CHAPTER Ⅰ GENERAL PROVISIONS

Article 1 (Purpose)

The purpose of this Act is to contribute to the stabilization of living and the promotion of welfare of the single-parent families by assisting them to lead healthy and cultural lives. <Amended by Act No. 6801, Dec. 18, 2002>

Article 2 (Responsibility of State, etc.)

(1) The State and local governments shall be responsible for promoting the welfare of the single-parent family. <Amended by Act No. 6801, Dec. 18, 2002>

Article 1 ~ 2

(2) All citizens shall cooperate in promoting the welfare of the single-parent family. <Amended by Act No. 6801, Dec. 18, 2002>

Article 3 (Effort for Self-Support)

The mother and child or the father and child of the single-parent family shall endeavor to achieve self-support and improvement in their lives by making the utmost use of their assets and their ability to labor. <Amended by Act No. 6801, Dec. 18, 2002>

Article 4 (Definitions)

The definitions of terms as used in this Act shall be as follows:

1. The term “mother”　or “father” means any person that falls under any of the following subparagraphs, who brings up her or his own child or children:

(a)An individual who has been bereaved of, divorced from, or abandoned by his or her spouse;

(b) An individual having a spouse who has lost ability to labor for a long time due to mental or physical handicap;

(c)An unmarried individual (excluding any person in a de facto marital relation); and

(d)Any person who has such status as corresponds to that of the individual as defined in any of the items (a) through (c), who is determined by the Ordinance of the Ministry of Health and Welfare;

2. The term “single-parent family” means a family in which the mother or father is the head of the household (including an individual who actually supports members of a household even though he or she is not the head of the household);

3. The term “child” means a son or daughter under eighteen years of age (in case of a child in school, under twenty years of age), who is brought up by the mother or father;

4. The term “protection authority” means the State or local governments that perform the act of protection as provided in this Act; and

5. The term “single-parent family welfare organization” means an institution or organization that has been established for the purpose of promoting the welfare of the single-parent family.

Article 5 (Scope of Individuals Eligible for Protection)

Those who are

eligible for protection as provided in this Act shall besuch individuals as fall under subparagraphs 1 through 3 of Article 4, who are determined by the Ordinance of the Ministry of Health and Welfare. <Amended by Act No. 5454, Dec. 13, 1997; Act No. 6801, Dec. 18, 2002>

Article 7 (Single-Parent Family Welfare Counseling Office)

(1) In order to provide consultation or guidance service with respect to the welfare of the single-parent family, the Special Metropolitan CityMayor, the Metropolitan City Mayor, Do governor (hereinafter referred as the “Mayor/Do governor”), and the head of Si/Gun/Gu (referring to the head of an autonomousGu; hereinafter the same shall apply) may establish a single-parent family welfare counseling office within his jurisdiction. In this case, the head of Si/Gun/Gu shall obtain approval from the Mayor/Do governor. <Amended by Act No. 5454, Dec. 13, 1997; Act No. 6801, Dec. 18, 2002>

(2) Necessary matters concerning the organization, operation, etc. of the single-parent family welfare counseling office shall be determined by the Presidential Decree. <Amended by Act No. 6801, Dec. 18, 2002>

Article 8 (Single-parent Family Welfare Counselor)

(1) Single-parent family welfare counselors shall be assigned to each of the Special Metropolitan City, Metropolitan Cities, Dos, Sis/Guns/Gus,

and the single-parent family welfare counseling offices as provided inArticle 7. <Amended by Act No. 5454, Dec. 13, 1997; Act No. 6801, Dec. 18, 2002>

(2) Necessary matters concerning the qualifications and duties of singleparent family welfare counselors shall be determined by the Presidential Decree. <Amended by Act No. 6801, Dec. 18, 2002>

Article 9 (Promotion of Single-Parents Family Welfare Organization)

The State or local governments may support and promote the singleparent family welfare organizations. <Amended by Act No. 6801, Dec. 18, 2002>

CHAPTER Ⅱ DETAILS OF WELFARE AND THEIR IMPLEMENTATION

Article 10 (Research and Report, etc. on Individuals Eligible for Protection)

(1) The head of Si/Gun/Gu shall conduct research into the individuals who are eligible for protection within his jurisdiction not less than once a year.

(2) When the head of Si/Gun/Gu has conducted research into the realities of the individuals who are eligible for protection in accordance

with paragraph (1), he shall report to the Mayor/Do governor on the findings from the research.

(3) Upon receipt of the report as provided in paragraph (2), the Mayor/ Do governor shall, in turn, report it to the Minister of Health and Welfare. <Amended by Act No. 5454, Dec. 13, 1997>

(4) The protection authority shall prepare a register on, and keep records of, the actual conditions of the individuals eligible for protection and the individuals under protection.

