제1장 총칙
CHAPTER I GENERAL PROVISONS
제1조(목적)
이 법은 한국수화언어가 국어와 동등한 자격을 가진 농인의 고유한 언어임을 밝히고, 한국수화언어의 발전 및 보전의 기반을 마련하여 농인과 한국수화언어사용자의 언어권과 삶의 질을 향상시키는 것을 목적으로 한다.
Article 1 (Purpose)
The purpose of this Act is to improve the right to language and quality of life of the deaf and the users of the Korean sign language, by declaring that Korean sign language is the inherent language of the deaf, which has the same status with the Korean national language, and by laying the foundation for development and preservation of Korean sign language.
제2조(기본이념)
① 한국수화언어(이하 “한국수어”라 한다)는 대한민국 농인의 공용어이다.
② 국가와 국민은 한국수어를 사용하는 농인이 농정체성을 확립하고 한국수어와 농문화를 계승ㆍ발전할 수 있도록 협력한다.
③ 농인과 한국수어사용자(이하 “농인등”이라 한다)는 한국수어 사용을 이유로 정치ㆍ경제ㆍ사회ㆍ문화의 모든 생활영역(이하 “모든 생활영역”이라 한다)에서 차별을 받지 아니하며, 모든 생활영역에서 한국수어를 통하여 삶을 영위하고 필요한 정보를 제공받을 권리가 있다.
④ 농인등은 한국수어로 교육받을 권리가 있다.
Article 2 (Basic Idea)
(1) Korean sign language is the official language of the deaf of the Republic of Korea.
(2) The State and the people shall give assistance so that the deaf using Korean sign language can establish their deaf identity and succeed to and develop Korean sign language and deaf culture.
(3) The deaf and the users of Korean sign language (hereinafter referred to as the “deaf, etc.”) shall not be discriminated against in any of the life areas of politics, economics, society and culture (hereinafter referred to as “all life areas”) for using Korean sign language, and shall have the right to live a life and be provided with the necessary information required for using Korean sign language in all life areas.
(4) The deaf, etc. shall have the right to education provided in Korean sign language.
제3조(정의)
이 법에서 사용하는 용어의 뜻은 다음과 같다.
1. “한국수어”란 대한민국 농문화 속에서 시각ㆍ동작 체계를 바탕으로 생겨난 고유한 형식의 언어를 말한다.
2. “농인”이란 청각장애를 가진 사람으로서 농문화 속에서 한국수어를 일상어로 사용하는 사람을 말한다.
3. “한국수어사용자”란 농인 외에 청각장애 또는 언어장애로 인하여 한국수어를 일상어로 사용하거나 보조적으로 사용하는 사람을 말한다.
4. “농문화”란 농인으로서의 농정체성과 가치관을 기반으로 하는 생활양식의 총칭을 말한다.
5. “농정체성”이란 농인으로서 가지는 자기동일성을 말한다.
6. “수어통역”이란 한국수어를 국어로 변환하거나 국어를 한국수어로 변환하는 것을 말한다.
7. “공공기관등”이란 국가, 지방자치단체 및 「공공기관의 운영에 관한 법률」에 따른 공공기관을 말한다.
Article 3 (Definitions)
The terms used in this Act are defined as follows:
1. The term “Korean sign language” means an inherent form of language created based on a visual and gestural system in the deaf culture of the Republic of Korea;
2. The term “the deaf” means to the persons with hearing disability who use Korean sign language as the everyday language in the deaf culture;
3. The term “user of Korean sign language” means to a person, other than the deaf, who uses Korean sign language as an everyday language or auxiliary means due to his or her hearing disability or language disorder;
4. The term “deaf culture” means to a generic term describing the lifestyles based on the deaf identity and a value system as a deaf;
5. The term “deaf identity” means to self-identity as a deaf;
6. The term “sign language interpretation” means to conversion of Korean sign language into the Korean language or conversion of the Korean language into Korean sign language;
7. The term "public institution, etc." means to the State, a local government, and a public institution under the Act on the Management of Public Institutions.
제4조(국가와 지방자치단체의 책무)
① 국가와 지방자치단체는 한국수어를 교육ㆍ보급하고 홍보하는 등 농인등의 한국수어 사용 환경을 개선하기 위한 정책을 수립ㆍ시행하여야 한다.
