The purpose of this Decree is to prescribe matters mandated by the Literature Promotion Act and matters necessary for its enforcement.
| Article 2 (Standards for Literature Museum Materials) |
| 1. | It shall be necessary to utilize or preserve it in order to carry out the business of the literature museum under Article 17 of the Act; |
| 2. | It shall have artistic, historical and academic value; |
| Article 3 (Content of Fact-Finding Survey) |
| (1) | The fact-finding survey pursuant to Article 6 (1) of the Act (hereinafter referred to as "fact-finding survey") shall include the following matters: |
| 1. | Matters concerning literary figures and literary organizations; |
| 2. | Matters pertaining to the actual state of literary creation; |
| 3. | Matters concerning the current status of enjoyment of literature; |
| 4. | Matters pertaining to the operational status of the literature museum; |
| 5. | Other matters deemed necessary by the Minister of Culture, Sports and Tourism for the establishment and implementation of literature promotion policies. |
| (2) | The survey shall be conducted every 3 years, but may be conducted at any time if the Minister of Culture, Sports and Tourism deems it necessary. |
| (3) | The Minister of Culture, Sports and Tourism may commission an institution, corporation, or organization with literary expertise and personnel to conduct a fact-finding survey. |
| Article 4 (Literature Promotion Policy Committee) |
| (1) | The term of office of a newly appointed member due to the resignation, etc. of a member of the Literature Promotion Policy Committee pursuant to Article 7 (1) of the Act (hereinafter referred to as "Policy Committee") (hereinafter referred to as "member") shall be the remainder of the term of office of the predecessor member. |
| (2) | In order to handle the administrative affairs of the Policy Committee, the Policy Committee shall have one secretary, and the secretary shall be appointed by the Minister of Culture, Sports and Tourism from among public officials belonging to the Ministry of Culture, Sports and Tourism. |
| (3) | The chairperson of the Policy Committee (hereinafter referred to as the "chairperson") shall represent the Policy Committee and exercise general supervision over its affairs. |
| (4) | If the chairperson is unable to perform his or her duties due to unavoidable reasons, the vice-chairperson shall perform his or her duties. |
| Article 5 (Exclusion of, Challenge to, and Recusal of Members) |
| (1) | If a member falls under any of the following subparagraphs, he or she shall be excluded from deliberation and resolution of the relevant agenda: |
| 1. | When a member or his or her spouse or former spouse is a party to the relevant agenda (if the party is a corporation or organization, including its executive officers; hereafter the same shall apply in this Article) or is a joint right holder or joint obligor with the party to the relevant agenda; |
| 2. | Where a member is or was a relative of a party to the relevant agenda; |
| 3. | Where a member testifies, makes a statement, gives advice, researches, provides services, or makes an appraisal on the relevant agenda; |
| 4. | Where a member, or corporation to which the member belongs, is the current or former agent of a party to the agenda. |
| (2) | If a party to the relevant agenda has grounds for exclusion as specified in each subparagraph of paragraph (1) or if there are any circumstances in which it is difficult to expect a fair deliberation and resolution from the member, he or she may file a request for recusal with the Policy Committee, and the Policy Committee shall decide on the challenge to the member through resolution. In such cases, the member who is the subject of the application for challenge shall not participate in the resolution. |
| (3) | If a member falls under the grounds for exclusion as specified in each subparagraph of paragraph (1), he or she shall voluntarily recuse himself or herself from deliberation and resolution on the relevant agenda. |
| Article 6 (Dismissal of Members) |
The Minister of Culture, Sports and Tourism may dismiss a member if the member falls under any one of the following subparagraphs:
| 1. | If a member becomes incapable of performing his or her duties due to any mental or physical disorder; |
| 2. | If a member has engaged in misconduct in relation to his or her duties; |
| 3. | If a member is deemed unsuitable as a member of the Policy Committee due to neglect of a duty, loss of dignity, or on any other reason; |
| 4. | If a member fails to recuse himself or herself upon the occurrence of any of the causes specified in the subparagraphs of Article 5 (1); |
| 5. | If a member voluntarily indicates that it is impracticable to perform his or her duties. |
| Article 7 (Meetings of Policy Committee) |
| (1) | The chairperson shall convene and preside over the meetings of the Committee. |
| (2) | The meetings of the Policy Committee are divided into regular meetings and extraordinary meetings. |
| (3) | In principle, regular meetings are held once per half year. |
| (4) | Extraordinary meetings shall be held in any of the following cases: |
| 1. | When the Minister of Culture, Sports and Tourism requests a meeting to be convened; |
| 2. | When more than one-third of the members requests a meeting to be convened; |
