 Article 1 (Purpose)
The purpose of this Decree is to prescribe matters regarding public holidays of government offices pursuant to the State Public Officials Act and the Act on Public Holidays. <Amended on Aug. 4, 2021>
 Article 2 (Public Holidays)
Public holidays of government offices shall be as follows: Provided, That public holidays of embassies and legations abroad shall be the public holidays of Korea, among its national holidays, and public holidays of residing nations: <Amended on Dec. 18, 1998; Jun. 30, 2005; Sep. 6, 2006; Dec. 28, 2012; Oct. 17, 2017>
1. Sundays;
2. The March 1st Independence Movement Day, Independence Day, National Foundation Day of Korea, and Hangul (the Korean alphabet) Day, among national holidays;
3. The first day of January;
4. The day preceding Seollal (Korean New Year's Day), Seollal, and the day following Seollal (the last day of December, and the first and second days of January according to the lunar calendar);
5. Deleted; <Jun. 30, 2005>
6. Buddha's Birthday (the eighth day of April according to the lunar calendar);
7. The fifth day of May (Children's Day);
8. The sixth day of June (Memorial Day);
9. The day preceding Chuseok (Korean Thanksgiving Day), Chuseok, and the day following Chuseok (14th, 15th, and 16th days of August according to the lunar calendar);
10. The 25th day of December (Christmas Day);
10-2. Election days for elections held on the termination of term of office referred to in Article 34 of the Public Official Election Act;
11. Other days occasionally designated by the Government.
 Article 3 (Alternative Public Holidays)
(1) Where a public holiday specified in any of subparagraphs 2 through 10 of Article 2 falls under any of the following cases, the first non-public holiday following the public holiday (referring to a day other than the public holidays under the subparagraphs of Article 2; hereinafter the same shall apply) shall be an alternative public holiday:
1. Where a public holiday under subparagraph 2 or 7 of Article 2 overlaps with a Saturday or Sunday;
2. Where a public holiday under subparagraph 4 or 9 of Article 2 overlaps with a Sunday;
3. Where a public holiday under subparagraph 2, 4, 7 or 9 of Article 2 is not a Saturday or Sunday and overlaps with any of the other public holidays listed in subparagraphs 2 through 10 of Article 2.
(2) Where the alternative public holiday under paragraph (1) overlaps on the same day, the alternative holidays shall last until the first non-public holiday following such alternative public holiday.
(3) Where the alternative public holiday under paragraphs (1) and (2) falls on a Saturday, the first non-public holiday thereafter shall be an alternative public holiday.

 Article 4 (Designation of Temporary Public Holidays)
Designation of public holidays under subparagraph 11 of Article 2 shall be deliberated upon by the State Council.

ADDENDUM <Presidential Decree No. 13155, Nov. 5, 1990>
This Decree shall enter into force on January 1, 1991.
ADDENDUM <Presidential Decree No. 15939, Dec. 18, 1998>
This Decree shall enter into force on January 1, 1999.
ADDENDA <Presidential Decree No. 18893, Jun. 30, 2005>
(1) (Enforcement Date) This Decree shall enter into force on the date of its promulgation.
(2) (Transitional Measures concerning the National Foundation Day of Korea among National Holidays) Notwithstanding subparagraph 2 of Article 2, the National Foundation Day of Korea shall remain a public holiday until December 31, 2007.

This Decree shall enter into force on the date of its promulgation: Provided, That the amended provisions of Article 1 shall enter into force on January 1, 2022.