(5) Necessary matters concerning the research, report, and register as referred to in paragraphs (1) through (4) shall be determined by the Ordinance of the Ministry of Health and Welfare. <Amended by Act No. 5454, Dec. 13, 1997>

Article 11 (Application for Welfare Benefit)

(1) An individual eligible for protection, his relative, or any other interested person may apply to the head of competent Si/Gun/Gu for the welfare benefit as referred to in Article 12. <Amended by Act No. 6801, Dec. 18, 2002>

(2) Necessary matters concerning the methods and procedures for application for welfare benefit under paragraph (1) and the scope of the interested persons shall be determined by the Ordinance of the Ministry of Health and Welfare. <Amended by Act No. 5454, Dec. 13, 1997>

Article 12 (Details of Welfare Benefit)

(1) The State or local governments may, upon receipt of an application for welfare benefit under Article 11, grant the following welfare benefit:if an individual eligible for protection as provided in this Act is under protection as provided in other Act and subordinate statutes, such as the National Basic Living Security Act, within the limits of the benefit received thereunder shall the amount of benefit under this Act not be granted accordingly: <Amended by Act No. 6024, Sep. 7, 1999>

1. Cost of living;

2. Expenses for assistance in the education of children;

3. Vocational training expenses and living cost during a training period;

4. Expenses for bringing up children; and

5. Such other expenses as prescribed by the Presidential Decree.

(2) The welfare benefits under paragraph (1) shall be provided at such regular intervals as prescribed by the Ordinance of the Ministry of Heath and Welfare. <Newly Inserted by Act No. 5612, Dec. 30, 1998>

Article 13 (Lending of Welfare Fund)

(1) In order to promote the stabilization of living and self-support of the single-parent

family, the State or local governments may lend the following funds: <Amended by Act No. 6801, Dec. 18, 2002>

1. Funds required for running a trade;

2. Expenses for the education of children;

3. Medical expenses;

4. Housing funds; and

5. Such other funds as may be required for the welfare of the single-parent family as prescribed by the Presidential Decree.

(2) The limits, methods, and procedures for the lending of the funds as referred to in paragraph (1) and other necessary matters shall be determined by the Presidential Decree.

Article 14 (Promotion of Employment)

(1) In order to promote the employment of the mother and child or the father and child of the single-parent family, the State or local governments shall endeavor to give them an appropriate vocational training and assist them in finding employment. <Amended by Act No. 6801, Dec. 18, 2002>

(2) The State or local governments shall endeavor to have the mother and child or the father and child of the single-parent family preferentially placed in the service of the places of business.

Article 14

Article 15 (Installation of Stalls and Service Booth within Public Facilities)

If the head of a public facility operated by the State or a local government permits stalls and service booths to be installed within the public facility, he may grant such a permission to the single-parent family or the single-parent family welfare organization in preference to any other person or organization. <Amended by Act No. 6801, Dec. 18, 2002>

Article 16 (Priority in Using Public Facilities)

The State or local governments shall endeavor to make pleasure facilities for children and other public facilities available for the children of the single-parent family in precedence to any other persons. <Amendedby Act No. 6801, Dec. 18, 2002>

Article 17 (Assistance from Specialized Social Welfare Services)

The State or local governments shall endeavor to provide the mother and child or the father and child of the single-parent family with such assistance as from the specialized social welfare services. <Amended by Act No. 6801, Dec. 18, 2002>

Article 18 (Sales and Rent of Units of National Housing)

In case of the sale

or rent of the units of national housing under the conditions as prescribed by the Housing Construction Promotion Act, theState or local governments shall endeavor to have a specified percent of the public housing preferentially sold to the single-parent family. <Amended by Act No. 6801, Dec. 18, 2002>

CHAPTER Ⅲ SINGLE-PARENT FAMILY WELFARE FACILITIES

Article 19 (Single-Parent Family Welfare Facilities)

(1) The single-parent family welfare facilities shall be as follows: <Amended by Act No. 5612, Dec. 30, 1998; Act No. 6801, Dec. 18, 2002>

1. Mother-and-child protection facility: Facility designed to protect and assist in living the mother-and-child homes having difficulty in livelihood on a temporary basis or for a fixed period of time and to help the mother and child prepare themselves for self-support after the completion of their living in the facility;

2. Mother-and-child self-supporting facility: Facility designed to provide the mother-and-child homes having difficulty in self-support only with the convenience of housing for a fixed period of time;

3. Father-and-child protection facility: Facility designed to protect

and assist in living the father-and-child homes having difficulty in livelihood on a temporary basis or for a fixed period of time and to help the father and child prepare themselves for self-support after the completion of their living in the facility;