| 3. | In other cases where the chairperson deems it necessary to hold a meeting of the Policy Committee. |
| (5) | A majority of the members of the Policy Committee shall constitute a quorum, and any decision thereof shall require a concurring vote of at least a majority of those present. |
| (6) | Allowances and travel expenses may be paid to the members who attend the meetings of the Policy Committee within the budget. |
| (7) | Except as provided in this Decree, matters necessary for the operation of the Policy Committee shall be determined by the chairperson after resolution by the Policy Committee. |
| Article 8 (Support for Overseas Expansion and International Exchange) |
| (1) | "Matters prescribed by Presidential Decree" in Article 11 (1) 4 of the Act means the following: |
| 1. | Survey, research and support for inter-Korean literary exchange; |
| 2. | Survey, research and support related to diasporic literature. |
| (2) | The Minister of Culture, Sports and Tourism may, pursuant to Article 11 (2) of the Act, entrust the projects specified in each subparagraph of paragraph (1) of that Article to the following institutions or organizations: |
| 2. | The Literature Translation Institute of Korea under Article 13 of the Act (hereinafter referred to as "LTI Korea"); |
| 3. | The National Museum of Korean Literature under Article 18 of the Act (hereinafter referred to as "NMKL"); |
| 6. | Other institutions or organizations determined and publicly notified by the Minister of Culture, Sports and Tourism. |
| (3) | When the Minister of Culture, Sports and Tourism entrusts a project pursuant to paragraph (2), he or she shall publicly notify the institution to which the project has been entrusted and the details of the entrusted project. |
| Article 9 (Standards and Procedures for Selection of Recipients of Support for Translation and Publication) |
| (1) | The criteria for selection of support targets under Article 13 (4) of the Act are as follows: <Amended on Nov. 19, 2021> |
| 1. | The relevant Korean literature shall have high artistic and cultural value; |
| 2. | The artistic and cultural value of the relevant Korean literature shall be recognizable overseas; |
| 3. | The relevant Korean literature shall fit the standards set by the president of the LTI Korea (hereinafter referred to as "the president of LTI Korea") as deemed necessary for the selection of persons eligible for support. |
| (2) | In order to select Korean literary works and publications eligible for support pursuant to Article 13 (4) of the Act, a selection committee for translation and publication support (hereinafter referred to as "the Selection Committee" in this Article) shall be established at the LTI Korea. |
| (3) | The Selection Committee shall be composed of up to 10 people appointed by the president of the LTI Korea from among those with abundant professional knowledge and experience in literature, translation, and publication. |
| (4) | Except as otherwise provided for in paragraphs (2) and (3), matters necessary for detailed procedures for selection of persons eligible for translation and publication support, and for the composition and operation of the Selection Committee and any other similar matters shall be prescribed by the president of the LTI Korea. |
| Article 10 (Organization and Operation of the National Museum of Korean Literature) |
| (1) | Pursuant to Article 18 (3) of the Act, the NMKL shall have the following executive officers: |
| 1. | 1 president of the NMKL (hereinafter referred to as "the president of the NMKL"); |
| 2. | Up to 15 directors, including the president of the NMKL; |
| (2) | The president of the NMKL shall be appointed and dismissed by the Minister of Culture, Sports and Tourism. |
| (3) | The president of the NMKL represents the NMKL and supervises its affairs. |
| (4) | Directors and auditors, excluding the president of the NMKL, shall be non-permanent, and matters necessary for their appointment shall be determined by the articles of incorporation of the NMKL. |
| (5) | The term of office of the president of the NMKL shall be 3 years, and he or she may be reappointed only once. |
| (6) | The term of office of directors and auditors, excluding the president of the NMKL, shall be 2 years, but they may be reappointed only once. |
| (7) | Except as otherwise provided for in paragraphs (1) through (6), matters necessary for the organization and operation of the NMKL shall be prescribed by the articles of incorporation of the NMKL. |
| Article 11 (Board of Directors of National Museum of Korean Literature) |
| (1) | The NMKL shall have a board of directors to deliberate on and decide on important matters related to its business affairs. |
| (2) | The board of directors shall be composed of directors, including the president of the NMKL. |
| (3) | A majority of incumbent directors shall constitute a quorum for the meeting of the board of directors and its resolutions shall be passed with the consent of the majority of the directors present. |
| (4) | The auditors may attend the board of directors' meetings and express their opinions. |
| (5) | Except as otherwise provided for in paragraphs (1) through (4), matters necessary for the operation of the board of directors shall be prescribed by the articles of incorporation of the NMKL. |
| Article 12 (Registration of Establishment of National Museum of Korean Literature) |
