NATIONAL ASSEMBLY BUDGET OFFICE ACT

 Article 1 (Purpose)
The purpose of this Act is to prescribe the organization and functions of the National Assembly Budget Office and other necessary matters.
 Article 2 (Status)
(1) The National Assembly Budget Office (hereinafter referred to as the "Budget Office") shall be established under the control of the Speaker of the National Assembly (hereinafter referred to as the "Speaker").
(2) The independence of the Budget Office shall be respected with regard to its functions.
 Article 3 (Functions)
The Budget Office shall handle the following business affairs in relation to the national budget, the settlement of accounts, funds, and financial management of the State::
1. Research and analysis on budget bills, settlement of accounts, fund management plans, and settlement of funds;
2. Estimation of costs regarding bills, such as legislative bills, etc. requiring budgetary or fund measures;
3. Analysis and prospects of national financial management and macroeconomic trends;
4. Analysis and evaluation of major projects of the State and analysis of mid- and long-term financial needs;
5. Surveys and analysis of requests by the Committees of the National Assembly (hereinafter referred to as the "Committees") or members of the National Assembly;
 Article 4 (Chief)
(1) The Chief of the National Assembly Budget Office (hereinafter referred to as the "Chief") shall be a public official in political service, and shall be paid the same amount of remuneration as a vice-minister.
(2) The Chief shall secure expertise and remain neutral in handling his or her business affairs.
(3) The Chief shall exercise overall control over the business affairs of the Budget Office under the supervision of the Speaker, and shall direct and supervise public officials under his or her control: Provided, That this shall not apply where the National Assembly Secretariat Act, the State Public Officials Act, the National Finance Act, the State Property Act, or other statutes or regulations prescribe that, out of the business affairs related to the Budget Office, personnel administration, budget and accounting, management of state-owned property, management of commodities, contingency plans, registration of property owned by public servants, etc., fall under the authority of the National Assembly Secretariat or the Secretary General of the National Assembly. <Amended on Oct. 4, 2006>
 Article 5 (Recommendation Committee of Chief of National Assembly Budget Office)
(1) The Speaker shall receive a recommendation from the Recommendation Committee of Chief of National Assembly Budget Office (hereafter in this Article referred to as the "Recommendation Committee") in advance when he or she requests consent to the appointment of the Chief pursuant to Article 22-2 (3) of the National Assembly Act.
(2) The Recommendation Committee shall be composed of persons who are neither members nor public officials of the National Assembly and who can handle the recommendation affairs impartially with expertise in the functions of the Budget Office while remaining politically neutral.
(3) Matters necessary for the composition, operation, etc. of the Recommendation Committee shall be prescribed by the Regulations.
 Article 5-2 (Documents to Be Accompanied for Consent to Appointment)
(1) To request consent to the appointment of the Chief under Article 5 (1), evidential documents regarding the following matters shall be accompanied:
1. Occupation, educational background, and career;
4. Records of payment of income tax, property tax, and aggregate land tax, and delinquency of payment thereof for the recent five years;
5. Criminal records.
(2) If necessary, a person whose appointment requires consent under paragraph (1) may request documents under the subparagraphs of that paragraph from the head of a Stage agency, a local government, or any other relevant agency, and the head of the agency in receipt of such request shall comply therewith.

 Article 6 (Appointment of Public Officials)
Public officials of Grade V or higher in the Budget Office shall be appointed and dismissed by the Speaker, and the other public officials shall be appointed and dismissed by the Chief: Provided, That the Speaker may delegate part of his or her authority to appoint such officials to the Chief as prescribed by the National Assembly Regulations.
 Article 7 (Organization)
(1) The Budget Office shall have assistant chiefs, director generals, and directors as its subsidiary organs: Provided, That the titles of the subsidiary organs may be differently set as prescribed by the National Assembly Regulations.
(2) The Budget Office may have officers who are in charge of directly assisting the Chief, assistant chiefs and director generals, and have one division under the control of the Chief that does not belong to a department or bureau.
(3) Assistant chiefs shall be appointed from among public officials of Grade I, II or research officers in general service, director generals from among public officials of Grade II, III or research officers in general service, and directors from among public officials of Grade III, IV or research officers in general service, respectively; and officers in charge shall be appointed from among public officials of Grades II through IV or research officers in general service or public officials in extraordinary civil service equivalent to Grades II through IV. <Amended on Dec. 11, 2012; Apr. 16, 2019>
(4) An advisory body may be established under the control of the Chief to provide advice to the Chief.
(5) The fixed number of public officials to be placed in the Budget Office, the establishment of departments, bureaus, divisions, and officers in charge and the assignment of their duties, and other necessary matters shall be prescribed by the National Assembly Regulations: Provided, That the establishment of divisions and officers in charge equivalent thereto and the assignment of their duties may be determined by the Chief.
 Article 7-2 (Position Screening of Public Officials in Research Service)
(1) The Chief may conduct the position screening of public officials in research service in order to employ public officials in research service.
(2) The Chief may determine the positions subject to competitive career employment examinations based on the result of position screening under paragraph (1), and request the head of an agency conducting the examination under Article 34 (3) of the State Public Officials Act to conduct a competitive career employment examination (referring to an examination under the main clause, with the exception of its subparagraphs, of Article 28 (2) of that Act).
(3) Matters necessary for procedures for position screening under paragraph (1) and competitive career employment examinations, etc. under paragraph (2) shall be prescribed by the National Assembly Regulations.

 Article 8 (Provision of Data to Committees and National Assembly Members)
The Chief, in performing the functions, shall provide necessary data, if requested by the Committees or members of the National Assembly.
 Article 9 (Report to Committees)
(1) The Chief or a public official under the control of and designated by the Chief shall provide a report or explanation to the relevant Committees to comply with its request.
(2) In performing the functions, if the Chief deems that there are any violations committed by relevant administrative agencies or any required improvements in statutes or regulations, systems, or administration, he or she shall file a report thereon with the competent Standing Committee of the National Assembly having jurisdiction over the relevant affair and the Special Committee on Budget and Accounts. <Amended on Mar. 24, 2020>
 Article 10 (Request for Data)
The Chief may request that state agencies and other institutions or organizations provide data necessary for the performance of the functions after obtaining the permission of the Speaker. In such cases, a person in receipt of such request shall comply therewith, unless there is any compelling reason not to do so.
 Article 11 (Delegation Provisions)
The matters mandated by this Act to be prescribed by the National Assembly Regulations and those necessary for the enforcement of this Act shall be determined by the Speaker with the consent of the House Steering Committee of the National Assembly.
ADDENDA <Act No. 6931, Jul. 18, 2003>
(1) (Enforcement Date) This Act shall enter into force three months after the date of its promulgation: Provided, That Article 5 shall enter into force on the date of its promulgation.
(2) (Omitted) The National Assembly Secretariat Act shall be amended as follows:
"Director of the National Assembly Library" in Article 12 shall be replaced with the "Director of the National Assembly Library, the National Assembly Budget Office or the Chief of the National Assembly Budget Office".