4. Father-and-child self-supporting facility: Facility designed to provide the father-and-child homes having difficulty in self-support only with the convenience of housing for a fixed period of time;

5. Unmarried mother protection facility: Facility designed to help unmarried women, who are pregnant or in labor, give safe birth to babies and to have them protected for such a fixed period as until they recover their mental and physical health;

6. Temporary protection facility: Facility designed to protect mothers and children or mothers on a temporary basis or for a fixed period of time in case the rearing of their children or their own health may seriously be affected by a physical and mental maltreatment on the part of their spouses (including a person having a de facto marital relation);

7. Women’s welfare hall: Facility designed to provide the mother-and-child homes and the unmarried women with overall services in the interests of their welfare, including a variety of counsels, guidance on life styles and occupations, day care for their children, vocational guidance, etc.; and

8. Single-parent family counseling office: Office designed to perform counseling service relating to investigation, guidance, admission to a welfare facility, etc. in support of the single-parent families.

(2) Necessary matters concerning the period of protection in the singleparent family welfare facilities and the extension thereof under paragraph (1) 1 through 6 shall be determined by the Ordinance of the Ministry of Health and Welfare. <Amended by Act No. 5612, Dec. 30, 1998; Act No. 6801, Dec. 18, 2002>

Article 20 (Establishment of Single-Parent Family Welfare Facilities)

(1) The State or a local government may establish a single-parent family welfare facility. <Amended by Act No. 6801, Dec. 18, 2002>

(2) If any person other than the State or local governments intends to establish and manage a single-parent family welfare facility, he shallreport it to the head of Si/Gun/Gu. <Amended by Act No. 5612, Dec. 30, 1998; Act No. 6801, Dec. 18, 2002>

(3) Necessary matters concerning the standards for the facilities of the single-parent family welfare facility and the permission for the establishment thereof shall be determined by the Ordinance

Article 20

Article 21 (Closure or Suspension)

If any person who has reported the establishment of a single-parent family welfare facility in accordance with Article 20 (2) intends to close or suspend such a facility, he shall in advance report to the head of Si/Gun/ Gu thereupon under the conditions as prescribed by the Ordinance ofthe Ministry of Health and Welfare. <Amended by Act No. 5454, Dec. 13, 1997; Act No. 5612, Dec. 30, 1998; Act No. 6801, Dec. 18, 2002>

Article 22 (Obligation to Comply with Request)

If any person who establishes and manages a single-parent family welfare facility is requested by the Mayor/Do governor or the head of Si/Gun/ Gu to cooperate in making his welfare facility available for public use, he shall not refuse such a request in the absence of any justifiable reason to the contrary. <Amended by Act No. 6801, Dec. 18, 2002>

Article 23 (Supervision)

(1) The Minister of Health and Welfare, the Mayor/Do governor, or the head of Si/Gun/Gu may require the person who establishes and managesa single-parent family welfare facility to make necessary reports on the welfare facility and also have the relevant

public official inspect the condition of management of the welfare facility or examine the books and other relevant documents, etc. <Amended by Act No. 5454, Dec. 13, 1997; Act No. 5612, Dec. 31, 1998; Act No. 6801, Dec. 18, 2002>

(2) When the relevant public official performs his duties under paragraph (1), he shall show a certificate verifying his authority to the interested persons.

Article 24 (Closure of Facility, etc.)

In case any single-parent family welfare facility falls under any of the following subparagraphs, the head of Si/Gun/Gu may order the suspention or discontinuance of its service, or close the facility: <Amended by Act No. 5358, Aug. 22, 1997; Act No. 5612, Dec. 30, 1998; Act No. 6801, Dec. 18, 2002>

1. Where the facility fails to meet the standards for the facilities as provided in Article 20 (3);

2. Where the facility violates the provisions of Article 22; and

3. Where the facility fails to submit such reports as referred to in Article 23 (1) without any justifiable reason or makes false reports or where it refuses or evades inspection or examination.

Article 24-2 (Hearing)

If the head of Si/Gun/Gu intends to order the discontinuance of serviceor close the facility in accordance with Article 24, he shall hold a hearing. <Amended by Act No. 5612, Dec. 30, 1998>

CHAPTER Ⅳ EXPENSES

Article 25 (Subvention for Expenses)

The State or local governments may provide subvention for the covering of expenses required for the single-parent family welfare services under the conditions as determined by the Presidential Decree. <Amended by Act No. 6801, Dec. 18, 2002>

Article 26 (Order to Return Subvention)

In case the head of the single-parent family welfare facility or the singleparent family organization falls under any of the following subparagraphs, the State or local governments may order the return of the whole or part of the subvention that has already been provided: <Amended by Act No. 6801, Dec. 18, 2002>

1. Where he has violated the conditions of the provision of subvention;

2. Where he has

received ubvention by deceit or by any other unlawful methods;

3. Where he has done any such act as may be designed for personal profits in managing the single-parent family welfare facility; and

4. Where he has violated this Act or orders issued thereunder.

CHAPTER Ⅴ SUPPLEMENTARY PROVISIONS

Article 27 (Prohibition of Seizure)

Money and other goods paid or provided under this Act and the rights to receive them shall not be seized.

