ENFORCEMENT DECREE OF THE SPECIAL ACT ON IMPROVEMENT OF PUBLIC HEALTH AND WELFARE OF RESIDENTS IN AGRICULTURAL AND FISHING VILLAGES

 Article 1 (Purpose)
The purpose of this Decree is to prescribe matters delegated by the Special Act on Improvement of Public Health and Welfare of Residents in Agricultural and Fishing Villages and matters necessary for the enforcement thereof.

 Article 2 (Persons Eligible for Preferential Implementation of Dental Health Programs)
"Low-income residents in agricultural and fishing villages prescribed by Presidential Decree" in Article 17 (1) of the Special Act on Improvement of Public Health and Welfare of Residents in Agricultural and Fishing Villages (hereinafter referred to as the "Act") means any of the following persons:
1. Recipients defined in subparagraph 2 of Article 2 of the National Basic Living Security Act;
2. Persons deemed by the Minister of Health and Welfare to have similar living standards to recipients under subparagraph 1.

 Article 3 (Persons Eligible for Support for Fostering Oriental Medicine Industry)
"Person prescribed by Presidential Decree" in Article 18 (1) of the Act means persons other than farmers and fishers, who cultivate, process, or distribute oriental medicines in accordance with the excellent oriental medicine management standards under Article 14 of the Oriental Medicine Promotion Act.

 Article 4 (Support for Families with Children)
Pursuant to Article 23 of the Act, the State and local governments may provide subsidies tailored to the characteristics of agricultural and fishing villages within the budget, in addition to subsidies granted under the Child Welfare Act or the Act on Special Cases concerning Adoption, to families falling under any subparagraph of paragraph (1) of that Article.

 Article 5 (Persons Eligible for Medical Treatment Services)
"Low-income senior citizens living in agricultural and fishing villages prescribed by Presidential Decree" in Article 25 (1) of the Act means any of the following persons among senior citizens in agricultural and fishing villages:
1. Eligible recipients under Article 3 (1) of the Medical Benefit Act;
2. Persons deemed by the Minister of Health and Welfare to have similar living standards to eligible recipients under subparagraph 1.

 Article 6 (Graded Subsidy Rates for Insurance Contributions under the National Health Insurance Act)
(1) Subsidy rates for insurance contributions under Article 27 (1) of the Act shall be classified as follows:
1. Where the contribution points per household under Article 72 of the National Health Insurance Act (hereafter in this Article referred to as "points per household") are below the standard points for flat-rate support determined by the Minister of Agriculture, Food and Rural Affairs (hereafter in this Article referred to as "standard flat-rate support points"): 28/100 of the insurance contributions under Article 69 of the National Health Insurance Act;
2. Where points per household are at least the standard flat-rate support points but below the standard points for exemption from payment of subsidies determined by the Minister of Agriculture, Food and Rural Affairs (hereafter in this Article referred to as "standard exemption points"): 28/100 of the insurance contributions under Article 69 of the National Health Insurance Act, where the points per household are the same as the standard flat-rate support points;
3. Where points per household are at least the standard exemption points: No subsidy for insurance contributions under Article 69 of the National Health Insurance Act.
(2) The Minister of Agriculture, Food and Rural Affairs shall determine and publicly notify the standard fixed-rate support points and the standard exemption points under the subparagraphs of paragraph (1) taking into account the average contribution points for farmers and fishers in the preceding year and the ratio of the insured to contribution point in the preceding year, in consultation with the Minister of Health and Welfare.

 Article 7 (Methods and Standards for Calculating Contribution Points)
(1) "Property of farmers and fishers prescribed by Presidential Decree, such as fallow and abandoned land" in Article 28 (1) of the Act means the following property:
1. Fallow and abandoned land;
2. Unoccupied livestock pens that have been left unattended for at least three consecutive years;
3. Farms that have been left unattended for at least three consecutive years.
(2) If contribution points are calculated pursuant to Article 42 of the Enforcement Decree of the National Health Insurance Act for the property of farmers and fishers falling under the subparagraphs of paragraph (1), a reduction of 20/100 of the property tax base amount shall be applied.

 Article 8 (Objects and Methods of Write-Off of Deficits)
Pursuant to Article 29 of the Act, the National Health Insurance Corporation shall write off the insurance contributions, etc. incurred by farmers and fishers who meet all the following requirements during the period when they were engaged in agriculture or fishery business, in accordance with Article 84 of the National Health Insurance Act: <Amended on May 7, 2024>
1. They shall have no income under Article 41 (1) of the Enforcement Decree of the National Health Insurance Act;
2. The total value of their building and land under Article 42 (1) 1 of the Enforcement Decree of the National Health Insurance Act, together with any security deposit and monthly rent under subparagraph 2 of that paragraph, shall not exceed 4.5 million won;

 Article 9 (Support for Quasi-Agricultural and Fishing Villages)
(1) Farmers and Fishers residing in quasi-agricultural and fishing villages under Article 33 of the Act may receive the following support:
1. Subsidization of additional expenses incurred in connection with child care services under Article 22 (2) of the Act;
2. Subsidization of insurance contributions under the National Health Insurance Act under Article 27 (1) of the Act.
(2) "Regions prescribed by Presidential Decree" in the main clause of subparagraph 3 of Article 33 of the Act means regions designated as any of the following regions or zones pursuant to Article 30 of the Enforcement Decree of the National Land Planning and Utilization Act:
1. Class I exclusive residential regions;
2. Class I general residential regions;
3. Green conservation regions;
4. Green natural regions.

ADDENDA <Presidential Decree No. 18378, Apr. 24, 2004>
(1) (Enforcement Date) This Decree shall enter into force on April 30, 2004.

ADDENDA <Presidential Decree No. 19243, Dec. 30, 2005>
(1) (Enforcement Date) This Decree shall enter into force on the date of its promulgation.
(2) (Applicability to Subsidy Rates for Health Insurance Contributions) The amended provisions of Article 6 shall begin to apply to portions of subsidization for the fiscal year 2006.
