ENFORCEMENT DECREE OF THE ACT ON THE ESTABLISHMENT AND OPERATION OF THE KOREA AGENCY OF HACCP ACCREDITATION AND SERVICES

Presidential Decree No. 27796, Jan. 17, 2017

 Article 1 (Purpose)
The purpose of this Decree is to prescribe matters mandated by the Act on the Establishment and Operation of the Korea Agency of HACCP Accreditation and Services and other matters necessary for the enforcement thereof.
 Article 2 (Registration of incorporation)
(1) Pursuant to Article 3 of the Act on the Establishment and Operation of the Korea Agency for HACCP Accreditation and Services (hereinafter referred to as the "Act"), the Korea Agency for HACCP Accreditation and Services (hereinafter referred to as the "Agency") shall file for registration of incorporation at the seat of its main office within 3 weeks from the date it obtains authorization for its articles of incorporation.
(2) Matters regarding the registration of establishment pursuant to paragraph (1) shall be the following:
1. Purpose;
2. Name;
3. Locations of the main office, affiliated institutions, and regional offices;
4. Names and domiciles of executive officers;
5. Total assets;
6. Methods of public announcement.
 Article 3 (Submission of business plans)
(1) Pursuant to Article 13 (1) of the Act, the Agency shall obtain approval from the Minister of Food and Drug Safety on a budget statement accompanied by a business plan for the following business year and the following documents, subject to resolution by the board of directors, before the commencement of each business year. The same shall also apply to any change thereof:
1. The estimated statement of financial position;
2. The estimated income statements;
3. A plan for revenue and expenditure of funds.
(2) The Agency shall submit a statement of accounts accompanied by business performance for each business year and the following documents to the Minister of Food and Drug Safety by the end of February of the following business year, subject to resolution by the board of directors, and obtain approval from the Minister of Food and Drug Safety by March 31 pursuant to Article 13 (2) of the Act:
1. A comparison table of the business plan for the relevant business year and the results of its execution;
2. Financial statements (including a written opinion of an auditor under Article 43 (1) of the Act on the Management of Public Institutions) and documents annexed thereto;
3. Other documents necessary for clarifying the details of the settlement of accounts.
 Article 4 (Criteria for imposing administrative fines)
The criteria for imposing administrative fines under Article 20 of the Act shall be as specified in the Appendix.

Article 1 (Enforcement Date)
This Decree shall enter into force on February 4, 2017.
Article 2 (Special cases concerning submission of business plans and budget statements)
Notwithstanding Article 3 (1), the Agency shall submit a business plan and a budget statement for 2017 to the Minister of Food and Drug Safety within 30 days from the date the Agency is established.
