ENFORCEMENT DECREE OF THE ORGANIZATION OF THE REPUBLIC OF KOREA NATIONAL RED CROSS ACT

Presidential Decree No. 31845, Jun. 29, 2021

 Article 1 (Purpose)
The purpose of this Decree is to prescribe the matters mandated by the Organization of the Republic of Korea National Red Cross Act? and the matters necessary for their enforcement. <Amended on Nov. 15, 2016>
 Article 2 (Specific scope of requested data)
The data that the Republic of Korea National Red Cross?may request under Article 8 (1)? of the Organization of the Republic of Korea National Red Cross Act (hereinafter referred to as the “Act”) shall be as follows:? <Amended on Jun. 27, 2017, Sep. 4, 2018; Jun. 16, 2020>
1. The name and the address of a head of a household under the Resident Registration Act;
2. The trade name and the address of a business entity or a business owner who is liable to pay taxes under the Local Tax Act;
3. The name and the address of a recipient defined in subparagraph 2 of Article 2? of the National Basic Living Security Act;
4. The name and the address of a person with a disability registered under Article 32 of the Act on Welfare of Persons with Disabilities;
5. The name and the location of a juristic person or an organization under Article 6 (2) of the Act (excluding a business entity or a business owner under subparagraph 2);
6. The following information materials concerning a person who paid the membership fee in accordance with Article 6 (3) of the Act:
a. The resident registration number as per Article 7-2 (1) of the Resident Registration Act;
b. The alien registration number?as per Article 31 (5) of the Immigration Act;
c. The report number of the domestic place of residence?as per Article 7 (1) of the Act on the Immigration and Legal Status of Overseas Koreans.

 Article 3 (Free lease of state or public property)
The free lease of state or public property pursuant to Article 23 of the Act shall be in accordance with a contract between the Red Cross and either the managing authority of the relevant state or public property or the head of the local government.
 Article 4 (Processing of sensitive information and personally identifiable information)
In an unavoidable situation, to conduct the business affairs as outlined in the following subparagraphs, the Red Cross may process the health information under Article 23 of the Personal Information Protection Act and materials containing a resident registration number, passport number, or alien registration number under subparagraph 1, 2, or 4 of Article 19 of the Enforcement Decree of that Act: <Amended on Jun. 16, 2020>
1. Matters concerning member recruitment and membership fee collection by the Red Cross under Article 6 (4) of the Act;
2. Matters concerning the issuance of donation receipts under Article 8 (1) of the Act;
3. Matters concerning the verification of the grounds for disqualification of an executive officer of the Red Cross pursuant to Article 18 of the Act.

 Article 5 (Criteria for imposition of administrative fines)
The criteria for imposing administrative fines as stipulated in Article 29 (1) of the Act shall be as listed in the Appendix.

Addenda <Presidential Decree No. 12424, Mar. 29, 1988>
(1) (Enforcement date) This Decree shall enter into force on the date of its promulgation.
(2) (Transitional measures concerning registration) The Red Cross (including its chapters), which is to be registered at the time of the enforcement of this Decree, shall be registered within 3? months of the enforcement of this Decree.

Article 2 (Effective period)
Article 4 of the Enforcement Decree of the Organization of the Republic of Korea National Red Cross Act amended in accordance with Article 74 shall enter into force until December 31, 2014.

This Decree shall enter into force on the date of its promulgation.
Addenda <Presidential Decree No. 28150, Jun. 27, 2017>
Article 1 (Enforcement date)
This Decree shall enter into force on July 1, 2017; provided, the amended provision of Article 3 of the Addenda shall enter into force on the date of its promulgation.

Article 1 (Enforcement date)
This Decree shall enter into force on the date of its promulgation.
Article 2 (Transitional measures concerning administrative fines)
Administrative fines imposed for an act of violation which was committed before the enforcement of this Decree shall not be included in calculating the number of violations pursuant to the amended provisions of the Appendix.

This Decree shall enter into force on the date of its promulgation.
