ENFORCEMENT DECREE OF THE ACT ON ASSISTANCE IN ENSURING MEAL SERVICE SAFETY IN SOCIAL WELFARE FACILITIES FOR SENIOR CITIZENS AND PERSONS WITH DISABILITIES

Presidential Decree No. 32816, Jul. 19, 2022

 Article 1 (Purpose)
The purpose of this Decree is to prescribe matters mandated by the Act on Assistance in Ensuring Meal Service Safety in Social Welfare Facilities for Senior Citizens and Persons with Disabilities and matters necessary for the enforcement thereof.
 Article 2 (Entrustment of Operation of Centers for Social Welfare’s Foodservice Management)
(1) The Special Metropolitan City Mayor, a Metropolitan City Mayor, a Special Self-Governing City Mayor, a Do Governor, or a Special Self-Governing Province Governor (hereinafter referred to as a "Mayor/Do Governor") or the head of a Si/Gun/Gu (the head of a Gu refers to the head of an autonomous Gu; hereinafter the same shall apply) may entrust the operation of a center for social welfare’s foodservice management to the following food-related corporations, institutions, or organizations under Article 5 (4) of the Act on Assistance in Ensuring Meal Service Safety in Social Welfare Facilities for Senior Citizens and Persons with Disabilities (hereinafter referred to as the “Act”):
1. Food-related government-funded research institutes established under the Act on the Establishment, Operation and Fostering of Government-Funded Research Institutes;
2. Universities or colleges, industrial colleges, or junior colleges under the Higher Education Act in which food-related departments are established;
3. Other food-related non-profit corporations or non-profit organizations determined and publicly notified by the Minister of Food and Drug Safety.
(2) Where a Mayor/Do Governor or the head of a Si/Gun/Gu entrusts the operation of a center for social welfare’s foodservice management pursuant to paragraph (1), he or she shall publicly notify the name of the entrusted institution, details of the entrusted affairs, and other relevant matters.
 Article 3 (Subsidization of Establishment and Operation of Centers for Social Welfare’s Foodservice Management)
The State or a local government may provide subsidies to cover the expenses incurred in the following under Article 5 (5) of the Act:
1. Wages of the dietitians and persons in charge of sanitation who work at centers for social welfare’s foodservice management;
2. Rents for the facilities of centers for social welfare’s foodservice management;
3. Education and guidance on, and management of, sanitation and nutrition of meal services for workers and users of social welfare meal service providers;
4. Other affairs related to the establishment and operation of centers for social welfare’s foodservice management.
 Article 4 (Subsidization of Operation of National Institute of Social Welfare Food and Nutrition Service)
The State may provide subsidies to cover the expenses incurred in the following under Article 6 (3) of the Act:
1. Wages of the workers of the National Institute of Social Welfare Food and Nutrition Service;
2. Rents for the facilities of the National Institute of Social Welfare Food and Nutrition Service;
3. Performance of the affairs prescribed in the subparagraphs of Article 6 (1) of the Act by the National Institute of Social Welfare Food and Nutrition Service.
 Article 5 (Delegation of Authority)
Pursuant to Article 10 of the Act, the Minister of Food and Drug Safety shall delegate to a Mayor/Do Governor his or her authority over guidance to and inspection of centers for social welfare’s foodservice management and social welfare meal service providers that receive assistance from such centers under Article 7 (2) of the Act.
ADDENDA <Presidential Decree No. 32816, Jul. 19, 2022>
Article 1 (Enforcement Date)
This Decree shall enter into force on July 28, 2022.
Article 2 (Transitional Measures concerning Entrustment of Operation of Centers for Social Welfare’s Foodservice Management)
A corporation, an institution, or an organization which is entrusted by a Mayor/Do Governor or the head of a Si/Gun/Gu with the management of and assistance in group meal services used by socially vulnerable groups, such as senior citizens and persons with disabilities, as at the time this Decree enters into force shall be deemed a corporation, an institution, or an organization entrusted under Article 2 (1) and (2) until the period of the previous contract for entrustment expires.