The establishment registration details of the NMKL pursuant to Article 18 (3) of the Act are as follows: | 4. | Name and address of the president of the NMKL; |
| 5. | Matters relating to assets; |
| 6. | Methods of contributions and the amount of contributions made. |
| Article 13 (Procedures for Establishment of Public Museums of Literature) |
| (1) | The head of a local government who intends to establish a public museum of literature under subparagraph 2 of Article 16 of the Act (hereinafter referred to as "public museum of literature") pursuant to Article 19 (1) of the Act shall consult in advance with the Minister of Culture, Sports and Tourism. |
| (2) | When requesting consultation under paragraph (1), the head of a local government shall submit the following documents to the Minister of Culture, Sports and Tourism (including submission by electronic document; hereinafter the same shall apply): |
| 1. | Operation plan for a literature museum; |
| 2. | Specifications and floor plan of the literature museum facilities; |
| 3. | Statements of literature museum materials; |
| Article 14 (Registration Procedures for Literature Museums) |
| (1) | Pursuant to the former part of Article 21 (1) of the Act, a person who wishes to register a National Museum of Literature pursuant to subparagraph 1 of Article 16 of the Act shall submit an application for registration of a literature museum with the following documents to the Minister of Culture, Sports and Tourism, as prescribed by Ministerial Decree of Culture, Sports and Tourism: |
| 1. | Operation plan for a literature museum; |
| 2. | Specifications and floor plan of the literature museum facilities; |
| 3. | Specifications for each literature museum material; |
| 4. | List of professional personnel of the literature museum; |
| 5. | Statement of admission fees and usage fees. |
| (2) | A person who wishes to register a public museum of literature pursuant to the former part of Article 21 (1) of the Act shall submit an application form for the registration of a literature museum, attached with documents specified in each subparagraph of paragraph (1), to the competent Special Metropolitan City Mayor, Metropolitan City Mayor, Special Self-Governing City Mayor, Do Governor, or Special Self-Governing Province Governor (hereinafter referred to as "Mayor/Do Governor"). |
| (3) | In accordance with the latter part of Article 21 (1) of the Act, a person who wishes to register a private museum of literature (hereinafter referred to as "private museum of literature") under Article 16 (3) of the Act shall submit an application form for the registration of a literature museum, attached with documents specified in each subparagraph of paragraph (1), to the competent Mayor/Do Governor. |
| (4) | The Minister of Culture, Sports and Tourism or the Mayor/Do Governor who has received an application for registration under paragraphs (1) through (3) shall notify the applicant of whether the registration is completed, within 2 months from the date he or she receives the application for registration. |
| (5) | When the Minister of Culture, Sports and Tourism or the Mayor/Do Governor has registered the relevant literature museum, he or she shall issue the certificate of registration of the relevant literature museum to the applicant pursuant to Article 21 (3) of the Act. |
| (6) | Except as otherwise provided for in paragraphs (1) through (5), matters necessary for the registration of a literature museum shall be prescribed by Ministerial Decree of Culture, Sports and Tourism. |
| Article 15 (Registration of Changes in Literature Museum) |
| (1) | A person who intends to register any modifications under Article 21 (2) of the Act shall submit an application form for the registration of modifications within 30 days from the date on which the registered matters are modified, as prescribed by Ministerial Decree of Culture, Sports and Tourism, attached with the following documents to the Minister of Culture, Sports and Tourism or the competent Mayor/Do Governor: |
| 1. | Literature museum registration certificate; |
| 2. | 1 copy of the document certifying the modifications of registered matters: provided, in the case of modifications of the facilities, registration data, professional staff, admission fees, or usage fees of the literature museum, 2 copies shall be submitted. |
| (2) | The Minister of Culture, Sports and Tourism or the Mayor/Do Governor who has received an application for the registration of modifications under paragraph (1) shall notify the applicant of whether such modifications are registered, within 30 days from the date on which he or she receives the application for the registration of modifications. |
| (3) | When the Minister of Culture, Sports and Tourism or the Mayor/Do Governor has registered the change of the relevant literature museum, he or she shall issue a new certificate of registration of the literature museum reflecting the changed matters to the applicant. |
| Article 16 (Registration Mark of Literature Museum) |
A literature museum that has obtained the certificate of registration of a literature museum shall indicate the registration authority and its registration number on outdoor signboards, various documents, publicity materials, etc. pursuant to the latter part of Article 21 (3) of the Act.
