ENFORCEMENT DECREE OF THE ACT ON THE ACQUISITION OF ACADEMIC DEGREES THROUGH SELF-EDUCATION

Presidential Decree No. 26548, Sep. 25, 2015

 Article 1 (Purpose)
The purpose of this Decree is to provide for matters delegated by the Act on the Acquisition of Academic Degrees through Self-Education, and other matters necessary for the enforcement of said Act.

 Article 2 (Evaluation Areas)
The evaluation areas of the examination for the acquisition of a degree (hereinafter referred to as "examination") for self-schooling persons shall be classified as follows:
1. Approval examination for cultural liberal education courses: Cultural education generally required by a person who has completed the curriculum of a university or college;
2. Approval examination for basic major courses: Knowledge and technology commonly required in each academic field to research academic studies in each major field of study;
3. Approval examination for advanced major courses of study: More specialized knowledge and technology in each major field of study;
4. Comprehensive examination for the acquisition of academic degrees: Comprehensive knowledge, professional knowledge, and technology generally required by a person who has acquired a degree as the final step of the examination.

 Article 3 (Provision of Convenience to Applicants)
(1) The Minister of Education may have educational institutions, educational administrative agencies, etc. establish and operate a self-education information counseling center in order to provide persons who intend to apply for an examination with materials related to the examination or to respond to counseling. <Amended on Mar. 23, 2013>
(2) Where the Minister of Education deems it necessary to facilitate the examination, the Minister may request the heads of educational institutions, educational administrative institutions, educational research institutes, and the heads of public institutions under Article 4 of the Act on the Management of Public Institutions to use facilities or provide support for personnel. <Amended on Mar. 23, 2013>
(3) The head of an institution in receipt of a request for support pursuant to paragraph (2) shall comply with such request, unless there is a compelling reason not to do so.

 Article 4 (Entrustment of Authority)
(1) Pursuant to Article 7 of the Act on the Acquisition of Academic Degrees through Self-Education (hereinafter referred to as the "Act"), the Minister of Education shall entrust his or her authority to conduct examinations under Article 3 (1) of the Act (including measures to be taken against cheaters, etc. under Article 5-2 (1) of the Act) to the President of the National Institute for Lifelong Education (hereinafter referred to as the "President"). <Amended on Mar. 23, 2013>
(2) Where the President deems it necessary to conduct an examination, he or she may entrust part of the affairs concerning the conduct of the examination to the superintendent of education of the Special Metropolitan City, Metropolitan City, Do, or Special Self-Governing Province with approval from the Minister of Education. <Amended on Mar. 23, 2013>
(3) The President deems it necessary, he or she may entrust all or part of experiments, practical examinations, or practical skill examinations to an educational institution, educational research institute, or other related institutions or organizations.

 Article 5 (Composition of Self-Education Degree Steering Committee)
(1) The Self-Education Degree Steering Committee (hereinafter referred to as the "Committee") shall be established under the National Institute for Lifelong Education to deliberate on important matters concerning the acquisition of degrees by self-educators.
(2) The Committee shall be comprised of not more than 15 non-standing members, including one chairperson and one vice chairperson.
(3) The chairperson and the vice-chairperson shall be elected from among the members, and the members shall be appointed or commissioned by the President from among persons from academic circles, educational administrative institutions, educational research institutes, or other education-related institutions and organizations.
(4) The Committee may separately have expert members and subcommittees for each field.
(5) Matters necessary for the composition and operation of the Committee and subcommittees shall be determined by the President after deliberation by the Committee.

 Article 6 (Functions of Committee)
The Committee shall deliberate on the following matters: <Amended on Mar. 23, 2013; Sep. 25, 2015>
1. Matters concerning examination subjects and evaluation subjects by courses;
2. Matters concerning examination implementation plans;
3. Matters concerning detailed standards for qualifications for examinations;
4. Matters concerning exemption from examination subjects;
4-2. Matters concerning measures against cheaters, etc. under Article 13 (1);
5. Other matters deemed necessary and referred to deliberation by the Minister of Education or the President.

