ENFORCEMENT DECREE OF THE SPECIAL ACT ON THE RESTORATION AND MAINTENANCE OF KEY HISTORIC SITES OF THE SILLA ROYAL CAPITAL

 Article 1 (Purpose)
The purpose of this Decree is to prescribe matters mandated by the Special Act on the Restoration and Maintenance of Key Historic Sites of the Silla Royal Capital and matters necessary for the enforcement thereof.
 Article 2 (Scope of core relics of Silla Royal Capital)
In subparagraph 2 of Article 2 of the Special Act on the Restoration and Maintenance of Key Historic Sites of the Silla Royal Capital (hereinafter referred to as the "Act"), "any ruins located in the Silla Royal Capital as prescribed by Presidential Decree, which include the royal palace site of Silla, Hwangnyongsa Temple, Donggung Palace and Wolji Pond, and the Cheomseongdae Observatory" means the following historic sites designated as the State-designated cultural heritage under the Act on Conservation and Utilization of Cultural Heritage: <Amended on May 7, 2024>
1. Silla Royal Palace (referring to Wolseong Palace Site in Gyeongju);
2. Hwangryongsa Temple Site and Surrounding Area in Gyeongju: The following historic sites:
a. Hwangryongsa Temple Site in Gyeongju;
b. Bunhwangsa Temple Site in Gyeongju;
c. Wonji Site and Surrounding Area in Guhwang-dong in Gyeongju;
d. Three-story Stone Pagoda at Mitansa Temple Site in Gyeongju;
3. Donggung Palace and Wolji Pond in Gyeongju;
4. Cheomseongdae in Gyeongju;
5. Daereungwon Ancient Tomb Complex and Surrounding Area in Gyeongju;
6. Archaeological Area in Eastern Gyeongju;
7. Chunyanggyoji and Woljeonggyoji Bridge Sites and Surrounding Areas in Gyeongju: The following historic sites:
a. Chunyanggyo and Woljeonggyo Bridge Sites in Gyeongju;
b. Temple Site in Inwang-dong in Gyeongju;
c. Cheongwansa Temple Site in Gyeongju;
8. Archaeological Area of Nangsan Mountain in Gyeongju;
9. Sacheonwangsa Temple Site in Gyeongju.
 Article 3 (Important matters of comprehensive plan for restoration and maintenance of key historic sites of the Silla Royal Capital)
(1) "Any important matters in the comprehensive plan as prescribed by Presidential Decree" in the latter part of Article 5 (1) of the Act means the following matters: <Amended on May 7, 2024>
1. Scope of key historic sites of the Silla Royal Capital;
2. Status of the protection zone designated under Article 27 (1) of Act on Conservation and Utilization of Cultural Heritage with respect to key historic sites of the Silla Royal Capital;
3. Promotion of the restoration and maintenance project of key historic sites of the Silla Royal Capital (hereinafter referred to as the "restoration and maintenance project") under Article 8 of the Act.
(2) The "matters prescribed by Presidential Decree" in Article 5 (2) 5 of the Act means the following matters: <Amended on May 7, 2024>
1. Current status of key historic sites of the Silla Royal Capital;
2. Current status of the historical and cultural environment of key historic sites of the Silla Royal Capital (referring to the surrounding environment that needs to be protected together with the national heritage, involving the natural landscape or space with outstanding historical and cultural value surrounding the national heritage);
3. Repair history and the current status of the conservation and management of key historic sites of the Silla Royal Capital;
4. External cooperation for the restoration and maintenance of key historic sites of the Silla Royal Capital;
5. Education and promotion related to key historic sites of the Silla Royal Capital;
6. The impact of the restoration and maintenance of key historic sites of the Silla Royal Capital on the conservation and management of World Heritage (referring to heritage inscribed on the World Heritage List by the United Nations Educational, Scientific and Cultural Organization in accordance with the Convention Concerning the Protection of the World Cultural and Natural Heritage; hereinafter the same shall apply);
7. The current status of implementation progress and the performance analysis of the restoration and maintenance projects.