② 국가와 지방자치단체는 농인의 농정체성 확립과 농문화 육성에 필요한 정책을 수립ㆍ시행하여야 한다.
③ 국가와 지방자치단체는 제1항 및 제2항에 따른 정책을 수립ㆍ시행할 때 농인등의 의견을 수렴하고 참여를 보장하여야 한다. <신설 2022. 1. 18.>
④ 국가와 지방자치단체는 이 법을 해석ㆍ적용함에 있어 「장애인의 권리에 관한 협약」의 내용과 취지에 부합하도록 하여야 한다. <개정 2022. 1. 18.>
Article 4 (Responsibilities of the State and Local Governments)
(1) The State and local governments shall establish and implement policies for improving Korean sign language-using environment for the deaf, etc., such as educating, distributing and publicizing Korean sign language.
(2) The State and local governments shall establish and implement policies necessary for establishing the deaf identity of the deaf and fostering deaf culture.
(3) When formulating and implementing policies prescribed in paragraphs (1) and (2), the State and local governments shall collect the opinions of the deaf, etc. and guarantee their participation. <Added on Jan. 18, 2022>
(4) The State and local governments shall ensure that the interpretation and application of this Act align with the content and purport of the Convention on the Rights of Persons with Disabilities.
제5조(다른 법률과의 관계)
한국수어에 관하여 다른 법률에 특별한 규정이 있는 경우를 제외하고는 이 법에서 정하는 바에 따른다.
Article 5 (Relationship to Other Statutes)
Except as otherwise provided in other statutes, this Act shall apply to Korean sign language.
제2장 기본계획의 수립 등
CHAPTER II FORMULATION OF BASIC PLANS
제6조(기본계획의 수립)
① 문화체육관광부장관은 한국수어의 발전 및 보전을 위한 한국수어발전기본계획(이하 “기본계획”이라 한다)을 한국수어 관련 전문가들의 심의를 거쳐 5년마다 수립ㆍ시행하여야 한다.
② 기본계획에는 다음 각 호의 사항이 포함되어야 한다.
1. 한국수어정책의 기본방향과 추진목표에 관한 사항
2. 모든 생활영역에서 농인의 한국수어 사용 환경의 개선에 관한 사항
3. 한국수어의 연구 및 전문용어 표준화에 관한 사항
4. 한국수어의 교육에 관한 사항
5. 한국수어의 보급에 관한 사항
6. 한국수어 통역에 관한 사항
7. 한국수어 관련 전문인력 양성에 관한 사항
8. 농인의 농정체성 확립과 농문화 육성에 관한 사항
9. 한국수어의 정보화에 관한 사항
10. 남북한 한국수어의 교류 및 연구에 관한 사항
11. 한국수어의 발전을 위한 민간 부분의 활동 촉진에 관한 사항
12. 한국수어 관련 법령의 제정ㆍ개정에 관한 사항
13. 그 밖에 한국수어의 발전에 필요한 사항
③ 문화체육관광부장관은 기본계획을 수립할 때에는 미리 관계 중앙행정기관의 장과 협의하여야 한다.
④ 문화체육관광부장관은 확정된 기본계획을 관계 중앙행정기관의 장과 특별시장ㆍ광역시장ㆍ특별자치시장ㆍ도지사ㆍ특별자치도지사(이하 “시ㆍ도지사”라 한다)에게 알려야 한다.
⑤ 문화체육관광부장관은 기본계획의 수립을 위하여 필요하다고 인정하는 경우 공공기관등에 기본계획의 수립에 필요한 자료의 제출을 요구할 수 있으며 자료의 제출을 요구받은 자는 정당한 사유가 없으면 이에 따라야 한다.
⑥ 그 밖에 기본계획의 수립 등에 필요한 사항은 대통령령으로 정한다.
Article 6 (Formulation of Basic Plans)
(1) The Minister of Culture, Sports and Tourism shall formulate and implement a basic plan for Korean sign language development (hereinafter referred to as “basic plan”) via deliberation by Korean sign language-related experts, every five years.
