; Mar. 31, 2020>

 Article 6 (Organization of Office)
Matters necessary for, among other things, the organization of any mission, and types, fixed number, remuneration, duties, service, and summons of public officials belonging thereto shall be prescribed by Presidential Decree. <Amended on Dec. 24, 2018>

 Article 7 (Honorary Consul-Generals)
The Minister of Foreign Affairs may, if deemed necessary, assign an honorary consul-general or honorary consul in any area in which no Consulate General is assigned. <Amended on Mar. 23, 2013; Mar. 31, 2020>
