The purpose of this Decree is to prescribe matters mandated by the Dental Health Act and matters necessary for the enforcement thereof. <Amended on Oct. 29, 2015>
Article 2 (Details of master plans for dental health programs) |
(1) | “Other programs prescribed by Presidential Decree in connection with dental health programs” in Article 5 (2) 8 of the Dental Health Act (hereinafter referred to as the "Act") means the following programs: |
1. | Programs for training and supply of and demand for human resources related to dental health; |
2. | Public relations programs for dental health; |
3. | Programs for evaluating dental health programs; |
4. | Other programs deemed necessary by the Minister of Health and Welfare, such as international cooperation on dental health. |
(2) | “Where he or she intends to amend any of the minor matters prescribed by Presidential Decree” in the proviso of Article 5 (3) of the Act means where the details of any of the following programs are amended: |
1. | A capability building program for human resources related to dental health under Article 5 (2) 7 of the Act; |
2. | A program falling under any subparagraph of paragraph (1). |

Article 3 (Implementation of dental health programs) |
The Minister of Health and Welfare, the Special Metropolitan City Mayor, a Metropolitan City Mayor, a Special Self-Governing City Mayor, a Do Governor, a Special Self-Governing Province Governor (hereinafter referred to as "Mayor/Do Governor"), or the head of a Si/Gun/Gu (referring to the head of an autonomous Gu; hereinafter the same shall apply) shall endeavor to secure human resources and finance necessary for implementing dental health programs under Article 7 (1) of the Act. <Amended on Feb. 29, 2008; Mar. 15, 2010; Oct. 29, 2015>
Article 4 (Timing and methods for conducting fact-finding surveys on dental health) |
(1) | Fact-finding surveys on citizens’ dental health under Article 9 of the Act shall be regularly conducted every 3 years by classifying them into a survey on dental health conditions and a survey on the awareness of dental health. <Amended on Oct. 29, 2015> |
(2) | The survey on dental health conditions under paragraph (1) shall include the following matters: <Amended on Oct. 29, 2015; Jul. 2, 2019> |
1. | Health conditions of the teeth; |
2. | Periodontal health conditions; |
4. | Other matters regarding dental health conditions, such as tooth mottling. |
(2) | The survey on the awareness of dental health under paragraph (1) shall include the following matters: <Amended on Oct. 29, 2015> |
1. | Knowledge about dental health; |
2. | Attitudes toward dental health; |
3. | Conduct for dental health; |
4. | Other matters regarding the awareness of dental health. |
(4) | The survey on the dental health conditions and the survey on the awareness of dental health under paragraph (1) shall be conducted on a sampling basis, but the former shall be conducted through a direct oral examination, and the latter shall be conducted through interviews. <Amended on Oct. 29, 2015> |
(5) | Except as provided in this Decree, matters necessary for fact-finding surveys on dental health shall be separately determined by the Commissioner of the Korea Disease Control and Prevention Agency. <Amended on Feb. 29, 2008; Mar. 15, 2010; Sep. 11, 2020> |
Article 5 (Public announcement on plans for programs to adjust fluorine concentration of tap water) |
The Mayor/Do Governor, the head of a Si/Gun/Gu, or the President of the Korea Water Resources Corporation who intends to implement or suspend a program to adjust the fluorine concentration of tap water pursuant to Article 10 of the Act shall publicly announce the following matters regarding the plan for the program to adjust the fluorine concentration of tap water in a public gazette and a daily newspaper mainly distributed in the relevant area for at least 3 weeks and, if necessary, publicly announce such matters by effective means, such as website and broadcasting. <Amended on Feb. 28, 2004; Oct. 29, 2015> 1. | The purpose of implementing the program to adjust the fluorine concentration of tap water or the grounds for suspension thereof; |

