ENFORCEMENT DECREE OF THE ACT ON SPECIAL CASES CONCERNING THE ENCOURAGEMENT OF LEARNING ON PUBLIC HEALTH

 Article 1 (Purpose)
The purpose of this Decree is to prescribe matters mandated by the Act on Special Cases concerning the Encouragement of Learning on Public Health (hereinafter referred to as the "Act") and matters necessary for the enforcement thereof.
 Article 2 (Public health services)
The scope of "public health services" under Article 2 of the Act shall be as follows: <Amended on Feb. 28, 1984; Dec. 23, 1994; Feb. 29, 2008; Mar. 15, 2010; Dec. 29, 2010>
1. Public health services in medically underserved areas, such as outlying regions, remote areas, and islands;
2. Services of public health institutions;
3. Public health services in areas prone to infectious diseases;
4. Other public health services that the Minister of Health and Welfare deems particularly necessary in light of medical policies.
 Article 3 (Fixed number of scholarship students)
(1) The fixed number of scholarship students under Article 3 (1) of the Act shall be determined by the Minister of Health and Welfare every year within the budget, in consideration of the number of personnel required to provide public health services under the subparagraphs of Article 2. <Amended on Dec. 23, 1994; Feb. 29, 2008; Mar. 15, 2010; Jan. 5, 2021>
(2) The Special Metropolitan City Mayor, a Metropolitan City Mayor, a Special Self-Governing City Mayor, a Special Self-Governing Province Governor, a Do Governor, or a Special Self-Governing Province Governor shall annually notify the Minister of Health and Welfare of the number of personnel required for performing public health services under the subparagraphs of Article 2 within his or her jurisdiction by the end of January of the relevant year. <Amended on Nov. 16, 2023>

 Article 4 (Expenses necessary for studying)
The scope of "expenses necessary for studies such as tuition" referred to in Article 3 (2) of the Act shall include tuition, school supplies, school uniforms, transportation expenses, textbooks and materials, and other expenses such as room and board.
 Article 5 (Relatives and joint signature with relatives)
A relative referred to in Article 4 (1) of the Act shall be the one referred to in Article 777 of the Civil Act, and the joint signatures shall be from either a relative or a legal representative of the applicant and from the applicant himself or herself.
 Article 6 (Application for scholarship payment)
(1) The dean of a university or college with which scholarship students selected pursuant to Article 5 (1) of the Act are affiliated (hereinafter referred to as "dean") shall file applications with the Minister of Health and Welfare for the payment of scholarships with respect to all the scholarship students affiliated with the university or college by one month prior to the commencement of each quarter; provided, an application for the 1st quarter scholarship shall be filed in February. <Amended on Dec. 23, 1994; Feb. 29, 2008; Mar. 15, 2010>
(2) Upon receipt of an application for scholarship payment under paragraph (1), the Minister of Health and Welfare shall grant scholarships to all scholarship students in a lump sum to the relevant dean. <Amended on Dec. 23, 1994; Feb. 29, 2008; Mar. 15, 2010>
(3) The dean granted with scholarships from the Minister of Health and Welfare shall pay the tuitions of the scholarship students out of the scholarships on their behalf, and shall pay the remainder of the scholarships to the scholarship students on a monthly basis. <Amended on Dec. 23, 1994; Feb. 29, 2008; Mar. 15, 2010>
 Article 7 (Period to fulfill license conditions)
(1) The length of the period to fulfill the license conditions under the proviso of Article 6 (1) of the Act shall be the same as the length of the period during which a scholarship is paid; provided, if the period during which a scholarship is paid is less than 2 years, the period to fulfill the license conditions shall be 2 years, and if the period exceeds 5 years, the period to fulfill the license conditions shall be 5 years.
(2) If a person who fulfills the license conditions pursuant to Article 6 (1) of the Act works in a medically underserved area designated by the Minister of Health and Welfare, such as outlying regions, remote areas, and islands, the period to fulfill such conditions may be shortened by up to 1/4 of the period of service in such medically underserved area; provided, if the period resulting therefrom becomes less than 2 years, the period to fulfill such conditions shall be 2 years. <Amended on Dec. 23, 1994; Feb. 29, 2008; Mar. 15, 2010>
 Article 7-2 (Exemption from fulfillment of conditions)
A person who intends to be exempted from performing conditions of a conditional license under Article 6 (3) of the Act shall file an application for exemption with the Minister of Health and Welfare, as prescribed by Ministerial Decree of Health and Welfare. <Amended on Dec. 23, 1994; Feb. 29, 2008; Mar. 15, 2010>

 Article 8 (Grounds for inability to fulfill license conditions)
“Unavoidable cause” referred to in Article 6 (2) 4 of the Act means cases where it is impossible to fulfill the license conditions due to a natural disaster.
 Article 9 (Procedures for return of national funds)
(1) The Minister of Health and Welfare shall issue a notice requiring the return of the amount calculated pursuant to Article 9-2, within 2 weeks from the date on which the payment of a scholarship is suspended, to a person whose scholarship payment is suspended because he or she falls under Article 7 (2) 2 through 7 of the Act; from the date the final successful candidates are announced, to a person who receives a scholarship but fails to pass a national examination for a doctor, dentist, or nurse within 3 years after graduation; from the date on which his or her license is revoked for violating the license conditions, to a person who fails to fulfill the license conditions, in violation of Article 6 (2) of the Act; from the date his or her license is revoked, to a person whose license as a doctor, dentist, or nurse is revoked within the period to fulfill the license conditions under Article 6 (1) of the Act. <Amended on Feb. 28, 1984; Aug. 7, 1989; Dec. 23, 1994; Feb. 29, 2008; Mar. 15, 2010>
(2) The period for payment of the amount to be returned pursuant to paragraph (1) shall be 90 days from the date of issuance of the notice.
 Article 9-2 (Computation of amount of national funds required to be returned)
(1) The amount of scholarships required to be returned to the National Treasury under Article 8 (1) and (2) of the Act shall be as follows:
1. In cases falling under Article 8 (1) of the Act:
It shall be the amount of the scholarship paid plus the statutory interest thereon;
2. In cases falling under Article 8 (2) of the Act:
It shall be the amount calculated by the following formula:

(2) The statutory interest to be added pursuant to paragraph (1) shall be calculated based on the number of days from the date on which the scholarship is paid to the date on which the grounds for returning the scholarship arise and the statutory interest rate under the Civil Act; provided. the period of military service under the Military Service Act, the period of fulfillment of obligations under other statutes, the period during which license conditions are met, and the grace period for the fulfillment of conditions under Article 6 (2) of the Act shall not be included.

 Article 10 (Disposition on default of amount required to be returned)
If a person fails to return the amount required to be returned within the payment period under Article 9 (2), the Minister of Health and Welfare shall issue a demand note with a specified period of at least 10 days. <Amended on Feb. 29, 2008; Mar. 15, 2010>

 Article 11 (Deferment of performance of conditions)
A person required to file a report under Article 9 (3) of the Act may directly file a report to the Minister of Health and Welfare, if his or her workplace is yet to be determined. <Amended on Dec. 23, 1994; Feb. 29, 2008; Mar. 15, 2010>

 Article 11-2 (Processing of personally identifiable information)
The Minister of Health and Welfare may process data including resident registration numbers under Article 19 (1) of the Enforcement Decree of the Personal Information Protection Act, if necessary to perform the following business affairs:
1. Business affairs regarding applications for scholarship students under Article 4 (1) of the Act;
2. Business affairs regarding exemption from performance of conditions under Article 6 (3) of the Act.

 Article 12 (Delegation provisions)
