| Article 2 (Plans prioritized over comprehensive plans for conservation and management of Pungnaptoseong Earthen Fortification) |
| Article 3 (Formulation of comprehensive plan for conservation and management of Pungnaptoseong Earthen Fortification) |
| (1) | If the Administrator of the Korea Heritage Service intends to formulate a comprehensive plan for the conservation and management of Pungnaptoseong Earthen Fortification under Article 5 (1) of the Act (hereinafter referred to as "comprehensive plan"), he or she shall publicly announce a draft comprehensive plan on the website of the Korea Heritage Service, and make it available for public inspection for at least 30 days, in order to hear opinions from local residents, experts, etc. and reflect such opinions, under paragraph (3) of that Article. <Amended on May. 14, 2024> |
| (2) | Any person who has opinions on the details of public announcement under paragraph (1) may submit his or her opinions during the period of public inspection. |
| (3) | The Administrator of the Korea Heritage Service shall review the opinions submitted under paragraph (2) and notify a person who submitted the opinions of the results of review within 60 days from the date the inspection period expires. <Amended on May. 14, 2024> |
| (4) | The Mayor of Seoul Special Metropolitan Government and the mayor of Songpa-gu shall publicly announce the formulated comprehensive plan on the websites of the Seoul Special Metropolitan City and Songpa-gu under Article 5 (4) of the Act and make it available for public inspection for at least 30 days. |
| Article 4 (Formulation of annual implementation plan) |
| (1) | An annual implementation plan under Article 5 (5) of the Act (hereinafter referred to as "implementation plan") shall include the following matters: |
| 1. | Direction-setting for promoting the conservation and management projects; |
| 2. | Detailed implementation plan for preservation and management projects; |
| 3. | Project cost and funding plan for the preservation and management project; |
| 4. | Other matters necessary for the preservation and management of Pungnaptoseong Earthen Fortification. |
| (2) | The Mayor of the Seoul Metropolitan Government shall submit an implementation plan to the Administrator of the Korea Heritage Service by December 31 of each year under Article 5 (5) of the Act and obtain approval thereof. <Amended on May. 14, 2024> |
| (3) | Where the Mayor of the Seoul Metropolitan Government obtains approval under Article 5 (5) of the Act, he or she shall publicly announce the relevant implementation plan on the website of the Seoul Metropolitan Government and make it available to the citizens for public inspection for at least 30 days. |
| Article 5 (Content of basic investigation) |
| (1) | The subject matters of the basic investigation (hereinafter referred to as “basic investigation”) under Article 6 (1) of the Act are as follows: <Amended on May 14, 2024> |
| 1. | Current status of Pungnaptoseong Earthen Fortification; |
| 2. | Current status of and plan for the land use in Pungnaptoseong Earthen Fortification and surrounding areas; |
| 3. | Matters relating to the basic urban and Gun plans under subparagraph 3 of Article 2 of the National Land Planning and Utilization Act in relation to Pungnaptoseong Earthen Fortification and its surrounding areas, and the urban and Gun management plans under subparagraph 4 of that Article, and the current status of and plans for the infrastructure under subparagraph 6 of that Article; |
| 4. | Other matters deemed necessary by the Administrator of the Korea Heritage Service, the Mayor of the Seoul Metropolitan Government, or the mayor of Songpa-Gu to designate a conservation and management area. |
| (2) | The Administrator of the Korea Heritage Service, the Mayor of the Seoul Metropolitan Government, or the mayor of Songpa-gu may request the head of a relevant central administrative agency to submit data necessary for the basic investigation. <Amended on May. 14, 2024> |
| (3) | In conducting a basic investigation, the Administrator of the Korea Heritage Service, the Mayor of the Seoul Metropolitan Government, or the mayor of Songpa-gu may utilize data, if any, from survey conducted under other statutes or regulations regarding the subject matter of the investigation. <Amended on May 14, 2024> |
| Article 6 (Hearing opinions on designation of conservation and management areas) |
| (1) | If the Administrator of the Korea Heritage Service intends to grant a designation, revocation, or modification (hereinafter referred to as "designation, etc.") of a conservation and management area under Article 7 (1) and (2) of the Act, he or she shall publicly announce the matters referred to in the subparagraphs of paragraph (1) of that Article on the website of the Korea Heritage Service to hear opinions of local residents, experts, etc. and reflect such opinions under paragraph (3) of that Article, and shall make them available to the general public for inspection for at least 30 days. <Amended on May. 14, 2024> |

| Article 7 (Public notice of designation of conservation and management areas) |
| (1) | If the Administrator of the Korea Heritage Service determines the designation, etc. of a conservation and management area under Article 7 (4) of the Act, he or she shall give public notice of the following matters: <Amended on May. 14, 2024> |
| 1. | Name, location and surface area of the conservation and management area; |
| 2. | Grounds for designation, etc.; |
| 3. | Other matters related to the designation, etc. of a conservation and management area that need to be made known to the general public. |
| (2) | The Mayor of Seoul Metropolitan Government and the mayor of Songpa-gu who receives the copies of relevant documents under Article 7 (4) of the Act shall post the content of the copies on the websites of the Seoul Metropolitan Government and Songpa-gu and make them available for public inspection for at least 30 days. |
| Article 8 (Scope of resident support projects) |
The “resident support projects prescribed by Presidential Decree” in Article 10 (1) of the Act refers to the following projects: <Amended on May 7, 2024> | 1. | Projects for the establishment and support for Baekje History and Culture Experience Learning Center; |
| 2. | Projects for the improvement of the infrastructure such as roads, parking lots, and water supply and sewage systems; |
| 3. | Projects for the establishment and operation of the libraries, exhibition halls, etc.; |
| 4. | Support project for residents' groups established for the activities for improving the historical and cultural environment and similar activities (referring to the natural scenery or surrounding environment around the national heritage with outstanding historical and cultural value that needs to be protected together with the national heritage); |
| 5. | Trial excavation and excavation projects within the conservation and management area; |
| 6. | Other projects deemed necessary by the Administrator of the Korea Heritage Service to improve the residential and living environment of residents. |
| Article 9 (Targets for reduction or exemption of usage fees) |
In Article 11 of the Act, “facilities prescribed by Presidential Decree such as public facilities and facilities serving the public interest” refers to public facilities and public-use facilities installed in line with a resident support project under Article 10 of the Act.
ADDENDA <Presidential Decree No. 31544, Mar. 23, 2021>
Article 1 (Enforcement date)
This Decree shall enter into force on June 10, 2021.
Article 2 (Special cases on submission of implementation plans)
The Mayor of the Seoul Metropolitan Government shall submit the first implementation plan to be formulated after this Decree enters into force to the Administrator of the Korea Heritage Service within 3 months from the formulation of a comprehensive plan, notwithstanding Article 4 (2).
