| Article 3 (Jail Wardens, etc.) |
| (1) | The heads of correctional institutions, juvenile correctional institutions, detention centers or branches thereof shall perform the duties of senior judicial police officers (hereinafter referred to "senior judicial police officers") pursuant to Article 197 (1) of the Criminal Procedure Act in relation to offenses committed in the relevant correctional institutions, juvenile correctional institutions, detention centers or branches thereof. <Amended on Mar. 16, 2021> |
| (2) | The heads of juvenile reformatories or branches thereof, or the heads of juvenile classification review boards or branches thereof shall perform the duties of senior judicial police officers in relation to offenses committed in the juvenile reformatories or branches thereof, or the Juvenile Classification Review Center or branches thereof. |
| (3) | The heads of protective custody centers, or medical treatment and custody facilities or branches thereof shall perform the duties of senior judicial police officers in relation to offenses committed in protective custody centers, or medical treatment and custody facilities or branches thereof. |
| (4) | The national public officials of Grades IV through VII engaged in the duties of making a tour of inspection of correctional facilities pursuant to Article 8 of the Administration and Treatment of Correctional Institution Inmates Act shall perform the duties of senior judicial police officers in relation to offenses committed in the correctional facilities, and the national public officials of Grades 8 and 9 shall perform the duties of deputy judicial police officers (hereinafter referred to "junior judicial police officer") pursuant to Article 197 (2) of the Criminal Procedure Act in relation to such offenses. <Amended on Aug. 11, 2015; Mar. 16, 2021> |
| (5) | The national public officials of Grade IV through VII engaged in the duties of immigration shall perform the duties of senior judicial police officers in relation to any of the following offenses, and the national public officials of Grade VIII and IX shall perform the duties of junior judicial police officers in relation to such offenses: <Amended on Aug. 11, 2015> |
| 1. | An offense concerning documents under PART II Chapter XX of the Criminal Act and offense concerning seals under Chapter XXI of the same PART, which amounts to concurrent crimes with immigration violations; |
| 2. | An offense in violation of the Passport Act, which amounts to concurrent crimes with immigration violations; |
| 3. | An offense in violation of the Stowaways Control Act, which amounts to concurrent crimes with immigration violations. |

| Article 4 (Public Officials Engaged in Forest Protection) |
Persons who are to be in exclusive charge of forest protection at Korea Forest Service or its affiliated agencies (excluding Forest Aviation Headquarters), a Special Metropolitan City, Metropolitan City, Special Self-Governing City, Do, Special Self-Governing Province (hereinafter referred to as “Special Metropolitan City/Metropolitan Cities/Dos”), Si, Gun or Gu (referring to autonomous Gus; hereinafter the same shall apply), who are public officials of Grade VI and VII regarding whom the heads of their agency have made a report to the chief prosecutor of the relevant district prosecutors’ office shall perform the duties of senior judicial police officers, and the public officials of Grade VIII and IX shall perform the duties of junior judicial police officers. <Amended on May 4, 2010; Aug. 11, 2015>

