ENFORCEMENT DECREE OF THE SPECIAL ACT ON SUPPORT FOR THE 2023 SAEMANGEUM WORLD SCOUT JAMBOREE

Presidential Decree No. 30241, Dec. 10, 2019

 Article 1 (Purpose)
The purpose of this Decree is to prescribe matters mandated by the Special Act on Support for the 2023 Saemangeum World Scout Jamboree and those necessary for the enforcement thereof.
 Article 2 (World Jamboree-Related Facilities)
(1) "Facilities ... prescribed by Presidential Decree" in subparagraph 2 (h) of Article 2 of the Special Act on Support for the 2023 Saemangeum World Scout Jamboree (hereinafter referred to as the "Act") means the following facilities:
1. A stadium for the opening and closing ceremony;
2. Shading facilities;
3. Security facilities;
4. Other facilities so designated based on consultation between the Minister of Gender Equality and Family and the Organizing Committee for the 2023 Saemangeum World Scout Jamboree under Article 5 (1) of the Act (hereinafter referred to as the “Organizing Committee”).
(2) "Facilities ... prescribed by Presidential Decree" in subparagraph 3 (d) of Article 2 of the Act means the following facilities:
1. Parking lots;
2. Facilities for waste disposal;
3. Facilities for sewage disposal;
4. Other facilities determined by consultation between the Minister of Gender Equality and Family and the Organizing Committee.
 Article 3 (Procedures for Receipt of Donations)
(1) When the Organizing Committee receives donations pursuant to Article 7 (1) of the Act, it shall issue a receipt to a donor: Provided, That where donations are made anonymously or a donor is unknown, a receipt need not be issued.
(2) Where a donor under paragraph (1) specifies the purpose of donations, the Organizing Committee shall use the donations only for such purpose.
(3) Notwithstanding paragraph (2), where any extenuating circumstance makes it impracticable to use donations for the purpose specified by a donor, the Organizing Committee may use such donations for other purposes with the consent of the donor: Provided, That where it is impossible to obtain the consent of the donor for unavoidable reasons such as that donations are made anonymously or that a donor is unknown, the Organizing Committee may use them for other purposes after posting the relevant information on its bulletin board or website for at least seven days.
(4) The Organizing Committee shall create a separate account for donations specified in paragraph (1) to manage them.
(5) The Organizing Committee shall prepare financial record books regarding the status of the donations received, how they are used, etc., and make such books available for perusal by donors.
 Article 4 (Counter-Terrorism and Security Measures)
(1) The head of a relevant administrative agency that performs affairs related to the collection of information, security, anti-terrorism activities, etc. (hereafter in this Article referred to as the “head of the relevant administrative agency”) shall establish and operate an organization for counter-terrorism and security measures (hereinafter referred to as the “organization for counter-terrorism and security measures”) under Article 8 (2) of the Act.
(2) Where deemed necessary for performing the affairs of the organization for counter-terrorism and security measures, the head of the relevant administrative agency may request other central administrative agencies, local governments, public institutions, etc. to dispatch employees under their control or to provide other necessary cooperation.
(3) Affairs regarding counter-terrorism and security measures that are to be performed by the Organizing Committee and the organization for counter-terrorism and security measures under Article 8 (3) of the Act shall be as follows:
1. The Organizing Committee: The following affairs:
(a) Matters regarding security, access control, provision of information, etc. with regard to World Jamboree-related facilities;
(b) Matters regarding the safety of staff, participants, employees, etc. for the 25th World Scout Jamboree (hereinafter referred to as the “World Jamboree”);
2. The organization for counter-terrorism and security measures: The following affairs:
(a) Matters regarding the formulation and implementation of comprehensive counter-terrorism and security measures related to the World Jamboree;
(b) Matters regarding security, public safety, traffic management, etc. on the periphery of World Jamboree-related facilities;
(c) Matters regarding fire prevention, firefighting, rescue and emergency activities, etc. related to the World Jamboree;
(d) Handling of and support for other matters requested by the Organizing Committee to prevent terrorist acts and ensure safety.
(4) Except as provided in paragraphs (1) and (2), details necessary for the establishment and operation of the organization for counter-terrorism and security measures shall be determined by the head of the relevant administrative agency in consultation with the Organizing Committee.
 Article 5 (Operation and Management of Fund)
(1) The World Jamboree Fund established under Article 9 (1) of the Act (hereinafter referred to as the "Fund") shall be operated and managed by the Organizing Committee.