(2) Basic plans shall contain the following:
1. Basic direction-setting for and execution goals of the policies on Korean sign language;
2. Improving the Korean sign language-using environment for the deaf in all life areas;
3. Research of Korean sign language and the standardization of terminology in Korean sign language;
4. Korean sign language education;
5. Distribution of Korean sign language;
6. Korean sign language interpretation;
7. Fostering Korean sign language-related professional manpower;
8. Establishing deaf identity and fostering deaf culture;
9. Informatization of Korean sign language;
10. Exchange and research with respect to Korean sign languages of South and North Korea;
11. Promoting the private sector's activities for developing Korean sign language;
12. Enacting and amending the Korean sign language-related statutes or regulations;
13. Other matters necessary for developing Korean sign language.
(3) When formulating a basic plan, the Minister of Culture, Sports and Tourism shall consult in advance with the heads of the relevant central administrative agencies.
(4) The Minister of Culture, Sports and Tourism shall notify the heads of the relevant central administrative agencies, and the Special Metropolitan City Mayor, Metropolitan City Mayors, the Special Self-Governing City Mayor, Do Governors and the Special Self-Governing Province Governor (hereinafter referred to as “Mayors/Do Governors”), of the finalized basic plan.
(5) If deemed necessary for establishing a basic plan, the Minister of Culture, Sports and Tourism may request public institutions, etc. to submit materials necessary for establishing the basic plan, the persons requested to submit materials shall comply with such request, except in extenuating circumstances.
(6) Other matters necessary for establishing basic plans shall be prescribed by Presidential Decree.
제7조(연도별 시행계획의 수립ㆍ시행 등)
① 문화체육관광부장관, 관계 중앙행정기관의 장 및 시ㆍ도지사는 기본계획에 따라 매년 한국수어발전시행계획(이하 “시행계획”이라 한다)을 수립ㆍ시행하여야 한다.
② 관계 중앙행정기관의 장과 시ㆍ도지사는 다음 연도의 시행계획 및 전년도의 시행계획에 따른 추진실적을 대통령령으로 정하는 바에 따라 문화체육관광부장관에게 제출하고, 문화체육관광부장관은 매년 시행계획에 따른 추진실적을 평가하여야 한다.
③ 시행계획의 수립ㆍ시행과 추진실적의 평가 등에 필요한 사항은 대통령령으로 정한다.
Article 7 (Formulation and Implementation of Annual Implementation Plans)
(1) The Minister of Culture, Sports and Tourism, the heads of the relevant central administrative agencies and Mayors/Do Governors shall respectively formulate and implement implementation plans annually for developing Korean sign language (hereinafter referred to as “implementation plan”) on the basis of the basic plan.
(2) The heads of the relevant central administrative agencies and Mayors/Do Governors shall submit implementation plans for the upcoming year and the execution results of implementation plans of the previous year, as prescribed by Presidential Decree, and the Minister of Culture, Sports and Tourism shall evaluate the execution results of the implementation plans every year.
(3) Matters necessary for the evaluation, etc. of the implementation plans shall be prescribed by Presidential Decree.
제8조(보고)
정부는 기본계획, 시행계획 및 추진실적을 확정한 후 지체 없이 국회에 보고하여야 한다.
Article 8 (Reporting)
The Government shall finalize and report without delay to the National Assembly a basic plan, implementation plans and execution results thereof.
제9조(실태조사)
① 문화체육관광부장관은 한국수어 정책의 추진을 위하여 3년마다 농인의 한국수어 사용 환경 등에 관한 실태를 조사할 수 있다.
② 문화체육관광부장관은 제1항에 따른 실태조사를 위하여 필요한 경우에는 공공기관등에 자료 제출이나 의견 진술 등을 요구할 수 있다. 이 경우 자료 제출이나 의견 진술 등을 요구받은 자는 특별한 사유가 없으면 이에 따라야 한다.
③ 한국수어의 사용 환경 등에 관한 실태조사에 필요한 사항은 대통령령으로 정한다.
Article 9 (Investigation of Current Situation)
(1) The Minister of Culture, Sports and Tourism may conduct an investigation of current situation concerning the Korean sign language-using environment, etc. every three years to promote policies for Korean sign language.
(2) If necessary for conducting investigations of current situation under paragraph (1), the Minister of Culture, Sports and Tourism may request public institutions, etc. to submit materials or state their opinions. In such cases, the persons requested to submit materials or state their opinions shall comply with such request, except in extenuating circumstances.