 Article 7 (Qualifications for Examination)
(1) Qualifications for examinations by course of study shall be as follows: <Amended on Sep. 25, 2015>
1. Any of the following persons shall be eligible to take an examination for accreditation of a cultural course, an examination for accreditation of a basic major course, and an examination for accreditation of an advanced major course:
(a) A high school graduate;
(b) Pursuant to Article 98 (1) of the Enforcement Decree of the Elementary and Secondary Education Act, a person who is deemed to have an academic background equivalent to that of a high school graduate in admission to a higher school;
(c) A person who has completed a curriculum equivalent to that of a high school curriculum at a school-type lifelong educational establishment in which educational attainment designated pursuant to Article 31 (2) of the Lifelong Education Act is recognized;
(d) A person who has completed a high school curriculum at a juvenile reformatory school under Article 29 of the Act on the Treatment of Protected Juveniles;

4. Any of the following persons shall be eligible to take a comprehensive examination for the acquisition of a degree, and any of the following persons shall be eligible to take the comprehensive examination for obtaining a degree, and any person who falls under items (b) through (e) shall have the same field of degree and major as he or she intends to obtain:
(a) A person who has passed the liberal culture course recognition examination, the basic major course recognition examination, and the advanced major course recognition examination;
(b) A person who has completed at least three years of educational courses at universities (including schools under subparagraphs 2, 3, and 5 of Article 2 of the Higher Education Act and universities established pursuant to other statutes and regulations) and various kinds of schools equivalent thereto (limited to schools designated as schools subject to recognition of educational attainment) or has earned at least 105 credits or more;
(c) A person who has graduated from a junior college with a term of three years of study or is deemed to have qualifications equivalent thereto;
(d) A person who has obtained recognition of at least 105 credits pursuant to Article 7 of the Act on Recognition of Credits;
(e) A person who has completed at least 15 years of school curricula in a foreign country.
(2) Any person who are exempt from examination subjects in the liberal culture course accreditation examination and the majority basic course accreditation examination pursuant to Article 9 may apply for the following accreditation examination in any of the following cases:
1. Where the exempted subjects are at least 60 percent of the total subjects of the relevant examination;
2. Where at least 60 percent of the total subjects of the relevant examination are exempted and the subjects that have passed among other subjects.
(3) The President shall determine the detailed qualification standards for applicants under paragraph (1) after deliberation by the Committee.

 Article 8 (Methods of Examination)
(1) The liberal arts course recognition examination and an examination for accreditation of a basic major course may be conducted by mixing a multiple-choice type with a short-answer type.
(2) An examination for accreditation of an advanced major course and a comprehensive examination for the acquisition of a degree shall be conducted by mixing multiple-choice types and thesis types.
(3) The methods of evaluating subjects requiring experiments, practical examinations, or practical skills shall be separately determined by the President.

 Article 9 (Exemption from Examination Subjects)
(1) Article 5 (1) of the Act, with the exception of its subparagraphs, persons eligible to be exempted from all or part of the recognition examination for each course (excluding a comprehensive examination for the acquisition of a degree), or the examination subjects shall be any of the following persons: <Amended on Mar. 23, 2013; Sep. 25, 2015>
1. A person who has acquired a qualification under the National Technical Qualifications Act;
2. A person who has passed an examination prescribed by Ministerial Decree of Education among examinations administered by the State or a local government;
3. A person who has obtained qualifications or licenses prescribed by Ministerial Decree of Education;
4. A person who has completed lectures or training courses designated by the director from among open courses conducted by universities or colleges, training courses for training craftsmen conducted by polytechnic colleges, educational courses conducted by government-funded research institutes, etc., and training courses conducted by enterprises;
5. Any other person prescribed by Ministerial Decree of Education, taking into consideration the curriculum completed or recognized credits, etc., which have been completed.
(2) Matters necessary for the scope of course-by-course accreditation examinations or examination subjects to be exempted pursuant to paragraph (1), procedures for exemption, procedures for exemption, procedures for designation of lectures or courses, etc. shall be prescribed by Ministerial Decree of Education. <Amended on Mar. 23, 2013>

 Article 10 (Examination and Public Announcement of Successful Examinees)
(1) The President shall publicly announce the examination implementation plan for the relevant year by Jan. 31 each year. <Amended on Sep. 25, 2015>
(2) When the President decides to pass the examination pursuant to Article 12, he or she shall make a public announcement thereof.
(3) Matters necessary for public announcement under paragraphs (1) and (2) shall be prescribed by Ministerial Decree of Education. <Amended on Mar. 23, 2013>

 Article 11 (Appointment of Examiners)
The President shall appoint or commission at least two examiners for each subject to take charge of preparing and grading examinations and other matters necessary for the administration of examinations.