(2) The Fund shall be operated in the following manners:
1. Deposit in a bank defined in Article 2 (1) 2 of the Banking Act;
2. Purchase of Government bonds or public bonds.
(3) The Fund shall be used to cover the costs incurred in conducting projects reflected in the business plan and budget bill referred to in Article 19 of the Act.
 Article 6 (Profit-Making Projects)
(1) “Projects ... prescribed by Presidential Decree” in Article 13 (1) 4 of the Act means the following:
1. Projects to sell tickets to the World Jamboree;
2. Advertising programs (excluding outdoor advertising business under the Act on the Management of Outdoor Advertisements and Promotion of Outdoor Advertisement Industry);
3. Projects to sell tickets to cultural, artistic, and athletic events, etc. related to the World Jamboree;
4. Other projects deemed specifically necessary by the Organizing Committee for efficiently hosting and operating the World Jamboree.
(2) The Organizing Committee may grant part of the funds raised from profit-making projects to agencies, corporations, or organizations related to the World Jamboree with approval from the Minister of Gender Equality and Family under Article 13 (2) of the Act, in any of the following cases:
1. Where the following World Jamboree-related facilities are renovated or repaired:
(a) Facilities directly related to the World Jamboree;
(b) Water supply and drainage facilities under subparagraph 3 (c) of Article 2 of the Act and facilities for sewage disposal under Article 2 (2) 3 of this Decree;
2. Where subsidies are provided to domestic and foreign youths who are socially disadvantaged to help them cover the expenses incurred in their participation in the World Jamboree;
3. Where support is provided for cultural, artistic, and athletic events related to the World Jamboree;
4. Other cases such as where it is necessary for efficiently promoting profit-making projects.
 Article 7 (Service Charges)
Where the Organizing Committee intends to receive service charges or use fees under Article 16 of the Act, it shall submit a document stating the following to the Minister of Gender Equality and Family for approval:
1. Types and details of service charges or use fees;
2. Rates and calculation standards of service charges or use fees;
3. Methods and procedures for collecting service charges or use fees;
4. Other matters deemed necessary by the Minister of Gender Equality and Family for collecting service charges or use fees.
 Article 8 (Composition and Operation of Support Committee)
(1) The Government Support Committee for the 2023 Saemangeum World Scout Jamboree under Article 22 of the Act (hereinafter referred to as the "Support Committee") shall deliberate on and coordinate the following matters:
1. Matters regarding approval of a plan for the establishment, use, post-event use, etc. of World Jamboree-related facilities under Article 23 (1) of the Act (hereinafter referred to as "project plan");
2. Matters requiring government-wide support with regard to preparing and hosting the World Jamboree;
3. Other matters deemed necessary by the chairperson of the Support Committee with regard to the World Jamboree.
(2) The term of office of each member under Article 22 (2) 16 of the Act shall be three years.
(3) The chairperson of the Support Committee may dismiss or decommission a member under Article 22 (2) 16 of the Act in any of the following cases:
1. Where the member becomes unable to perform his or her duties due to mental or physical disability;
2. Where the member commits any misconduct in relation to his or her duties;
3. Where the member is deemed unsuitable as a member due to neglect of duties, loss of dignity, or any other reason;
4. Where the member voluntarily expresses his or her intention that it is difficult to perform his or her duties.
(4) When the chairperson of the Support Committee is unable to perform his or her duties due to any unavoidable reason, the Minister of Gender Equality and Family, the Minister of Economy and Finance, and the Minister of Education shall act on behalf of the chairperson in the order named, and when the chairperson and vice chairpersons of the Support Committee are all unable to perform their duties due to any unavoidable reason, a member in the order prescribed in the subparagraphs of Article 22 (2) of the Act shall act on his or her behalf.
(5) A majority of the members of the Support Committee shall constitute a quorum, and any decision thereof shall require the concurring vote of at least a majority of those present.
(6) Except as provided in paragraphs (1) through (5), details necessary for the composition and operation of the Support Committee shall be determined by the chairperson of the Support Committee based on committee decisions .
 Article 9 (Composition and Operation of Working Committee)
(1) The working committee for supporting the 2023 Saemanguem World Scout Jamboree under Article 22 (4) of the Act (hereinafter referred to as the “working committee”) shall be comprised of not more than 30 members, including one chairperson.