(3) Other matters necessary for conducting investigations of current situation concerning the Korean sign language-using environment, etc. shall be prescribed by Presidential Decree.
제3장 한국수어의 발전 및 보급
CHAPTER III DEVELOPMENT AND DISTRIBUTION OF KOREAN SIGN LANGUAGE
제10조(한국수어의 연구 등)
① 문화체육관광부장관은 한국수어의 보전 및 발전을 위하여 한국수어에 대한 지속적인 연구를 수행하여야 한다.
② 문화체육관광부장관은 농인등이 각 분야의 전문용어를 쉽고 편리하게 사용하도록 전문용어를 한국수어로 표준화하는 연구 사업을 실시할 수 있다.
③ 문화체육관광부장관은 제1항에 따른 연구를 수행하기 위하여 전문기관을 지정하거나 연구소ㆍ대학 또는 그 밖에 필요하다고 인정하는 관계 전문기관에 연구를 위탁할 수 있다.
Article 10 (Research of Korean Sign Language)
(1) The Minister of Culture, Sports and Tourism shall conduct continuous research of Korean sign language to preserve and develop Korean sign language.
(2) The Minister of Culture, Sports and Tourism may conduct research projects for standardizing terminologies in various fields in Korean sign language so that the deaf, etc. can use them easily and conveniently.
(3) The Minister of Culture, Sports and Tourism may designate a specialized institution in order to conduct research under paragraph (1) or may entrust such research to research institutes or universities, or other specialized institutions deemed necessary.
제11조(한국수어의 교육 등)
① 국가와 지방자치단체는 농인등의 한국수어 및 한국어 능력을 신장할 수 있는 교육환경을 조성하여야 한다.
② 국가와 지방자치단체는 농인등의 교육에 있어서 장애 발생 초기부터 한국수어를 습득할 수 있도록 필요한 정책을 마련하여야 한다.
③ 국가와 지방자치단체는 농학교로 하여금 한국수어를 한국어와 동등한 교수ㆍ학습 언어로 사용하도록 하여야 한다.
④ 국가와 지방자치단체는 농학교 교육에서 한국수어를 사용한 교육 및 한국수어를 통한 학습이 원활히 이루어질 수 있도록 지원하여야 한다.
Article 11 (Korean Sign Language Education)
(1) The State and local governments shall create educational environment in which the deaf, etc. can improve proficiency in Korean sign language and the Korean language.
(2) The State and local governments shall, with respect to educating the deaf, etc., devise the policies necessary for the deaf to learn Korean sign language from the early stage of disability.
(3) The State and local governments shall ensure that Korean sign language is used at schools for the deaf as a teaching and learning language on an equal footing with the Korean language.
(4) The State and local governments shall give support so that, with respect to education at schools for the deaf, education using Korean sign language and study through Korean sign language can be seamlessly realized.
제12조(농인등의 가족에 대한 지원)
① 국가와 지방자치단체는 농인등의 가족을 위한 한국수어 교육, 상담 및 관련 서비스 등 지원체계를 마련하여야 한다.
② 국가와 지방자치단체는 청각장애가 있는 아동의 부모 등이 한국수어를 원활히 사용할 수 있도록 한국수어 교육 등을 실시하여야 한다.
Article 12 (Support for Families of the Deaf)
(1) The State and local governments shall establish a system for supporting families of the deaf, etc. such as Korean sign language education, counseling and related services.
(2) The State and local governments shall conduct Korean sign language education, etc. in order that the parents, etc. who have a child with hearing disability can use Korean sign language proficiently.
제13조(한국수어의 정보화)
① 국가는 한국수어의 정보화를 통하여 지식과 정보를 생산ㆍ활용할 수 있도록 각종 사업을 적극적으로 시행하여야 한다.
② 국가는 원격정보통신서비스망 등 정보통신망을 활용하여 누구나 한국수어를 편리하게 사용할 수 있도록 필요한 정책을 마련하여야 한다.
Article 13 (Informatization of Korean Sign Language)
(1) The State shall actively conduct various projects to make it possible to produce and utilize knowledge and information through the informatization of Korean sign language.
(2) The State shall establish necessary policies so that everyone can use Korean sign language conveniently by utilizing an information and communications network such as a remote information and communications service network.
