ENFORCEMENT DECREE ACT ON PROMOTION OF AND SUPPORT FOR SELF-IMPOSED CONTROL FISHERIES

Presidential Decree No. 31439, Feb. 9, 2021

 Article 1 (Purpose)
The purpose of this Decree is to prescribe matters mandated by the Act on Promotion of and Support for Self-Imposed Control Fisheries and those necessary for enforcing said Act.
 Article 2 (Scope of Private Organizations)
"Corporation or organization prescribed by Presidential Decree, such as the National Federation of Fisheries Cooperatives under the Fisheries Cooperatives Act, and the Korea Fisheries Association and the Korea Association of Self-Imposed Control Fisheries established under the Civil Act" in subparagraph 4 of Article 2 of the Act on Promotion of and Support for Self-Imposed Control Fisheries (hereinafter referred to as the "Act") means the following corporations or organizations:
1. The National Federation of Fisheries Cooperatives under the Fisheries Cooperatives Act;
2. The Korea Fisheries Association established under Article 32 of the Civil Act;
3. The Korea Association of Self-Imposed Control Fisheries established under Article 32 of the Civil Act;
4. Other corporations or organizations determined and publicly notified by the Minister of Oceans and Fisheries, which perform duties related to technology exchange or public relations for self-imposed control fisheries.
 Article 3 (Formulation and Execution of Comprehensive Plans for Promoting Self-Imposed Control Fisheries)
(1) The Minister of Oceans and Fisheries shall formulate a comprehensive plan for promoting self-imposed control fisheries under Article 5 (1) of the Act (hereinafter referred to as “comprehensive plan”) and an implementation plan for promoting self-imposed control fisheries under Article 5 (3) of the Act (hereinafter referred to as “implementation plan”), notify such plans to the head of a relevant central administrative agency and to the Special Metropolitan City Mayor, a Metropolitan City Mayor, a Special Self-Governing City Mayor, a Do Governor, or a Special Self-Governing Province Governor (hereinafter referred to as “Mayor/Do Governor”), and publicly announce the details of the plans in the Official Gazette, the website of the Ministry of Oceans and Fisheries, etc.
(2) "Matters prescribed by Presidential Decree" in Article 5 (2) 6 of the Act means matters regarding education and training of fishers, etc. who form communities.
(3) A Mayor/Do Governor may formulate and execute a detailed action plan in accordance with an implementation plan.
(4) The Minister of Oceans and Fisheries may request a specialized institution to conduct survey and research on the outcomes of executing a comprehensive plan in order to revitalize self-imposed control fisheries.
 Article 4 (Formulation of Plans for Education and Training)
The Minister of Oceans and Fisheries shall formulate a plan for education and training that includes the following, to efficiently provide education and training under Article 7 of the Act:
1. Basic directions for education and training;
2. Target recipients of, and methods for, education and training;
3. Details of education and training;
4. Other matters necessary for providing education and training.
 Article 5 (Organization and Registration of Communities)
(1) "Person ... prescribed by Presidential Decree" in Article 9 (1) 4 of the Act means a person who obtains a license or permission under the Aquaculture Industry Development Act.
(2) Pursuant to the proviso of Article 9 (2) of the Act, the registration of a community which encompasses a City/Do unit or a metropolitan area larger than an individual City/Do unit shall be filed with the head of the Si/Gun/Gu (the head of a Gu refers to the head of an autonomous Gu; hereinafter the same shall apply) having jurisdiction over its main office.
 Article 6 (Evaluation of and Support for Communities’ Activities)
(1) Where the Minister of Oceans and Fisheries provides support to communities pursuant to Article 11 (1) of the Act, he or she may grade such communities into five categories based on the results of evaluating their activities prescribed in Article 11 (2) of the Act and accordingly grant differential support.
(2) Upon the recommendation of a Mayor/Do Governor, the Minister of Oceans and Fisheries may reward communities demonstrating an outstanding performance in their activities or may support them in additional expenses.
(3) Except as provided in paragraphs (1) and (2), matters necessary for evaluating communities’ activities and supporting communities shall be prescribed by Ordinance of the Ministry of Oceans and Fisheries.
 Article 7 (Rewards)
Where the Minister of Oceans and Fisheries rewards a person pursuant to Article 12 (1) of the Act, he or she may select a person upon the recommendation of relevant institutions, organizations, and individuals.
 Article 8 (Delegation of Authority and Entrustment of Business Affairs)
(1) Pursuant to Article 13 (1) of the Act, the Minister of Oceans and Fisheries shall delegate his or her authority to revoke the registration of a community under Article 9 (4) of the Act to the head of a Si/Gun/Gu.
(2) Pursuant to Article 13 (2) of the Act, the Minister of Oceans and Fisheries may entrust a private organization or a dedicated agency prescribed in Article 33 of the Framework Act on Fisheries and Fishing Villages Development with the following business affairs:
1. A fact-finding survey under Article 6 (1) of the Act;
2. Education and training under Article 7 of the Act;
3. Technology exchange and public relations under Article 8 of the Act;
4. Evaluation of activities under Article 11 (2) of the Act.
(3) Where the Minister of Oceans and Fisheries entrusts duties pursuant to paragraph (2), he or she shall give public notice of the institutions entrusted with such duties, the details of the entrusted duties, etc. in the Official Gazette and shall make them public on the website of the Ministry of Oceans and Fisheries, etc.
 Article 9 (Standards for Imposition of Administrative Fines)
Standards for imposing administrative fines under Article 14 (1) of the Act shall be as specified in the attached Table.
ADDENDUM <Presidential Decree No. 31439, Feb. 9, 2021>
This Decree shall enter into force on February 19, 2021.
