INTERNATIONAL CULTURAL EXCHANGE PROMOTION ACT

Presidential Decree No. 33886, Nov. 21, 2023

 Article 1 (Purpose)
The purpose of this Decree is to prescribe matters mandated by the International Cultural Exchange Promotion Act and matters necessary for its enforcement.
 Article 5 (Formulation of Comprehensive Plans to Promote International Cultural Exchanges)
(1) If the Minister of Culture, Sports and Tourism intends to formulate a comprehensive plan for the promotion of international cultural exchange pursuant to Article 5 (1) of the International Cultural Exchange Promotion Act (hereinafter referred to as "the Act") (hereinafter referred to as "comprehensive plan"), the Minister shall collect opinions from the heads of relevant central administrative agencies and persons with specialized knowledge and abundant experience in international cultural exchange. The same shall apply to any modifications of the comprehensive plan.
(2) Where the Minister of Culture, Sports and Tourism establishes or changes a comprehensive plan, he/she shall announce the details thereof on the website of the Ministry of Culture, Sports and Tourism without delay.
(3) Except as otherwise provided for in paragraphs (1) and (2), matters necessary for the formulation and modification of a comprehensive plan shall be prescribed by Ministerial Decree of Culture, Sports and Tourism.
 Article 3 (Formulation of Action Pans for Promotion of International Cultural Exchange)
(1) The Minister of Culture, Sports and Tourism shall formulate an action plan for promoting international cultural exchange (hereinafter referred to as “action plan”) pursuant to Article 6 (1) of the Act by the end of February every year.
(2) An action plan shall include the following matters:
1. Performance of the previous year’s action plan;
2. Prospects and directions for international cultural exchange in the relevant year;
3. Detailed implementation plans for international cultural exchanges by country and sector for the relevant year;
4. Other matters deemed necessary by the Minister of Culture, Sports and Tourism to promote international cultural exchange.
(3) When the Minister of Culture, Sports and Tourism formulates or modifies an action plan, he/she shall publicly announce the details thereof on the website of the Ministry of Culture, Sports and Tourism without delay.
(4) Except as otherwise provided for in paragraphs (1) and (2), matters necessary for formulating and modifying an action plan shall be prescribed by Ministerial Decree of Culture, Sports and Tourism.
 Article 4 (Submission of Regional Plans for Promotion of International Cultural Exchange)
(1) The Special Metropolitan City Mayor, Metropolitan City Mayor, Special Self-Governing City Mayor, Do Governor, and Special Self-Governing Province Governor (hereinafter referred to as "Mayor/Do Governor") shall, pursuant to Article 7 (2) of the Act, submit a regional plan for the promotion of international cultural exchange for the relevant year (hereinafter referred to as "regional plan") and the performance of the previous year‘s plan to the Minister of Culture, Sports and Tourism by January 31 of each year.
(2) Where a comprehensive plan is formulated or modified, the Mayor/Do Governor shall reflect the relevant details in the regional plan under his/her jurisdiction.
 Article 5 (Support for Nurturing Professional Manpower)
The Minister of Culture, Sports and Tourism and the Mayor/Do Governor shall promote the following projects for nurturing professional manpower related to international cultural exchange pursuant to Article 9 (1) of the Act:
1. Support for developing programs and teaching materials necessary for nurturing professional manpower;
2. Support for education, training, research, etc. necessary for nurturing professional manpower;
3. Other support projects recognized by the Minister of Culture, Sports and Tourism or the Mayor/Do Governor as necessary for nurturing professional manpower.
 Article 6 (Fact-Finding Survey)
(1) The fact-finding survey pursuant to Article 10 (1) of the Act (hereinafter referred to as “fact-finding survey”) shall include the following matters:
1. Current status of international cultural exchange activities and projects by public institutions, private organizations, etc.;
2. Current status of public institutions' support for international cultural exchange activities in the private sector;
3. Current status of professional manpower specialized in international cultural exchange;
4. International trends in international cultural exchange.
(2) The fact-finding survey shall be conducted by dividing it into a regular survey and an ad hoc survey, and the regular survey shall be conducted every three years, and the ad hoc survey shall be conducted when the Minister of Culture, Sports and Tourism deems it necessary for the formulation and implementation of a comprehensive plan and action plan.
 Article 7 (Establishment and Operation of International Cultural Exchange Information System)
The scope and content of information related to international cultural exchange pursuant to Article 11 (1) of the Act are as follows:
1. Information on comprehensive plans, action plans, and regional plans;
2. Results and statistics of fact-finding survey;
3. Various other information that may help promote international cultural exchange between countries.
 Article 8 (Requirements for Designation of Dedicated Agency)
(1) The Minister of Culture, Sports, and Tourism may designate an institution, corporation, or organization that is recognized to satisfy all of the following requirements as an agency exclusively in charge of promoting international cultural exchange pursuant to Article 12 (1) of the Act (hereinafter referred to as the "dedicated agency"): <Amended on Aug. 9, 2022; Nov. 21, 2023>