제14조(한국수어의 사용촉진 및 보급)
① 문화체육관광부장관은 공공 대중매체를 활용하여 국민들에게 한국수어를 홍보하는 등 한국수어에 대한 인식을 확산하고 한국수어 사용을 촉진하여야 한다.
② 문화체육관광부장관은 한국수어를 배우려는 국민을 위하여 교육과정과 교재를 개발하고 한국수어교원을 양성하는 등 한국수어의 보급에 필요한 사업을 시행하여야 한다.
③ 문화체육관광부장관은 한국수어 사용촉진 및 보급을 위하여 공공기관 및 한국수어 관련 법인ㆍ단체를 한국수어교육원으로 지정할 수 있다.
④ 국가는 제3항에 따라 지정된 한국수어교육원의 운영에 필요한 경비를 예산의 범위에서 지원할 수 있다.
⑤ 제2항에 따른 한국수어교원의 자격요건 등에 관한 사항 및 제3항에 따른 한국수어교육원의 지정요건 등에 관한 사항은 대통령령으로 정한다.
Article 14 (Promotion of Use and Distribution of Korean Sign Language)
(1) The Minister of Culture, Sports and Tourism shall spread awareness of Korean sign language and promote the use of Korean sign language, through means such as publicizing Korean sign language by using public mass media.
(2) The Minister of Culture, Sports and Tourism shall execute projects necessary for distributing Korean sign language, including the development of educational courses and texts for the people intending to learn Korean sign language and the fosterage of Korean sign language teachers.
(3) The Minister of Culture, Sports and Tourism may designate a public institution or a Korean sign language-related corporation or organization as an institute for Korean sign language education to promote the use of Korean sign language and distribute it.
(4) The State may subsidize, within budgetary limits, expenses necessary for operating the institutes for Korean sign language education designated pursuant to paragraph (3).
(5) Matters concerning qualification requirements, etc. for Korean sign language teachers under paragraph (2) and requirements for designating institutes for Korean sign language education under paragraph (3) shall be prescribed by Presidential Decree.
제15조(한국수어 능력의 검정)
① 문화체육관광부장관은 한국수어능력의 향상ㆍ평가를 위하여 한국수어능력을 검정할 수 있다.
② 제1항에 따른 한국수어능력의 검정 방법ㆍ절차ㆍ내용 및 시기에 관하여 필요한 사항은 대통령령으로 정한다.
Article 15 (Verification of Proficiency in Korean Sign Language)
(1) The Minister of Culture, Sports and Tourism may verify proficiency in Korean sign language to improve and evaluate proficiency in Korean sign language.
(2) Matters necessary for methods, procedures, contents and timing for verification of proficiency in Korean sign language under paragraph (1) shall be prescribed by Presidential Decree.
제16조(수어통역)
① 국가와 지방자치단체는 수어통역을 필요로 하는 농인등에게 수어통역을 지원하여야 한다.
② 국가와 지방자치단체는 공공행사, 사법ㆍ행정 등의 절차, 공공시설 이용, 공영방송, 그 밖에 공익상 필요하다고 인정하는 경우에 수어통역을 지원하여야 한다.
③ 국가와 지방자치단체는 대통령령으로 정하는 중요 정책 등을 발표하는 경우 발표 현장에 수어통역사를 배치하는 등 수어통역을 지원하여야 하며, 발표 내용을 농인등이 알 수 있도록 정보통신망 등을 이용하여 수어통역 영상을 공표하여야 한다. <신설 2022. 1. 18.>
④ 국가와 지방자치단체는 농인등이 구직, 직업훈련, 근로 등 직업 활동 전반에 불이익이 없도록 수어통역을 지원하여야 한다. <개정 2022. 1. 18.>
⑤ 국가와 지방자치단체는 수어통역 관련 전문인력의 양성을 위하여 노력하여야 한다. <개정 2022. 1. 18.>
⑥ 국가와 지방자치단체는 「장애인복지법」 제58조제1항제2호에 따른 장애인 지역사회재활시설 중 수어통역센터를 설치ㆍ운영할 수 있다. <개정 2022. 1. 18.>
Article 16 (Sign Language Interpretation)
(1) The State and local governments shall provide sign language interpretation for the deaf, etc. in need of sign language interpretation.