| Article 5 (Judicial Police Officers by Designation of Chief Prosecutor) |

| 7. | National public officials of Grade VI through IX or local public officials of Grade IV through IX who work for a Si/Gun/Gu or an Eup/Myeon, performing the duty to protect forests and the duty to enforce the law on the specifications and quality of timber products; |
| 8. | National public officials or local public officials of Grade IV through IX who work for the Ministry of Food and Drug Safety, any of its affiliated agencies, the Special Metropolitan City, a Metropolitan City or Do, or a Si/Gun/Gu, performing the duty to enforce the law on food; |
| 9. | National public officials or local public officials of Grade IV through IX who work for the Ministry of Food and Drug Safety, any of its affiliated agencies, the Special Metropolitan City, a Metropolitan City or Do, or a Si/Gun/Gu, performing the duty to enforce the law on drugs, cosmetics and medical devices and the duty to enforce the law on tests and inspections conducted under the Act on Testing and Inspection in the Food and Drug Industry; |
| 10. | National public officials of Grade VI through IX who work in a lighthouse, performing the duty to manage the lighthouse; |
| 11. | National public officials of Grade 4IV through IX who work for the Ministry of Land, Infrastructure and Transport or any of its affiliated agencies, performing the duty of railroad policing; |
| 12. | Fire officers in the rank of fire sub-deputy chief and below; |
| 13. | National public officials of Grade VI through IX who work for a national school, performing the duty to protect the training forest or conservation forest of the school; |
| 14. | National public officials and local public officials of Grade IV through IX who work for the Cultural Heritage Administration, any of its offices, regional management offices or branches, the Hyeonchungsa Shrine Office, the Chilbaeguichong Shrine Office, the King Sejong Shrine Office, the Special Metropolitan City, a Metropolitan City or Do, or a Si/Gun/Gu, performing the duty to protect cultural heritage; |
| 15. | Measurement inspection officials prescribed under the Measures Act; |
| 16. | National public officials and local public officials of Grade IV through IX who work for any of the park management agencies referred to in Article 34 of the Natural Parks Act, performing the duty of park management under the same Act; |
| 17. | Customs officers who perform the duty to investigate customs duty evaders pursuant to the Customs Act; |
| 20. | Public officials of the Ministry of Patriots and Veterans Affairs or any of its affiliated agencies; |
| 21. | National public officials or local public officials of Grade IV through IX who work for the Ministry of Health and Welfare or any of its affiliated agencies, the Special Metropolitan City, a Metropolitan City or Do, or a Si/Gun/Gu, performing the following duties: |
| (d) | The duty to enforce the law on social service programs, social service facilities, and subsidies under the Social Services Act; |
| 22. | National public officials or local public officials of Grade IV through IX who work for the Ministry of Environment or any of its affiliated agencies, the Special Metropolitan City, a Metropolitan City or Do, or a Si/Gun/Gu, performing the duty to enforce the law on environment; |
| 23. | National public officials of Grade IV through IX who work for the Ministry of Science and ICT, any of its affiliated agencies, or Korea Communications Commission, performing the duty to enforce the law on radio systems, telecommunications systems, broadcasting and communications systems, wiretapping systems, business entities specialized in detecting unregistered, illegal wiretapping systems, equipment and materials for broadcasting and communications under Article 58-2 (1) of the Radio Waves Act, and advertising information for profit-making; |

| 28. | National public officials or local public officials of Grade IV through IX who work for Ministry of Agriculture, Food and Rural Affairs or any of its affiliated agencies, the Ministry of Oceans and Fisheries or any of its affiliated agencies, the Ministry of Food and Drug Safety or any of its affiliated agencies, the Special Metropolitan City, a Metropolitan City or Do, a Si/Gun/Gu, performing any of the following duties: |
| 29. | National public officials or local public officials of Grade IV through IX who work for the Ministry of Trade, Industry and Energy, the Special Metropolitan City, a Metropolitan City or Do, or a Si/Gun/Gu, performing the duty to enforce the law on the labeling of the country of origin pursuant to the Foreign Trade Act; |
| 30. | National public officials or local public officials of Grade IV through IX who work for the Ministry of Trade, Industry and Energy, the Special Metropolitan City, a Metropolitan City or Do, or a Si/Gun/Gu, performing the duty to approve raw materials and machinery for earning foreign currency and the duty to approve a change of the purpose of use of such materials and machinery; |
| 31. | National public officials or local public officials of Grade IV through IX who work for the Rural Development Administration, the National Institute of Agricultural Science and Technology, the Special Metropolitan City, a Metropolitan City or Do, or a Si/Gun/Gu, performing the duty to enforce the law on pesticides and fertilizers; |
| 32. | National public officials or local public officials of Grade IV through IX who work for the Ministry of Land, Infrastructure and Transport, the Special Metropolitan City, a Metropolitan City or Do, or a Si/Gun/Gu, performing the duty to monitor rivers; |