Article 28 (Request for Review)

(1) If an individual eligible for protection, his relative, or any other interested person is dissatisfied with a welfare benefit he has received in accordance with this Act, he may, in writing, apply to the welfare management institution concerned for the review of such a decision within ninety days after he was notified of the said decision. <Amended by ActNo. 5612, Dec. 30, 1998; Act No. 6801, Dec. 18, 2002>

(2) The welfare management institution shall, upon receipt of an application for review under paragraph (1), review and decide on the matter within thirty days and notify the applicant thereof.

Article 27 ~ 28

Article 29 (Penal Provisions)

(1) Any person who falls under any of the following subparagraphs shall be punished by imprisonment for not more than one year or a fine not exceeding three million won: <Amended by Act No. 5358, Aug. 22, 1997; Act No. 5612, Dec. 30, 1998; Act No. 6801, Dec. 18, 2002>

1. A person who has established a single-parent family welfare facility without a report as provided in Article 20 (2); and

2. A person who continues to perform services even after he has been ordered to close the facility or to suspend or discontinue the services in accordance with Article 24.

(2) Any person who violates the provisions of Article 22 shall be punished by a fine not exceeding one million won.

Article 30 (Joint Penal Provisions)

If the representative of a corporation or an agent, employee, or any other hired person of a corporation or an individual commits an offense as prescribed in Article 29 with respect to the affairs of the corporation or the individual, not only shall the wrongdoer be punished accordingly,but also the corporation or the individual shall be punished by a fine as referred to in the relevant Article. <Amended by Act No. 6801, Dec. 18, 2002>

Article 31 (Delegation of Authority)

Article 29 ~ 31

The Minister of Health and Welfare or the Mayor/Do governor may delegate part of authority vested in him under this Act to the head of Si/ Gun/Gu under the conditions as prescribed by the Presidential Decree. <Amended by Act No. 5454, Dec. 13, 1997>

ADDENDA

(1) (Enforcement Date) This Act shall enter into force on July 1, 1989.

(2) (Transitional Measures concerning Mother and Child Protection Facilities, etc.) The mother and child protection facilities established under the Child Welfare Act at the time when this Act enters into force shall be considered as the mother and child welfare facilities established with permission under this Act.

Article 1 (Enforcement Date)

This Act shall enter into force three months after the date of its promulgation.

Article 2 (Transitional Measures on Change of Name of Women’s Welfare Halls, etc.)

Addenda

The women’s welfare halls and women’s consultation offices established under the previous provisions at the time of enforcement of this Act shall be considered as the women’s welfare halls and consultation offices for mother and child homes under the amendment to Article 19.

Article 3 (Transitional Measures on Penal Provisions)

The application of penal provisions to any act committed prior to the enforcement of this Act shall be governed by the previous provisions.

Article 1 (Enforcement Date)

This Act shall enter into force on October 1, 2000. (Proviso Omitted.)

This Act shall enter into force six months after the date of its promulgation.

Article 2 (Transitional Measures for Scope, etc. of Individuals Eligible for Protection)

Addenda

A mother and child home eligible for protection under the previous provisions and a father and child eligible for assistance under the Framework Act on Social Security at the time of enforcement of this Act shall be deemed to be the single-parent family eligible for protection under this Act.

Article 3 (Transitional Measures for Mother and Child Welfare Consulting Office)

The mother and child welfare consulting office established under the previous provisions at the time of enforcement of this Act shall be deemed to be the single-parent family welfare counseling office established in accordance with the amended provisions of Article 7.

Article 4 (Transitional Measures for Mother and Child Welfare Consultant)

The mother and child welfare consultant under the previous provisions at the time of enforcement of this Act shall be deemed to be the singleparent family welfare counselor in accordance with the amended provisions of Article 8.

Article 5 (Transitional Measures for Mother and Child Welfare Facilities)

The mother and child welfare facilities under the previous provisions at the time of enforcement of this Act shall be deemed to be the single-parent

family welfare facility established in accordance with the amended provisions of Article 20.

Article 6 (Transitional Measures for Administrative Dispositions, etc.)

Dispositions and other actions that were made or taken by the protection authority, or otherwise such acts as reports, etc. that were made to the protection authority, under the previous provisions prior to the enforcement of this Act shall be deemed to be dispositions and other actions made or taken by the protection authority or such acts as reports, etc. made to the protection authority under this Act.
