SPECIAL ACT ON SUPPORT FOR THE 2023 SAEMANGEUM WORLD SCOUT JAMBOREE

CHAPTER I GENERAL PROVISIONS
 Article 1 (Purpose)
The purpose of this Act is to contribute to the promotion of youth exchange and experience activities and the facilitation of leisure activities for the public by supporting the success of the 25th World Scout Jamboree to be held in 2023.
 Article 2 (Definitions)
The terms used in this Act are defined as follows:
1. The term “World Jamboree-related facilities” means facilities directly related to the 25th World Scout Jamboree (hereinafter referred to as the “World Jamboree”) and facilities for creating an environment for the World Jamboree;
2. The term "facilities directly related to the World Jamboree" means any of the following facilities:
(a) Facilities for operating and managing the World Jamboree;
(b) Campsites and convenience facilities related thereto;
(c) Experience centers and convenience facilities related thereto;
(d) Exhibition halls;
(e) Roads that lead to a campsite;
(f) Emergency medical facilities;
(g) Electric, electronic, communications, and gas facilities;
(h) Other facilities directly related to the World Jamboree which are prescribed by Presidential Decree.
3. The term "facilities for creating an environment for the World Jamboree" means any of the following facilities:
(a) Transportation facilities, such as main and auxiliary arterial roads that need to be established or maintained for the operation of the World Jamboree and for the construction of access networks;
(b) Road signs regarding facilities directly related to the World Jamboree, and publicity information facilities;
(c) Water supply and drainage facilities;
(d) Other facilities necessary for creating an environment for the World Jamboree which are prescribed by Presidential Decree.
 Article 3 (Relationship to Other Statutes)
With respect to the provisions applicable to projects related to the establishment, use, follow-up, etc. of the World Jamboree-related facilities, this Act shall prevail over other statutes.
 Article 4 (Responsibility of the State and Local Governments)
(1) The State and local governments shall establish and implement comprehensive policies and prepare a support plan to ensure that the World Jamboree is held successfully.
(2) The State and local governments shall take necessary measures to ensure that the World Jamboree is operated safely and conveniently.
CHAPTER II ORGANIZING COMMITTEE
 Article 5 (Establishment of Organizing Committee)
(1) The Organizing Committee for the 2023 Saemangeum World Scout Jamboree (hereinafter referred to as the “Organizing Committee”) shall be established upon authorization from the Minister of Gender Equality and Family for the successful preparation and hosting of the World Jamboree.
(2) The Organizing Committee shall be a corporation.
(3) The affairs of the Organizing Committee shall be as follows:
1. Formulation of a comprehensive plan for the World Jamboree, and formulation and? implementation of detailed operational plans;
2. Formulation and implementation of a plan to establish and use the World Jamboree-related facilities;
3. Establishment and management of the World Jamboree-related facilities;
4. Cooperation with countries participating in the World Jamboree and domestic and international scout organizations;
5. Other projects necessary for the smooth preparation and operation of the World Jamboree.
(4) The Organizing Committee shall have a president, a vice president, executive members, and auditors as its executive officers and shall have an executive committee for the efficient performance of the general assembly and its affairs. In such cases, there may be established an advisory committee to provide advice on matters necessary for performing the affairs.
(5) The Organizing Committee shall have a secretariat to deal with its administrative affairs.
(6) Matters regarding the maximum number of executive officers, terms of office, and methods of election under paragraph (4); the composition and functions of the general assembly, an executive committee, and an advisory committee under that paragraph; and matters regarding the organization and operation of the secretariat under paragraph (5) shall be prescribed by the articles of association.
(7) Except as provided in this Act, the provisions of the Civil Act governing incorporated foundations shall apply mutatis mutandis to the Organizing Committee.
 Article 6 (Support from the State)
(1) The Organizing Committee may request the State, local governments, public institutions (referring to public institutions prescribed in Article 4 of the Act on the Management of Public Institutions; hereinafter the same shall apply), corporations, organizations, etc. to provide administrative and financial cooperation and support and other necessary convenience, and the relevant institutions shall comply therewith unless there is a compelling reason not to do so.