(2) Members of the working committee shall be the following persons:
1. One person each nominated by the head of the agency he or she belongs to, from among public officials who are members of the Senior Executive Service of the Ministry of Economy and Finance, the Ministry of Education, the Ministry of Science and ICT, the Ministry of Foreign Affairs, the Ministry of Justice, the Ministry of the Interior and Safety, the Ministry of Culture, Sports and Tourism, the Ministry of Agriculture, Food and Rural Affairs, the Ministry of Trade, Industry and Energy, the Ministry of Health and Welfare, the Ministry of Environment, the Ministry of Gender Equality and Family, the Ministry of Land, Infrastructure and Transport, the Ministry of Oceans and Fisheries, the Office for Government Policy Coordination, and the Saemangeum Development and Investment Agency; or from among public officials equivalent thereto;
2. The Vice-Governor for Administrative Affairs of Jeollabuk-do;
3. An executive member of the Organizing Committee in overall charge of the operation of the secretariat, who is nominated by the president of the Organizing Committee;
4. A person commissioned by the chairperson of the working committee with due consideration given to gender equality, from among those with extensive expertise and experience in preparing and hosting international competitions.
(3) The term of office of each member referred to in paragraph (2) 4 shall be three years.
(4) The person who has nominated or commissioned a member of the working committee may withdraw such nomination or decommission such member in any of the following cases:
1. Where the member becomes unable to perform his or her duties due to mental or physical disability;
2. Where the member commits any misconduct in relation to his or her duties;
3. Where the member is deemed unsuitable as a member due to neglect of duties, loss of dignity, or any other reason;
4. Where the member voluntarily expresses his or her intention that it is impracticable to perform his or her duties.
(5) A majority of the members of the working committee shall constitute a quorum, and any decision thereof shall require the concurring vote of at least a majority of those present.
(6) Except as provided in paragraphs (1) through (5), details necessary for the composition and operation of the working committee shall be determined by the chairperson of the working committee based on committee decisions.
 Article 10 (Formulation and Implementation of Project Plans)
(1) A project plan shall include the following:
1. Basic direction-setting for and overview of the project plan;
2. Plan to create sites related to the World Jamboree;
3. Locations and areas of World Jamboree-related facilities;
4. Plan to establish, construct, or create World Jamboree-related facilities;
5. Total project costs, annual investment plans, and funding plans;
6. Plan to use World Jamboree-related facilities after the event, and methods for raising operating costs;
7. Other matters deemed necessary based on consultation between the Organizing Committee and the Governor of Jeollabuk-do.
(2) Where deemed necessary for efficiently formulating and implementing project plans, the Organizing Committee and the Governor of Jeollabuk-do may request cooperation from the relevant central administrative agencies, local governments, public institutions, corporations, organizations, etc.
(3) Where the Minister of Gender Equality and Family publicly notifies a project plan under Article 23 (3) of the Act, he or she shall publish the plan in the Official Gazette or on the website of the Ministry of Gender Equality and Family.
(4) "Modification as to minor matters prescribed by Presidential Decree" in the proviso of Article 23 (5) of the Act means any of the following cases:
1. Where the area of World Jamboree-related facilities is modified by up to 10/100 of the total area;
2. Where project costs are modified by up to 10/100 of the total project costs;
3. Where the total project costs are modified due to changes in the price of commodities, changes in the method of construction, or settlement of accounts;
4. Where the project period is modified by up to six months;
5. Where the project plan is modified to utilize the existing facilities, other than those under such plan, as World Jamboree-related facilities (limited to where project costs are not modified).
 Article 11 (Support for World Jamboree-related Facilities)
(1) Where central administrative agencies or relevant local governments preferentially implement projects for World Jamboree-related facilities under Article 24 (2) of the Act, the relevant central administrative agencies or relevant local governments shall endeavor to swiftly assist with the costs related to such projects or to facilitate procedures for approval, permission, registration, reporting, etc.
(2) Where central administrative agencies or relevant local governments preferentially implement projects for World Jamboree-related facilities under Article 24 (2) of the Act, they shall endeavor to complete projects with regard to facilities directly related to the World Jamboree not later than one year before the World Jamboree is held.
(3) Where deemed necessary for preferentially implementing projects for World Jamboree-related facilities under Article 24 (2) of the Act, central administrative agencies or relevant local governments may hear the opinions of the Organizing Committee.
 Article 12 (Criteria for Imposition of Administrative Fines)
The criteria for the imposition of administrative fines under Article 34 (1) of the Act shall be as specified in the attached Table.
ADDENDA
Article 1 (Enforcement Date)
This Decree shall enter into force on December 19, 2019.
Article 2 (Effective Period)
This Act shall be effective until December 31, 2024.