| 35. | Local public officials of Grade V through IX who work for the Special Metropolitan City, a Metropolitan City or Do, or a Si/Gun/Gu, performing the duty to enforce the law against unregistered auto maintenance shops, the failure to apply for the registration of a transfer of ownership of a vehicle, illegal abandonment of a vehicle, or the operation of a vehicle not insured with mandatory insurance; |

| 38-2. | National public officials of Grade IV through IX who work for the Korean Intellectual Property Office and performing the duty to enforce the law against infringement of patent rights or exclusive licenses; unfair competition practices; the acquisition, use, or disclosure of trade secrets; and infringement of design rights or exclusive licenses; |
| 39. | Local public officials of Grade IV through IX who work for the Special Metropolitan City, a Metropolitan City or Do, or a Si/Gun/Gu, performing the duty to enforce the law on passenger transport services and trucking transport businesses; |
| 41. | National public officials of Grade IV through IX who work for the Military Manpower Administration or any of its affiliated agencies, performing the duty to enforce the law against self-mutilation or fraud committed for the purpose of evading military service or being exempted from military service or the duty to conduct draft physical examinations or physical examinations pursuant to the Military Service Act; |
| 42. | National public officials or local public officials of Grade IV through IX who work for the Ministry of Agriculture, the Food and Rural Affairs or any of its affiliated agencies, the Korea Forest Service, the Special Metropolitan City, a Metropolitan City or Do, or a Si/Gun/Gu, performing the duty to investigate violations of plant variety rights under the Seed Industry Act and the Act on the Protection of New Varieties of Plants or the duty to investigate the distribution of seeds and other duties; |
| 43. | National public officials or local public officials of Grade IV through IX who work for the Ministry of the Interior and Safety or any of its affiliated agencies, the Special Metropolitan City, a Metropolitan City or Do, or a Si/Gun/Gu, performing the duty to conduct emergency safety inspections under Article 30 of the Framework Act on the Management of Disasters and Safety; |
| 44. | National public officials or local public officials of Grade IV through IX who work for the Ministry of Trade, Industry and Energy, the Special Metropolitan City, a Metropolitan City or Do, a Si/Gun/Gu, performing the duty to conduct inspections and enforce the law on petroleum and petroleum substitute fuels; |

| 49. | National public officials of Grade IV through IX who work for the Financial Service Commission, performing the duty to conduct investigations and enforce the law against unfair transactions in capital markets and other duties; |
| 50. | National public officials of Grade IV through IX who work for the Nuclear Safety and Security Commission or any of its affiliates, performing the duty to conduct investigations and enforce the law for nuclear safety management; |
| 51. | National public officials of Grade IV through IX who work for the Ministry of Employment and Labor or any of its affiliated agencies, performing the duty to enforce the law against fraudulent receipt of unemployment benefits, child-care leave benefits, maternity leave benefits, etc. under the Employment Insurance Act or fraudulent receipt of training fees, training allowances, etc. under the Act on the Development of Vocational Skills of Workers; |
| 53. | National public officials or local public officials of Grade IV through IX who work for the Ministry of Land, Infrastructure and Transport or any of its affiliated agencies, the Special Metropolitan City, a Metropolitan City or Do, or a Si/Gun/Gu, performing the duty to conduct investigations and enforce the law against illegal activities conducted in connection with real estate. |

| Article 6 (Scope of Duties and Investigative Jurisdiction) |
The scope of duties and investigative jurisdiction of persons who are to perform the duties of judicial police officers under Articles 4 and 5 shall be limited to the crimes as prescribed in the following subparagraphs: <Amended on Dec. 31, 2008; Apr. 22, 2009; Jun. 9, 2009; Jan. 1, 2010; Feb. 4, 2010; May 4, 2010; Apr. 28, 2011; May 19, 2011> May 30, 2011, Jul. 21, 2011; Jul. 28, 2011; Aug. 4, 2011; Sep. 15, 2011; Jan. 17, 2012; Feb. 1, 2012; Jun. 1, 2012;Jun. 4, 2013; Jul. 30, 2014; Dec. 30, 2014; Feb. 3, 2015; Aug. 11, 2015; Dec. 22, 2015; Jan. 6, 2016; May 29, 2016; Dec. 20, 2016; Jan. 17, 2017; Dec. 19, 2017; Dec. 18, 2018; Apr. 2, 2019; Aug. 27, 2019; Jan. 29, 2020; Dec. 8, 2020> | 1. | In cases of persons prescribed in subparagraph 1 of Article 5, offenses committed in the relevant correctional institutions, juvenile correctional institutions, detention centers or branches thereof; |