(2) The State shall comply with a plan for the establishment, use, follow-up, etc. of the World Jamboree-related facilities approved pursuant to Article 23.
(3) The State and local governments may subsidize costs incurred in establishing and operating the Organizing Committee, preparing and operating the World Jamboree, and maintaining and managing the World Jamboree-related facilities.
(4) The State, local governments, and the Organizing Committee may provide administrative and financial support necessary for the operation and projects of organizations for private promotional campaigns to encourage public participation, civilized conduct, etc. for the success of the World Jamboree.
 Article 7 (Receipt of Donations)
(1) The Organizing Committee may receive donations voluntarily given in compliance with the project purposes, notwithstanding Article 5 (2) of the Act on Collection and Use of Donations.
(2) Matters regarding the procedures, etc. for receiving donations under paragraph (1) shall be prescribed by Presidential Decree.
 Article 8 (Counter-Terrorism and Security Measures)
(1) The Organizing Committee may request support from the State to prepare against terrorism and safety threats to the World Jamboree-related facilities, employees, participants, etc.
(2) In order to provide support requested by the Organizing Committee under paragraph (1), the State may establish and operate an organization for counter-terrorism and security measures consisting of counter-terrorism and security-related institutions.
(3) Matters necessary for the detailed division of affairs among the Organizing Committee and relevant administrative agencies and the establishment, operation, etc. of the organization for counter-terrorism and security measures under paragraphs (1) and (2) shall be prescribed by Presidential Decree.
 Article 9 (Establishment of Fund)
(1) The Organizing Committee shall the World Jamboree Fund (hereinafter referred to as the “Fund”) to appropriate funds necessary for the establishment and operation of the Organizing Committee and costs incurred in preparing and operating the World Jamboree.
(2) The Fund shall consist of the following financial resources:
1. Contributions, subsidies, and donations from the Government and persons other than the Government;
2. Loans from the borrowing of funds under Article 10;
3. Profits from profit-making projects under Article 13;
4. Earnings from the outdoor advertising business provided to the Organizational Committee under Article 6 (5) of the Act on the Management of Outdoor Advertisements, etc. and Promotion of Outdoor Advertisement Industry;
5. Profits from the operation of the Fund;
6. Other profits.
(3) The fiscal year of the Fund shall coincide with that of the Government.
(4) The accounts of the Fund shall be kept according to business accounting principles.
(5) Except as provided in paragraphs (1) through (4), matters necessary for the operation and management of the Fund shall be prescribed by Presidential Decree.
 Article 10 (Borrowing of Funds)
(1) If necessary for the preparation and operation of the World Jamboree, the Organizing Committee may borrow funds or bring in materials (including borrowing funds and bringing in materials from international organizations, foreign governments, foreigners, etc.) with approval from the Minister of Gender Equality and Family.
(2) Where the Organizing Committee borrows funds or brings in materials from overseas, the Introduction and Management of Public Loans Act and the Foreign Exchange Transactions Act shall apply.
 Article 11 (Reduction of or Exemption from Charges)
The State and local governments may reduce or exempt the following charges, etc., if necessary for providing support to the World Jamboree:
1. Development charges under the Restitution of Development Gains Act;
2. Expenses incurred in creating forest replacement resources under the Mountainous Districts Management Act;
3. Infrastructure-building fees under the National Land Planning and Utilization Act;
4. Occupancy or use fees of pubic waters under the Public Waters Management and Reclamation Act;
5. Occupancy or use fees under the River Act;
6. Charges for causing traffic congestion under the Urban Traffic Improvement Promotion Act;
7. Marine ecosystem conservation levies under the Conservation and Management of Marine Ecosystems Act;
8. Charges imposed on causers under the Water Supply and Waterworks Installation Act and charges on burden-causing entities under the Sewerage Act.
 Article 12 (Exemption from Duty to Purchase Bonds)
Where the Organizing Committee acquires movable property, immovable property, etc. for its operation and activities, it shall be exempt from the duty to purchase various bonds, etc. under the relevant statutes and regulations in the same manner as such exemption is applied to State agencies.
