ENFORCEMENT DECREE OF THE SPECIAL ACT ON CONSERVATION, MANAGEMENT AND UTILIZATION OF WORLD HERITAGE

Presidential Decree No. 34505, May 14, 2024

 Article 1 (Purpose)
The purpose of this Decree is to prescribe matters mandated by the Special Act on Conservation, Management and Utilization of World Heritage and matters necessary for the enforcement thereof.
 Article 2 (Consultation on Major Policies)
Pursuant to Article 6 (1) of the Special Act on the Conservation, Management and Utilization of World Heritage (hereinafter referred to as the "Act"), the head of a central administrative agency, and the Special Metropolitan City Mayor, a Metropolitan City Mayor, a Special Self-Governing City Mayor, Do Governor, or a Special Self-Governing Province Governor (hereinafter referred to as the "Mayor/Do Governor") shall consult in advance with the Administrator of the Korea Heritage Service when establishing the following policy measures or plans: <Amended on May 14, 2024>
1. Designation of enterprise city development zones pursuant to Article 5 of the Special Act on the Development of Enterprise Cities;
2. Designation of urban development zones under Article 3 of the Urban Development Act and planning of urban development projects under Article 4 of that Act;
3. Designation of wetland protection areas and wetland surrounding management areas pursuant to Article 8 of the Wetlands Conservation Act;
4. Designation of natural parks under Article 4 of the Natural Parks Act;
5. Designation of ecological and landscape conservation areas under Article 12 of the Natural Environment Conservation Act;
6. Designation of protected marine areas pursuant to Article 25 of the Conservation and Management of Marine Ecosystems Act.
 Article 3 (Public Notice of Designation of World Heritage Districts)
(1) When the Administrator of the Korea Heritage Service designates, changes or cancels (hereinafter referred to as "designation, etc.") a World Heritage District (hereinafter referred to as "World Heritage District") pursuant to Article 10 (1) of the Act, he or she shall publicly notify the following matters pursuant to Article 10 (6) of that Act: <Amended on May 14, 2024>
1. Details of the name, location, area, topographical map, etc. of the World Heritage District;
2. Grounds for the designation, etc.;
3. Other matters related to the designation, etc. of a World Heritage District that need to be notified to the general public.
(2) The competent Mayor/Do Governor or the head of a Si/Gun/Gu (referring to the head of an autonomous Gu; hereinafter the same shall apply), who has received the copies of the relevant documents shall publicly announce the content of such copies on the bulletin board and website of the Special Metropolitan City, a Metropolitan City, a Special Self-Governing City, Do, a Special Self-Governing Province (hereinafter referred to as "City/Do") or Si/Gun/Gu (referring to autonomous Gu; hereinafter the same shall apply) and make them accessible for public viewing for at least 30 days.
 Article 4 (Public Announcement of Implementation Plan for Each World Heritage)
Where the competent Mayor/Do governor intends to publish an implementation plan for each World Heritage pursuant to Article 13 (2) of the Act, he or she shall publicly announce it on the bulletin board and website of the City/Do, and shall make it accessible for public viewing for at least 30 days.
(1) The annual project plan (hereinafter referred to as "project plan") pursuant to Article 14 (1) of the Act shall include the following matters:
1. Basic goals and outline of the project;
2. Implementation policies for each major project;
3. Detailed plans for each major project;
4. Implementation results of previous year's project;
5. Other matters necessary for the efficient implementation of the project.
(2) The Administrator of the Korea Heritage Service shall prepare the guidelines for formulating a project plan for the following year so that the competent Mayor/Do Governor may establish a project plan in accordance with Article 14 (1) of the Act, and shall notify the Mayor/Do Governor thereof by October 31 of each year. <Amended on May 14, 2024>
(3) The Mayor/Do Governor shall establish a project plan for the following year in accordance with the guidelines for formulating a project plan under paragraph (2) and submit it to the Administrator of the Korea Heritage Service by December 31 of each year. <Amended on May 14, 2024>
(4) The Administrator of the Korea Heritage Service shall compile the project plan submitted pursuant to paragraph (3) and notify the Mayor/Do Governor, and publicly announce it on the bulletin board and website of the Korea Heritage Service. <Amended on May 14, 2024>
(5) The Mayor/Do Governor shall publicly announce the project plan received pursuant to paragraph (4) on the bulletin board and website of City/Do.
 Article 6 (Content of Basic Investigation)
(1) The content of the basic investigations under Article 15 (1) of the Act shall include the following matters:
1. Matters concerning the outstanding universal value of the World Heritage and Tentative List Properties;
2. Matters pertaining to the current status of the conservation, management and utilization of the World Heritage;
3. Other matters necessary for the conservation, management and utilization of the world heritage.
(2) The Administrator of the Korea Heritage Service or the competent Mayor/Do Governor may request the head of the relevant central administrative agency to submit data necessary for the basic investigation pursuant to paragraph (1), and the head of the relevant central administrative agency in receipt of such request shall comply therewith unless there are special reasons not to do so. <Amended on May 14, 2024>
 Article 7 (Submission of Regular Inspection Results)
(1) The results of regular inspections pursuant to the latter part of Article 16 (1) of the Act shall include the following matters:
1. Current status of the World Heritage, including the name, location, and areas of the World Heritage;
