ACT ON ASSISTANCE TO AND COMMEMORATIVE PROGRAMS FOR MINERS, NURSES AND PRACTICAL NURSES SENT TO GERMANY

 Article 1 (Purpose)
The purpose of this Act is to provide for matters necessary to commemorate the hard work and sacrifice of miners, nurses and practical nurses who went to and worked in Germany as part of economic and technical cooperation between the Government of the Republic of Korea and the Government of the Federal Republic of Germany, and to conduct commemorative programs and to provide assistance commensurate with their distinguished service that contributed to the development of national economy.
 Article 2 (Persons Eligible for Assistance)
Persons eligible for assistance under this Act are:
1. Miners who went to Germany and provided labor for getting a wage during the period starting on December 21, 1963 and ending on December 31, 1977 under the Protocol on Economic and Technical Cooperation between the Government of the Republic of Korea and the Federal Republic of Germany signed in 1961 and the Korean-German Agreement on the Temporary Employment of Korean Miners signed in December 1963;
2. Nurses and practical nurses who went to Germany and provided labor for getting a wage during the period starting on January 29 1966 and ending on December 31, 1976 through job placement by the Korea Overseas Development Corporation and under the Agreement between the Korea Overseas Development Corporation and the German Hospitals Association signed in August 1969.
 Article 3 (Assistance to Eligible Persons)
(1) The State may provide persons eligible for assistance with the following assistance:
1. Basic information, including giving a person eligible for assistance information about social services necessary to live in the Republic of Korea or country in which the person resides;
2. Education or advice necessary to settle in the Republic of Korea;
3. Connection with an association or organization relevant to miners, nurses and practical nurses sent to Germany.
(2) The scope and methods of the assistance specified in the subparagraphs of paragraph (1) and other necessary matters shall be prescribed by Presidential Decree.
 Article 4 (Commemorative Programs)
(2) The State may conduct the following programs in respect of miners, nurses and practical nurses sent to Germany:
1. A commemorative program, such as building a memorial hall;
2. Collecting, preserving, managing, exhibiting, investigating and researching historical data;
3. Education, public-awareness campaign and academic activities;
4. Activities in Korea and overseas, including international exchanges and joint investigations;
5. Other programs incidental to the programs referred to in subparagraphs 1 through 4.
(2) Matters necessary to conduct the programs specified in paragraph (1) shall be prescribed by Presidential Decree.
 Article 5 (Subsidization)
Where a legal person or an organization that meets the requirements prescribed by Presidential Decree conducts the programs specified in the subparagraphs of Article 4 (1), the State may fully or partially subsidize expenses incurred in conducting the programs, within the budget.
 Article 6 (Entrustment of Functions)
Functions of the Minister of Employment and Labor under this Act may, in part, be entrusted to a related legal person or organization, as prescribed by Presidential Decree.

This Act shall enter into force one year after the date of its promulgation.