 Article 13 (Profit-Making Projects)
(1) In order to cover the expenses incurred in preparing and operating the World Jamboree, the Organizing Committee may engage in the following profit-making projects with approval from the Minister of Gender Equality and Family:
1. Insignia projects;
2. Sale of commemorative coins;
3. Facility lease projects;
4. Other projects related to the World Jamboree which are prescribed by Presidential Decree.
(2) The Organizing Committee may grant part of the funds raised from profit-making projects to other agencies, corporations, or organizations related to the World Jamboree, as prescribed by Presidential Decree.
 Article 14 (Sale of Commemorative Coins)
(1) The Organizing Committee may request the Bank of Korea to issue commemorative coins to cover the expenses incurred in preparing and operating the World Jamboree.
(2) The Organizing Committee may exclusively acquire commemorative coins issued under paragraph (1).
 Article 15 (Issuance of Commemorative Stamps)
The Organizational Committee may request the Minister of Science and ICT to issue commemorative stamps or post cards in order to publicize or commemorate the World Jamboree.
 Article 16 (Service Charges)
Where the Organizing Committee performs affairs for the World Jamboree or other projects related to the World Jamboree, it may receive service charges or use fees as prescribed by Presidential Decree, in any of the following cases:
1. Where the Organizational Committee allows the use of the World Jamboree-related facilities or goods managed by it;
2. Where the Organizing Committee provides services to individuals, corporations, or organizations;
3. Other matters prescribed by Presidential Decree.
 Article 17 (Requests for Dispatch of Public Officials)
(1) If deemed necessary for performing the affairs, the Organizing Committee may request relevant administrative agencies, local governments, or corporations or organizations related to the World Jamboree to dispatch public officials prescribed in Article 2 (2) of the State Public Officials Act or Article 2 of the Local Public Officials Act or executive officers or employees of the corporations or organizations with approval from the Minister of Gender Equality and Family.
(2) Where the Organizing Committee requests the dispatch of public officials or executive officers and employees pursuant to paragraph (1), the heads of the relevant administrative agencies, corporations, or organizations shall select and dispatch persons appropriate for performing the affairs unless there is a compelling reason not to do so; and where they intend to cancel such dispatch during the period of dispatch, they shall consult in advance with the Organizing Committee.
(3) The heads of the relevant administrative agencies, corporations, or organizations that dispatch public officials or executive officers and employees pursuant to paragraph (2) shall not treat dispatched persons unfavorably in relation to their promotion, change of position, education, awards, welfare, etc.
(4) Where dispatched public officials or executive officers and employees are deemed inappropriate for performing the affairs, the Organizing Committee may request the relevant administrative agencies, corporations, or organizations which have dispatched the relevant public officials or executive officers and employees to cancel the dispatch services.
 Article 18 (Requests for Provision of Data)
(1) The Organizing Committee may request relevant administrative agencies, public institutions, educational institutions, research organizations, etc. to provide data related to the World Jamboree, such as research reports or research papers.
(2) Upon receipt of a request under paragraph (1), the head of an institution or organization shall comply with such request unless there is a compelling reason not to do so.
 Article 19 (Approval of Budget Bills)
The Organizing Committee shall prepare a business plan and a budget bill for the following year and obtain approval from the Minister of Gender Equality and Family before the beginning of the following fiscal year. The same shall apply to any modification thereto.
 Article 20 (Report on Settlement of Accounts)
The Organizing Committee shall submit a written settlement of the accounts of revenues and expenditures for each fiscal year to the Minister of Gender Equality and Family, along with the business performance reports for the relevant year, by March 31 of the following year.
 Article 21 (Devolvement of Residual Property)
Where the Organizing Committee dissolves, Article 13 of the Act on the Establishment and Operation of Public Interest Corporations shall apply mutatis mutandis to the devolvement of residual property. In such cases, the residual property shall be used for follow-up in a project plan under Article 23.
