The purpose of this Decree is to establish the National Policy Planning Advisory Committee to ensure the smooth and orderly development of the national governance system, to strengthen national policy planning through public participation and communication, and to prescribe matters necessary for its composition and operation.
| Article 2 (Establishment) |
A National Policy Planning Advisory Committee (hereinafter referred to as the "Committee") shall be established under the jurisdiction of the President to provide advice and suggestions on national policy planning to the President.
The Committee shall advise the President on the following matters:
| 1. | Understanding the structure, functions, and budget status of the Government; |
| 2. | Establishing the Government's policy direction; |
| 3. | Establishing medium- and long-term plans for the selection and implementation of major national policies; |
| 4. | Other matters necessary for the President's national policy planning. |
| (1) | The Committee shall be comprised of 1 chairperson, 3 vice chairpersons, and not more than 30 members. |
| (2) | The chairperson, vice chairpersons, and members shall be appointed or commissioned by the President. |
| (3) | The Committee shall have 1 executive secretary and 1 spokesperson, respectively, and the executive secretary shall be appointed by the chairperson from among the vice chairpersons and the spokesperson from among the members, respectively. |
| Article 5 (Duties of chairperson) |
| (1) | The chairperson shall have general supervision and control of the business affairs of the Committee, and direct and supervise the staff of the Committee. |
| (2) | The chairperson shall report to the President from time to time on matters handled by the Committee and receive necessary instructions. |
| (3) | If the chairperson is unable to perform his or her duties due to any unavoidable cause, a vice chairperson designated by the President shall act on behalf of the chairperson. |
| Article 6 (Steering committee) |
| (1) | The Committee shall have a steering committee comprised of 3 vice chairpersons and the chairpersons of subcommittees established under paragraph (2) for the smooth operation of the Committee. |
| (2) | The Committee shall have subcommittees composed of members in order to perform the duties of the Committee by specialized field. |
| (3) | The Committee shall have a working committee comprised of public officials in general service belonging to the Senior Executive Service of the relevant administrative agencies, whose class of duties is Grade A or equivalent thereto, who shall serve as working-level members of the working committee to support the business affairs of subcommittees. In such cases, the First Deputy Minister of the Office for Government Policy Coordination shall be the chairperson of the working committee. |
| Article 7 (Organization for public participation and communication) |
| (1) | In order to gather policy ideas and opinions from the public and reflect them in Government policies, etc., a body for public participation and communication (hereinafter referred to as the "Public Participation Body") shall be established within the Committee. |
| (2) | The Public Participation Body shall appoint as operating members those who fall under the following categories to enable discussion, evaluation, and other activities regarding policy ideas and opinions it receives: |
| 1. | A citizen who participates in a policy proposal; |
| 2. | A member appointed by the chairperson; |
| 3. | A senior secretary to the President for relevant business affairs. |
| (1) | The chairperson may convene meetings of the Committee when deemed necessary and shall preside over such meetings. |
| (2) | A resolution of a meeting of the Committee shall require the concurring vote of a majority of all incumbent members. |
The chairperson may, when deemed necessary for the efficient operation of the Committee, hold meetings in private upon resolution by the Committee.
The Committee may establish a secretariat to efficiently perform its business affairs.
| (1) | The Committee may appoint staff, including expert advisors and administrative personnel, to efficiently perform its business affairs. |
| (2) | Expert advisors, administrative personnel, and other staff shall be appointed or commissioned by the chairperson. |
| (3) | Expert advisors shall assist the chairperson, vice chairpersons, and members, and shall perform their business affairs under the subcommittees or secretariat to which they are assigned. |
| (4) | If deemed necessary for the performance of its business affairs, the Committee may request that public officials of relevant administrative agencies or executive officers and employees of relevant organizations concurrently serve as expert advisors, administrative personnel, or other staff, or be assigned to the Committee, with the consent of the head of their respective agencies or organizations. In such cases, the heads of the relevant agencies or organizations shall comply with such requests unless there is a compelling reason not to do so. |
| Article 11 (Grounds for disqualification of members) |
| Article 12 (Prohibition of divulgence of confidential information and abuse of authority) |
The chairperson, vice chairpersons, members, working-level members, and staff of the Committee, as well as any persons who formerly held such positions, shall not disclose to others any confidential information learned in the course of performing their duties or use such information for purposes other than those related to the Committee’s business affairs, nor shall they abuse their authority.
| Article 13 (Support for Committee activities) |
| (1) | The Minister of the Interior and Safety shall provide support for the following matters to ensure the smooth operation of the Committee: |
| 1. | Necessary measures including office space, equipment, communication services, and vehicles; |
| 2. | Budget support necessary for the establishment and operation of the Committee; |
| 3. | Support for the establishment and operation of a participation platform for the operation of the Public Participation Body; |
| 4. | Other matters necessary for the operation of the Committee. |
| (2) | The heads of relevant agencies shall provide necessary cooperation, including the submission of data, information, or opinions and the securing of budget, to ensure the efficient operation of the Committee. |
Allowances, travel expenses, and other necessary expenses may be paid to the chairperson, vice chairperson, members, working-level members, staff, etc. of the Committee within the budget.
| Article 15 (Publication of white paper) |
The Committee shall compile a white paper detailing the progress of its activities and the statement of budget execution, and shall make it public within 30 days after the conclusion of its activities.
| Article 16 (Term of existence) |
The Committee shall remain in existence for a term of up to 50 days from the date of enforcement of this Decree; provided, if deemed necessary, the term of existence of the Committee may be extended by up to 20 days, upon resolution by the Committee and with the approval of the President.
| Article 17 (Detailed operating rules) |
Except as provided in this Decree, matters necessary for the composition, operation, etc. of the Committee shall be determined by the chairperson following a resolution by the Committee.
ADDENDA <Presidential Decree No. 28049, May 16, 2017>
Article 1 (Enforcement date)
This Decree shall enter into force on the date of its promulgation.
Article 2 (Special Cases concerning term of existence of Public Participation Body)
| (1) | Notwithstanding Articles 7 and 16, if necessary for follow-up measures to reflect the public's policy ideas and opinions in Government policies, etc., the term of existence of the Public Participation Body may be extended by up to 50 days after the completion of activities of the Committee, with approval from the President. |
| (2) | In the case of paragraph (1), the progress of activities and the statement of budget execution shall be compiled into a white paper and made public within 30 days after the conclusion of the activities of the Public Participation Body. |