1. It shall be an institution, corporation, or organization related to culture;
2. A person who satisfies each of the following requirements, who has at least 8 persons of professional manpower (including at least 1 business manager) who are exclusively in charge of the business affairs of a dedicated agency:
(a) Business manager (team leader level): A person who falls under any of the following:
i) A person who has obtained a master's degree or higher in the culture-related field and has at least 3 years of experience working in international cultural exchange (including experience before obtaining a degree);
ii) A person who has acquired a bachelor's degree in the culture-related field (including cases where the same level of education has been obtained in accordance with the statutes and regulations) and has at least 5 years of experience working in international cultural exchange (including experience before obtaining the degree);
iii) A person with more than 7 years of experience working for the international cultural exchange affairs at an organization related to international cultural exchange, international development cooperation, etc.;
(b) Employees other than a business manager (team members): A person with at least 1 year of experience of engaging in international cultural exchange affairs at an organization related to international cultural exchange, international development cooperation, etc.;
3. A person shall secure an office and equipment to carry out the business affairs.
(2) Any institution, corporation or organization that wishes to be designated as a dedicated agency pursuant to Article 12 (1) of the Act shall submit an application for designation in the form prescribed by Ministerial Decree of Culture, Sports and Tourism to the Minister of Culture, Sports and Tourism.
(3) When the Minister of Culture, Sports and Tourism designates a dedicated agency pursuant to Article 12 (1) of the Act, he/she shall issue to the applicant a letter of designation of a dedicated agency prescribed by Ministerial Decree of Culture, Sports and Tourism and publicly announce the fact on the website of the Ministry of Culture, Sports and Tourism.
(4) If the Minister of Culture, Sports and Tourism cancels the designation of a dedicated agency pursuant to Article 12 (3) of the Act, he/she shall notify the relevant institution, corporation or organization of the fact, and publicly announce it on the website of the Ministry of Culture, Sports and Tourism.
(5) The head of the dedicated agency shall submit the following matters to the Minister of Culture, Sports and Tourism by December 31 of each year:
1. Next year‘s promotion plan for a project specified in each subparagraph of Article 12 (2) of the Act;
2. Next year's execution plan for the subsidies for expenses received pursuant to Article 12 (4) of the Act.
(6) Except as otherwise provided for in paragraphs (1) through (5), matters necessary for the designation, operation, etc. of a dedicated agency shall be prescribed and publicly notified by the Minister of Culture, Sports and Tourism.
 Article 9 (Subsidization for Expenses)
The Minister of Culture, Sports and Tourism may provide subsidies for the expenses incurred in the following projects pursuant to Article 13 (1) of the Act:
1. Research and academic projects and activities by related institutions, academic societies, etc. for the promotion of international cultural exchange;
2. Maintenance and management of related facilities to promote international cultural exchange;
3. Other projects and activities deemed necessary by the Minister of Culture, Sports and Tourism to promote international cultural exchange.
 Article 10 (Reward)
(1) Pursuant to Article 14 (1) of the Act, the Minister of Culture, Sports and Tourism may select and award the institutions, corporations, organizations and individuals that fall under any of the following subparagraphs:
1. A person who has contributed to promoting mutual cultural understanding between the countries through international cultural exchange projects;
2. A person who has contributed to the promotion of international cultural exchange through the research on international cultural exchange or nurturing of professional manpower, etc.
(2) The Minister of Culture, Sports, and Tourism may receive nominations from the institutions, corporations, organizations, and individuals related to international cultural exchange when granting awards under Article 14 (1) of the Act.
(3) The Minister of Culture, Sports and Tourism shall publicly announce the content, standards, methods, and procedures of awards under paragraphs (1) and (2) on the website of the Ministry of Culture, Sports and Tourism by December 31 each year.
 Article 11 (Entrustment of Authority)
(1) The Minister of Culture, Sports and Tourism may entrust the following business affairs to a dedicated agency pursuant to Article 16 (2) of the Act:
1. Affairs related to the nurturing of professional manpower under Article 9 (1) of the Act;
2. Affairs related to fact-finding survey and statistical compilation on international cultural exchange pursuant to Article 10 (1) of the Act;
3. Affairs related to the establishment and operation of the international cultural exchange information system pursuant to Article 11 (1) of the Act;
4. Affairs related to subsidization to cover the expenses incurred by projects, activities, or facilities that are aimed at promoting international cultural exchange under Article 13 (1) of the Act.
(2) When the Minister of Culture, Sports and Tourism entrusts the business affairs pursuant to paragraph (1), he/she shall publicly notify the dedicated agency entrusted with the business affairs and the details of the entrusted affairs.

This Decree shall enter into force on September 22, 2017.