CHAPTER III GOVERNMENT SUPPORT COMMITTEE
 Article 22 (Government Support Committee)
(1) The Government Support Committee for the 2023 Saemangeum World Scout Jamboree (hereinafter referred to as the "Support Committee") shall be established under the Prime Minister for deliberation on and coordination of major policies related to the World Jamboree.
(2) The Support Committee shall be comprised of not more than 30 members, including the chairperson: the Prime Minister shall serve as its chairperson; the Minister of Economy and Finance, the Minister of Education, and the Minister of Gender Equality and Family shall serve as its vice chairpersons; and the remaining members shall be the following persons:
1. The Minister of Science and ICT;
2. The Minister of Foreign Affairs;
3. The Minister of Justice;
4. The Minister of the Interior and Safety;
5. The Minister of Culture, Sports and Tourism;
6. The Minister for Agriculture, Food and Rural Affairs;
7. The Minister of Trade, Industry and Energy;
8. The Minister of Health and Welfare;
9. The Minister of Environment;
10. The Minister of Land, Infrastructure and Transport;
11. The Minister of Oceans and Fisheries;
12. The Minister of Office for Government Policy Coordination;
13. The Administrator of Saemangeum Development and Investment Agency;
14. The Governor of Jeollabuk-do;
15. The president of the Organizing Committee (hereinafter referred to as the “president”);
16. Persons appointed or commissioned by the chairperson from among those who have much expert knowledge and experience in preparing and hosting the World Jamboree;
17. The heads of other institutions deemed necessary by the chairperson.
(3) The Support Committee shall have one executive secretary. In such cases, the executive secretary shall be designated by the chairperson from among the Senior Executive Service of the Ministry of Gender Equality and Family.
(4) A working committee for supporting the 2023 Saemangeum World Scout Jamboree (hereinafter referred to as "working committee") shall be established under the Support Committee to review and coordinate the agenda subject to deliberation and decision by the Support Committee and to deal with the matters delegated by the Support Committee. In such cases, the Vice Minister of Gender Equality and Family shall serve as the chairperson of the working committee.
(5) Except as provided in paragraphs (1) through (4), matters necessary for the composition and operation of the Support Committee and the working committee shall be prescribed by Presidential Decree.
 Article 23 (Formulation and Implementation of Plans for Establishment, Use, and Follow-Up of World Jamboree-Related Facilities)
(1) The Organizing Committee and the Governor of Jeollabuk-do (hereinafter referred to as the “Governor”) shall formulate a plan for the establishment, use, follow-up, etc. of the World Jamboree-related facilities (hereinafter referred to as “project plan”) for the successful hosting of the World Jamboree and obtain the approval of the plan from the Minister of Gender Equality and Family. In such cases, the Organizing Committee and the Governor shall consider the surrounding environmental conditions and geographical characteristics for the environment-friendly establishment and use of the World Jamboree-related facilities.
(2) Where the Minister of Gender Equality and Family intends to approve a project plan under paragraph (1), he or she shall consult in advance with the head of a relevant central administrative agency and report it to the Support Committee.
(3) When the Minister of Gender Equality and Family approves a project plan under paragraph (1), he or she shall send relevant documents to the head of the relevant central administrative agency, the president, and the Governor and publicly notify such fact.
(4) Matters necessary for the establishment, public notice, etc. of a project plan shall be prescribed by Presidential Decree.
(5) Paragraphs (2) through (4) shall apply mutatis mutandis to any modification to a project plan approved under paragraph (1): Provided, That this shall not apply to any modification to minor matters prescribed by Presidential Decree.
 Article 24 (Support for World Jamboree-Related Facilities)
(1) The State or a local government may subsidize all or part of the project costs necessary for the construction, remodeling, or repair of the World Jamboree-related facilities, including facilities to provide programs related to youth activities for the future global leaders.
(2) The State or a local government may preferentially implement projects for the World Jamboree-related facilities by adjusting their schedule to the period during which the World Jamboree is held, as prescribed by Presidential Decree.