(3) If necessary for the formulation or change of the comprehensive plan for the restoration and maintenance of key historic sites of the Silla Royal Capital under Article 5 (1) of the Act (hereinafter referred to as the "comprehensive plan"), the Administrator of the Korea Heritage Service may request Gyeongju City Mayor to submit relevant data. <Amended on May 14, 2024>
(4) If the Administrator of the Korea Heritage Service intends to formulate or amend the comprehensive plan, he or she shall hear opinions of relevant experts. <Amended on May. 14, 2024>
(5) Where the Administrator of the Korea Heritage Service formulates or amends a comprehensive plan, he or she shall notify the Governor of Gyeongsangbuk-do and Gyeongju City Mayor thereof, and publicly announce it on the website of the Korea Heritage Service. <Amended on May. 14, 2024>
 Article 4 (Formulation of annual implementation plan)
(1) The annual implementation plan under Article 6 (1) of the Act (hereinafter referred to as the "implementation plan") shall include the following matters: <Amended on May 14, 2024>
1. Direction for the promotion of the restoration and maintenance projects;
2. Detailed plans for the restoration and maintenance projects;
3. Expenses and financing plans for the restoration and maintenance projects;
4. Other matters necessary for the implementation of restoration and maintenance projects, as determined by the Administrator of the Korea Heritage Service.
(2) Gyeongju City Mayor shall formulate an implementation plan for the following year by December 31 of each year and submit it to the Administrator of the Korea Heritage Service. <Amended on May 14, 2024>
(3) Where the Administrator of the Korea Heritage Service approves the implementation plan under Article 6 (1) of the Act, he or she shall notify the fact to the Governor of Gyeongsangbuk-do and Gyeongju City Mayor, and the Governor of Gyeongsangbuk-do and Gyeongju City Mayor shall, without delay, publicly announce the implementation plan on the bulletin boards and websites of the relevant institutions. <Amended on May 14, 2024>
 Article 5 (Duties and composition of promotion team)
(1) The promotion team for the conservation and maintenance of key historic sites of the Silla Royal Capital under Article 7 (1) of the Act (hereinafter referred to as the "promotion team") shall perform the following business affairs:
1. Formulation and revision of comprehensive plan;
2. General supervision and coordination of the restoration and maintenance projects;
3. Basic survey and research related to the restoration and maintenance projects;
4. External cooperation for the restoration and maintenance of key historic sites of the Silla Royal Capital;
5. Education and promotion related to key historic sites of the Silla Royal Capital;
6. Analysis of the impacts of the restoration and maintenance projects on the conservation and management of world heritage;
7. Other matters necessary for the promotion of restoration and maintenance projects.
(2) The promotion team shall be composed of 1 team leader and members.
(3) The leader of the promotion team (hereinafter referred to as the "head") shall be appointed by the Administrator of the Korea Heritage Service from among public officials who belong to the Korea Heritage Service. <Amended on May 14, 2024; Jul. 22, 2025>
(4) The members of the promotion team (hereinafter referred to as "members") shall be those who are dispatched from among public officials affiliated with the Korea Heritage Service and related administrative agencies, and the employees of related institutions and organizations. <Amended on May 14, 2024>
(5) The head shall oversee the operation and business affairs of the promotion team under the direction of the Administrator of the Korea Heritage Service, and direct and supervise the members. <Amended on May 14, 2024>
ADDENDA <Presidential Decree No. 31127, Oct. 27, 2020>
Article 1 (Enforcement date)
This Decree shall enter into force on December 11, 2020.
Article 2 (Special cases regarding formulation of implementation plans)
The first implementation plan to be formulated after this Decree enters into force shall be formulated within 3 months after the comprehensive plan is established, notwithstanding Article 4 (2).