| 4. | In cases of persons prescribed in subparagraph 4 of Article 5, offenses committed in the relevant custody facilities or branches thereof; |
| 4-2. | In cases of persons prescribed in subparagraph 4-2 of Article 5, offenses prescribed in Article 38 or 39 of the Act on the Electronic Monitoring, which are committed by electronic device wearers within the jurisdiction of the agencies with which such persons are affiliated; |
| 5. | In cases of persons prescribed in Article 4 and subparagraphs 5 through 7 and 13 of Article 5, offenses under the following classifications: |
| (a) | Persons performing the duties of protecting and managing forests: offences committed in relation to forest managed by the agencies with which such persons are affiliated, and forest products and hunting thereof; |
| (b) | Persons performing the duties of controlling standards and quality of timber products: offences prescribed by the Act on the Sustainable Use of Timbers, which are committed within the jurisdiction of the agencies with which such persons are affiliated; |
| 6. | In cases of persons prescribed in subparagraph 8 of Article 5, offenses prescribed by the Food Sanitation Act, the Special Act on Imported Food Safety Control, or the Health Functional Foods Act and food sanitation offenses prescribed by the Act on Special Measures for the Control of Public Health Crimes, which are committed within the jurisdiction of the agencies with which such persons are affiliated; |
| 7. | In cases of persons prescribed in subparagraph 9 of Article 5, offenses prescribed by the Pharmaceutical Affairs Act, the Cosmetics Act, the Medical Devices Act, or the Act on Testing and Inspection in the Food and Drug Industry and pharmaceutical affairs-related offenses prescribed under the Act on Special Measures for the Control of Public Health Crimes, which are committed within the jurisdiction of the agencies with which such persons are affiliated; |
| 8. | In cases of persons prescribed in subparagraph 10 of Article 5, offenses committed in the lighthouse where he or she works; |