 Article 25 (Special Cases concerning Approval of Project Plans)
When a project plan is approved, the following permission, etc. shall be deemed granted:
2. Formulation of and reporting on a medium-term local financial plan prescribed in Article 33 of the Local Finance Act and the appraisal of financial investment projects prescribed in Article 37 of that Act.
3. Permission, consultation, and approval prescribed in Articles 8, 10, 17, and 44 of the Public Waters Management and Reclamation Act;
 Article 26 (Application Mutatis Mutandis of Other Statutes)
The Special Act on Promotion and Support for Saemangeum Project shall mutatis mutandis to projects, etc. for creating a site for the World Jamboree.
CHAPTER IV PROHIBITION OF USE OF INSIGNIA AND SIMILAR NAMES
 Article 27 (Use of Insignia for the World Jamboree)
A person who intends to place an insignia, mascot, or any similar mark designated by the Organizational Committee which symbolizes the World Jamboree on a product, etc. or to use it for advertisement or any other commercial purposes shall obtain approval from the Organizing Committee: Provided, That this shall not apply where a right holder registered pursuant to the Trademark Act or the Design Protection Act uses such insignia, mascot, or mark.
 Article 28 (Prohibition Against Use of Similar Names)
No person, other than the Organizing Committee established under this Act, shall use the “Organizing Committee for the 2023 Saemangeum World Scout Jamboree" or any other name similar thereto.
 Article 29 (Delegation of Authority)
(1) The head of a central administrative agency may delegate part of the authority under this Act to the Governor, as prescribed by Presidential Decree.
(2) Where the Governor performs the affairs prescribed by Presidential Decree among those delegated pursuant to paragraph (1), he or she shall consult in advance with the heads of the relevant central administrative agencies.
(3) The Governor may delegate part of his or her authority under this Act to the heads of Sis/Guns, as prescribed by Presidential Decree.
(4) Where the heads of Sis/Guns perform the affairs prescribed by Presidential Decree among those delegated pursuant to paragraph (3), they shall consult in advance with the Governor.
 Article 30 (Legal Fiction as Public Officials for Purposes of Penalty Provisions)
The executive officers and employees of the Organizing Committee and those dispatched to the Organizing Committee from corporations or organizations pursuant to Article 17 (1) shall be deemed public officials for purposes of applying the penalty provisions pursuant to Articles 127 and 129 through 132 of the Criminal Act.
 Article 31 (Support for Activities of Youth Organizations)
The State, local governments, and the heads of relevant administrative agencies may provide support to train human resources and promote the activities of youth organizations for the successful hosting of the World Jamboree, according to the comprehensive plan for the World Jamboree.
CHAPTER V PENALTY PROVISIONS
 Article 32 (Penalty Provisions)
Any person who violates Article 27 shall be punished by imprisonment with labor for not more than five years or by a fine not exceeding 50 million won.
 Article 33 (Joint Penalty Provisions)
Where the representative of a corporation or an agent or employee of, or any other person employed by, the corporation or an individual commits any violation prescribed in Article 32 in connection with the business affairs of the corporation or individual, the corporation or individual shall, in addition to punishing the violators accordingly, be punished by a fine prescribed in the relevant Article: Provided, That this shall not apply where such corporation or individual has not been negligent in giving due attention to and supervision over the relevant business affairs to prevent such violation.
 Article 34 (Administrative Fines)
(1) A person who violates Article 28 shall be subject to an administrative fine of not more than three million won.
(2) Administrative fines under paragraph (1) shall be imposed and collected by the Minister of Gender Equality and Family, as prescribed by Presidential Decree.
ADDENDA
Article 1 (Enforcement Date)
This Act shall enter into force on the date of its promulgation: Provided, That the amended provisions of Article 2 (limited to facilities prescribed by Presidential Decree) and Articles 7 through 9, 13, 14, 16, 22, 23, 24 (2), 27, 29, 32, and 34 shall enter into force one year after the date of promulgation thereof.
Article 2 (Effective Period)
This Act shall remain effective until December 31, 2024.