(2) The State and local governments shall provide sign language interpretation, if deemed necessary with respect to public events; judicial, administrative and other procedures; use of public facilities; public broadcasting; and other cases deemed necessary for public interest.
(3) When the State and local governments announce important policies, etc. prescribed by Presidential Decree, they shall provide sign language interpretation, such as arranging sign language interpreters at the site of the announcement, and sign language interpretation video shall be published using information and communication networks, etc., so that the deaf, etc. can recognize the contents of the announcement. <Added on Jan. 18, 2022>
(4) The State and local governments shall endeavor to foster manpower specializing in sign language interpretation. <Amended on Jan. 18, 2022>

(6) The State and local governments may establish and operate centers for sign language interpretation among community rehabilitation facilities for persons with disabilities under Article 58 (1) 2 of the Act on Welfare of Persons with Disabilities. <Amended on Jan. 18, 2022>
제17조(한국수어의 날)
① 농인등의 한국수어 사용 권리를 신장하고 한국수어에 대한 국민의 인식을 고취하기 위하여 매년 2월 3일을 한국수어의 날로 하며, 한국수어의 날이 속한 주간을 한국수어 주간으로 정한다.
② 국가와 지방자치단체는 제1항에 따른 한국수어의 날 기념 행사 등을 실시할 수 있다.

Article 17 (Day of Korean Sign Language)
(1) In order to extend the rights of the deaf to use Korean sign language and inspire people’s awareness of Korean sign language, February 3 each year shall be set aside as the Day of Korean Sign Language and the week starting from the Day of Korean Sign Language shall be set aside as the Week of Korean Sign Language.
(2) The State and local governments may hold memorial events for the Day of Korean Sign Language under paragraph (1).

제18조(민간단체 등의 활동 지원)
국가와 지방자치단체는 한국수어의 발전과 보급을 목적으로 하는 법인ㆍ단체 등에 대하여 예산의 범위에서 필요한 지원을 할 수 있다.
Article 18 (Support for Activities of Civil Organizations)
The State and local governments may provide necessary support, within budgetary limits, to corporations, organizations, etc., the purpose of which is to develop and distribute Korean sign language.
제4장 보칙
CHAPTER IV SUPPLEMENTARY PROVISIONS
제19조(협의)
중앙행정기관의 장은 한국수어의 사용에 관한 내용이 포함된 법령을 제정하거나 개정하고자 할 때에는 미리 문화체육관광부장관과 협의하여야 한다.
Article 19 (Consultation)
When the head of a central administrative agency intends to enact or amend statutes or regulations containing the content concerning the use of Korean sign language, he or she shall consult in advance with the Minister of Culture, Sports and Tourism.
제20조(권한의 위임ㆍ위탁)
① 이 법에 따른 문화체육관광부장관의 권한은 대통령령으로 정하는 바에 따라 그 일부를 시ㆍ도지사에게 위임할 수 있다.
② 문화체육관광부장관은 이 법에 따른 업무의 일부를 대통령령으로 정하는 바에 따라 관련 기관ㆍ단체 등에 위탁할 수 있다.
Article 20 (Delegation and Entrustment of Authority)
(1) Authority of the Minister of Culture, Sports and Tourism under this Act may be partially delegated to Mayors and Do Governors, as prescribed by Presidential Decree.
(2) The Minister of Culture, Sports and Tourism may partially entrust business affairs under this Act to the relevant institutions and organizations, as prescribed by Presidential Decree.

이 법은 공포 후 6개월이 경과한 날부터 시행한다.

이 법 시행 당시 다른 법령에서 “수화”, “수화통역” 또는 “수화통역사”를 인용한 경우에는 종전의 규정을 갈음하여 이 법의 “한국수어”, “한국수어 통역” 또는 “한국수어 통역사”를 각각 인용한 것으로 본다.

Article 1 (Enforcement Date)
This Act shall enter into force six months after this Act enters into force.
Article 2 Omitted.
Article 3 (Relationship to Other Statutes or Regulations)
A citation of “sign language”, “sign language interpretation”, or “sign language interpreter” by other statutes or regulations as at the time this Act enters into force shall be deemed a citation of “Korean sign language”, “Korean sign language interpretation”, or “Korean sign language interpreter”, respectively, in lieu of the previous provisions.
