ENFORCEMENT DECREE OF THE POLAR ACTIVITIES PROMOTION ACT

Presidential Decree No. 32025, Oct. 5, 2021

 Article 1 (Purpose)
The purpose of this Decree is to prescribe matters mandated by the Polar Activities Promotion Act and those necessary for the enforcement thereof.
 Article 2 (Formulation and Modification of Master Plans for Promotion of Polar Activities)
(1) Where necessary to formulate a master plan for the promotion of polar activities (hereinafter referred to as "master plan") pursuant to Article 6 (1) of the Polar Activities Promotion Act (hereinafter referred to as the "Act"), the Minister of Oceans and Fisheries may request the heads of relevant central administrative agencies to submit materials.
(2) "Where any minor matters prescribed by Presidential Decree are modified" in the proviso of Article 6 (3) of the Act means any of the following cases:
1. Where the system of detailed tasks, the schedule of implementation, or a supervising agency or a relevant agency is modified without modifying the objectives of the master plan and of the detailed tasks included therein;
2. Where the master plan is modified to reflect the details according to the amendment to the Act or the enactment, amendment, or repeal of other statutes and regulations;
3. Where the master plan is modified to reflect the details of plans formulated under other statutes and regulations;
4. Where any miscalculations, misspelling, omission, or other obvious errors equivalent thereto are modified.
 Article 3 (Formulation of Action Plans for Promotion of Polar Activities)
(1) The Minister of Oceans and Fisheries may request the heads of the relevant central administrative agencies to submit action plans under their jurisdiction for the relevant year and materials on the progress of action plans of the preceding year by the end of February each year, to formulate action plans for the promotion of polar activities under Article 6 (4) of the Act (hereinafter referred to as "action plan").
(2) The action plans under each jurisdiction under paragraph (1) shall include the following:
1. Objectives and details of implementation in the relevant year relating to promotion of polar activities under each jurisdiction;
2. Detailed implementation plans relating to the objectives and details referred to in subparagraph 1.
(3) Upon receipt of materials submitted under paragraph (1), the Minister of Oceans and Fisheries shall prepare an action plan by compiling action plans under each jurisdiction and notify the head of each relevant central administrative agency thereof by May 31 of each year.
 Article 4 (Scope and Methods of Fact-Finding Surveys)
(1) The scope of a fact-finding survey under Article 7 (1) of the Act (hereinafter referred to as "fact-finding survey") shall be as follows:
1. Domestic and international trends relating to polar activities;
2. Current status of the progress of polar research and development projects;
3. Actual conditions of securing, operation, and development of the infrastructure, research equipment, etc. for polar activities;
4. Current status of experts engaged in polar research and actual conditions of operation of research institutes;
5. Other matters deemed necessary by the Minister of Oceans and Fisheries to conduct surveys for the promotion of polar activities.
(2) Fact-finding surveys may be conducted by means of literature reviews, on-site inspections, etc. In such cases, matters necessary for the methods, procedures, etc. for on-site inspections shall be prescribed by Ordinance of the Ministry of Oceans and Fisheries.
(3) Fact-finding surveys shall be conducted according to the following classification:
1. Regular survey: To be conducted in the preceding year of the year for formulating the master plan;
2. Occasional survey: To be conducted occasionally where deemed necessary by the Minister of Oceans and Fisheries to formulate and implement the master plan and action plans.
 Article 5 (Policies for Fostering Experts)
The Minister of Oceans and Fisheries may formulate and implement the following policies to foster polar experts under Article 9 of the Act:
1. Development and distribution of programs for training polar experts;
2. Expansion of facilities and fostering of teachers to provide education for polar experts;
3. Other policies necessary for fostering polar experts, such as education and training for polar experts.
 Article 6 (Facilities and Equipment for Polar Activities)
"Facilities and equipment necessary for polar activities prescribed by Presidential Decree" in Article 11 (1) 4 of the Act means the following:
1. Emergency evacuation facilities;
2. Facilities and equipment to prepare for emergency transportation situation, such as emergency aerial lighting facilities;
3. Facilities and equipment for observation of the surrounding environment of a polar science station;
4. Other facilities and equipment that the Minister of Oceans and Fisheries deems necessary for the operation of the infrastructure for polar activities.
 Article 7 (Safety Management of Infrastructure for Polar Activities)
(1) The Minister of Oceans and Fisheries shall prepare the safety management guidelines that include the methods, timing, and procedures for conducting safety inspections on the infrastructure for polar activities under Article 11 (1) of the Act and the facility user guide, and shall notify such guidelines to a person entrusted with the installation and operation of the infrastructure for polar activities pursuant to Article 10 (hereinafter referred to as "manager of the infrastructure for polar activities").
(2) The Minister of Oceans and Fisheries may, if necessary, request a manager of the infrastructure for polar activities to conduct a safety inspection in compliance with the safety management guidelines under paragraph (1).
 Article 8 (Utilization of Infrastructure for Polar Activities)
The Minister of Oceans and Fisheries may formulate a plan for the use of the infrastructure for polar activities for each facility after conducting a demand survey for the utilization and undergoing a review, for the utilization of the infrastructure for polar activities under Article 11 (2) of the Act.
 Article 9 (Investigation of Accidents Occurring in Polar Activities)
(1) Where any safety accident occurs in the course of polar activities or serious defects occur in the infrastructure for polar activities referred to in Article 11 (1) of the Act, the Minister of Oceans and Fisheries may investigate the details of the accident pursuant to Article 14 (2) of the Act.
(2) For the purpose of a prompt accident management and conduct of investigation, the Minister of Oceans and Fisheries may request the head of a supervising research institute or the manager of the infrastructure for polar activities to report on the safety accident or serious defects under paragraph (1) and to take emergency safety measures or other necessary measures, and may request the heads of the relevant central administrative agencies, such as the Ministry of Foreign Affairs, to provide cooperation.
 Article 10 (Entrustment of Duties)
(1) The Minister of Oceans and Fisheries may entrust any of the following duties to persons prescribed in paragraph (2), pursuant to Article 16 (2) of the Act:
1. Fact-finding surveys under Article 7 of the Act;
2. Implementation of policies to foster polar experts under Article 9 of the Act;
3. Installation and operation of the infrastructure for polar activities under Article 11 (1) of the Act;
4. Promotion of and support for activities for facilitating international cooperation under Article 12 of the Act;
5. Establishment and operation of the integrated polar information system under Article 13 of the Act;
6. Education and public relations under Article 15 of the Act.
(2) A person entitled to be entrusted with the duties under paragraph (1) shall be as follows:
2. A government-funded science and technology research institute under the Act on the Establishment, Operation and Fostering of Government-Funded Science and Technology Research Institutes;
3. The Korea Institute of Ocean Science and Technology and its affiliated institutions under the Korea Institute of Ocean Science and Technology Act;
4. The Korea Institute of Marine Science and Technology Promotion under Article 23 (1) of the Marine Science and Technology Promotion Act.
(3) Where the Minister of Oceans and Fisheries entrusts the duties pursuant to paragraphs (1) and (2), he or she shall publicly notify the entrusted institutions and the details of entrusted duties.
ADDENDUM <Presidential Decree No. 32025, Oct. 5, 2021>
This Decree shall enter into force on October 14, 2021.
