ENFORCEMENT RULE OF THE FAIR HIRING PROCEDURE ACT

Ordinance Of the Employment and Labor No. 119, Dec. 31, 2014

 Article 1 (Purpose)
The purpose of this Rule is to prescribe the matters mandated by the Fair Hiring Procedure Act and the Enforcement Decree of said Act and those necessary for the enforcement thereof.
 Article 2 (Approval of Hiring Examination Expenses)
(1) Where a job offerer intends to require a job seeker to bear part of hiring examination expenses pursuant to the proviso of Article 9 of the Fair Hiring Procedure Act (hereinafter referred to as "Act"), he or she shall attach the following documents to an application for approval of hiring examination expenses in attached Form 1 and submit them to the director of the competent regional employment and labor office:
1. Detailed statement of calculation of hiring examination expenses;
2. Job announcement.
(2) Where the director of the competent regional employment and labor office approves the application under paragraph (1), he or she shall provide a written approval of hiring examination expenses in attached Form 2.
 Article 3 (Methods of Request for Return of Hiring Documents)
Where a job seeker requests a return of hiring documents pursuant to Article 11 (2) of the Act, he or she shall submit a written request for the return of hiring documents in attached Form 3 to the job offerer via the website, e-mail, or facsimile.
ADDENDA
The enforcement date of this Rule shall be as follows:
1. A business or place of business that regularly employs at least 300 workers, public institutions under Article 4 of the Act on the Management of Public Institutions, local government-invested public corporations under Article 49 of the Local Public Enterprises Act and local public agencies under Article 76 of that Act, and the State and local governments: January 1, 2015;
2. A business or place of business that regularly employs at least 100 but less than 300 workers: January 1, 2016;
3. A business or place of business that regularly employs at least 30 but less than 100 workers: January 1, 2017.