| (a) | Violations of the Customs Act; violations of the Licensed Customs Broker Act; violations of the Act on Special Cases concerning the Refund of Customs Duties, etc. Levied on Raw Materials for Export; violations of the Act on Special Cases of the Customs Act for the Implementation of Free Trade Agreements; violations of the Act on Designation and Management of Free Trade Zones; violations of the Special Act on Civil Affairs concerning the Implementation of the Agreement under Article IV of the Mutual Defense Treaty between the Republic of Korea and the United States of America, regarding Facilities and Areas and the Status of United States Armed Forces in the Republic of Korea; violations of the Foreign Trade Act; violations of Article 4 (1) 2 of the Act on the Investigation of Unfair International Trade Practices and Remedy against Injury to Industry; violations of intellectual property rights relating to the customs clearance and transshipment of imports and exports; violations related to the importation and exportation of the payment means or securities specified by the Foreign Exchange Transactions Act; violations related to the importation and exportation under the Foreign Exchange Transactions Act; violations of the Foreign Exchange Transactions Act in service transactions and capital transactions where payments or receipts are made by the method prescribed in subparagraph 3 or 4 of Article 16 of the same Act for exportation or importation or for the purpose of an alternative remittance system; violations of Article 8 (3) of the Foreign Exchange Transactions Act; and violations of the Foreign Exchange Transactions Act in which a person who has made any of the foreign exchange transactions specified in Article 8 (3) 1 of said Act, the other party to such transaction and other interested persons are involved, which are committed within the jurisdiction of the agencies with which such persons are affiliated; |
| (b) | Capital flight prescribed under Article 4 of the Act on the Aggravated Punishment of Specific Economic Crimes over offenses prescribed in item (a) committed within the jurisdiction of the agencies with which such persons are affiliated; |
| (c) | Violations of the Act on the Regulation and Punishment of Criminal Proceeds Concealment over offenses prescribed in items (a) and (b) committed within the jurisdiction of the agencies with which such persons are affiliated; |
| (d) | Narcotic or psychotropic drug offenses and cannabis offenses committed at the airports, ports and bonded areas where aircraft or vessels traveling between Korea and foreign countries arrive and depart in the jurisdiction of the agencies with which such persons are affiliated; |
| (e) | Crimes concerning documents under PART II Chapter XX of the Criminal Act and crimes concerning seals under Chapter XXI of the same PART which amount to concurrent crimes prescribed in item (a) committed within the jurisdiction of the agencies with which such persons are affiliated; |
| (f) | Violations of the Act on Origin Labeling of Agricultural and Fishery Products related to exports, imports, and goods processed with exports or imports (goods required to have a country of origin marking under Article 33 of the Foreign Trade Act) and violations of any provision of Articles 4 through 7, 8 through 10, and 12-2 of the Food Sanitation Act regarding imports; Articles 17-2 and 23 through 25 of the Health Functional Foods Act; Article 20 of the Special Act on Imported Food Safety Control; Articles 42, 43, 56 through 58, 61 (limited to the requirements specified in Articles 56 through 58 of the Pharmaceutical Affairs Act), 62 through 65, 65-2, 65-3, and 66 of the Pharmaceutical Affairs Act; Articles 7, 9, 10, 15, and 16 (1) 1 of the Cosmetics Act; and Articles 20 through 23 and 26 of the Medical Devices Act, which are committed within the jurisdiction of the agencies with which such persons are affiliated; |

| Article 7 (Captains and Seamen) |
| (1) | Captains shall perform the duties of senior judicial police officers in relation to offenses committed on a seagoing ship (that which is of a gross tonnage of 20 or more tons or of 36 or more cubic meters of loadage and has a coastline route or farther as its navigation area), and a person designated by the captain from among purser or seamen of deck, engine and clerical department shall perform the duties of junior judicial police officers. |
| (2) | Airline pilots and flight attendants shall perform the duties of senior judicial police officers and junior judicial police officers in relation to offenses committed on an airplane by applying paragraph (1) mutatis mutandis. |

| Article 10 (Autonomous Police Public Officials) |
Autonomous police chiefs, autonomous police assistant commissioner, autonomous police commanders, autonomous police majors, autonomous police captains and autonomous police lieutenants pursuant to the Special Act on the Establishment of Jeju Special Self-Governing Province and the Development of Free International City shall perform the duties of senior judicial police officers in relation to offenses prescribed in subparagraphs 5 (applicable only to the jurisdiction of the persons falling under subparagraphs 6 and 7 of Article 5), 6, 7, 11, 13, 15, 18, 19, 21, 22, 24, 25, 28, 29, 31, 32, and 41 through 46 of Article 6 of this Act, Articles 471 and 473 of the Special Act on the Establishment of Jeju Special Self-Governing Province and the Development of Free International City and Articles 477 and 478 of the same Act in relation thereto, and autonomous police sergeants, autonomous police detectives and autonomous police officers shall perform the duties of junior judicial police officers in relation to such offenses. <Amended on May 4, 2010; Jul. 24, 2015; Aug. 11, 2015> [This Article Wholly Amended on Jun. 13, 2008]

Article 4 (Transitional Measures following Amendment to the Court-Martial Act)
A person designated by the director of the Agency for National Security Planning as a senior judicial police officer or junior police officer pursuant to the Agency for National Security Planning Act as at the time this Act enters into force shall be deemed a senior military judicial police officer or junior military judicial police officer pursuant to the Court-Martial Act, and the duties of military judicial police officer performed as prescribed by the provisions of the previous Agency for National Security Planning Act shall be deemed to have been performed pursuant to the Court-Martial Act. <Act No. 3644, Dec. 31, 1982>