2. Overview of regular inspections, including the date and details, etc. of regular inspections;
3. Matters specified in the report format (only applicable to periodic reports) pursuant to Article 29 of the Convention on the Protection of World Cultural Heritage and Natural Heritage (hereinafter referred to as “World Heritage Convention”);
4. Comparison with the previous year’s regular inspection results;
5. General opinions.
(2) The competent Mayor/Do Governor shall submit the results of regular inspections under paragraph (1) to the Administrator of the Korea Heritage Service by January 31 of each year. <Amended on May 14, 2024>
(3) Except as otherwise provided for in paragraphs (1) and (2), matters concerning the methods, procedures, etc. of regular inspections shall be prescribed by the Administrator of the Korea Heritage Service. <Amended on May 14, 2024>
 Article 8 (Matters for Consultation with World Heritage Conservation Council)
“Matters prescribed by Presidential Decree” in Article 18 (1) 4 of the Act means the following matters:
1. Matters requested by the World Heritage Committee in accordance with Article 8 of the World Heritage Convention, such as changes to the boundaries or names of the World Heritage;
2. Matters related to the implementation of restoration projects or construction projects that may have a significant impact on the outstanding universal value of the World Heritage.
 Article 9 (Term of Office of Council Members)
The term of office for the members of the World Heritage Conservation Council (hereinafter referred to as “the Council") who are not public officials, pursuant to Article 18 (2) of the Act, shall be 2 years, and they may be reappointed for one additional term only.
 Article 10 (Dismissal and Removal of Council Members)
If a member of the Council falls under any of the following subparagraphs, the Council member may be dismissed or removed:
1. When the Council member becomes incapable of performing his or her duties due to any mental or physical disorder;
2. When the Council member engages in misconduct in connection with his or her duties;
3. When the person is deemed unsuitable to be a Council member due to neglect of duty, loss of dignity, or other reasons;
4. When he or she personally expresses his or her intent that fulfilling duties is difficult.
 Article 11 (Allowances)
The Council members who attend the council meetings may be paid an allowance within the budget: provided, if a Council member who is a public official attends the meeting directly related to his or her duties, no allowance shall be paid.
 Article 12 (Operating Rules)
In addition to the matters stipulated in Articles 8 through 11, matters necessary for the operation of the Council shall be determined by the chairperson after resolution by the Council.
 Article 13 (Hearing Opinions of Residents)
(1) If the Administrator of the Korea Heritage Service or the competent Mayor/Do Governor intends to hear the opinions of local residents and relevant experts pursuant to Article 19 (1) of the Act, he or she shall publicly announce the data regarding the matters specified in each subparagraph of Article 15 (1) of the Act on the bulletin board and website of the Korea Heritage Service or the City/Do, and ensure that it is available for public viewing for at least 60 days. <Amended on May 14, 2024>
(2) Any person who has an opinion regarding the content of the viewing pursuant to paragraph (1) may submit his or her opinion during the viewing period, and the Administrator of the Korea Heritage Service or the Mayor/Do Governor shall review the submitted opinion and notify the person who submitted the opinion of the reviewing results within 30 days from the end date of the viewing period. <Amended on May 14, 2024>
 Article 14 (State Management of World Heritage)
(1) If the head of the competent local government intends to request the State for direct management of the World Heritage pursuant to Article 20 (1) 1 of the Act, he or she shall submit the following documents to the Administrator of the Korea Heritage Service: <Amended on May 14, 2024>
1. Documents stating the reasons why direct management by the State is necessary;
2. In cases where the World Heritage extends across two or more City/Do, a letter of consent from the competent Mayor/Do Governor and the head of a Si/Gun/Gu;
3. A report on the results of gathering opinions from local residents and others.
(2) Except as provided in paragraph (1), matters necessary for the national management of the World Heritage shall be prescribed by the Administrator of the Korea Heritage Service. <Amended on May 14, 2024>
 Article 15 (Financial Support)
“Projects prescribed by Presidential Decree” in subparagraph 6 of Article 22 of the Act means the following projects:
1. Project to encourage local community participation in environmental cleanup in the World Heritage Districts and to improve the quality of life of residents;
2. Construction and operation of the world heritage information system in accordance with Article 17 of the Act;
3. Education utilizing the World Heritage, such as production of educational materials and experiential learning programs for the World Heritage.
 Article 16 (Entrustment of Authority)
(1) The Administrator of the Korea Heritage Service may entrust the following authorities to the institutions, corporations, or organizations with expertise in the field of the World Heritage that are established for the purpose of protecting, conserving, disseminating, or utilizing the national heritage: <Amended on May 7, 2024>
1. Basic survey on the World Heritage, etc. pursuant to Article 15 of the Act;
2. Regular inspections and the analysis and evaluation of the inspection results pursuant to Article 16 of the Act.
(2) When the Administrator of the Korea Heritage Service entrusts authority pursuant to paragraph (1), he or she shall publicly notify the name of the entrusted institutions and the details of entrustment. <Amended on May 7, 2024>

This Decree shall enter into force on February 5, 2021.
