ENFORCEMENT DECREE OF FRAMEWORK ACT ON NATIONAL HERITAGE

Presidential Decree No. 34487, May 7, 2024

 Article 1 (Purpose)
The purpose of this Decree is to prescribe matters delegated by the Framework Act on National Heritage and matters necessary for the enforcement thereof.
 Article 2 (Inter-Korean cooperation on national heritage exchange)
(1) The Administrator of the National Heritage Administration may, within the limits of the budget, provide financial support for expenses necessary for the projects set forth in the following subparagraphs, in order to promote mutual exchanges and cooperation between South and North Korea in the field of national heritage, pursuant to Article 29(1) of the Framework Act on National Heritage (hereinafter referred to as the “Act”):
1. Joint investigation, research, and repair of national heritage;
2. Exchange of information and technology related to the conservation and management of national heritage;
3. Exchange of experts in the field of national heritage;
4. Support for the inscription of North Korean national heritage on the UNESCO World Heritage List;
5. Promotion of national heritage exchange and cooperation projects;
6. Other projects necessary to promote mutual exchanges and cooperation between South and North Korea in the field of national heritage.
(2) Where the Administrator of the Korea Heritage Service requests cooperation from relevant organizations pursuant to Article 29(3) of the Act, the Administrator shall make the request in writing, clearly stating the grounds for the need for cooperation, the period of cooperation, and the details of cooperation.
 Article 3 (Protection of World Heritage)
(1) Where it is necessary for the conservation of World Heritage, etc. provided in Article 31(2) of the Act (hereinafter referred to as “World Heritage sites, etc.” in this Article), the Administrator of the Korea Heritage Service may conduct regular surveys and inspections of the current status and condition of World Heritage, etc.
(2) The Administrator of the Korea Heritage Service may request the head of a competent local government having jurisdiction over the location of World Heritage, etc. to submit materials and opinions necessary for the investigations and inspections under paragraph (1). In such cases, the head of a local government who is requested to submit such relevant materials and opinions shall comply with the request unless there is a special reason not to do so.
(3) Where the Administrator of the Korea Heritage Service issues an order to take measures pursuant to Article 31(3) of the Act, such order shall be made in writing and shall include the matters set forth in the following subparagraphs:
1. The act that gave rise to the order to take measures;
2. The details of measures and the period for compliance with the order to take measures;
3. The timing and method of notification of the results of compliance with the order to take measures.
 Article 4 (Submission of business plans)
(1) The Korea Heritage Agency established pursuant to Article 32 of the Act (hereinafter referred to as the “KHA”) shall prepare a business plan and a budget for the following fiscal year and submit them to the Administrator of the Korea Heritage Service by November 30 of each year.
(2) The KHA shall prepare a business performance report and a statement of accounts for each fiscal year and submit them to the Administrator of the Korea Heritage Service by the end of February of the following fiscal year.
 Article 5 (Criteria for imposition of administrative fines)
The criteria for imposing administrative fines under Article 35(1) of the Act are as set forth in Appendix.

Article 1 (Enforcement date)
This Decree shall enter into force on May 17, 2024.
Article 2 Omitted.
Article 3 (Relationship to other statutes or regulations)
A citation of the former Enforcement Decree of the Cultural Heritage Protection Act or any provisions thereof in other statutes or regulations as at the time this Decree enters into force shall be deemed a citation of this Decree or the corresponding provisions of this Decree, in lieu of the former Enforcement Decree of the Cultural Heritage Protection Act or the provisions thereof, if such corresponding provisions exist herein.