| Article 17 (Standards for Registration by Literature Museum) |
The registration standards for each literature museum pursuant to Article 21 (4) of the Act are as shown in the attached table.
| Article 18 (Approval of Plan for Establishment of Private Museum of Literature) |
| (1) | Any person who wishes to establish a private museum of literature pursuant to Article 22 (1) of the Act shall submit an application for approval to the Mayor/Do Governor, attaching the following documents, as prescribed by Ministerial Decree of Culture, Sports and Tourism: |
| 1. | Operation plan for a literature museum; |
| 2. | A ledger of the land (indicating its location, lot number, land category, area, details of rights other than ownership, the name or title and address of the owner, and the name or title and address of persons holding the surface rights, easements, leasehold rights, mortgage rights, rights related to usage loans or leases, and any other rights related to the land); |
| 3. | A ledger of the building (indicating its location, lot number of the site, building structure, floor area, total floor area, details of the rights other than ownership, the name or title and address of the owner, and the name or title and address of persons holding the leasehold rights, mortgage rights, rights related to usage loans or leases, and any other rights related to the building) or a basic construction plan that includes a spatial plan (applicable only in the case of new construction); |
| 4. | Location map and blueprint; |
| 5. | Specifications of literature museum materials; |
| 6. | List of professional personnel of the literature museum. |
| (2) | Upon receipt of an application under paragraph (1), the Mayor/Do Governor shall review documents and conduct an on-site inspection within 3 months from the date on which he or she receives an application for approval under paragraph (1), and shall notify the applicant of whether an approval is granted. |
| Article 19 (Approval for Modification of Establishment Plan of Private Museum of Literature) |
"Important matters prescribed by Presidential Decree" in Article 22 (2) of the Act means any of the following matters: | 1. | Name of a literature museum; |
| 2. | The establishment location or area of a literature museum; |
| 3. | Location or area of the exhibition halls or storage rooms; |
| 4. | Project implementation period (limited to cases where the period is extended by 3 months or more). |
| Article 20 (Revocation of Approval for Establishment Plan of Private Museum of Literature) |
In accordance with Article 22 (4) of the Act, if a person who has obtained approval for an establishment plan or approval for modifications thereof under Article 22 (1) or (2) of the same Article suspends the project for at least 6 months without any justifiable grounds, the Mayor/Provincial Governor may order rectification, and if the rectification order is not complied with, the approval may be revoked.
| Article 21 (Reporting on Closure) |
A person who wishes to close a registered literature museum shall submit a closure report prescribed by Ministerial Decree of Culture, Sports and Tourism pursuant to Article 24 (1) of the Act, along with the literature museum registration certificate, to the Minister of Culture, Sports and Tourism or the competent Mayor/Do Governor.
| (1) | The operational status report submitted by the president of a national museum of literature registered in accordance with Article 21 of the Act to the Minister of Culture, Sports and Tourism pursuant to Article 28 (1) of the Act shall include the following matters: |
| 1. | Organization (including professional personnel) and financial status of the relevant national museum of literature; |
| 2. | Current status of collection and management of literature museum materials; |
| 3. | Current status of the users of literature museum materials, admission fees, usage fees, etc. |
| (2) | The operational status reported by the Mayor/Do Governor to the Minister of Culture, Sports and Tourism pursuant to Article 28 (1) of the Act shall include the following matters: |
| 1. | List of registered literature museums; |
| 2. | Organizational structure (including professional staff) and financial status of each registered literature museum; |
| 3. | Current status of guidance and supervision of registered literature museums; |
| 4. | Current status of collection and management of literature museum materials; |
| 5. | Current status of the users of literature museum materials, admission fees, usage fees, etc. |
| (3) | Except as otherwise provided for in paragraphs (1) and (2), detailed matters necessary for reporting shall be prescribed by Ministerial Decree of Culture, Sports and Tourism. |
| Article 23 (Organization of Cooperative Networks of Literature Museums) |
| (1) | The cooperative network of literature museums under Article 30-2 (1) of the Act shall be comprised of a central center and regional representative centers. |
| (2) | The central center under paragraph (1) shall be the NMKL, and the regional representative centers may be designated by the Minister of Culture, Sports and Tourism upon application from the literature museums. |
| (3) | Matters concerning the standards, procedures, etc. for designation of regional representative centers under paragraph (2) shall be determined and publicly notified by the Minister of Culture, Sports and Tourism. |