 Article 12 (Determination of Success in Examination)
(1) In the liberal arts course recognition examination, the basic major course recognition examination, and the advanced major course recognition examination, scores at least 60 points out of 100 in each subject and scores at least 60 points in all subjects shall be passed.
(2) With respect to subjects that score at least 60 points out of the recognition examination for cultural arts courses, the recognition examination for basic major courses, and the recognition examination for advanced major courses, the passing of subjects shall be recognized in the next subsequent examination only for the relevant recognition examination for the course of study.
(3) In a comprehensive examination for the acquisition of a degree, scores at least 60 percent of the total score shall be deemed passed: Provided, That if deemed necessary, the Minister of Education may concurrently determine the method of passing the examination under paragraphs (1) and (2). <Amended on Mar. 23, 2013>

 Article 13 (Measures against Cheaters)
(1) The detailed criteria for taking measures under Article 5-2 (1) of the Act against a person who has committed an unlawful act in an examination or a person who has falsely stated matters concerning his or her eligibility to take an examination on an application form for examination, etc. (hereinafter referred to as "cheaters, etc.") shall be as specified in the Appendix.
(2) The President shall take measures under paragraph (1) after deliberation by the Committee within 30 days from the date he or she discovers cheaters, etc.: Provided, That where he or she discovers cheaters, etc. during an examination, he or she may immediately take measures to suspend applying for the examination or subjects of the examination separately from the measures under paragraph (1).
(3) Where the President intends to take measures under the main clause of paragraph (2), he or she shall give cheaters, etc. an opportunity to state an opinion by attending the Committee or submitting a written statement, etc.
(4) Except as otherwise expressly provided for in paragraphs (1) through (3), matters necessary for taking measures against cheaters, etc. shall be determined by the President after deliberation by the Committee.

 Article 14 (Conferment of Degrees)
(1) The Academic Degree shall be conferred to a person who has passed a comprehensive examination for the acquisition of a degree by issuing a certificate of degree.
(2) Matters necessary for the management of academic affairs of persons who have acquired a degree shall be prescribed by Ministerial Decree of Education. <Amended on Mar. 23, 2013>

 Article 15 (Management of Records of Conducting Examinations)
The President shall record and manage matters concerning the administration of examinations and the results thereof.

 Article 16 (Payment of Allowances and Travel Expenses)
(1) Members and expert members of the Committee and subcommittees shall be paid allowances and travel expenses within budgetary limits: Provided, That this shall not apply where a member who is a public official attends a meeting in direct connection with his or her duties.
(2) Allowances and travel expenses shall be paid within budgetary limits to examination committee members and other examination management and supervision of examinations or other examination operation personnel, and travel expenses shall be reimbursed.

 Article 17 (Management of Personally Identifiable Information)
The Minister of Education (including persons entrusted with the authority of the Minister of Education pursuant to Article 4) may manage data containing resident registration numbers or alien registration numbers under subparagraph 1 or 4 of Article 19 of the Enforcement Decree of the Personal Information Protection Act, if it is inevitable to perform the following affairs:
1. Administrative affairs concerning conducting examinations under Article 3 of the Act;
2. Affairs concerning measures against cheaters, etc. under Article 5-2 of the Act;
3. Administrative affairs concerning the conferment of degrees and other management of academic affairs under Article 6 of the Act.

ADDENDA <Presidential Decree No. 13000, May. 3, 1990>
(1) (Enforcement Date) This Decree shall enter into force on the date of its promulgation.
(2) (Transitional Measures concerning Public Announcement of Examination) The provisions of Article 10 (1) shall not apply to the public announcement of the examination in 1990.