4. | Other matters deemed necessary for gathering consensus from residents. |

Article 6 (Submission of program plans in relation to supporting programs to adjust fluorine concentration of tap water) |
The Mayor/Do Governor, the head of a Si/Gun/Gu, or the President of the Korea Water Resources Corporation who intends to receive technical and financial support necessary for formulating and implementing a plan for a program to adjust the fluorine concentration of tap water pursuant to Article 10 (3) of the Act shall submit the plan to the Minister of Health and Welfare. Article 7 (Revision of plans for programs to adjust fluorine concentration of tap water) |
If the Minister of Health and Welfare in receipt of a plan for a program to adjust the fluorine concentration of tap water pursuant to Article 6 deems it necessary to revise the plan after review, he or she may notify the relevant Mayor/Do Governor, the head of the relevant Si/Gun/Gu, or the President of the Korea Water Resources Corporation of the review results. <Amended on Feb. 28, 2004; Feb. 29, 2008; Mar. 15, 2010; Oct. 29, 2015> [Title Amended on Feb. 28, 2004]
Article 8 (Technical support team for programs to adjust fluorine concentration of tap water) |
(1) | The Minister of Health and Welfare shall establish a technical support team for programs to adjust the fluorine concentration of tap water in the Ministry of Health and Welfare to provide technical support to Mayors/Do Governors, the heads of Sis/Guns/Gus, or the President of the Korea Water Resources Corporation who implement programs to adjust fluorine concentration of tap water. <Amended on Feb. 28, 2004; Feb. 29, 2008; Mar. 15, 2010> |

Article 9 (School dental health education) |

Article 11 (Concentration of Fluorine Solution) |
The concentration of fluorine solution and the frequency of fluoride application necessary for a fluoride mouth-rinsing program under Article 12 (1) 4 of the Act shall be prescribed by Ministerial Decree of Health and Welfare. [This Article Wholly Amended on Oct. 29, 2015]
Article 12 (Continuous dental health management) |
If the head of a school provides students with continuous dental health care under Article 12 (1) 5 of the Act, he or she shall include matters regarding the prevention of dental diseases, early treatment, etc. <Amended on Oct. 29, 2015> [Title Amended on Oct. 29, 2015]
Article 13 (Contents of workplace dental health education) |
The following matters shall be included in the dental health education provided by an employer of a workplace to workers of the relevant workplace pursuant to Article 14 of the Act; provided, the matters referred to in subparagraphs 2 through 5 shall be limited to cases of dental health education for workers prescribed by Ministerial Decree of Health and Welfare for whom it is deemed that there is a risk of occupational dental disease: <Amended on Feb. 29, 2008; Mar. 15, 2010; Oct. 29, 2015> 2. | Types of occupational dental diseases; |

Article 14 (Workplace dental examination) |
(2) | If necessary for the management of dental health of employees engaged in business affairs prone to the occurrence of dental diseases, such as dental corrosion, the employer of a workplace may commission a dentist with extensive knowledge in industrial dental health. |

Article 15 (Scope of dental health programs for senior citizens) |
(1) | The scope of dental health programs for senior citizens implemented by the State and a local government pursuant to Article 15 (2) of the Act shall be as follows: |
1. | Dental health education programs for senior citizens; |
2. | Dental examination programs for senior citizens; |
3. | Other programs deemed necessary for promoting the dental health of senior citizens. |
(2) | The details of dental health education programs for senior citizens and dental examination programs for senior citizens under paragraph (1) shall be as specified in Appendix 1. |

Article 16 (Scope of dental health programs for persons with disabilities) |
(1) | The scope of dental health programs for persons with disabilities implemented by the State and a local government pursuant to Article 15 (2) of the Act shall be as follows: |
1. | Dental health education programs for persons with disabilities; |
2. | Dental examination programs for persons with disabilities; |
3. | Other programs deemed necessary for promoting the dental health of persons with disabilities. |
(2) | The details of dental health education programs for persons with disabilities and dental examination programs for persons with disabilities under paragraph (1) shall be as specified in Appendix 1. |

Article 17 (Business affairs of Association) |
The business affairs of the Korea Dental Health Association under Article 19 (1) of the Act (hereinafter referred to as the "Association") shall be as follows: <Amended on Oct. 29, 2015> 1. | Prevention of and investigation into dental diseases; |
2. | Education and public relations on dental health; |
3. | Education and public relations on good foods for healthy teeth; |
